What happens after a council refuses a planning application in England?

A planning refusal is not necessarily the end of a project. In England, you normally have two practical routes: appeal the refusal to the Planning Inspectorate, or change the proposal and submit a revised application to the local planning authority (LPA). The right choice depends on the decision notice, the precise refusal reasons, the application type, the date the application was submitted and, in some cases, whether enforcement action is involved. Check the deadline immediately; missing it can remove the appeal option.

Start with the decision notice, not the headline refusal

The formal decision notice is the document that controls what happened and what you can do next. Read every refusal reason and the date of the decision. Then compare each reason with the drawings, design statement, access information, transport evidence, ecology material and other documents that were submitted.

A reason should explain what the LPA considered unacceptable and identify the planning policy or development-plan conflict where relevant. Separate objections that could be fixed by changing the scheme from objections that challenge the principle of development. For example, a refusal based on an unacceptable roof form may be capable of redesign; a refusal based on a protected designation or a fundamental policy conflict may require a different site or a different type of development.

  • Record the application type (for example, householder, minor commercial, advertisement consent or listed building consent).
  • Write down the application submission date as well as the decision date. The procedural guide that applies is tied to the application date.
  • Check whether the notice mentions enforcement, an appeal period or special ownership notifications.
  • Keep the approved and refused drawings together so you can identify exactly what would have to change.

These checks give you the facts needed to choose between an appeal and a new application. They also prevent relying on a generic six-month rule that may not apply to your case.

The two main routes after refusal

Appeal the refusal

Under section 78 of the Town and Country Planning Act 1990, an applicant whose planning application has been refused can appeal to the Planning Inspectorate, subject to the applicable rules and time limit. An appeal asks an independent planning inspector to examine the refusal through the procedure set for that case. It is not an automatic second application and filing one does not guarantee permission.

An appeal is most defensible when the refusal reasons appear inconsistent with the development plan or planning policy, when the LPA has misunderstood the proposal or evidence, or when the planning balance supports permission despite the stated objections. Your statement should respond to every refusal reason with policy references and evidence rather than simply asserting that the council was wrong.

Submit a revised application

If a specific amendment or additional piece of information could overcome the refusal reasons, a new application may be more efficient. The Planning Inspectorate’s guidance says that an applicant who thinks amendments will overcome the LPA’s reasons for refusal should make a new planning application. It also advises considering re-engagement with the LPA before deciding whether to appeal.

Talk to the LPA about the changes you are considering, where that is practicable. A revised proposal still has to be assessed on its own merits; discussion does not amount to a promise of permission. A new application can be appropriate where the issue is clearly design-related, where mitigation can be provided, or where the original submission lacked information the LPA needs to determine the proposal.

Get specialist planning advice when the stakes justify it

A planning consultant or other suitably qualified adviser can test the refusal reasons against policy, identify evidence gaps and compare the likely merits of an appeal with a redesigned scheme. Advice is particularly useful for technically complex, high-value or enforcement-linked cases, but the official process does not require you to appoint a consultant.

How long do you have to appeal?

Do not assume every refusal has a six-month deadline. The current general GOV.UK guidance describes six months as typical for many refusals, but householder cases have a 12-week period. The Planning Inspectorate’s procedural guide for applications dated on or after 1 April 2026 sets out deadlines by appeal type, while applications dated on or before 31 March 2026 use the earlier guide. Read the decision notice and the guide that matches your application date.

Appeal type under the guide for applications dated on or after 1 April 2026 Deadline stated in the guide Important qualification
Householder refusal 12 weeks Count from the relevant decision date shown in the case documents.
Refusal of minor commercial development 12 weeks The shorter period applies to this defined appeal category.
Advertisement consent 8 weeks Use the advertisement-consent category in the applicable guide.
Most other planning application and listed building consent appeals 6 months The guide contains case-specific exceptions, so confirm the period for your notice.

The guide for applications dated on or before 31 March 2026 remains relevant to those applications, even though the newer guide applies to later submissions. That date distinction matters when a refusal arrives after the procedural rules have changed.

Enforcement can shorten the period. An enforcement-linked refusal may have a 28-day deadline, or a deadline calculated as the earlier of 28 days from service of the notice and the usual refusal-appeal period, according to the official notification template. If enforcement action is mentioned, check the notice and official guidance urgently rather than relying on the ordinary category deadline.

A practical deadline check

  1. Find the date of the decision letter or notice.
  2. Identify the application type and whether enforcement is involved.
  3. Identify whether the application was dated on or before 31 March 2026 or on or after 1 April 2026.
  4. Read the corresponding Planning Inspectorate procedural guide and the appeal-period wording in your notice.
  5. Allow time to assemble the form, ownership notifications and supporting documents; do not plan to submit on the final day.

The exact deadline cannot be calculated from the refusal alone if the decision date, application type, submission date or enforcement context is unknown.

Who can appeal and what must be checked?

Under the current Planning Inspectorate guide, the person who made the application is the person with the appeal right. A neighbour, community group or contractor cannot substitute for the applicant’s appeal. If the appellant does not own the whole site, rules may require notification to owners or agricultural tenants. Check the applicable guide for the complete eligibility, forms and notification requirements.

Before submitting, make sure the appeal addresses the proposal that was actually refused. An appeal is not the place to introduce a substantially different development. If the design has changed materially, a revised application may be the appropriate route.

