Employers do not need a separate federal scaffold standard for women. They must apply the same OSHA scaffold protections to every worker, while making sure the equipment actually fits the person and task, restrooms are sanitary and promptly accessible, training matches the scaffold hazards, and legally required pregnancy-related accommodations are handled individually. For work more than 10 feet above a lower level, the required fall-protection system depends on the scaffold type; a harness-only rule is not sufficient guidance.
The federal baseline employers must meet
This article describes the United States federal baseline for construction employers, supervisors, safety professionals and scaffold users. The principal rules are in OSHA’s construction standards, including 29 CFR Part 1926, Subpart L. A state-plan OSHA program or state and local employment law may impose additional duties.

Women are not a separate category under the federal scaffold standard. The employer’s responsibility is to control the hazards of the scaffold and the work, then provide equipment, facilities and procedures that each worker can use safely. That approach matters because a control that exists on paper can fail in practice if a guardrail is missing, a harness does not fit, a worker cannot reach a restroom without unreasonable delay, or training does not cover the scaffold actually being used.

Plan the scaffold and fall protection before work starts
OSHA requires fall protection for each employee on a scaffold more than 10 feet above a lower level. The rule does not authorize one universal setup for every scaffold. The scaffold’s design and use determine whether guardrails, a personal fall-arrest system, or both are required.

Match protection to the scaffold type
For example, employees on single-point or two-point adjustable suspension scaffolds need both a personal fall-arrest system and a guardrail system. Other scaffold types have their own provisions. A written plan that simply says “wear a harness” can therefore be incomplete or wrong. The competent safety review should identify the exact scaffold configuration and then apply the corresponding Subpart L requirements.
Address erection and dismantling separately
When workers erect or dismantle a supported scaffold, a competent person must determine whether fall protection is feasible and safe. The employer must provide protection when it is feasible and does not create a greater hazard. That determination should be made for the actual sequence of work, not copied from a generic plan. Changing the platform level, tie-ins, access method or surrounding operations can change the answer.
Control the full set of scaffold hazards
Fall exposure is only one part of the plan. OSHA identifies falls, falling objects, structural instability, electrocution and overloading among the hazards addressed by the scaffold standards. Before the crew climbs, the employer should verify:
- The foundation and supporting surface are capable of carrying the scaffold and intended loads.
- The scaffold is erected, tied, braced and accessed according to the applicable requirements and manufacturer information.
- Platforms, guardrails, openings and access points are complete for the work level.
- Materials and personnel loads will not exceed the scaffold’s capacity.
- Overhead electrical hazards have been identified and controlled.
- Falling-object protection is provided where people below could be exposed.
- Inspection and correction procedures are assigned to a competent person.
These checks protect every worker. They also prevent a common failure in which a woman is offered a different or smaller setup that has not been engineered or inspected for the actual load and configuration.
Provide PPE that fits the worker and the hazard
The construction PPE standard was revised to explicitly require properly fitting PPE effective January 13, 2025. The obligation is not a rule that women must use one particular product. It requires the employer to select and provide equipment that fits the worker and protects against the hazard identified for the task.
Why fit is a safety control
OSHA has explained that ill-fitting PPE can be ineffective or create new hazards. Oversized gloves, for example, can catch in machinery; uncomfortable equipment can discourage use. Assistant Secretary for Occupational Safety and Health Doug Parker said in a U.S. Department of Labor announcement dated December 11, 2024: “I’ve talked to workers in construction, particularly women, who have spoken of personal protective equipment that didn’t fit or was simply unavailable at the jobsite in their size.”

Build a usable size and compatibility process
Employers should ask workers whether issued equipment fits and provide suitable size options rather than assuming one size range serves the entire crew. The review should include gloves, footwear, head protection, eye protection and fall-arrest equipment. Check that each item works with the worker’s clothing, other PPE and the task’s movement requirements. A harness that fits while standing may need adjustment for the worker’s clothing, reach and work position; the employer should follow the equipment instructions and its hazard assessment.
These implementation practices do not replace the rule’s central test: the PPE must be appropriate for the hazard and properly fitting. Keep records of the hazard assessment, available sizes, worker feedback, inspections and replacement decisions so supervisors can correct a fit problem instead of treating it as a worker preference.
Train every scaffold user, then retrain when conditions change
Each employee working on a scaffold must be trained by a person qualified in the subject matter. The training must enable the worker to recognize hazards associated with the type of scaffold used and understand the procedures that control or minimize those hazards.
Cover the hazards workers will actually face
Training should address the applicable electrical, fall and falling-object hazards, along with the protective systems selected for the scaffold. Workers need to know how to use the access system, guardrails, personal fall-arrest equipment and falling-object controls provided at that site. They also need a way to report a missing component, unsafe loading, damaged equipment or a change in conditions without being pressured to continue.

