What Happens After the MCD Issues a Notice for Unauthorised Construction?

An MCD notice is not automatically a demolition order. The section cited, action required, service date and any appeal stay determine what happens next.

An MCD notice for unauthorised construction is not automatically a demolition order. What happens next depends on the section cited, the action the document directs, how it was served, and whether an appeal or stay is in place. Read the operative wording and deadline first: a show-cause notice, an order to stop work, an alteration notice, a sealing action and a demolition order are different steps under the Delhi Municipal Corporation Act, 1957.

This explains the general statutory process in Delhi. The actual notice, service date, alleged work, approved plans and any Tribunal or court order control an individual case. If you have an active notice, verify the deadline and seek qualified advice promptly.

First identify what kind of MCD document you received

Do not rely on a document’s heading alone. Check the section number and the operative wording: what work or part of the property is identified, what action is required, and by what date? Also record the addressee, date and method of service, and any response or compliance instructions.

Document or action What it generally does What to check
Section 343 show-cause notice Gives the recipient an opportunity to explain before MCD makes a demolition order. The allegations, response deadline, submission method and service details. The Act does not set one universal number of days for every show-cause reply. Delhi Municipal Corporation Act, 1957, section 343
Section 343 demolition order Orders demolition and states a period for compliance, with brief reasons. The order’s delivery date, stated compliance period and appeal instructions. Act, section 343
Section 344 stoppage direction Directs construction work to stop; disobedience can trigger enforcement measures. Which work must stop and whether the direction is in force. Act, section 344
Section 345 alteration notice Identifies a departure from sanction or law and may require specified alterations or a show-cause response. The required alterations or response and the notice period. Act, section 345
Section 345A sealing Allows premises to be sealed before or after a demolition or stoppage order. The sealing action and any related order or directions. Act, section 345A

The Municipal Corporation of Delhi (MCD) is the relevant civic authority for this statutory route. The MCD portal says the former civic bodies were reunified on 22 May 2022; older records or documents may reflect the earlier structure. See the MCD portal.

Compare documents by the section cited, the stage of the process, the action requested, the deadline, the date and proof of service, and whether an appeal or express stay exists. A label such as “notice” does not tell you by itself whether work must stop, alterations are required, or demolition has been ordered. Read the directions and the section together.

What happens after a section 343 show-cause notice?

Before making a demolition order under section 343, the Commissioner must give the person a reasonable opportunity to show cause. The Act states: “Provided that no order of demolition shall be made unless the person has been given by means of a notice served in such manner as the Commissioner may think fit, a reasonable opportunity of showing cause why such order shall not be made.”

The notice is an opportunity to respond, not itself proof that demolition has been ordered. Follow the deadline and filing method in the document, and retain a copy of the response and evidence that it was delivered. Because the Act does not provide one universal reply period for every show-cause notice, do not assume a standard number of days applies.

Check that your response addresses the specific alleged work and the portion of the property named in the notice. Relevant plans, approvals and dated photographs may help you understand and explain the issue, but assembling those records is practical preparation, not a guarantee that MCD will accept the response or cancel the notice. Keep the submission acknowledgement because it can help establish what was filed and when.

If MCD issues a demolition order, how much time do you get?

A section 343 demolition order must give a compliance period of at least five days and no more than fifteen days, counted from delivery of the order. It must also state brief reasons. Read the period in your order and calculate it from its delivery, not from an assumed date or a general rule. Delhi Municipal Corporation Act, section 343.

If the work is incomplete, MCD may also direct that it stop while the appeal period runs. A stoppage direction is distinct from the demolition order; comply with each operative direction and check whether any later order changes it.

Keep the delivery information for the order. The statutory five-to-fifteen-day compliance window runs from delivery, so the service or delivery date can matter when working out the period. Do not substitute the date printed on the document, the date you first heard about it, or a generic deadline for the period stated in the order.

Can you appeal an MCD demolition order?

A section 343 demolition appeal goes to the Appellate Tribunal within the period specified in the demolition order. The Tribunal may stay enforcement, potentially on terms. A stay is not automatic: filing an appeal alone should not be treated as stopping demolition.

Section 347B contains general thirty-day language for specified appeals and allows a late appeal where sufficient cause is shown. That general period should not be substituted for section 343’s express direction to appeal within the period specified in the demolition order. Check the order and current Tribunal procedure promptly. India Code, Delhi Municipal Corporation Act, appeal provisions.

In practical terms, distinguish three things: the time to comply with the demolition order, the period specified for an appeal, and whether the Tribunal has actually granted a stay. They are not interchangeable. If you challenge the order, check the appeal instructions and deadline in the order, and confirm whether there is an express stay before assuming enforcement is paused.

Can MCD stop work or seal the property?

Stopping construction

Under section 344, the Commissioner may direct that work stop. If that direction is disobeyed, the Commissioner may call on the police to remove workers or seize construction equipment and materials. Do not assume a pending discussion or a response to another notice suspends a stoppage order.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Look closely at the work covered by the direction and comply with the stop-work requirement as written. A stoppage direction is a separate statutory action from a demolition order, but it may be issued in the same enforcement context. If there is uncertainty about what activity is covered, get clarification promptly rather than treating the uncertainty as permission to continue.

Sealing

Section 345A permits MCD to seal premises before or after a demolition or stoppage order. Sealing is therefore a separate enforcement power, not a finding that the matter is resolved. Check the sealing notice or order for its scope and any directions about access or next steps. Delhi Municipal Corporation Act, sections 344 and 345A.

