What approvals are required to build a resort on forest or eco-sensitive land in India?

There is no single all-India “resort permit” for forest or eco-sensitive land. Whether a project can proceed depends first on the parcel’s legal forest status, its distance from a protected area, the exact Eco-sensitive Zone (ESZ) notification, the project’s built-up area and wider development scope, and whether coastal regulation applies. Separate forest, environmental, wildlife, coastal, state and local approvals may all be required.

The safest approach is to establish the site’s legal status and map its constraints before buying land, finalising a design or relying on planning permission. One approval never substitutes for another.

Why the site must be classified before any application

“Forest land” and “eco-sensitive land” are not precise legal categories by themselves. A parcel may be recorded as forest, treated as forest under applicable law, located inside a protected area, within a notified ESZ, covered only by a draft ESZ proposal, or outside an ESZ but close enough to trigger wildlife or environmental controls. A coastal location can add a separate regulatory track.

Start with cadastral coordinates, revenue records and the forest department’s classification. Identify the state, district, local planning authority and development-plan jurisdiction. Then establish whether the site lies:

  • on land requiring approval for forest diversion or non-forest use;
  • inside a national park, sanctuary or other protected area;
  • inside a notified ESZ, and if so, under which Gazette notification and map;
  • within a draft or otherwise unnotified ESZ;
  • in a wildlife corridor, wetland or another specially regulated landscape; or
  • within the Coastal Regulation Zone (CRZ) and an approved Coastal Zone Management Plan.

These answers determine which authority can consider the proposal and whether a resort is prohibited, regulated, or potentially permissible at all.

The approval tracks are separate

Use the following as a screening framework, not as a substitute for a parcel-specific legal opinion.

Regulatory track When it is triggered What must be checked Typical government pathway
Forest diversion The land is legally forest land and the proposal involves non-forest use or diversion. Forest classification, area, proposed use, maps, and conditions under the current forest-conservation law and rules. Proposal through the government forest-clearance workflow; central approval may be required under the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980 and the Van (Sanrakshan Evam Samvardhan) Rules, 2023.
Environmental clearance (EC) The resort or a linked township/area-development project falls within a category listed in the amended EIA Notification, 2006. Actual built-up area, total development scope, phases, utilities and the applicable appraisal category. Application and appraisal by the competent state or central authority identified under the operative EIA schedule.
ESZ and wildlife The site is in or near a protected area, a notified or draft ESZ, or a project is covered by wildlife-related directions. Exact ESZ notification, activity table, boundary map, zonal and tourism master plans, corridors and court or ministry orders. ESZ compliance and, where applicable, National Board for Wildlife (NBWL) or Standing Committee consideration.
CRZ The parcel is coastal or otherwise falls within the current CRZ framework. CRZ classification and the approved Coastal Zone Management Plan. Separate CRZ screening and clearance through the PARIVESH system where required.
State and local permissions Requirements imposed by the state, district, planning authority, utility agencies and pollution-control authority. Land conversion, zoning, building design, water source, wastewater, waste, access, trees, tourism registration and construction conditions. Applications to the responsible state and local bodies; the list changes with location, capacity and design.

Forest land: diversion approval is a separate gate

Construction of a resort on land legally treated as forest is ordinarily a non-forest-use question. The applicable framework is the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980, together with the Van (Sanrakshan Evam Samvardhan) Rules, 2023. The Ministry of Environment, Forest and Climate Change (MoEFCC) describes those rules as prescribing the procedure for central approval of proposals involving forest-land diversion or non-forest use.

The user agency submits the proposal through the government forest-clearance workflow. The processing route depends on matters such as the area, completeness of the submission and the rules that apply to the parcel. Forest departments and the central ministry examine the proposal on its own facts; there is no automatic entitlement to build a hospitality project merely because the applicant owns or leases the land.

Documents and decisions to settle early

  • Obtain the latest revenue and cadastral records and the forest department’s written position on classification.
  • Prepare an accurate location map, boundary coordinates, area statement and site photographs.
  • Describe every proposed use, including rooms, villas, roads, parking, staff housing, utilities, water infrastructure and construction areas.
  • Identify trees, habitat, access routes and any compensatory or mitigation conditions that an approval may impose.

Do not treat a municipal building sanction, tourism registration or land-use conversion as permission to use forest land. Those approvals cannot cure the absence of forest diversion approval.

