The Town of Victoria Park considered whether residents could place privately owned children’s play equipment on street verges, but it did not approve a permission scheme in the decisions documented through March 2025. Council deferred the options for further discussion in February 2025, and the Town’s March action register still listed the matter as work in progress. The available sources do not establish a later outcome.
Which Perth council was considering verge play equipment?
The proposal concerned the Town of Victoria Park, not the City of Perth. In November 2024, Victoria Park councillors asked the Town’s CEO to develop options for allowing privately owned play equipment on verges. PerthNow reported councillor Claire Anderson saying the idea could support community engagement and accessible places for families to connect near home. PerthNow’s report covered the motion and her comments.
The distinction matters for residents: each local government sets and administers its own verge rules. The City of Perth’s separate verge guidance says play structures or equipment are not permissible on verges there, and approval is required for developments outside its listed permissible categories. That City of Perth guidance does not establish the Town of Victoria Park’s rules.
What did Victoria Park decide?
At its 18 February 2025 meeting, Council deferred the requested options for further discussion at a February Concept Forum. The Town’s March 2025 action register continued to mark the resolution as work in progress. Those records show a proposal under consideration—not a final approval or a rejection. The sources available do not confirm what the Town decided after the March register entry.

The request asked the CEO to develop short-, medium- and long-term possibilities, including temporary permits or verge-use agreements, a temporary pause on enforcement against existing equipment while options were examined, a trial, a policy, and amendments to relevant local laws. These were matters for consideration, not measures Council had adopted. The meeting report records the deferral and requested work; the March action register records its status at that time.
Why would a permit or trial need careful rules?
The Town’s discussion paper said the proposal aligned with community priorities but involved legal, operational and practical questions. The Town reported considering internal service feedback, discussions with LGIS, written legal advice and examples from other Western Australian councils. It also stated that the options had been developed without community consultation at that stage. The paper identifies several issues any policy, permit or pilot would need to address. - Liability and insurance: The paper says responsibility would depend on the circumstances of an incident. It also notes that approval could create an inspection responsibility and that private insurance costs might deter residents. These are considerations reported by the Town, not a general legal determination.
- Access and street conditions: Equipment must be considered alongside pedestrian passage, traffic safety, street-tree access and maintenance, and placement that could create hazards.
- Administration and enforcement: Applications, site investigations, inspections, compliance and permit management would require staff time; the Town said resourcing would depend partly on application volumes.
- Existing local law: The paper says the Town’s current local-law framework did not straightforwardly permit the proposed activity. Depending on the option chosen, legal or policy changes might be needed.
Do other Perth-area councils allow play equipment on verges?
There is no single Perth-wide rule. The Town’s 2025 discussion paper compared different local approaches; those examples describe the comparison at that time and should not be treated as current permission in another council area.
- City of Bayswater: The paper describes its 2020 local law as allowing verge play equipment by permit. Its guideline excludes examples such as tree houses, cubby houses, equipment fixed to street trees and trampolines.
- Town of Cottesloe: The paper describes permits as generally required for play equipment, with exemptions for some tree attachments and basketball hoops.
- City of Stirling: Its petition-status page says an application was still required after the City reconsidered its position in October 2024. It says suitable amendments might be considered in a 2025 local-law review; it does not establish that those amendments were enacted. See Stirling’s petition-status page.
- Town of Bassendean: A public notice proposed adding an option to consider verge play equipment under permit and set 23 January 2026 as the deadline for submissions. The notice is evidence of a proposal, not proof that it became law. See Bassendean’s public notice.
Permit details can differ on eligible equipment, placement and access, maintenance and inspection, insurance or indemnity, council removal powers and application administration. Check the relevant council’s current rules rather than relying on another council’s example.

Can you put a trampoline, cubby house or basketball hoop on your verge?
Do not assume that an item allowed in one suburb is allowed in another. The Town of Victoria Park’s documented 2025 process did not itself grant permission to residents, and the Town’s later outcome is not established by the available records. Before placing any privately owned equipment on a verge, contact your local government and ask whether approval is required for that specific item and location. Mention whether it is fixed or movable, how it would be secured, and whether it could affect pedestrians, traffic or street trees; the council can tell you which rules apply.
