Accessory dwelling units

What Chicago Homeowners Can Build Under Current ADU and Coach House Rules (2026)

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Chicago homeowners have two workable accessory-dwelling-unit paths under the current zoning text: a conversion unit inside an existing building or a new, detached coach house. A coach house is limited to one dwelling unit, may be built without its own accessory parking, and cannot be constructed before the principal building. Extra restrictions apply on designated RS lots, including owner-occupancy at pre-certification for a detached principal house, annual block-face caps, and an administrative adjustment for every conversion unit or coach house. The code also limits height and setbacks and prohibits transient rentals of qualifying coach houses.

The two ADU choices Chicago zoning recognizes

Conversion unit inside an existing building

A conversion unit is an additional dwelling created within an existing building. The project might use part of a house, an attic, a basement, or another interior area, but zoning permission does not by itself make the space safe or legal to occupy. The existing structure still has to support the proposed work under the applicable building, fire, accessibility, plumbing, electrical, and utility requirements.

The practical question is whether the building can be divided without structural work, fire-separation problems, inadequate exits, low ceiling or light conditions, inaccessible utilities, or an impractical service upgrade. A conversion can avoid the land, setback, and weatherproofing challenges of a detached structure, but it can be more disruptive to an occupied home because walls, stairs, mechanical systems, and life-safety components are altered inside the building.

Detached coach house

A coach house is a separate detached building on the same zoning lot as the principal residence. The zoning ordinance permits only one dwelling unit per coach house. Section 17-9-0201-F(9) states: “Only one dwelling unit is permitted per coach house.” A second apartment, internal subdivision, or additional independent unit would not fit that permission.

The coach house cannot be built first. The principal building must exist before the detached accessory dwelling is established. This matters for a vacant lot, a lot where the house is being demolished, or a phased project: the sequence is not simply a matter of convenience, and a permit strategy that reverses it can fail at the zoning stage.

When RS-area rules add another approval layer

New coach-house permits on RS-designated lots must comply with the Additional Dwelling Unit-Allowed RS Areas rules. The ordinance identifies ten designated areas by detailed boundaries. A street address that appears to be in an RS district is not enough; the parcel must be checked against the current designated-area boundaries and the City’s review requirements.

Owner occupancy at pre-certification

In a designated RS area, when the principal building is a detached house, that house must be owner-occupied at the time of pre-certification. Section 17-7-0573(2) uses that specific timing: “Where the principal building on the zoning lot adding a conversion unit or coach house is a detached house, the detached house must be owner-occupied at the time of pre-certification.”

This is not a general statement that every Chicago ADU requires the homeowner to live on site. It is a condition tied to the designated RS-area pathway and to a detached principal building. Confirm how the City will document ownership and occupancy before paying for plans or signing a construction contract.

Annual cap by block face and RS district

The same and opposite block face are counted together for an annual pre-certification limit. Under the current 2026 S-74 edition of Section 17-7-0573(1), the combined annual limits are:

A technically compliant design can therefore still be delayed or blocked if the applicable annual allowance has already been used. Ask the reviewing department how many qualifying pre-certifications remain for the relevant block face before committing to construction financing or ordering long-lead materials.

Administrative adjustment

Every conversion unit or coach house in the designated RS areas requires an administrative adjustment. The request is prepared under Section 17-7-0573(3), followed by the applicable building-permit process. Treat the adjustment as a separate zoning milestone, not as an informal exception that can be sorted out after construction drawings are complete.

Coach-house dimensional and placement rules

The following standards come from the current coach-house provisions. They describe zoning limits; other chapters of the municipal code can impose additional construction requirements.

Item Current rule Planning implication
Maximum height 22 feet The building and rooftop features must remain within the 22-foot overall height above grade.
Side separation At least 3 feet of unobstructed, unoccupied open space from the lowest level to the sky along at least one side property line, unless that line abuts an alley or street. Survey the lot and reserve a continuous clear side passage; fences, projections, storage, and site features can affect the usable clearance.
Rear separation Normally 15 feet between the principal building’s rear wall and the coach-house front wall. On a lot shorter than 125 feet front-to-rear, an administrative adjustment may reduce the separation to no less than 10 feet.
Unit count One dwelling unit per coach house. A design with multiple independent units does not qualify as a single coach house under Section 17-9-0201-F(9).
Parking for the coach house No accessory parking is required for the coach house itself. The structure may be possible without adding a dedicated parking stall for its resident.
Principal-building parking Parking serving the principal residential building may be reduced or waived through an administrative adjustment. Do not assume an existing or required stall can simply be removed; show the parking change in the adjustment request.
Lot area, open space, and floor-area ratio Coach houses are exempt from the listed minimum-lot-area, open-space, and floor-area-ratio provisions. The exemption does not authorize loss of open space required for the principal building and does not override other code chapters.

