What Construction Workers Can Do If They Were Misclassified as Independent Contractors

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a construction company paid you as a contractor even though it controlled your work like an employee, start by preserving records and matching the problem to the right government process. The U.S. Department of Labor (DOL) handles possible Fair Labor Standards Act (FLSA) minimum-wage and overtime issues; the Internal Revenue Service (IRS) uses Form SS-8 to decide federal employment-tax status. Those are separate from any claim under the law of the state where you worked.

Start with the legal question, not the label on your paperwork

A contract, invoice, or Form 1099 does not by itself settle whether you were an employee. For FLSA purposes, the DOL describes misclassification as treating a worker who is legally an employee as an independent contractor. The agency’s analysis concerns whether the worker is covered by employee wage protections, including minimum wage and overtime, rather than what the company called the relationship. See the DOL’s current guidance on misclassification under the FLSA.

The IRS applies a separate federal employment-tax framework. Its public determination in a construction and trades matter explains that the actual relationship and the right to control are important; contract wording alone cannot decide status. In that determination, the IRS wrote: “Thus, if an employer-employee relationship exists, any contractual designation of the employee as a partner, coadventurer, agent, or independent contractor must be disregarded.” That statement is limited to the federal common-law tax analysis in that particular determination, not a universal construction-industry rule. Read the example at IRS Form 14430-A determination 03TRA42708.

Because the DOL and IRS answer different questions, a result from one agency does not automatically decide a wage claim, a state-law claim, or the other agency’s process.

Preserve the facts before you contact an agency

Agencies decide status from the real working relationship. Preserve records in their original form and do not alter them. Do not take documents you are not allowed to access. Make a private chronology while events are fresh, noting who directed the work, when you worked, how you were paid, and what expenses you carried.

Records worth gathering

  • Any written contract, subcontract, scope-of-work document, change order, or termination notice.
  • Invoices, pay statements, canceled checks, bank deposits, and Forms 1099.
  • Daily schedules, crew assignments, time sheets, project-management entries, and job-site sign-in records.
  • Texts, emails, or app messages showing instructions about methods, hours, sequencing, safety procedures, uniforms, or reporting.
  • Information about who supplied tools, vehicles, materials, protective equipment, software, and insurance, and who paid repair or operating costs.
  • Records showing whether you could work for other customers, advertise an independent business, hire helpers, negotiate prices, or risk a profit or loss.
  • Names and contact information for people who can accurately describe the working arrangement, subject to privacy and legal limits.

The IRS says Form SS-8 requires complete information and supporting documents; incomplete submissions may be returned or rejected. Organizing the evidence does not guarantee a particular classification, but it helps an agency evaluate the facts instead of relying only on a label.

Choose the route based on the harm you are trying to fix

Route Decision-maker Main question What it covers Timing or limit stated by the agency
FLSA wage concern DOL Wage and Hour Division Were you an employee entitled to FLSA protections? Potential federal minimum-wage and overtime rights, subject to coverage and the facts. The cited guidance does not establish your individual deadline, amount owed, coverage, or outcome.
Federal tax status IRS Were you an employee or independent contractor for federal employment-tax purposes? Employment-tax treatment and income-tax withholding status. The IRS says an SS-8 decision can take at least six months.
State or local rights The labor agency or court identified by the state where the work occurred Which state test, filing route, and remedies apply? State minimum wage, overtime, unemployment, workers’ compensation, wage-payment, or other protections, depending on the jurisdiction. Varies by state and facts; the worker’s location is essential.

These options can be considered in parallel when appropriate. Filing one does not substitute for another, and an IRS determination does not resolve an FLSA or state claim.

If the problem is unpaid minimum wage or overtime, start with the DOL

Identify the wage issue

List the weeks in which you worked, the hours you believe were not paid, the amounts received, and whether you were paid hourly, by the day, by the project, or by another method. Keep this as a factual record; do not assume every hour or every worker is covered by the FLSA. Coverage, exemptions, the applicable pay calculation, and any filing deadline require an assessment of your specific facts.

Use the Wage and Hour Division’s information and resources

Review the DOL’s FLSA misclassification guidance and follow its current instructions for contacting the Wage and Hour Division. Ask what information the office needs and keep copies of anything you submit. The DOL can explain its process, but the cited material does not promise that an inquiry will be opened, that a violation will be found, or that a particular amount will be recovered.

Keep the wage record separate from the status argument

Explain both parts clearly: the facts suggesting an employee relationship and the wage consequence, such as unpaid overtime or pay below the applicable minimum. A company’s use of a contractor agreement may be relevant evidence, but it is not the only fact. Avoid presenting an IRS filing as if it were a wage complaint; the agencies have different authority and standards.

If the problem is federal tax classification, consider Form SS-8

What an SS-8 request does

Workers and businesses may file Form SS-8 to ask the IRS for a determination of whether a worker is an employee or an independent contractor for federal employment-tax and income-tax withholding purposes. It is a request for the IRS’s federal tax-status determination, not a damages claim and not a ruling on state wage rights.

