Start with the official land-title record for the property’s jurisdiction. A current official title register, title certificate, or equivalent registry record is normally stronger proof of ownership than utility bills, tax receipts, insurance, or evidence that you live in the house. If no registered title or deed can be found, assemble the chain of transfers and a carefully organized file showing possession, payments, insurance, repairs, and dealings with public authorities. Those records may support a first-registration or title-claim process, but their legal weight depends on local law.
A missing building permit is a separate issue. Ownership of land or a building and permission to construct, alter, or occupy it are not the same question. The documents that establish title should therefore be collected and checked separately from the building authority’s permit, inspection, completion, and occupancy records.

1. Obtain the official title record first
The best starting point is the land registry, recorder, or other official property register that governs the parcel. Ask for the document intended to prove ownership, not merely an informal search result or a copy for general information.

For registered property in England and Wales, HM Land Registry identifies the official copy of the title register as the document to obtain when proof of ownership is required, including for court use. The register identifies the registered owner and describes the property. An ordinary online copy is useful for general checks, but it is not the proof copy described in the guidance.

The title plan has a different function. It generally shows the location and broad extent of the title rather than fixing every boundary to surveying accuracy. Use the title number and property description in the register to make sure the record relates to the same parcel as the house.
Other jurisdictions
Terminology varies. The equivalent may be a certified title, land-record extract, deed of record, certificate of title, or recorder’s certified copy. Ask the registry what form is accepted for a sale, mortgage, court proceeding, probate matter, or permit application. Do not assume that an England-and-Wales procedure applies in Scotland, Northern Ireland, the United States, or another country.
2. Find the deed or transfer that explains how ownership passed
If the register refers to an earlier transfer, locate the underlying conveyance, transfer, purchase contract, inheritance papers, probate documents, or court order. These documents explain the chain by which the claimant acquired the interest and can help resolve a name change, an estate issue, or a gap in the register.

In the England-and-Wales system, filed deeds may sometimes be available from HM Land Registry. Even when an underlying deed is located, the official title-register copy remains the document to request when the immediate question is who is registered as owner.
Check every identity detail
Compare the names, addresses, title number, parcel description, dates, and signatures across the records. A deed for a neighboring lot, a former address, or a similarly named person does not prove ownership of the house in question. Keep certified or official copies together with the search request or receipt that identifies the parcel.
3. If the title is missing, incomplete, or unregistered
A lost deed does not automatically mean that ownership has disappeared, but it changes the task. You may need to reconstruct the chain of ownership and follow the local first-registration, adverse-possession, probate, rectification, or title-claim procedure. The correct route depends on the jurisdiction and the facts; a property lawyer or conveyancer can identify the applicable process.

Build a possession and payment file
When a formal title record is unavailable, gather documents that consistently connect the claimant to the property over time:

- Rent agreements, rent receipts, or income records if the property was rented out.
- Council-tax, property-tax, or other local-tax bills and payment histories.
- Utility bills and historical utility payments showing service to the same address.
- Home or building insurance policies, renewal notices, and claim correspondence.
- Receipts, invoices, or contracts for repairs, maintenance, extensions, or other improvements.
- Letters or applications exchanged with planning, building, housing, or other public authorities.
- Grant, planning, or improvement records that identify the property and the person who applied or paid.
HM Land Registry’s lost-deed guidance for England and Wales lists this type of material as evidence that may support an application. These records corroborate possession, payment, or dealings with the property; they are not a universal substitute for a deed or registered title. Their value depends on the total evidence and the rules where the property is located.
Organize the chronology
Put the documents in date order and make a one-page index. For each item, record the issuing organization, the property address or parcel reference, the named person, the period covered, and whether it is an original, certified copy, or ordinary copy. Note gaps instead of silently filling them. A clear chronology helps a registry or lawyer see whether the same person, parcel, and interest are being followed through time.

4. Request a separate building-permit and occupancy file
Contact the local building or code-enforcement authority and ask for the complete file for the address and parcel. Request permit applications, issued permits, inspection results, completion or final certificates, occupancy authorizations, and any record showing that no permit or inspection file exists.
This file addresses whether construction or use was authorized and inspected. It does not, by itself, establish who owns the land. Conversely, a title register does not prove that an extension complied with building rules. Keep the two files separate so that a missing permit is not mistaken for a missing title.

