To bid as a prime contractor on U.S. federal construction work, you generally need an active SAM.gov registration with a Unique Entity ID (UEI), a solicitation-compliant offer, required bid and contract bonds, applicable licenses, insurance and safety evidence, and any socioeconomic or technical certifications claimed in the bid. State, county, city, school-district and utility owners add their own registration, prequalification, wage, insurance and licensing rules. The controlling document is always the specific solicitation and its amendments.
The core document set at a glance
Public construction owners use paperwork to answer four questions: Is the business legally eligible, can it perform the work, can it protect the owner and workers from foreseeable risks, and will it comply with the contract after award? Assemble the following evidence before searching seriously for opportunities.

Federal registration: SAM.gov and the UEI
What a federal prime must do
A company seeking a federal prime award needs an active registration in SAM.gov. During registration, SAM assigns a Unique Entity ID. The UEI identifies the entity, but a UEI-only record is not a substitute for an active registration that permits direct applications for federal awards.
Start registration early. The profile must match the legal entity that will sign the offer and receive payment. Prepare the legal business name, physical and mailing addresses, ownership and control information, banking and electronic-payment details, primary and additional NAICS codes, size representations and points of contact. Keep every field synchronized with state corporate records and the bid signature block; inconsistencies can trigger clarification requests or make an offer nonresponsive.

Size and NAICS accuracy
Small-business eligibility is determined against the size standard for the NAICS code assigned to the work, not by a universal employee or revenue limit. Document the employee count or receipts measure that applies to the selected code, including the affiliation rules that may require related entities to be counted. Select codes that accurately describe the construction services you perform rather than adding every possible code.
Read the solicitation as the definitive checklist
Invitation for bids versus request for proposals
An invitation for bids normally emphasizes a sealed price and compliance with stated specifications. A request for proposals can require a technical approach, staffing plan, construction schedule, management methods, quality controls, past performance and discussions. The solicitation determines which forms, certifications and attachments are mandatory; a generic “government contractor packet” cannot replace it.

Build a compliance matrix
Download the complete solicitation, drawings, specifications, wage determinations, clauses and every amendment. Create one row for each submission instruction and record the responsible person, source section, form version, signature requirement, due date and status. Include “not applicable” explanations where the solicitation permits them. Have a second person check that every amendment has been acknowledged and that pricing on the official schedule matches the detailed estimate.
Common response components
- Signed offer or bid form by an authorized representative.
- Completed pricing schedule, alternates, unit prices and additive or deductive options.
- Technical approach or work plan explaining means, methods, quality control and site logistics.
- Baseline schedule, milestone dates and availability of key personnel and equipment.
- Representations, certifications and conflict-of-interest disclosures.
- Subcontractor and supplier information, including required consent or approval forms.
- Past-performance or similar-project evidence in the requested format and time period.
- Questions, assumptions and acknowledgement of all issued amendments.
Bonds and bid security
Federal thresholds
For federal construction contracts exceeding $150,000, the Miller Act as implemented in Federal Acquisition Regulation (FAR) 28.102 generally requires performance and payment bonds, subject to statutory exceptions. For contracts greater than $35,000 but not greater than $150,000, the contracting officer selects alternative payment protections. Those protections can differ from a full payment bond, so read the clause rather than assuming one form applies to every project.
When a performance bond or a performance-and-payment bond is required, a bid guarantee is generally required as well. The solicitation states the guarantee amount, acceptable instruments and the deadline. A missing, unsigned or incorrectly calculated guarantee can make an otherwise competitive bid nonresponsive.
What to check on a bond
- Obligee: the legal name of the government owner must match the solicitation.
- Penal sum: confirm the required percentage or dollar amount and whether options affect it.
- Execution: obtain signatures from the principal and surety and attach the surety’s power of attorney.
- Form: use the government or owner form when one is prescribed; do not substitute a private template without written acceptance.
- Timing: arrange underwriting before bid submission and meet the post-award execution deadline.
Plan bonding capacity before estimating
A surety evaluates financial statements, working capital, bank support, experience, management, current backlog and the largest completed projects. Give the surety the draft solicitation, estimated cost, schedule, subcontracting plan and requested bond form. Ask for both single-job and aggregate capacity so a new award does not exceed the program available for existing work.