Environmental clearance under the EIA Notification, 2006

The EIA Notification, 2006, as amended, requires prior environmental clearance for projects within its listed categories. A resort’s marketing label does not decide applicability. Screen the physical proposal: total built-up area, site area, supporting infrastructure, construction phases and whether the resort is part of a wider township or area-development project.

The operative notification and amendments must be checked at the time of filing. The competent appraisal authority depends on the project category and the state or central allocation. Because no built-up area, phasing plan or masterplan information is available from the title alone, it is not responsible to quote a threshold or say that every small resort either needs or avoids EC.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How to scope the project correctly

  1. Draw the complete development envelope, not just the first building package.
  2. Add roads, parking, sewage treatment, water storage, power systems, staff facilities and common amenities.
  3. Check whether legally or functionally linked parcels form one township or area-development proposal.
  4. Compare the resulting scope with the latest EIA schedule and amendments.
  5. Confirm whether appraisal is by the state authority or a central authority before preparing the application.

“Prior” matters: construction or site development should not begin on the assumption that EC can be obtained retrospectively.

ESZ rules depend on the protected area’s own notification

MoEFCC’s explanation dated 8 February 2024 states that a notified ESZ is governed by its particular notification. Each notification can define a different boundary, prohibited activities, regulated activities, permitted activities and planning requirements. Read the Gazette notification and map for the named protected area, not a generic ESZ summary.

Notified, draft and unnotified areas

The same MoEFCC/PIB explanation says that, where an ESZ is not notified or remains at draft stage, covered projects within the default zone up to 10 km from the boundaries of national parks and sanctuaries require prior environmental clearance under the applicable EIA provisions and NBWL/Standing Committee consideration. This is an explanation of the ministry’s 17 May 2022 office memorandum; later orders and the site’s own legal circumstances must also be checked.

A notified ESZ does not create a universal national setback for resorts. For example, the Ballavpur notification does not allow new hotels and resorts within 1 km of the protected-area boundary or to the nearer ESZ limit. Farther inside that ESZ, new resorts are limited to pre-defined and designated eco-tourism areas under the Tourism Master Plan. The Mookambika notification contains a similar site-specific approach and addresses the period before its zonal master plan is approved. These examples apply only to those named protected areas.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Questions to answer from the exact notification

  • Where is the protected-area boundary and where is the mapped ESZ boundary?
  • Is the proposed resort listed as prohibited, regulated or permitted?
  • Are there distance restrictions, designated tourism sites or limits on expansion?
  • Has the zonal or tourism master plan been approved, and does it identify the parcel?
  • Are wildlife corridors, seasonal restrictions, road access or court orders relevant?

Wildlife and NBWL consideration

Wildlife review is not folded automatically into forest diversion or building approval. Depending on the protected-area relationship, ESZ status and applicable orders, the proposal may require consideration by the National Board for Wildlife or its Standing Committee. The need is particularly important to test in a draft or unnotified ESZ and where the project could affect habitat connectivity, watercourses or a corridor.

Map the site against the protected-area boundary and any officially identified corridor before choosing a layout. A “buffer” shown on a private drawing is not a legal substitute for the notified boundary or government map.

CRZ screening for coastal resorts

A coastal parcel may need a separate CRZ review even when forest and ESZ issues are absent. PARIVESH provides a distinct CRZ clearance category. Before design or construction, compare the site with the current CRZ framework and the approved Coastal Zone Management Plan.

No coastal location is specified in the title, so CRZ applicability cannot be decided in the abstract. Obtain the survey coordinates and the applicable coastal map first. Do not assume that a resort outside a protected area is outside coastal regulation.

State and local approvals after the national screening

Once the parcel and project are fixed, build a state-and-local approvals register. Depending on the state, district, capacity and utility plan, it may include:

  • conversion of agricultural or other land to a permitted non-agricultural use;
  • conformity with the master plan, zoning or development plan;
  • layout approval, access permission and building-plan sanction;
  • permission for groundwater, surface-water intake or another proposed source;
  • pollution-control consents for construction and operation, including wastewater and air or noise controls where applicable;
  • solid-waste, sewage-treatment and storm-water compliance;
  • tourism registration or classification;
  • tree-felling or tree-transplantation permission; and
  • fire, electrical, road, public-health and other local permissions triggered by the design.

The exact list cannot be settled nationally without the state, local authority, parcel, room capacity, water balance, discharge plan and construction method. Ask each competent authority for its current checklist rather than relying on an old consultant’s template.

