What Counts as a Construction Project Start for Lenders, Contractors and Regulators?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no single legal “first day” for every construction project. A lender or grant program may use the date in a Notice to Proceed, a contractor’s performance period may begin when that notice is received, a building-control authority may require a defined amount of physical work, and a lien statute may use a notice filing for an entirely different purpose. The controlling date is the one in the applicable contract, financing agreement, regulation or statute for the specific decision being made.

Before calling a project “started,” identify the jurisdiction, project type, governing document and reason the date matters. Then record both the documentary trigger (such as a Notice to Proceed) and the physical milestone, because they can occur on different days.

The practical answer: “start” depends on what the date controls

Ask four questions before selecting a construction-start date:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Is the date for financing or a grant? The program may define commencement by a Notice to Proceed or contract date.
  • Is it for the contractor’s time for performance? The contract may start the clock on issuance or receipt of a notice and may allow a later date stated in the notice.
  • Is it for building control or permit validity? The authority may require completion of a specified physical stage, not merely paperwork or site activity.
  • Is it for lien administration? A notice of commencement can create a statutory filing and posting obligation without defining the first day of physical work.

Those triggers are not interchangeable. A permit, mobilization, site clearing, recorded notice and concrete pour can all be relevant evidence, yet none is automatically the controlling start date in every jurisdiction or contract.

Context Typical trigger in the cited authority What the date controls
USDA Rural Development program Date in the Notice to Proceed; if absent, the contract date or another date established by the contract or parties Program definition of “date of commencement of work”
California State Water Resources Control Board wastewater program Notice to Proceed issuance, or, when no notice is required, commencement of building and erection Program definition of “Initiation of Construction”
Philippines standard-contract framework cited by the Construction Industry Authority FAQ Contractor should commence within seven days after receiving the Notice to Proceed, unless the notice or contract sets a later date Contractor’s obligation to begin
England: complex building Supporting foundations and the structure of the lowest floor level completed Regulatory “commencement” for the specified building-control purpose
England: ordinary new building or horizontal extension Sub-surface structure completed, including foundations, basement levels and ground-floor structure Regulatory “commencement” for the specified building-control purpose
England: other building work Initial work completed, with the regulation defining initial work by reference to work the client considers to amount to 15% of the described work Regulatory “commencement” for the specified building-control purpose
Florida lien administration Notice of Commencement recorded and posted before the first inspection, as directed by the cited 2026 statute Construction-lien notice procedure, not a universal physical-start test

These examples come from different jurisdictions and programs. They illustrate why a project team must name the governing authority instead of applying one worldwide rule.

How financing programs define commencement

USDA Rural Development: the Notice to Proceed controls

For the USDA Rural Development program addressed in 7 CFR §1924.4(e), the “date of commencement of work” is the date established in a Notice to Proceed. The regulation states: “The date established in a ‘Notice to Proceed’ or, in the absence of such notice, the date of the contract or other date as may be established in it or by the parties to it.”

This is a program definition. It does not establish a rule for every commercial construction loan, private lender or public grant. If a USDA-covered project has no Notice to Proceed, the executed contract or a date established under that contract becomes important. Keep the signed notice, contract version and any written agreement that changes the date together in the project file.

California wastewater funding: issuance or actual building

A California State Water Resources Control Board wastewater-facilities program document defines “Initiation of Construction” as the date the Notice to Proceed is issued. If a Notice to Proceed is not required, it uses the date building and erection of the project begins.

The two-part wording matters. A project can have a program commencement date based on notice issuance even if substantial field activity follows later; alternatively, a project without a required notice may need evidence of actual building or erection. Confirm the program’s current agreement and definitions rather than transferring this rule to another California funding program.

What a lender should verify

When the start date affects a draw, interest period, insurance requirement, grant deadline or completion deadline, the lender and borrower should reconcile:

A lender’s internal practice may be stricter than a statutory minimum. The executed financing documents and the applicable program manual control the transaction.

How the contractor’s start obligation is triggered

Issuance and receipt are different events

A Notice to Proceed can be dated when the owner or agency issues it, delivered on a later day, and received by the contractor later still. Contracts often specify which event starts the performance period. Do not assume that the date printed on the notice is the date the contractor’s obligation begins.

The seven-day example in the Philippines

The Construction Industry Authority of the Philippines FAQ, discussing its referenced standard contract framework, says the contractor should commence work within seven days from receipt of the Notice to Proceed unless the notice or contract provides a later date. That seven-day period belongs to that contract framework and jurisdiction; it is not a worldwide construction rule.

For a project using that framework, preserve proof of delivery (for example, an acknowledged receipt or reliable electronic transmission), identify any later date stated in the notice, and check whether the contract includes conditions that must be met before the period runs.

Contract items that can change the answer

Read the commencement clause with related provisions, including:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • notice-form and delivery requirements;
  • access to the site and possession of work areas;
  • availability of permits, designs, financing or insurance;
  • conditions precedent and owner-supplied information;
  • weather, suspension and excusable-delay clauses; and
  • the definition of substantial completion or the contract completion date.

If a notice is issued before the contractor has the contractual right to access the site, the parties may have a dispute over whether the performance clock truly began. A written reservation or clarification at the time of notice is safer than reconstructing intent after a delay.

How England’s building-control rules use physical thresholds

“Work may start” is not the same as “work is commenced”

England’s building-control regime distinguishes permission to begin work from the point at which work is formally regarded as commenced for specified regulatory purposes. The 2023 amendments, described in the UK government circular, replaced earlier guidance for the relevant lapse-of-approval purpose. The applicable definition must be met within three years of a building-control approval application; check the approval date and current statutory text for a live project.