Qualifying small businesses can ask a participating surety about the Small Business Administration’s Surety Bond Guarantee program. SBA states that its guarantee can support bid, performance and payment bonds and that the guarantee fee is 0.6% of the contract price. Confirm eligibility, fee treatment and the surety’s process before relying on the program for a deadline-sensitive bid.
Licenses, insurance and safety evidence
Licensing is jurisdiction- and trade-specific
Public owners commonly require an active state contractor license and, where applicable, local business registration and trade licenses for electrical, plumbing, mechanical, asbestos, environmental or other controlled work. Check whether the license must be held by the prime, a designated qualifying individual or each subcontractor. Verify classification, monetary limits, bond requirements, responsible managing employee rules and renewal dates with the issuing authority.
Insurance certificates are not the whole requirement
The solicitation or contract controls coverage types and limits. Typical requirements include workers’ compensation, commercial general liability and automobile liability; larger or specialized projects may add umbrella, builder’s risk, pollution, professional liability or railroad protective coverage. Ask the broker to issue certificates and endorsements with the exact additional-insured, waiver-of-subrogation and notice language required. A certificate that shows a high limit but omits a mandated endorsement may not satisfy the contract.
Safety and labor records
Prepare a project safety plan, competent-person designations, training records, equipment inspection logs and a record of safety performance in the format requested. Federal contracts must comply with labor-standard and safety statutes identified by the contract. Depending on the project, the owner may ask for incident rates, citations, workers’ compensation history, drug-and-alcohol policies, site-specific plans or proof that key supervisors hold required credentials.

Set-aside programs
SBA programs include 8(a), Women-Owned Small Business (WOSB), HUBZone and Service-Disabled Veteran-Owned Small Business (SDVOSB). A certification can make a firm eligible for a set-aside or evaluation preference, but it does not waive ordinary licensing, bonding, insurance or technical requirements. Each program has its own ownership, control, size, location or veteran-status tests. Keep the underlying evidence current and report changes that could end eligibility.
| Program | Evidence reviewers typically focus on | Continuing obligation |
|---|---|---|
| 8(a) | Qualifying ownership and control, personal and business eligibility, and program documentation | Maintain eligibility throughout participation and disclose material changes. |
| WOSB | Women’s ownership and control plus applicable small-business status | Keep ownership, control and size information accurate. |
| HUBZone | Principal-office and employee-location rules, ownership and size | Continue meeting location and employee requirements. |
| SDVOSB | Service-disabled veteran ownership and control plus size eligibility | Preserve qualifying ownership and control and renew required records. |
Cybersecurity and technical requirements
Some Department of Defense solicitations specify a Cybersecurity Maturity Model Certification (CMMC) level. If the clause applies, determine the required level, assessment timing and scope for the systems that handle federal contract information or controlled unclassified information. A marketing statement about cybersecurity is not a substitute for the certification or assessment evidence named in the solicitation.