What happens after an appeal is filed?

Validation by the Planning Inspectorate

The Planning Inspectorate first checks whether the appeal is valid. It may check the deadline, the applicant’s status, the required form and documents, and any ownership or agricultural-tenant notifications. If something is missing or the appeal is out of time, the Inspectorate explains what happens next; an invalid or late appeal may not proceed.

Procedure and representations

Once the appeal is accepted, the Inspectorate tells the appellant what happens next and how long the process may take. The procedure depends on the application type and the procedural guide that applies to the application date. The 2026 guide describes an amended written-representations process for qualifying cases. Follow the timetable and document instructions issued for your individual appeal rather than assuming that every case follows the same sequence.

The LPA supplies its case and interested parties may be able to make representations under the procedure set for the appeal. Your submissions should be organised around the refusal reasons, the development plan and relevant planning policy. Include only evidence that relates to the refused scheme and the issues in dispute.

Inspector’s decision

An inspector considers the appeal material under the applicable procedure and issues a decision. The outcome is not guaranteed by filing an appeal. A successful appeal can result in permission, sometimes subject to conditions; an unsuccessful appeal leaves the refusal in place. The decision document, rather than informal comments during the process, determines the result and any conditions.

How to decide whether an appeal has a realistic case

Use the refusal reasons as a decision framework. For each reason, ask:

  • Policy: Which development-plan policy or national planning consideration is said to be breached, and does the LPA’s interpretation fit the policy wording?
  • Evidence: Did the application contain evidence addressing the issue, or is new technical work needed?
  • Changeability: Can a drawing, layout, access arrangement, landscape measure, operating detail or mitigation package remove the objection?
  • Principle: Is the objection about the detailed design, or about the location and principle of development?
  • Materiality: Would the proposed change alter the development enough that it should be assessed as a new application?

An appeal is stronger when the refusal is demonstrably inconsistent with policy or evidence already before the LPA. A revised application is often more logical when a defined design or information change directly answers the refusal reason. If the proposal would need a fundamental change, obtain advice on whether starting again is more proportionate than appealing.

Appeal versus revised application

Option What it does When it may fit Main caution
Appeal Asks the Planning Inspectorate to consider the refusal under the applicable process. You have arguable grounds that the LPA’s reasons conflict with policy, evidence or the planning balance. There is a strict, case-dependent deadline, formal validation requirements and possible costs exposure.
Revised application Gives the LPA a changed proposal to assess. A specific amendment or additional material could resolve the refusal reasons. The change must address the reasons, and permission is not assured.
Planning advice Provides a policy and evidence review of the refusal, possible revisions and appeal merits. The project is technically complex, high value or difficult to assess objectively. No adviser can guarantee an appeal result or planning permission.

Do not let informal discussions cause an appeal deadline to expire. If you are exploring amendments, record the deadline and preserve the appeal option while you establish whether the LPA will engage and whether a new scheme is viable.

Costs, risks and conduct

The official guidance treats costs as a possible consequence of unreasonable behaviour, not as an automatic appeal fee or penalty. A party may apply for a costs award if it believes the other side behaved unreasonably and caused expense. The guidance also warns that pursuing an appeal unreasonably, without sound grounds, can expose the appellant to a costs award.

That risk is separate from the ordinary cost of preparing drawings, reports or professional advice. Keep submissions focused, meet the timetable and avoid repeating arguments that do not answer the refusal reasons. A well-founded disagreement with the LPA is not, by itself, unreasonable conduct; the concern is pursuing or defending a case in a way that lacks sound grounds or causes avoidable expense.

Common mistakes to avoid

  • Using the wrong deadline: applying the six-month rule to a householder, minor commercial, advertisement or enforcement-linked case.
  • Using the wrong procedural guide: ignoring the application-date split at 1 April 2026.
  • Appealing as a non-applicant: the current guide gives the appeal right to the person who made the application.
  • Changing the scheme through the appeal: an appeal should address the refused proposal, not replace it with a materially different development.
  • Ignoring ownership notifications: incomplete owner or agricultural-tenant notification can affect validity.
  • Submitting a bare disagreement: an appeal needs a reasoned response to each refusal reason, supported by policy and evidence.
  • Waiting for informal feedback: discussions with the LPA do not automatically extend the statutory or procedural deadline.
  • Assuming success: neither an appeal nor a revised application guarantees permission.

A decision checklist for the next few days

  1. Save the decision notice, plans and all officer reports in one file.
  2. List each refusal reason in separate lines and identify the policy or evidence cited.
  3. Confirm the application type, application date, decision date and any enforcement reference.
  4. Calculate the likely appeal deadline from the applicable guide, then verify it against the notice.
  5. Ask whether a specific, proportionate change could answer every reason.
  6. Contact the LPA about potential amendments where appropriate, without assuming that discussion grants extra time.
  7. Choose an appeal, a revised application or professional advice based on the merits and the scale of change required.
  8. If appealing, prepare the required form, documents and ownership notifications early and answer every refusal reason.
  9. If revising, produce a clear schedule showing how each refusal reason is addressed in the new drawings or supporting information.

Scope of this guidance

This article concerns planning refusals in England. Planning is devolved, and the Planning Inspectorate procedures and deadlines described here should not be applied to Scotland, Wales or Northern Ireland. For an individual case, the decision notice, the application date, the application type and any enforcement documents control the next step.