The 2025 MCD office order describes sealing as temporary pending effective demolition. That statement reflects the administrative directions recited in that order; it does not establish an individual property’s timetable or mean every case will follow the same sequence. Do not infer that sealing ends the process or that it necessarily means demolition will occur on a particular date.

How is an alteration notice different?

Section 345 provides a separate route from a section 343 demolition order. During or after construction, MCD may issue a written notice of not less than seven days that specifies how work departs from the sanction or law. It may require specified alterations to bring the work into conformity or require the recipient to show cause.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the recipient responds, the Commissioner may cancel the notice or confirm it, with modifications if appropriate. Read what the notice actually requires: an alteration notice is not interchangeable with a demolition order, and its stated response or alteration period matters. Delhi Municipal Corporation Act, section 345.

The key comparison is the action requested. A section 343 demolition order directs demolition and gives a five-to-fifteen-day compliance period from delivery. A section 345 notice identifies departures and gives not less than seven days for the specified alteration or show-cause route. These are different statutory processes, so do not apply one period to the other.

What if the demolition order is not obeyed?

If no appeal is filed, or the order remains in effect after the statutory appeal process, failure to comply within the applicable period can allow the Commissioner to cause the demolition. MCD may recover its demolition expenses as arrears of tax. The statutory outcome depends on the order and case history; a notice alone does not establish that this enforcement stage has been reached. Delhi Municipal Corporation Act, section 343.

That sequence matters: a show-cause notice provides an opportunity to explain; a demolition order sets out an action and compliance period; an appeal may be available within the period specified in the order; and a stay must be granted rather than presumed. Enforcement consequences follow from the operative order and its status, not merely from receiving an initial notice.

What records should you gather?

Keep a clear, dated file so you can understand what was alleged, what was served and what you submitted. These are practical records to assemble, not a checklist expressly mandated by the cited sections:

  • The complete notice or order, including every page and enclosure, plus the envelope, delivery record or other proof of service.
  • Your reply, supporting documents and acknowledgement or proof of delivery.
  • Sanctioned building plans and related approvals relevant to the portion identified in the notice.
  • Dated photographs of the identified work and its current condition.
  • Any appeal filing, Tribunal directions, stay order or court order.

Later paperwork does not, by itself, legalise construction. MCD’s online services and unauthorised-property information may help locate public records, but they are not a substitute for the actual notice or full property file. An online listing may help you find information; it does not resolve what a particular notice requires or establish the status of an appeal or stay.

What does MCD’s 2025 enforcement order say?

An MCD office order from 2025 recites directions that unauthorised construction should be completely removed, describes sealing as temporary pending effective demolition, and directs that time- and date-stamped photographs of booking, sealing and demolition be retained. This describes stated administrative practice; it does not guarantee the timetable or outcome in any individual case. MCD 2025 office order on unauthorised-construction enforcement.

The direction to retain time- and date-stamped photographs concerns MCD’s documentation of enforcement events. It is distinct from the practical suggestion that a recipient keep dated photographs of the work and copies of their own submissions.

What to do when a notice arrives

  1. Identify the legal route. Find the cited section and determine whether the document is a show-cause notice, demolition order, stoppage direction, alteration notice or sealing action.
  2. Mark dates and requirements. Record when it was served, the response or compliance deadline, the required action and the stated filing method.
  3. Assemble relevant records. Compare the allegation with approved plans, approvals and dated photographs; keep copies of the notice and proof of service.
  4. Respond or comply at the stated stage. Use the method and deadline in the document. Do not assume that a reply, appeal or informal contact pauses an order.
  5. If challenging a demolition order, act promptly. Use the Appellate Tribunal route and period stated in the order, and seek an express stay rather than assuming an appeal prevents enforcement.

The validity of a particular notice, available defences and exact deadline cannot be determined without the document, service information, plans and case history. For a live matter, verify current Tribunal procedure and obtain qualified advice without delay.

Frequently Asked Questions

Can MCD demolish my house after notice?

A notice alone is not necessarily a demolition order. Under section 343, MCD must give a reasonable opportunity to show cause before making a demolition order. If an operative order is not complied with within the applicable period and remains effective after the appeal process, the Commissioner may cause demolition and recover the expenses as arrears of tax. The actual document and case history matter.

How many days do I get to reply to an MCD notice?

There is no single reply period for every section 343 show-cause notice in the cited provision; follow the deadline and filing instructions in the notice. A section 345 alteration notice must provide not less than seven days for the specified alteration or show-cause route. A section 343 demolition order, by contrast, must give five to fifteen days from delivery for compliance.

Can I appeal an MCD demolition order?

A section 343 demolition appeal goes to the Appellate Tribunal within the period specified in the demolition order. Check the order and current Tribunal procedure promptly. The general thirty-day language in section 347B for specified appeals should not be assumed to replace section 343’s express period.

Does filing an appeal stop demolition?

No automatic stay should be assumed. The Tribunal may stay enforcement, potentially on terms, but filing an appeal alone does not mean demolition is paused. Check whether an express stay has actually been granted.

What should I check first when I receive an MCD notice?

Check the section cited, the specific work and property portion identified, what action is required, the deadline, the date and proof of service, and any filing instructions. Keep the complete notice and supporting records. A heading alone may not explain whether the document is a show-cause notice, stoppage direction, alteration notice, sealing action or demolition order.

The Bottom Line

Bottom line: An MCD notice is not automatically a demolition order. Identify the statutory section and required action, respond or comply by the stated deadline, and distinguish the order’s compliance period from any appeal deadline. A section 343 appeal does not itself stay enforcement; look for an express stay and get qualified advice promptly if the matter is live.