Prepare a complete submission

  1. Read the IRS instructions on completing Form SS-8, including the situations in which the IRS will not accept a request.
  2. Describe the actual work relationship, not just the written contract. Give concrete examples of instructions, scheduling, supervision, payment, expenses, tools, and the ability to work for other customers.
  3. Attach copies of relevant contracts, pay records, schedules, messages, time records, and other supporting material. Keep the originals and redact personal information that is not needed, while preserving details the form requests.
  4. Review every answer for completeness and consistency. The IRS warns that incomplete submissions may be returned or rejected.
  5. Submit the form using the current IRS instructions and retain proof of what you sent and when.

Plan for the waiting period and your tax filings

The IRS says an SS-8 determination can take at least six months. Do not postpone a tax return while waiting. The IRS instructs taxpayers to file by the return’s due date rather than wait for an SS-8 response. It also gives a general period for claiming a refund of three years from filing the original return or two years from the date the tax was paid, whichever is later. Those periods can depend on your facts, so discuss your returns and any amended filing with a qualified tax professional.

Check the state where the work occurred

State law may use a different test, cover more workers, or provide remedies that the FLSA does not. The correct agency and deadline depend on where the work was performed, not simply where the company’s headquarters is located. A project that crossed state lines may require a location-by-location analysis.

The DOL maintains links to state labor offices and labor-law topics at its state contacts page. Use the relevant state agency’s current instructions to check wage claims, unemployment insurance, workers’ compensation, wage-payment rules, and any state independent-contractor test. Because no state, work dates, or employment facts are provided here, a specific state deadline or remedy cannot be identified reliably.

Construction facts agencies may examine

Instructions and control

Record who assigned jobs, set the sequence of tasks, required particular methods, established hours, approved time off, monitored performance, or imposed discipline. A written promise of independence may carry less weight if day-to-day conduct shows detailed control.

Integration into the company’s service

Describe whether your work was part of the firm’s ordinary construction offering, whether you worked on its crews, and whether customers received the service as the firm’s work. The IRS construction determination cited above considered work performed as part of the firm’s services, among other facts.

Financial risk, tools, and expenses

Identify who supplied tools and materials, paid travel or equipment costs, carried insurance, corrected defective work, and could make a profit or suffer a loss. Payment by project rather than by hour is only one fact; it does not answer the classification question by itself.

Independent business indicators

Note whether you advertised to the public, maintained a separate business, had multiple clients, hired and paid helpers, negotiated prices, or could decline assignments. Explain what actually happened during the period at issue, including any limits that made outside work impractical.

Understand what an agency result can—and cannot—do

An FLSA inquiry addresses federal wage protections. An SS-8 determination addresses federal employment-tax treatment. A state agency or court may apply its own definition. One favorable finding can be useful evidence, but it does not automatically establish liability under every law, calculate back pay, change a state deadline, or decide a different tax year. Keep each filing’s purpose and requested remedy clear.

The IRS construction-related determination is an example of how an agency weighed assignments and instructions, the firm’s services, tools and expenses, pay arrangements, and the worker’s independent business. The IRS concluded employee status in that specific matter. It is illustrative, not a categorical rule for every construction worker.

When individualized professional advice is worth the cost

Consider an employment attorney or worker-rights clinic when substantial overtime, several workers, retaliation, a threatened lawsuit, or multiple states are involved. A tax professional can help with withholding, amended returns, estimated payments, and refund claims while an SS-8 request is pending. Ask any adviser to distinguish FLSA, state-law, and tax issues rather than treating “1099” status as one universal question. No particular provider or referral program is established here.

Common mistakes to avoid

  • Assuming the contract or 1099 label ends the analysis.
  • Waiting for an SS-8 decision before filing a tax return by its due date.
  • Sending an incomplete SS-8 form or omitting records that explain control, pay, tools, and expenses.
  • Using an IRS determination as a substitute for a DOL wage inquiry or a state filing.
  • Guessing at a state deadline without confirming the state where the work occurred.
  • Altering messages, time records, invoices, or other evidence, or taking records you are not authorized to possess.
  • Assuming a project-rate payment automatically means independent-contractor status or automatically proves overtime liability.

A practical sequence for the next few days

  1. Write a timeline of the jobs, dates, hours, supervisors, assignments, and payments.
  2. Secure lawful copies of contracts, invoices, 1099s, schedules, messages, time records, and expense information.
  3. Separate the harms: unpaid minimum wage or overtime, tax withholding or self-employment-tax concerns, and state benefits or protections.
  4. Check the DOL’s current FLSA misclassification information and determine whether to contact the Wage and Hour Division.
  5. Review the IRS SS-8 instructions and decide whether a federal tax-status determination is needed.
  6. File tax returns on time; do not wait for an SS-8 response.
  7. Identify every state in which the work occurred and check the applicable labor office and deadlines.
  8. Consult an employment lawyer, worker-rights clinic, or tax professional when the amounts, risks, or overlapping jurisdictions justify advice.
  9. Keep a dated log of agency contacts, submissions, responses, and upcoming deadlines.

This federal overview cannot determine whether a particular construction worker is legally an employee or what remedy is available. The decisive details are the actual working relationship, the dates and locations, the wages and hours, and the rules of each agency or state involved.