Complex buildings

For a complex building, the cited 2024 regulation generally treats work as commenced when the supporting foundations and the structure of the lowest floor level are complete. Early activity such as fencing, excavation or isolated foundation work may not satisfy that threshold if the prescribed foundation and lowest-floor structure are not complete.

Ordinary new buildings and horizontal extensions

For an ordinary new building or a horizontal extension, the threshold is completion of the sub-surface structure. That includes the foundations, any basement levels and the ground-floor structure. The category is different from the complex-building test, so the project’s classification matters before anyone relies on a commencement date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Other building work and the 15% initial-work test

For other building work, the rule refers to completion of the initial work. The regulation defines initial work by reference to work the client considers amounts to 15% of the described work. The 15% figure is a threshold within this English regulatory category, not a general measure of progress and not a rule for lenders or contractors elsewhere.

Notices to the building-control body

In the cited England process, the person carrying out the work must give at least two working days’ advance notice of the intended start. After the work is regarded as commenced, a further notice must be given no more than five working days later. The building-control approver can examine whether the physical commencement threshold has actually been met.

Maintain dated photographs, inspection requests, delivery records, foundation and ground-floor certificates, and site diaries that identify the work completed. A notice sent on time does not by itself prove that the physical threshold was achieved.

What Florida’s Notice of Commencement does—and does not—mean

The Florida statute cited for 2026 treats a Notice of Commencement as a construction-lien-related filing. It directs the permit authority to warn the owner that the notice must be recorded and posted before the first inspection. When financing is planned, the warning says to consult the lender or an attorney before recording.

This filing has a statutory notice function. It should not be described as a universal definition of the first day of construction, and it should not be conflated with a Notice to Proceed or an England building-control commencement notice. Follow the current Florida statute, recording requirements and project-specific legal advice for the county and work involved.

Does site preparation, mobilization or a permit count?

There is no automatic answer. Site clearing, grading, utility relocation, temporary facilities, equipment delivery and excavation may be meaningful physical progress, but a particular contract, funding program or building-control rule may require a later milestone. Conversely, a program that defines commencement by Notice to Proceed may use that notice even when field work has not begun.

Classify each event rather than labeling it “the start” without context:

  • Paperwork event: approval, permit issuance, Notice to Proceed, building-control notice or lien filing.
  • Access and mobilization: possession of the site, fencing, trailers, equipment and workforce.
  • Enabling work: clearing, demolition, grading, temporary utilities or excavation.
  • Structural milestone: foundations, basement, lowest-floor structure or another threshold named by the regulator.
  • Contract milestone: the date that starts the contractor’s performance period under the executed agreement.

Record the date and description of every category. The fact pattern may later need to be analyzed under more than one definition.

A step-by-step method for choosing the controlling date

  1. State the purpose. Write whether the date is needed for a loan or grant, contractor time, permit or building-control status, lien administration, insurance or another obligation.
  2. Identify the authority. Name the country, state or other jurisdiction, the project type and the current regulation, statute, program manual or contract edition.
  3. Locate the definition. Search the executed agreement and incorporated documents for “commencement,” “date of commencement,” “initiation of construction,” “Notice to Proceed,” “start” and “initial work.”
  4. Map the trigger. Note whether the rule uses issuance, receipt, a stated contract date, actual building, a percentage or a completed physical stage.
  5. Check conditions and exceptions. Confirm site access, permits, approvals, funding conditions, notice timing, project classification and any later date allowed by the document.
  6. Build an evidence file. Keep the signed notice, delivery proof, permits, inspection records, photographs, daily reports, invoices and correspondence that establishes the event.
  7. Check for conflicting clocks. Put the financing, contractor, regulator and lien dates on one timeline. Obtain written clarification before relying on a date that affects payment, delay damages or approval lapse.

Common mistakes and how to prevent them

Assuming the first on-site activity is decisive

Early activity may not meet a prescribed structural threshold, while a notice-based program may have already started its clock. Describe what happened and apply the relevant definition.

Treating every Notice to Proceed as identical

One authority may use issuance, another contract language may use receipt, and a notice may state a later commencement date. Identify the issuer, recipient, delivery date and operative clause.

Conflating three kinds of notice

A financing or contract Notice to Proceed, an advance notice to a building-control body and a lien-related Notice of Commencement have different purposes and deadlines. Label each document precisely in correspondence and schedules.

Ignoring project classification

England’s physical thresholds differ for complex buildings, ordinary buildings and extensions, and other work. Applying the wrong category can produce an incorrect lapse-of-approval date.

Using an outdated rule

Regulations, statutes and program documents change. Record the approval, contract and work dates, then verify the version in force for that period before asserting that a project has or has not commenced.

Worked examples

Example 1: USDA-funded building

A Notice to Proceed is issued on 4 March and states that work commences that day. Under the USDA program definition, 4 March is the program commencement date even if the contractor mobilizes on 11 March. If no notice existed, the executed contract or another date established under it would control instead.

Example 2: England extension

An owner sends the required advance notice before excavation. The project is an ordinary horizontal extension. The regulatory commencement point is reached when the sub-surface structure—including foundations, any basement level and the ground-floor structure—is complete, not merely when fencing or excavation begins. A follow-up notice is then due within the stated five-working-day window.

Example 3: Florida financed project

An owner records and posts a Notice of Commencement before the first inspection after receiving the permit authority’s warning. That filing satisfies a lien-notice procedure; it does not, without more, establish the contractor’s contractual start date or prove that physical construction began.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Bottom line

Construction “starts” on the date that the applicable contract, financing program, regulator or statute says it starts. A Notice to Proceed can control a funding or contractual milestone; a contractor’s clock may run from receipt; England’s building-control rules can require a completed physical stage; and Florida’s Notice of Commencement serves a lien-notice purpose. Put every applicable date on a single project timeline, preserve the evidence for each trigger and confirm the current local rule before relying on it.
