What Condo Buyers Should Know About Construction Financing and Project Delays

A pre-construction condo brings separate risks: whether the developer can complete the project and whether you can finance your closing. Here is what buyers should check about delays, occupancy, appraisal gaps and contract terms.

Buying a pre-construction condo involves two separate financing risks: the developer may not be able to finance or complete the project, and you may not be able to obtain enough mortgage financing when your own closing arrives. A project delay can affect both risks, as well as your housing costs. The contract and local law determine what can happen next; rules discussed here are Canadian examples, particularly from Ontario and British Columbia, not universal protections.

Why developer financing and your mortgage are different risks

When a buyer hears that a condo project has a financing condition, that usually concerns the developer’s ability to fund construction and completion. It does not establish whether the buyer will qualify for a suitable mortgage years later. Keep the two questions separate from the start.

Can the developer finance and complete the project?

A project or phase may depend on sales, permits, construction financing, construction costs and available labour. Ontario’s Home Construction Regulatory Authority (HCRA) identifies minimum unit sales and a developer securing financing for construction and completion as examples of conditions that may allow a developer to terminate an agreement. British Columbia’s Financial Services Authority (BCFSA) lists inadequate sales, delayed financing or building permits, rising construction costs and labour shortages as possible causes of delay or non-completion.

Read the actual agreement and disclosure documents to find out which conditions apply to your project, how long they can remain in effect, what notices the developer must give, and what happens to your deposits if the project is cancelled. A general description of project risk cannot tell you the rights created by a particular contract.

Will your own mortgage be sufficient at completion?

Your mortgage depends on your circumstances and the lender’s assessment when financing is arranged. Those may change between signing and closing, as may interest rates and the condo’s appraised value. A pre-approval at the time you sign is not a guarantee of the mortgage you will receive at completion. It also does not guarantee that the developer has financing or that construction will proceed.

BCFSA warns that a buyer can have trouble obtaining financing if the unit’s appraised value has decreased by completion. If the lender bases its loan on a value below the contract price, the approved amount may be insufficient to cover the purchase. The buyer may need additional cash; the contract and local law determine the consequences if the buyer cannot complete.

What a construction delay can change

A delayed project can push back the date you can move in or the date title transfers. That may mean keeping your current housing longer, changing moving arrangements, and revisiting your plans for mortgage approval. The Canada Mortgage and Housing Corporation (CMHC) cautions that a new condo project can take longer than expected and advises buyers to assess the construction state before making moving and financing arrangements.

There is no broadly applicable delay frequency, average duration or typical financial cost established by the official sources discussed here. Rather than budgeting around a supposed average, look at the project’s stated dates, the agreement’s extension terms, and what you could afford if your existing housing costs continue longer than planned.

Ontario: firm and outside occupancy dates

Ontario’s Condominium Home Addendum includes a Statement of Critical Dates, including a firm occupancy date and an outside occupancy date. The Condominium Authority of Ontario (CAO) says delayed-occupancy coverage may be available if the builder misses the firm date. It also describes a possible option to terminate within 30 days if the outside occupancy date is missed. Whether coverage or termination is available in a particular case depends on the applicable rules and agreement; check the current addendum and Tarion requirements rather than assuming every purchase has identical terms.

Ontario protections also depend on when the purchase agreement was signed. Regulation 165/08 is consolidated through August 27, 2026. Regulation 293/26 sets out provisions for agreements entered into on or after January 1, 2027. Do not assume that a form, date rule or protection for one contract automatically applies to another signed on a different date.

Build a delay plan from the contract

Before relying on a projected move-in date, identify the agreement’s firm date, outside date, permitted extensions and notice requirements. Find out how the builder must communicate a change and what remedies, if any, are set out for a missed date. Then consider your own practical exposure: how long you could carry your present housing, whether work or school arrangements depend on moving, and when you should revisit mortgage discussions.

Treat those as separate planning tasks. A date change may affect housing and financing plans, but it does not by itself tell you whether you can cancel, receive compensation or recover a deposit. Those questions turn on your documents and applicable law.

Ontario interim occupancy: keys do not mean ownership

In Ontario, a buyer may be allowed to occupy a condo before the condominium corporation is registered and before title transfers. This interval is called interim occupancy. You do not yet own the unit during this period, and you cannot make mortgage payments on it, but you must pay an interim occupancy fee even if you do not move in.

The fee is not a mortgage payment. CAO describes its statutory components as interest on the unpaid purchase balance at the prescribed rate, estimated municipal taxes and projected common expenses. Interim occupancy can be extended, so its duration may not match a buyer’s original expectation.