Height is measured as an overall limit

The 22-foot maximum applies to the coach house, and rooftop features may not exceed 22 feet overall height above grade. A roof deck enclosure, stair bulkhead, mechanical screen, or other rooftop element should be shown early in the elevations rather than treated as an afterthought. Small changes in roof form can determine whether the design fits.

Side and rear clearances shape the floor plan

The side rule requires a three-foot unobstructed, unoccupied open space from the lowest level to the sky along at least one side property line, unless that side abuts an alley or street. Measure from actual property lines, not from a fence that may be misplaced. The rear rule is normally 15 feet between the rear wall of the main building and the front wall of the coach house. If the lot is less than 125 feet deep, an administrative adjustment can reduce that gap, but never below 10 feet under the stated rule.

These dimensions should be tested on a current survey with the proposed foundation, eaves, stairs, decks, utility routes, refuse storage, and required access shown. A nominally open strip that is occupied by a structure or obstructed from ground to sky may not satisfy the zoning condition.

Parking, open space, and other code limits

A coach house can be established without accessory parking for itself. That does not automatically preserve every parking space associated with the principal home. If the project removes, narrows, or relocates parking serving the principal residential building, seek the administrative adjustment that can reduce or waive that requirement.

The coach-house provisions exempt the structure from listed minimum-lot-area, open-space, and floor-area-ratio provisions. The exemption is limited: it cannot reduce open space required for the principal building, and the project remains subject to other applicable code chapters. Building, fire, energy, accessibility, stormwater, utility, and public-way requirements can still control the design even when a zoning calculation is exempt.

Affordability and rental restrictions

Affordability obligation

The code requires coach houses to be maintained as affordable housing to the extent required by Section 2-44-106. The exact obligation depends on that section and the project’s circumstances, so include an affordability review in the early zoning and legal checklist rather than assuming a private rental is unrestricted.

Transient rentals are barred for qualifying newer coach houses

A coach-house dwelling lawfully established after May 1, 2021 may not be rented, leased, or otherwise offered for compensation for transient occupancy to people outside the unit owner’s or tenant’s household. That language rules out an Airbnb-style short stay to unrelated guests for a qualifying post-May 1, 2021 coach house.

Violations carry a stated fine of $1,500 to $3,000 per offense, and each continuing day is treated as a separate offense. A homeowner choosing a rental strategy should therefore distinguish a permitted household arrangement or longer-term use from transient occupancy before advertising, accepting deposits, or handing over keys.

Conversion unit or coach house: a practical comparison

Decision factor Conversion unit Detached coach house
Where the unit goes Inside an existing building. In a new detached building behind or beside the principal structure.
Primary feasibility test Can the existing structure accommodate safe separation, exits, utilities, fire protection, accessibility, and legal living conditions? Does the lot have enough rear depth, a compliant side clearance, a workable foundation location, and access for construction?
Unit count Determined by the approved conversion proposal and applicable code. Exactly one dwelling unit per coach house.
RS-area conditions In a designated RS area, an administrative adjustment is required; owner occupancy and block-face limits can apply when the principal building is a detached house. The same designated-area adjustment, owner-occupancy, and annual-cap questions apply.
Parking Evaluate how the added unit affects existing parking and access. No accessory parking is required for the coach house; principal-building parking may need an adjustment if reduced or waived.
Construction disruption Work occurs inside the home and can affect occupants, stairs, kitchens, bathrooms, and mechanical systems. Less interior disruption to the main house, but adds excavation, foundation, utility connections, weatherproofing, and site logistics.
Rental planning Review the applicable affordability and occupancy rules for the approved unit. Review Section 2-44-106 and the post-May 1, 2021 transient-rental prohibition before selecting a use.
Cost and schedule evidence Project-specific; zoning text does not establish a universal price or timeline. Project-specific; zoning text does not establish a universal price, permit fee, or timeline.

Approval sequence for a Chicago homeowner

  1. Confirm the parcel. Identify the zoning district, verify whether the lot lies inside an Additional Dwelling Unit-Allowed RS Area, and check the current boundary description for the parcel. Do not rely on a neighborhood label or an old listing.
  2. Choose the legal pathway. Decide whether the proposal is an interior conversion unit or a detached coach house. For a coach house, confirm that the principal building already exists or will be established first.
  3. Test the physical envelope. Use a current survey to draw the 22-foot height envelope, the three-foot side clearance, and the 15-foot rear separation. If the lot is shorter than 125 feet, test whether a reduction to 10 feet is necessary and supportable through an administrative adjustment.
  4. Check RS eligibility conditions. If the principal building is a detached house in a designated RS area, document owner occupancy at pre-certification. Ask about the remaining annual combined cap for the same and opposite block face: one unit in RS1, two in RS2, or three in RS3.
  5. Prepare the administrative-adjustment request. Address the required adjustment under Section 17-7-0573(3), including any parking reduction or waiver and any rear-separation relief. Coordinate the zoning drawings with the eventual building-permit set.
  6. Review affordability and use. Check the Section 2-44-106 affordability requirement. If the unit will be rented, confirm that the proposed term and occupants do not create prohibited transient occupancy, particularly for a coach house established after May 1, 2021.
  7. Submit the building-permit package. After the zoning path is confirmed, pursue the applicable City building-permit process with architectural, structural, mechanical, electrical, plumbing, fire, accessibility, and site information appropriate to the work.
  8. Reconfirm before construction. The online American Legal Publishing text identifies the 2026 S-74 code as current but cautions that the online version may not be the definitive official copy. Confirm the parcel’s zoning, RS-area status, current code text, and City review requirements immediately before funds are committed or work begins.

