Build a dated evidence file that shows four things: what the damp or mould looks like and where it is, when you reported it, what the landlord or agent did in response, and how the defect affected the home, belongings or household. Keep original messages and photographs, preserve proof that your report was received, and back up the file. This record is useful for repairs, complaints, a council inspection or later legal advice.
The procedure and deadlines below are primarily for England. Social-housing rules, private-renting processes and the law in Scotland, Wales and Northern Ireland differ, so identify your tenancy and location before relying on a deadline.

Start one evidence file today
Use one folder—digital or paper—with a simple chronological index. Give every item a date and a short description, such as “12 February 2026 – bedroom north wall, close photograph” or “18 February 2026 – repair request, reference 4817”. Keep the unedited original of every photograph, message and document, plus a backup outside the device you normally use.
- Condition record: photographs, room-by-room notes and a diary of changes.
- Notice record: reports, delivery or acknowledgement evidence, call notes and replies.
- Repair record: appointment notices, inspection reports, work orders, contractor notes and records of missed visits.
- Impact record: damaged belongings, costs, disruption and relevant medical correspondence.
- Independent findings: council environmental-health reports or an appropriately qualified expert’s report.
Do not edit an original image to add a date or arrow. If you annotate a copy, retain the untouched file as well. A clear file lets a reader understand the sequence without having to infer it from scattered messages.

Document the visible condition and how it changes
Photograph every affected area
Take a wider image showing the room and the affected wall, ceiling, floor or window area, then take closer images that show the detail. Photograph each room separately and include related staining, peeling finishes, damaged furnishings or belongings. In your note, identify the room, the surface, the position (for example, “behind the wardrobe, external wall”) and the date and time.
Record when you first noticed the issue, not just when you took the first photograph. Describe the appearance in neutral terms—black spotting, tide marks, blistered paint, wet patches, condensation or a musty smell—and note whether it spread, dried, returned after cleaning or appeared elsewhere. A dated sequence is more informative than a single dramatic image.
Keep a condition diary
Use a weekly entry while the problem is active and an entry after every significant event. Note weather or ventilation conditions only as observations, not as conclusions about fault. Record when rooms could not be used, whether furniture had to be moved, and whether the problem recurred after a repair or treatment.
A photograph demonstrates visible condition and progression; it does not, by itself, prove the technical cause. Moisture ingress, plumbing leaks, building defects, inadequate ventilation and other causes can look similar. An inspection or expert report may be needed to establish why the damp or mould is occurring.
Prove when and how you told the landlord
Make the first report in writing
Use the contact route in your tenancy agreement or the landlord’s published repair process. An email, retained text message, online-form confirmation or letter creates a contemporaneous record. State the property address, affected rooms, when the problem began, earlier report dates, what has changed, visible damage or health effects, and that you are requesting investigation and a written plan.
Keep the sent email with its full thread and attachments. For an online form, save the confirmation page or reference number. For a letter, keep a copy and use a delivery method that provides confirmation. GOV.UK’s tenant guidance says a retained written request, including an email or text, is useful evidence.

Turn phone calls into written records
If you call, write down the date and time, the person’s name or role, the number used, what you reported and what they promised. Ask for confirmation by email. Send a short follow-up such as, “To confirm our call today, you said an inspection would be arranged and that I would receive an appointment time.” Keep the call note and any reply together.
Maintain a complete chronology of the response
Use a table or spreadsheet with these columns: date and time; contact or event; person or organisation; what you reported or were told; promised action and deadline; evidence file name; and outcome. Add every chase, appointment, missed visit, inspection finding, repair promise, completed job and later recurrence.
Keep copies of the landlord’s repairs policy, complaints procedure and every complaint response you request or receive. A chronology should show not only that you complained, but whether access was offered, whether an inspection occurred, what work was proposed, and whether the work solved the problem.
| Record | What it can establish | How to preserve it |
|---|---|---|
| Dated photographs and diary | Visible condition, location, duration and progression | Retain original files, dated notes and a backup |
| Emails, letters, report references and call notes | What was reported, when notice was given and how the landlord responded | Keep complete threads, attachments and proof of sending or receipt |
| Receipts and written quotes | Damage, replacement and repair costs | Link each amount to the item, date and reported defect |
| Medical letters | Health effects described by a clinician | Store relevant correspondence securely; do not delay reporting while seeking it |
| Council or expert report | Inspection findings, possible cause or work required | Keep the complete signed or issued report and any covering correspondence |
Record inspections, proposed work and repeat failures
Before an appointment
Save the appointment notice and note whether access was offered, accepted or rearranged. Photograph the condition before contractors arrive. If a visit is missed, record the date, the scheduled time window, who failed to attend and any resulting message or complaint.

Check whether the problem returns
Take new dated photographs after the work and continue the diary. Record the date of recurrence, the exact location and the interval since the repair. Government guidance for housing providers recommends records of reports and action and checks that treatment has worked. Shelter advises that recurring damp and mould should be investigated for its cause rather than repeatedly cleaned without finding why it returns.
Show damage, financial loss and disruption
Belongings and replacement costs
Photograph damaged furniture, clothing, books, carpets and other belongings alongside the room condition where possible. Keep purchase records if available, repair invoices, replacement receipts and written quotes. Note what each cost relates to, when the damage occurred and whether the item was disposed of; photograph it before disposal if safe and practical.
Other reasonable costs
Keep receipts for cleaning, temporary storage, alternative accommodation or other expenditure you believe resulted from the defect. Record why the expense was necessary and the dates covered. Do not assume that keeping a receipt proves entitlement to reimbursement; it documents the amount and connection for whoever assesses the claim.