Plan for the possibility that your current rent or other housing cost and the occupancy fee overlap. Confirm the anticipated occupancy period and fee terms in your documents, and do not assume that the first day you can access the unit is the date mortgage payments begin or title transfers.

Which documents to read before signing

Disclosure and purchase documents explain different parts of the transaction. In Ontario, CAO advises buyers to review the agreement of purchase and sale, Information for Buyers of Pre-Construction Condominium Homes, Condominium Home Addendum, Tarion warranty information sheet, disclosure statement and Ontario’s Residential Condominium Buyers’ Guide. A lawyer familiar with condo transactions can help explain their combined effect.

Ontario project status and cancellation conditions

HCRA says the Condominium Information Sheet describes development status and risks, while cancellation conditions must be listed in the Condominium Addendum. Look for the exact conditions, not just a broad summary. Examples include reaching a minimum sales threshold and the developer obtaining construction financing. Check the deadlines and notice language as well as what the documents say about deposits if a condition is not met.

Ontario buyers generally have a 10-day cooling-off period, as described by CAO. Confirm how the period applies to your agreement and what steps are required to exercise any cancellation right. Do not treat the existence of a cooling-off period as a substitute for reviewing other termination conditions or dates.

British Columbia disclosure and buyer-rights information

In British Columbia, BCFSA directs buyers to the disclosure statement and purchase agreement. Its guide says that, for covered filings from April 1, 2025, a Summary of Pre-sale Risks and Buyer Rights form is required at the beginning of the disclosure statement. Check the project’s actual disclosure statement, any amendments and the agreement for the dates and rights that apply to your purchase.

Questions to answer from the documents

  • What are the firm occupancy or closing date and the outside date, and what extensions are allowed?
  • What sales, financing, permit or other conditions could let the developer terminate, and when do those conditions expire?
  • How must the developer give notice of a delay or termination?
  • What happens to deposits and any interest if the project is cancelled?
  • Does the agreement provide delay compensation, and what conditions or deadlines apply?
  • Are there interim occupancy charges, assignment restrictions or cancellation rights that affect your plans?
  • What does the agreement say if you cannot complete the purchase?

These questions are a document-review checklist, not a universal checklist of rights. The answer must come from the contract and the law that governs it.

What if your financing no longer works at closing?

A lower appraisal can leave a shortfall between the contract price and the mortgage available. BCFSA says that a buyer may need to contribute more cash to close. If the buyer cannot complete, the purchase may be in default and the deposit may be at risk. BCFSA also notes that a developer may seek additional amounts, potentially including the difference between the contract price and a later resale price, legal costs or administrative fees. The actual exposure depends on the agreement and applicable law.

If you think you may not be able to close, BCFSA recommends seeking legal advice immediately. Do not assume that walking away, waiting for a lender decision or negotiating with the developer will have a particular result. Get advice about your documents and circumstances promptly, and speak with your mortgage professional about the size and timing of any possible financing gap.

How to compare two projects or purchase agreements

Do not reduce the decision to a single promise of an occupancy date or a headline price. Compare the documents on the same practical questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
What to compare What to identify
Occupancy and closing schedule Firm and outside dates, how they are defined, extensions and notice requirements.
Project conditions Sales, developer financing, permit or other conditions that could affect whether the project proceeds, including their deadlines.
Cancellation and deposits Who may terminate, how notice must be given, and what the documents say about deposit handling and any interest.
Delay provisions Any stated compensation and the conditions, limits or procedures attached to it.
Occupancy arrangements Whether interim occupancy applies, when it could begin, and what charges or overlapping housing costs to plan for.
Buyer flexibility Assignment and cancellation rights, and what the agreement says if you cannot close.
Your closing finances Whether you could manage the purchase if the eventual appraisal or mortgage amount is less favorable than expected.

Some of these answers may not be directly comparable because agreements and local rules differ. If a document does not clearly answer a question, ask a qualified local lawyer to explain the gap before you rely on an assumption.

A brief note for U.S. buyers

The U.S. mortgage-disclosure process is a different issue from the developer’s project financing and a condo contract’s delay rights. Under Regulation Z, for certain construction-to-permanent loans, a creditor may treat construction and permanent financing as one transaction with combined disclosures or as separate transactions with separate disclosures. The regulation also addresses revised disclosures when a new-construction settlement is expected to occur more than 60 days after initial disclosures, subject to conditions. That 60-day provision concerns disclosure timing in specified circumstances; it does not decide whether a buyer can terminate a delayed condo purchase or what happens to a deposit.