Design and construction checks that prevent late changes

  • Survey and title: Verify property lines, alley or street adjacency, recorded easements, and the location of the principal building before laying out the coach house.
  • Access: Plan construction access, permanent occupant access, emergency egress, refuse handling, and utility maintenance without blocking the required open side.
  • Vertical envelope: Include roof pitch, parapets, decks, stair enclosures, solar equipment, and mechanical screens in the 22-foot calculation.
  • Separation: Keep the side strip genuinely unobstructed from the lowest level to the sky. Show foundations, porches, stairs, fences, and site walls on the same plan.
  • Utilities: Determine whether water, sewer, electric, gas, heating, and communications can serve the added unit and whether capacity or separate metering is needed.
  • Life safety: Resolve fire separation, smoke and carbon-monoxide detection, exits, emergency access, and any accessibility obligations before design development is complete.
  • Occupied-home logistics: For a conversion, sequence demolition, dust control, temporary shutdowns, and inspections around the household’s ability to remain safely in the building.
  • Documentation: Keep the zoning determination, adjustment decision, survey, stamped plans, inspection records, and occupancy documentation together. They may be needed to explain the unit’s legal status to a future buyer, lender, insurer, or tenant.

Common ways an otherwise promising project fails

The lot is outside the designated RS area

RS zoning alone does not answer whether the special ADU pathway applies. A parcel can be in an RS district but outside one of the ten designated areas, or the boundary can be misunderstood. Verify the exact lot and current boundary before using the RS-area assumptions.

The annual cap has already been reached

The block-face cap is a real capacity limit, not a design preference. Check availability early and ask how the City counts the same and opposite block face for the relevant year.

A parking exemption is assumed rather than approved

No parking is required for the coach house itself, but that does not automatically waive parking serving the principal home. Draw existing and proposed parking and request the necessary adjustment.

A short-term rental plan is built into the business case

For a coach house lawfully established after May 1, 2021, transient compensation to people outside the owner’s or tenant’s household is prohibited and continuing violations can be fined daily. Select a lawful occupancy model before design and financing decisions.

What the zoning rules do not tell you about cost

The zoning provisions establish location, dimensional, parking, occupancy, and approval constraints; they do not provide a project-specific construction estimate or a universal permit-fee schedule. A conversion may require less exterior work but substantial structural and mechanical upgrades. A coach house may require a new foundation, utility trenching, drainage work, weatherproofing, and a separate construction phase even when the floor area is modest.

Obtain a measured survey, preliminary code review, schematic drawings, and trade input before treating any budget as reliable. Price the administrative-adjustment work, design revisions, utility upgrades, inspections, temporary protection, and site restoration as well as the visible building shell. The right comparison is the total compliant project, not the cheapest square-foot concept.

A decision framework for the next meeting

Bring these questions to a Chicago architect, design-builder, zoning attorney, or permit specialist:

  1. What is the parcel’s exact zoning district, and is it inside a designated Additional Dwelling Unit-Allowed RS Area?
  2. Is the principal building detached, and if so, can owner occupancy at pre-certification be documented?
  3. What is the current RS1, RS2, or RS3 block-face allowance, and has the annual cap been used?
  4. Can an interior conversion meet structural, fire, accessibility, utility, and egress requirements without unacceptable disruption?
  5. Can a detached structure meet the 22-foot height limit, three-foot side clearance, and required rear separation?
  6. Will the project reduce principal-building parking or required open space, and what adjustment is needed?
  7. How will Section 2-44-106 affordability requirements affect ownership, leasing, or financing?
  8. Is the intended occupancy lawful, particularly if anyone proposes short stays or an Airbnb-style rental?
  9. Which City review requirements and code edition should govern the permit set at the time of filing?

Chicago’s current rules make both an interior ADU conversion and a detached coach house possible in the right circumstances, but neither is an automatic backyard entitlement. Parcel status, RS-area limits, owner occupancy, annual capacity, dimensional details, administrative adjustments, affordability duties, and rental restrictions must all be resolved before construction begins.