Finding opportunities and making your profile visible
SBA says federal agencies advertise contracts over $25,000 on SAM.gov. The information in your SAM registration feeds the Small Business Search profile used by agencies and prime contractors. Keep the profile useful: describe capabilities in plain language, list accurate NAICS codes and keywords, state bonding capacity and socioeconomic status, identify geographic coverage and maintain a monitored contact address.
For state and local work, register in the jurisdiction’s vendor portal, monitor public-works notices and determine whether a separate prequalification application is required. School districts, transit agencies, utilities and municipal authorities may publish opportunities outside the state’s central system.
Prime contractor versus subcontractor paperwork
Federal prime
A federal prime generally needs active SAM registration, a UEI, the required representations and certifications, and the full bond, license, insurance and technical package. The prime is responsible for meeting the prime contract even when portions are subcontracted.
Subcontractor
A subcontractor may not need its own SAM prime registration for every arrangement, but that is not automatic. Confirm the solicitation, flow-down clauses and subcontract terms. Expect the prime to request licenses, insurance certificates, safety records, financial or bonding information, relevant project history, labor compliance and certifications needed for a set-aside or approved-subcontractor plan.
Federal, state and local requirements compared
| Issue | Federal work | State or local public work |
|---|---|---|
| Registration | Active SAM.gov registration and UEI for a federal prime | Jurisdiction-specific vendor, contractor or prequalification registration |
| Bonding | Miller Act/FAR rules, including the generally applicable $150,000 performance-and-payment threshold and $35,000 alternative-payment-protection threshold | State or owner statutes and solicitation terms; thresholds vary widely |
| Licenses | Applicable state and local licenses still apply at the project site | Issuing authority’s classifications, exams, registrations and renewals |
| Wages and labor | Contract-specified federal labor standards and safety statutes | State prevailing-wage, local wage, apprenticeship and reporting rules where applicable |
| Certifications | SBA set-asides and any agency-specific technical or cybersecurity requirement | State, city, county, school or utility participation programs and prequalification criteria |
| Insurance | Limits and endorsements in the federal solicitation and contract | Owner- and jurisdiction-specific limits, forms and endorsements |
A practical pre-bid workflow
- Choose the role and jurisdiction. Decide whether you will bid as prime or subcontractor and identify the awarding authority, worksite and license jurisdiction.
- Check eligibility first. Confirm active SAM status if federal, correct NAICS size eligibility, required licenses, certification status and available bonding capacity.
- Download every controlling file. Obtain the solicitation, plans, specifications, clauses, wage information, attachments and amendments from the official portal.
- Build the compliance matrix. Record each form, signature, certification, insurance limit, bond requirement, experience criterion and submission instruction.
- Ask written questions. Send ambiguities to the contracting officer by the stated deadline and use only the official answer or amendment when revising the bid.
- Obtain surety and insurance confirmation. Have the surety review bond language and the broker verify limits and endorsements before final pricing.
- Collect evidence from subcontractors. Verify their licenses, insurance, safety records, certifications and requested consent forms before naming them in the offer.
- Run an independent quality check. Reconcile prices, signatures, dates, amendment acknowledgements, file naming, page limits and electronic-upload requirements.
- Submit early and retain proof. Allow time for portal outages or rejected files; save the confirmation, final files and the exact version submitted.
Common failure points and fixes
Expired or mismatched registration
Symptom: SAM shows inactive status, an outdated address or a legal name that differs from the offer. Fix: renew or correct the record before the solicitation deadline and ensure the signing entity, bank information and tax records align.
Assuming a UEI is enough
Symptom: the company has an identifier but cannot submit as a federal prime. Fix: complete and maintain the full SAM registration; treat the UEI as the identifier within that registration, not as permission to bid by itself.

Using the wrong bond form or amount
Symptom: a bid guarantee names the wrong obligee, lacks a power of attorney or uses an incorrect penal sum. Fix: give the solicitation and prescribed forms to the surety before the deadline and verify every field against the final amendment.
Relying on a generic insurance certificate
Symptom: limits appear adequate but required endorsements or notice language are missing. Fix: have the broker compare the certificate and endorsements line by line with the contract clause.
Claiming a certification without preserving eligibility
Symptom: ownership, control, location, size or veteran-status facts changed after certification. Fix: review eligibility whenever ownership, management, headquarters, employees or affiliated entities change and update the program record as required.
Ignoring amendments and local rules
Symptom: the price follows the original plans or a license, wage or prequalification rule from the project jurisdiction is missing. Fix: assign one person to monitor amendments and one to verify local requirements with the issuing authority before bid submission.
What to retain after submission
Keep the final signed offer, bid guarantee, submitted schedules, certifications, amendment acknowledgements, portal receipt, questions and official answers, insurance confirmations, surety correspondence and subcontractor evidence. If awarded, preserve the executed contract, bonds, notices to proceed, approved submittals and any updated certificates in a controlled project file. These records support negotiations, audits, claims administration and future past-performance submissions.
The shortest reliable answer is this: federal prime contractors need an active SAM registration and UEI, a solicitation-specific response, the required guarantee and bonds, valid licenses, contract-compliant insurance and safety evidence, and only those certifications they can substantiate and maintain. For every state or local opportunity, replace assumptions with the actual solicitation, amendments and issuing authority’s rules.
