When will the BC Construction Prompt Payment Act come into force?
The Act has been enacted but is not yet in force. Bill 20, the Construction Prompt Payment Act, received Royal Assent on November 27, 2025, and the current consolidation identifies it as SBC 2025, Chapter 24. The operative sections are marked “Not in force” and provide for commencement by regulation.
The Province of British Columbia says the legislation will generally establish 28-day payment timelines and a fast-track adjudication process. It also says the Act will be brought into force after a transition period while regulations, education, consultation and an adjudication authority are prepared. Until a commencement regulation is made, parties should not assume the statutory deadlines apply to a current invoice.
What the enacted text would do
Once commenced, eligible payment, invoice and valuation disputes may be referred to interim adjudication. The enacted mechanics generally require a determination within 30 days after the adjudicator receives the records. An amount ordered would be payable within 15 days after the determination, and non-payment can support suspension rights. Regulations and the eventual adjudication process may supply important operational detail, so contracts and procedures should be checked against the rules in force when a project is administered.
Which legal issues are on the agenda?
The published program has seven connected strands. Each affects a different point in a project’s payment, performance or dispute cycle.

Prompt payment, adjudication and lien-law amendments
The presenters will address payment obligations, the proposed adjudication route and amendments to the Builders’ Lien Act. Organizations should identify who receives payment applications, how valuations are recorded and who has authority to respond within a short statutory window once the regime starts.
Builders’ lien updates
The session covers discharging liens, damages for a wrongfully filed lien and prosecuting lien claims. A lien strategy should preserve filing and holdback records, verify the amount claimed and escalate defective or overstated claims promptly; an improper filing can create financing, title and delay consequences beyond the claim’s dollar value.
Builders-risk insurance and “damage”
The insurance segment examines what counts as “damage” under builders-risk policies. Coverage disputes often turn on the policy wording, the physical condition alleged to be damaged, causation and exclusions. Project teams should preserve photographs, site reports, schedules and notices from the first incident rather than relying on a later reconstruction.
Recovery after termination
Contract interpretation after termination is another topic. Recovery can depend on the termination clause, the party entitled to terminate, notice compliance, accepted work, mitigation and proof of resulting loss. A termination file should keep the contract version, notices, contemporaneous directions, payment history and replacement-cost evidence together.

Delay claims in adjudication
The webinar will consider how delay issues operate in prompt-payment adjudication. Because adjudication is interim and document-driven, parties should maintain current schedules, critical-path analyses, daily reports, change records and contemporaneous explanations of concurrency or owner-caused delay.
Pure economic loss in negligence claims
The presenters will discuss the scope of recoverable pure economic loss in construction negligence claims. Physical damage, contractual allocation of risk, proximity and the nature of the alleged loss can affect whether a negligence claim is viable; the analysis is fact-specific and should not be assumed from the existence of a project defect alone.

CCDC document updates
The agenda names CCDC 5A, CCDC 5B, CCDC 17, CCDC 30 and CCDC 32. Users should confirm the edition authorized for their project and review supplementary conditions, insurance language, payment procedures, notice clauses and dispute provisions before issuing a form for signature.
How should BC project teams prepare before the Act starts?
- Map the payment chain. List owners, prime contractors, subcontractors, consultants and payment-certification roles, including backup contacts.
- Standardize records. Keep dated invoices, valuation worksheets, notices, schedules, site reports and change documentation in a searchable project file.
- Review contract language. Identify clauses that may conflict with future statutory payment, notice, adjudication or suspension requirements.
- Train administrators. Make sure staff can recognize a payment application, dispute notice, lien notice and adjudication referral and know the escalation deadline.
- Audit lien controls. Track holdbacks, lien deadlines, releases, title searches and procedures for responding to an alleged wrongful lien.
- Refresh insurance protocols. Set an incident-notification path and preserve physical evidence before repair or demolition changes the condition.
- Protect delay evidence. Update the baseline schedule, record critical-path effects and separate concurrent causes rather than waiting for a claim.
- Verify CCDC editions. Obtain current authorized forms and compare supplemental conditions before procurement or contract renewal.
How does this webinar compare with other 2026 construction-law programs?
Jurisdiction and format matter. The following programs are not substitutes for a BC prompt-payment briefing.

Who should register?
Registration is most useful for anyone who will administer or respond to payment claims on a BC project: owners, developers, prime contractors, subcontractors, construction managers, architects, engineers, insurers, lenders and legal advisers. Submit a specific question about a payment workflow, lien problem, delay record or CCDC clause so the presenters can address a live implementation concern.

Is the BC Construction Prompt Payment Act already legally binding?
Royal Assent made the statute law, but its operative provisions are marked not in force. The province must complete regulations, consultation, education and establishment of an adjudication authority before commencement.
What should a subcontractor collect for a future adjudication?
Keep the contract and amendments, payment application, invoices, valuation backup, change orders, schedule updates, site diaries, correspondence and proof of delivery in date order. A concise chronology linking each amount to a document will make a short adjudication record easier to prepare.
Can a lien be removed before the underlying dispute is decided?
BC lien-discharge procedures can address title and financing pressure while the merits remain disputed, but the available route depends on the filing, security and court circumstances. Obtain project-specific legal advice before signing a release or consenting to payment terms.
Do CCDC 5A and CCDC 5B serve the same delivery model?
No. They are different CCDC contract families, so the appropriate form depends on the project’s procurement and construction-management structure. Confirm the authorized edition and read its supplementary conditions rather than selecting by form number alone.