Trigger retraining when the hazard changes
Retraining is needed when a workplace change or a change in scaffold, fall-protection or falling-object equipment creates a hazard the employee has not previously been trained to recognize. Examples include moving to a different scaffold type, changing the access arrangement, adding a new overhead operation or replacing one protective system with another. A new worker who has used scaffolds elsewhere still needs training relevant to the equipment and hazards at this workplace.
Make restroom access sanitary, immediate and practical
OSHA requires sanitary and immediately available toilet facilities for construction workers. Employers must provide enough facilities to prevent long lines, allow workers to leave their work locations when needed and avoid unreasonable restrictions that cause delays.

Evaluate access from the actual work area
A restroom can be technically present yet impractical if a scaffold crew must descend several levels, cross a controlled zone, find a key or wait for a supervisor’s permission. Site planning should consider the distance from elevated work, travel time, crew size, work schedules and whether workers can leave safely without abandoning a hazard. Key, sign-out and escort procedures should not create unreasonable delays.
Account for different access needs
Workers’ access needs can vary, including during pregnancy or a related medical condition. Supervisors should respond to a request for access rather than treating a standard break schedule as the only permitted option. If the site layout or procedure routinely produces lines or delays, increase capacity or change the process instead of shifting the burden to individual workers.

Handle pregnancy-related limitations through an individual process
The Pregnant Workers Fairness Act, or PWFA, generally applies to private employers and state or local public employers with 15 or more employees, among other covered entities. It requires reasonable accommodation for a qualified worker’s known limitations related to pregnancy, childbirth or related medical conditions unless the accommodation would cause undue hardship. The EEOC explains that the law does not replace more protective state or local requirements.
Do not use a blanket scaffold prohibition
Federal law does not establish a rule that every pregnant employee must stop working on scaffolds. Nor does a pregnancy automatically determine that leave is required. The employer must consider the worker’s known limitation, the actual scaffold assignment, the hazards and the proposed accommodation. A particular assignment may be unsuitable in a particular circumstance, but that conclusion must come from the individualized safety and accommodation analysis rather than a categorical assumption about women or pregnancy.
Use an interactive, documented review
- Receive the worker’s request or otherwise learn of the known limitation. Avoid demanding more medical information than is needed to understand the limitation and accommodation request.
- Identify the essential duties, scaffold type, height, access route, loads, electrical exposures, weather and other site conditions for the assignment.
- Discuss reasonable ways to address the limitation, which may include changing a work method, schedule, access arrangement or temporary assignment when those options are safe and workable. Treat these as possibilities to evaluate, not automatic entitlements.
- Check whether the proposed measure controls the actual hazard, preserves required training and fall protection, and avoids creating a greater hazard.
- Document the decision, communicate it to the worker and supervisors who need to implement it, and revisit it if the medical limitation or job conditions change.
The EEOC describes the PWFA as allowing workers to continue working safely and effectively through reasonable accommodations. Employers must also check any state or local law that provides broader protection.

- Verify worker training. Confirm that each user has training from a qualified person covering the scaffold and its electrical, fall and falling-object hazards.
- Check PPE fit and compatibility. Ask the worker to demonstrate that gloves, footwear, head and eye protection, and fall-arrest equipment fit and function with the task and other gear.
- Confirm sanitation access. Ensure a sanitary restroom is immediately available, lines are controlled and workers can leave the work location when needed.
- Ask about changes or limitations. Give workers a practical way to report a new hazard, a fit problem, a restroom-access problem or a pregnancy-related limitation.
- Correct before exposure. Stop and fix missing protection, unsafe loading, defective equipment, inadequate training or an accommodation issue before the worker is exposed.
Common mistakes and how to correct them
“One harness fits everyone”
Problem: The employer issues one nominal size and assumes adjustment solves every fit issue.
Correction: Offer suitable sizes, inspect fit during the actual task and replace equipment that cannot be adjusted safely. The January 13, 2025 construction PPE requirement makes proper fit an explicit duty.
“A harness replaces guardrails”
Problem: The plan treats personal fall arrest as the only protection on every scaffold.
Correction: Determine the scaffold type first. Some configurations, including single-point and two-point adjustable suspension scaffolds, require both systems.
“Past scaffold experience is enough”
Problem: A worker is assigned without training on the site’s scaffold, access or protective equipment.
Correction: Provide training by a qualified person and retrain when the scaffold, equipment or workplace introduces a hazard the worker has not been taught to recognize.
“The restroom is available if someone can get permission”
Problem: Keys, escorts, sign-out rules or distance produce unreasonable delays.
Correction: Measure real access time, provide enough facilities to prevent lines and allow workers to leave their locations when needed.
Recommended Free Tools
“Pregnancy means immediate removal from scaffold work”
Problem: A blanket rule bypasses the worker’s actual limitation and the accommodation process.
Correction: Apply the PWFA and other applicable laws through an individualized review of the assignment, hazards, proposed accommodation and undue-hardship question.
When federal rules are not the whole answer
This is a federal overview. State-plan OSHA programs can differ from federal OSHA, and state or local laws may provide additional pregnancy, disability, restroom-access or employment protections. Collective bargaining agreements, worker classification and the design of a particular scaffold can also affect the employer’s obligations. When the facts are disputed or a proposed accommodation could alter fall protection or scaffold stability, obtain advice from a qualified safety professional and employment counsel familiar with the governing jurisdiction.