A practical approval sequence

  1. Fix the site. Obtain cadastral coordinates, title and revenue records, the forest classification, the state and district, and the responsible planning authority.
  2. Map sensitive designations. Overlay the parcel on protected-area, ESZ and draft-ESZ maps, wildlife-corridor information, wetlands and, if coastal, the approved Coastal Zone Management Plan.
  3. Read the controlling ESZ notification. Record every resort and tourism restriction, the boundary distances, permitted areas and the status of the zonal or tourism master plan.
  4. Define the whole project. Calculate built-up area and include roads, utilities, staff facilities, phases and linked parcels. Screen the complete scope against the latest EIA schedule and amendments.
  5. Resolve forest status. If forest land is involved, obtain the forest department’s determination and prepare the applicable diversion proposal through the forest-clearance process before treating the parcel as developable.
  6. Test wildlife and coastal pathways. Determine independently whether NBWL or Standing Committee consideration, CRZ clearance or another environmental permission applies.
  7. Compile state and local applications. Confirm land conversion, zoning, building, water, pollution, waste, tourism, tree and life-safety requirements for that location.
  8. Sequence construction lawfully. Review every approval’s conditions, validity and pre-construction requirements. Do not start earthwork or construction because one application has been accepted or one licence has been issued.

How to compare potential sites

If several parcels are under consideration, compare them before commissioning detailed architecture. A site that appears cheaper may be unworkable if it requires forest diversion, falls under a restrictive ESZ notification or lacks a lawful water source.

Comparison question Favourable evidence Warning sign
Forest status Clear records and written confirmation that the intended use is not forest diversion. Conflicting records, forest classification or an untested claim that private ownership removes forest controls.
Protected-area and ESZ relationship Outside prohibited areas and identified in the applicable tourism or zonal plan. Inside a restricted distance, draft ESZ or an area with no approved plan.
Project scale A defined, modest scope that can be classified under the current EIA rules. Phased buildings or linked parcels that could be treated as a larger township or area-development project.
Coastal and habitat constraints Verified CRZ status, access and no mapped corridor conflict. Unresolved coastal classification, wetland interface or corridor dependence.
Local infrastructure Lawful access, reliable water and a workable wastewater and waste solution. Dependence on unapproved groundwater, new roads through habitat or discharge without a receiving solution.

Common mistakes that delay or stop projects

Buying first and checking classification later

Ownership does not answer whether the land is forest, protected, coastal or ESZ-regulated. Make written classification and mapping conditions precedent to acquisition or design expenditure.

Using a generic “10-km rule”

The 10 km figure in the ministry’s explanation concerns a default zone for certain projects where an ESZ is not notified or is in draft stage. It is not a universal permission distance, nor does it replace the named protected area’s notification.

Assuming planning permission overrides environmental law

Building sanction, land conversion and tourism registration operate on different legal tracks. None is a substitute for forest diversion, EC, wildlife or CRZ clearance.

Splitting a connected development into packages

Submitting villas, roads, utilities and later amenities as unrelated packages can obscure the project’s actual scope. Appraisal authorities may need the full township or area-development context.

Starting enabling works early

Clearing vegetation, grading, laying access roads or installing utilities can itself create compliance exposure. Confirm which pre-construction activities are allowed under each approval and its conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Process timing and professional review

Official process descriptions should not be read as guaranteed delivery dates. A PIB page on pending clearances refers to a 105-day period for conveying an EC decision after receipt of a complete application, and describes forest-rule timelines for in-principle consideration. Completeness, queries, site inspections, authority workload, court directions and compliance conditions can change the practical timetable.

For a live parcel, an environmental or land-use consultant and qualified local counsel can help reconcile cadastral records, forest status, ESZ maps, the EIA category and state checklists. Their role should be parcel-specific: no consultant can replace a decision by the competent authority, and a generic “eco-resort approval package” is not a legal category.

What a defensible go/no-go file contains

  • Survey coordinates, title and revenue records;
  • Written forest-status confirmation and all relevant maps;
  • Protected-area, ESZ, draft-notification, corridor and coastal overlays;
  • The complete concept plan, built-up calculation, phasing and utility designs;
  • A copy of the exact ESZ notification and the status of its zonal or tourism master plan;
  • An EIA screening note identifying the competent appraisal authority;
  • A forest-diversion and wildlife decision memo where applicable;
  • A state and local approvals matrix with responsible offices and dependencies; and
  • A conditions register showing which approvals must precede site work, construction and operation.

If those documents do not establish a lawful land status, a permitted use under the exact ESZ rules and a complete environmental pathway, the resort is not ready for construction.