An authority’s confirmation that it cannot find a permit is evidence about its records, not a determination of ownership. Preserve the response, including the search date, address or parcel used, and department that conducted the search. Ask whether older records are held under a predecessor address, lot number, or paper archive before concluding that no file exists.

5. Match each document to the question it can answer
| Document or record | Question it can help answer | Important limitation |
|---|---|---|
| Official title register, title certificate, or equivalent registry record | Who is recorded as owner and which property the title covers? | It may not resolve every boundary issue or explain an unregistered historical interest. |
| Official title plan | Where is the registered parcel and what are its general boundaries? | General boundaries are not a precise survey of every line. |
| Conveyance, transfer, purchase, inheritance, probate, or court order | How did the claimant acquire the interest? | An old or unfiled document may need to be reconciled with the current register and later transfers. |
| Tax bills and payment records | Who was billed or paid taxes for the property during a stated period? | Payment or liability does not, on its own, prove legal title. |
| Utility bills and payment histories | Who arranged and paid for services at the address? | They usually show service and occupation, not ownership. |
| Insurance policies | Who insured the building and accepted responsibility for it? | An insurer’s policy is not a land-title record. |
| Repair, improvement, grant, or planning records | Who commissioned, paid for, or corresponded about work at the property? | They may support a possession narrative but do not replace a deed. |
| Permit, inspection, completion, or occupancy records | Whether construction or use appears in the building authority’s file | These records concern compliance or authorized use, not ownership. |
6. A practical document-collection procedure
- Identify the jurisdiction. Confirm the country, state, county, district, or other authority that keeps the land and building records. Record the property’s legal description, lot or parcel number, and any title number.
- Order the official ownership record. Use the registry’s process for an official or certified copy. If the property is in England and Wales and proof is needed for court or another formal purpose, request the official copy of the title register rather than relying on an ordinary online copy.
- Read the register for gaps. Note the registered proprietor, property description, title number, restrictions, charges, and references to filed documents. Obtain any referenced transfer or deed that is necessary to explain the chain.
- Search the owner’s papers and public archives. Look for purchase, inheritance, probate, court, tax, utility, insurance, repair, grant, planning, and correspondence records. Preserve envelopes, dates, and issuing details where they help establish authenticity.
- Request the building file separately. Ask for permits, inspection notes, completion or final certificates, occupancy records, and a written confirmation if the authority has no record. Use the legal address and parcel identifier, not only a nickname for the house.
- Reconcile discrepancies. Compare names, dates, addresses, parcel references, and the physical description. Explain changes such as marriage, estate administration, renumbering, subdivision, or a new lot number in a written chronology.
- Ask a local professional to choose the legal route. If the title is unregistered, deeds are lost, an estate is unresolved, or another person claims the property, a local property lawyer or conveyancer can determine whether first registration, probate, correction, or a court application is appropriate.
7. Common mistakes that weaken an ownership claim
- Relying on utility bills alone. A bill usually proves that someone received or paid for a service at an address. It does not establish the legal estate.
- Treating tax payment as title. Tax records can corroborate long-term possession, but the person who pays a bill is not necessarily the registered owner.
- Using a general online title view when an official copy is required. Confirm what form the receiving court, lender, registry, or agency accepts.
- Assuming the title plan fixes every boundary. General-boundary plans should not be presented as a precise survey.
- Mixing permit evidence with ownership evidence. A permit, inspection, or occupancy record may show regulatory history while leaving title unanswered.
- Ignoring a missing-record explanation. A lost deed, unregistered parcel, renamed street, or archived paper file may require a different search and a formal application.
- Submitting unrelated copies without a timeline. An indexed chronology showing the same claimant and parcel is easier to evaluate than a stack of undated bills.
8. When to obtain legal help
Get jurisdiction-specific advice before relying on possession records as a substitute for title, selling or mortgaging the property, administering an estate, responding to a competing claim, or applying to register land for the first time. A local professional can also separate a title problem from a building-compliance problem and identify whether notices, inspections, legalization work, or other remedies are available under local rules. The legal effect of constructing without a permit is not uniform, so it should not be inferred from the existence or absence of the documents listed here.
9. The key decision points
Your next step is determined by two facts: whether an official title is already registered and whether the building authority has a permit file. A registered title points to obtaining the correct official copy and checking the parcel identity. An unavailable or incomplete title calls for a documented chain of transfers and possession evidence followed by the jurisdiction’s registration or title-claim process. A permit record, or a written confirmation that no record exists, should be handled in parallel because it answers construction and occupancy questions rather than ownership.
