What Construction Worker Formalisation Means for Wages, Safety and Social Security

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Construction-worker formalisation is the process of bringing jobs and employment relationships under enforceable labour, safety and social-protection rules. It is not achieved simply by registering a contractor or obtaining a business licence. A formally registered company can still use informal, unregistered or unprotected workers through subcontractors, labour brokers or short-term arrangements.

The practical test is whether each worker is covered in practice: a lawful and paid wage, written or otherwise provable employment terms, occupational-safety controls, access to complaint and inspection systems, and the social-security scheme that applies in that country. Because labour law, insurance and enforcement differ by jurisdiction, no global percentage increase in wages or decrease in injuries can be promised from formalisation alone.

What does construction worker formalisation mean?

The International Labour Organization (ILO) separates two ideas that are often confused:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Informal sector: a description of a production unit or enterprise, such as an unregistered or unincorporated business.
  • Informal employment: a description of a job or employment relationship that lacks formal protection, regardless of whether the enterprise itself is formal.

This distinction is decisive on construction projects. A principal contractor may be registered, keep accounts and hold a government contract while individual workers hired by a subcontractor remain outside payroll, workers’ compensation, social insurance or inspection coverage. Conversely, a small contractor may be legally organised but fail to formalise particular jobs.

ILO Recommendation No. 204 (adopted in 2015) describes the informal economy as economic activities that are not covered, or are insufficiently covered, by formal arrangements. Its objective is a transition that respects fundamental rights, protects income security and livelihoods, supports sustainable formal enterprises and decent jobs, and prevents existing formal jobs from becoming informal. Formalisation is therefore a policy and implementation process, not an administrative label.

The construction-specific questions

To determine whether a construction job is formal, examine the worker’s actual relationship with the project:

  • Who hires, directs and pays the worker?
  • Is there a record of the job, hours, wage rate and payment date?
  • Does the worker receive the statutory minimum wage and overtime treatment that applies?
  • Are safety duties assigned, funded and enforced at the worksite?
  • Is the worker enrolled in the applicable social-security, injury-insurance or health scheme?
  • Can the worker complain or claim benefits without being dismissed or blacklisted?

Answers can differ for a labourer, machine operator, electrician and supervisor on the same site. They can also differ between a direct employee and a person supplied by a subcontractor. A project-wide “formal” label is not enough.

How formalisation affects wages

Legal entitlement is not the same as money received

Formalisation can bring a worker within minimum-wage legislation, overtime rules, paid-leave provisions and wage-record requirements. The ILO notes, however, that outcomes depend on the country. Some legal systems exclude certain categories of informal workers from statutory protection; in many others, the rule already covers them but employers do not comply.

For that reason, wage analysis should separate four questions:

Question What it establishes What it does not establish
Is the job legally covered? Whether minimum-wage and related rules apply to this worker and employment status. That the worker is actually paid the required amount.
Was the wage paid in full and on time? The worker’s immediate cash outcome, including deductions and delayed payments. That the arrangement is sustainable or includes social protection.
Can the rule be enforced? Whether inspection, courts, labour offices or worker organisations can secure compliance. That every worker will use those mechanisms successfully.
What is the worker’s total compensation? Cash earnings plus legally required benefits and insurance contributions. That a higher cash wage always means better protection.

Formalisation may raise recorded earnings because underpayment becomes easier to detect and employers must account for overtime or deductions. It can also reduce take-home cash in the short term when lawful employee contributions are withheld, while adding benefits that are not visible in the payslip. A higher wage cannot be assumed without country-specific evidence on enforcement, sectoral rates, worker skills and bargaining power.

What to check on a construction job

  1. Identify the legal employer. Keep the contract, subcontract, hiring message or other proof showing who is responsible for pay.
  2. Record the rate and time. Track normal hours, overtime, rest days, allowances and deductions against the applicable wage order.
  3. Verify payment. Compare payslips, bank records or signed receipts with the hours worked; flag delayed or partial payments.
  4. Check classification. A label such as “casual,” “independent” or “daily worker” does not by itself determine legal status. The facts of control, supervision and payment matter.
  5. Use a remedy. Labour inspection, a worker organisation, a labour office or a court may be available, depending on national law.

For a project owner, wage formalisation also means tracing responsibility through every tier of contracting. A clause requiring lawful wages is weak if tender prices leave no realistic budget for them, if records are never checked or if the owner pays only the main contractor while lower-tier workers remain invisible.

How formalisation affects construction safety

Formal status can create enforceable duties

Construction hazards include falls, struck-by incidents, electrocution, collapsing excavations, unsafe lifting and exposure to dust, noise or hazardous substances. Formalisation can connect a worker and employer to occupational-safety statutes, risk assessments, training, reporting duties, protective equipment and workers’ compensation. It can also identify the person responsible for correcting a dangerous condition.

Those legal links do not make a site safe automatically. A formally employed worker can still work beside an unguarded edge, defective scaffold or overloaded lifting device if supervision and enforcement fail. Likewise, an informal worker may receive good protection on one site and none on another. The relevant evidence is the control implemented at the workplace, not the employment label alone.

Inspection and training are the mechanisms

The ILO describes labour inspection as covering occupational conditions as well as formality-related protections, including social security. Inspections, orders and sanctions can increase the cost of non-compliance and motivate enterprises to provide mandated protections. Effective systems also need enough inspectors, clear jurisdiction over subcontractors and a way for workers to report hazards without retaliation.

The ILO’s construction resources include a safety-and-health training package intended to support implementation of its code of practice and promote a safe and healthy working environment. Such training is an optional learning resource, not a substitute for the employer’s legal duties, competent supervision, safe equipment, emergency planning or public enforcement.