In the diary, record rooms or fixtures that could not be used, furniture moved away from walls, time spent cleaning or attending appointments, and cancelled or repeated visits. Distinguish an observed inconvenience from an estimate of financial compensation.
Document health effects without waiting for medical proof
If someone in the household develops symptoms or has a relevant condition, keep appropriate medical correspondence that describes the effect, where available. A clinician’s letter or report may help document impact, but it is not a prerequisite for requesting repairs.
The UK government’s damp and mould guidance for housing providers states: “Landlords should not delay action to await medical evidence or opinion – medical evidence is not a requirement for action, and damp and mould should always be addressed promptly to protect tenant health.” Report the condition promptly even if no one has seen a doctor and do not postpone an inspection while seeking records.

Store health information securely and share only what is relevant. A symptom diary can record dates and practical effects, but it should not claim that mould caused a condition unless a qualified professional has made that assessment.

Obtain independent evidence when the issue remains unresolved
Ask the council about environmental health
If serious disrepair remains unresolved, contact your local council and ask about an environmental-health inspection. Keep your request, appointment details and the council’s written report or findings. GOV.UK directs tenants to the council when repairs are not done, and Shelter identifies an environmental-health report as potential evidence.
Council powers and procedures depend on location, tenancy and the facts found at inspection. Ask what documents the officer needs and what happens next; do not assume that a request automatically produces a particular enforcement action.
Consider an expert report only when it answers a real question
If the landlord’s investigation does not establish the cause or the damp keeps returning, an expert may help. Shelter gives damp experts, building surveyors, plumbers and builders as examples. A useful report should explain the likely source of moisture, the observations supporting that conclusion and the work that may address it.
Consider cost, access and suitability before commissioning anyone. The available guidance does not suggest that every tenant needs a paid report, and a photograph cannot be upgraded into a diagnosis simply by labelling it “proof”.

England: understand the escalation context
Social housing and Awaab’s Law
For social housing in England, government guidance on Awaab’s Law says fixed timeframes for emergency hazards and for damp or mould hazards presenting a significant risk of harm took effect on 27 October 2025. Shelter’s social-housing advice says serious damp and mould should be investigated within 24 hours when it is an emergency and within 10 working days when it is very serious but not an emergency.
Those timeframes depend on the facts, the social-rented-sector rules and how the hazard is classified. They are not universal deadlines for private renting, and they should not be applied automatically in Scotland, Wales or Northern Ireland. Your evidence should therefore establish the severity, when the landlord was notified and what happened afterward, while you verify the current rule for your tenancy.

For other England private-renting cases, GOV.UK advises contacting the council’s environmental-health department if repairs are not done. The same GOV.UK page points tenants in Scotland and Northern Ireland to different standards and procedures. Use the relevant local process instead of relying on social-housing timescales.
Keep paying rent
GOV.UK advises tenants to keep paying rent while waiting for repairs. Do not treat the evidence file as permission to withhold rent or as a determination that your landlord has breached a legal duty. If you are considering court action, compensation or any change to rent payments, obtain advice that covers your tenancy and jurisdiction.
Common evidence mistakes and how to avoid them
- Only one close-up photograph: add a room-wide view and a note identifying the location.
- Edited or undated images: retain original files and record when each was taken.
- Verbal reports with no follow-up: make a written report and confirm every call.
- Missing receipt evidence: save repair references, delivery confirmations and portal acknowledgements.
- Assuming a treatment solved the defect: photograph and diary the area after work and record any recurrence.
- Calling a photograph a diagnosis: describe what is visible and seek an inspection for the cause.
- Discarding damaged items immediately: photograph them first and retain receipts or quotes.
- Waiting for medical evidence before reporting: report promptly; medical evidence is not required for landlord action.
- Applying the wrong UK deadline: identify whether you are in England social housing, England private renting or another nation.
- Sending a disorganised bundle: number files and provide a one-page chronology so the decision-maker can follow it.
A practical evidence checklist
- Create a dated folder and a backup.
- Photograph each affected room with wide and close views; retain originals.
- Write the first-noticed date, locations, changes, recurrence and room-use effects.
- Report the issue in writing through the tenancy or repairs process.
- Save the sent message, attachments, reference number and proof of receipt.
- Log every call, reply, inspection, appointment, missed visit and promised action.
- Keep repair orders, contractor notes, reports and landlord complaint responses.
- Photograph and record completed work, then monitor for recurrence.
- Preserve receipts, quotes, damage photographs and relevant medical correspondence.
- Ask the council about environmental health when repairs remain unresolved; keep its written findings.
- Consider a suitably qualified expert if the cause is still unclear or the problem returns.
- Check the process and deadlines that apply to your location and tenancy, and continue paying rent unless properly advised otherwise.
Sources and scope
This practical checklist reflects Shelter England’s “Tell your landlord about damp and mould” and “Get evidence of repair problems” pages, both updated 27 October 2025; GOV.UK’s “Guide for tenants: Homes (Fitness for Human Habitation) Act 2018”; GOV.UK’s “Awaab’s Law: Guidance for social landlords—timeframes for repairs in the social rented sector”; GOV.UK’s “Understanding and addressing the health risks of damp and mould in the home”; and GOV.UK’s “Private renting: Repairs”.