Safety indicators worth measuring

  • Percentage of workers, including subcontracted and casual workers, receiving site induction and task-specific training.
  • Documented risk assessments, permits, inspections and corrective actions.
  • Availability and correct use of fall protection, guarding, lockout procedures and other controls required by local rules.
  • Timeliness and completeness of incident, near-miss and occupational-disease reporting.
  • Whether workers can stop or leave imminently dangerous work without losing pay or employment.
  • Inspection findings, repeat violations and closure of corrective orders.

Injury counts alone are an imperfect measure: under-reporting is more likely where workers fear dismissal or lack access to compensation. Pair outcome data with preventive practice and enforcement data.

How formalisation affects social security

Coverage is the practical test

Social security may include pension, health care, sickness, maternity, unemployment, employment injury or survivor benefits. The scheme, contribution rate, waiting period and eligibility rules are country-specific. Formalisation should therefore be judged by whether the worker is registered in the applicable scheme, contributions are actually remitted and claims can be made—not merely by a promise in a contract.

Construction creates particular continuity problems. Workers may move between projects, employers or provinces; subcontractors may change during a build; and short contracts can interrupt contributions. A worker who was enrolled on one project may lose coverage when the next contractor treats the same work as an informal day-labour arrangement.

Cambodia example: a study-specific definition

An ILO diagnostic of informality in Cambodia’s construction sector, published in 2024, used a specific operational test: wage workers were considered informally employed when they were not yet covered by Cambodia’s National Social Security Fund. The diagnostic included a purposive, occupationally stratified survey of 100 informal wage earners affiliated with worker organisations, alongside other methods.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That definition and sample are useful for understanding how coverage can be measured, but they are not a representative estimate of all Cambodian construction workers or a global statistic. A different country may use another institution, a different eligibility rule or several forms of insurance. Always name the scheme, population, period and sampling method when presenting a coverage figure.

How to tell whether formalisation is working

Use coverage, compliance and outcomes together

The ILO indicator framework includes social-security contributions and average labour earnings, split by formal and informal jobs. Those measures become meaningful when reported with the worker’s status, country, time period and method. A registration count can rise while contributions remain unpaid; average earnings can rise because higher-skilled workers enter the sample; and injury reports can increase because reporting improved.

Assessment area Questions to ask Useful evidence
Reach Which direct, subcontracted, casual and migrant workers are covered? Payroll and contractor registers matched to site rosters; enrolment records.
Implementation Are registration, contributions, wage rules and safety duties followed? Payment records, contribution receipts, inspection reports and corrective-action logs.
Worker outcomes Do earnings, payment regularity, protection and safety improve? Average hourly or monthly earnings, benefit claims, verified incidents and worker surveys.
Access and burden Can small contractors and workers comply, understand rights and claim benefits? Processing times, contribution costs, complaint resolution and documented barriers.

The first three areas are directly reflected in ILO measurement and policy work. Administrative burden and access are essential policy considerations, but they should be measured locally rather than presented as a universal quantified effect.

Compare policy options on four axes

  • Reach: Does the measure cover every employment relationship in the contracting chain?
  • Implementation: Are registration, contributions, wages and safety rules verified in practice?
  • Worker outcomes: Do people receive reliable earnings, continuous social protection and safer conditions?
  • Administrative burden and access: Can smaller firms register and can workers obtain help without prohibitive cost or delay?

A policy that is easy for large firms but impossible for micro-contractors may leave the most vulnerable jobs informal. A low-cost registration drive without inspection or contribution payment may improve paperwork without improving protection.

A practical formalisation roadmap

For workers

  1. Ask for the employer’s legal name, job terms, wage rate, payment date and applicable social-security scheme before starting.
  2. Keep copies or photographs of contracts, identity documents, payslips, attendance records, payment receipts and safety instructions.
  3. Confirm enrolment and contributions directly with the responsible agency where that service exists.
  4. Report missing pay, non-registration or dangerous conditions through a worker organisation, labour office or inspection channel available in your country.
  5. Seek urgent medical care after an incident and preserve medical and incident records for any compensation claim.

For contractors and project owners

  1. Map every employer and subcontractor, including labour suppliers and self-described independent workers.
  2. Make lawful wages, contribution payments, safety controls and record access conditions of the contract—not optional assurances.
  3. Budget for compliance in tender prices and retain payment and enrolment evidence for each worker.
  4. Give all workers the same site induction, hazard controls and emergency information, regardless of who signs the pay contract.
  5. Audit lower-tier contractors and correct failures before they become wage claims, injuries or interrupted coverage.

For regulators and programme designers

  1. Align registration, labour inspection and social-security databases where lawful and protect personal data.
  2. Define responsibility across contracting tiers so the principal employer cannot evade duties by outsourcing.
  3. Offer simple enrolment and payment processes for short projects and mobile workers.
  4. Publish understandable wage, safety and contribution guidance in languages workers use.
  5. Track both formalisation inputs and worker outcomes, disaggregated by job type, gender, migration status and contract arrangement where appropriate.

Common mistakes to avoid

  • Counting registered firms instead of protected jobs: enterprise registration does not prove that each worker is formal.
  • Equating a written contract with compliance: wages may still be withheld and contributions may never be remitted.
  • Assuming formal workers are safe: hazards depend on controls, equipment, supervision and enforcement.
  • Promising a universal pay rise: legal coverage, enforcement and local labour markets determine the result.
  • Using one country’s definition everywhere: the Cambodia National Social Security Fund test is specific to that diagnostic.
  • Relying only on injury totals: reporting changes can raise recorded injuries even when prevention improves.

The strongest definition of success is practical: more construction workers can prove who employs them, receive the pay and benefits required by law, work under enforceable safety controls, and maintain social protection when a project or contractor changes. Formalisation is meaningful only when those rights reach the job itself.
