Two Firefighters Suffered Chemical Burns During a Boring Company Tunnel Drill. Here’s What Happened

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Two Clark County firefighters suffered chemical burns during rescue-training exercises inside a Boring Company tunnel in Las Vegas on December 9 and 10, 2024. Nevada OSHA later issued three willful citations proposing $425,595 in penalties, but withdrew them on May 29, 2025. A federal OSHA review published in February 2026 agreed that the citations did not meet the legal standard for a willful violation. That decision addressed the citations—not whether the burns occurred or whether the tunnel hazard was adequately managed.

What happened inside the tunnel?

The firefighters were conducting a simulated emergency-rescue exercise involving the recovery of a mock injured worker. During the drill, they encountered wet muck or slurry on the tunnel floor and elsewhere in the work area. The material reportedly entered or filled the boots of two firefighters, causing chemical burns to their legs. Both were taken to a hospital for treatment.

Some published accounts have said the firefighters were left with scars. That claim should be attributed to the reporting; the publicly available material does not independently establish their long-term medical outcomes.

The exercise took place at a Boring Company construction site connected to the Las Vegas “Vegas Loop” project. It was a construction and training environment, not evidence by itself that the completed passenger system is unsafe.

What chemical caused the burns?

The available records do not establish a single, publicly confirmed chemical compound. They describe an accelerant or chemical additive associated with tunneling and concrete-hardening work. When such material mixed with groundwater and dirt, it formed a chemical-laden slurry or “muck” that firefighters encountered during the drill.

That distinction matters. Calling the substance simply “concrete accelerant” can make it sound like a formal product or chemical name, when the public record reviewed here does not identify a definitive formula or product-specific safety-data-sheet entry.

Nevada OSHA complaint materials also referred to employee concerns involving accelerants, chemical burns and rashes. The records included an allegation of a November 2024 employee injury involving accelerant and secondary chemical burns. Those allegations provide context, but they should not be treated as a verified total of all injuries at the company.

The dispute over warnings and protective equipment

The central safety dispute is not simply whether the firefighters wore protective equipment. It is whether the hazard was properly identified and communicated, whether the required equipment was worn, and whether that equipment was suitable for prolonged contact with wet chemical slurry.

According to Nevada OSHA’s investigative material, the Clark County Fire Department training plan called for three layers of protective clothing. One layer was described as a chemical barrier. Six firefighters reportedly did not wear the second layer, including the two who were burned.

The records also refer to structural firefighting turnout gear, chemical bib overalls or other chemical-resistant protection, and transportation intended to reduce the time firefighters spent walking through the tunnel. Standard turnout gear should not automatically be assumed to be chemical-resistant. Nevada’s legal memorandum reportedly noted that the turnout gear lacked a moisture barrier and could trap slurry against the skin.

The record contains competing accounts:

  • Investigative concerns: Some OSHA material indicated that firefighters were not adequately informed about hazards such as slurry falling from the ceiling or chemicals in the muck they would crawl through.
  • The company’s position: The Boring Company said it held safety meetings and provided hazard-communication training.
  • Company criticism of the drill: The company argued that Clark County Fire Department personnel failed to follow the training plan, including by not using provided transportation, and did not leave immediately for remediation after the exposure.
  • Unresolved equipment question: Even where a protective layer was specified, the public record does not conclusively resolve whether the equipment supplied or worn was appropriate for this particular slurry.

Thus, it would be inaccurate to say either that the company definitively failed to warn the firefighters or that the firefighters alone caused the incident by ignoring instructions. The available evidence supports a dispute over both hazard communication and compliance with the training plan.

Nevada OSHA proposed $425,595 in penalties

Nevada OSHA investigated the incident and issued three citations in May 2025. The citations were classified as willful and proposed penalties totaling $425,595.

“Willful” is a technical OSHA classification. It generally requires more than proof that an unsafe condition existed; the agency must establish the legal elements supporting a deliberate or plainly indifferent violation. It is not merely a synonym for “serious,” “dangerous” or “intentional injury.”

The proposed amount was not a final fine paid by The Boring Company. Nevada OSHA withdrew the citations on May 29, 2025, and told the company at a second closing conference on June 6 that citations would not be reissued.

Why were the citations withdrawn?

Nevada officials said the withdrawal followed a legal review that occurred after the citations had been issued. The review identified problems with several required elements, including:

  • whether the cited standard applied to the circumstances;
  • whether the standard had been violated;
  • whether employees were exposed to the cited hazard;
  • whether The Boring Company had the necessary employer knowledge; and
  • penalty calculations and other inspection-paperwork deficiencies.

Nevada’s stated position was that the citations were legally insufficient and should not be reissued. That is different from finding that no one was injured, that no chemical hazard existed, or that the worksite’s safety practices were adequate.

The state’s explanation is set out in its November 2025 statement and its legal memorandum.

Why did the withdrawal raise political-interference questions?

The timing and handling of the withdrawal prompted allegations of political influence.

Date Documented event
May 28, 2025 A Boring Company representative contacted Nevada Department of Business and Industry Director Kristopher Sanchez about the citation and proposed penalty.
May 29, 2025 Nevada OSHA withdrew the citations. State officials also held internal meetings and met with company representatives that day.
June 6, 2025 The company was informed that citations would not be reissued.
November 19, 2025 Nevada publicly defended the withdrawal and acknowledged deficiencies in the case-file documentation.
February 12, 2026 Nevada published the outcome of federal OSHA’s independent review.

A case-file diary referenced a meeting involving Nevada OSHA, the governor’s office and Boring Company representatives. A version of the file obtained through public-records processes initially did not contain that entry. Nevada later acknowledged documentation problems; a forensic review reportedly could not determine who changed the document or when.

Critics and former OSHA officials questioned the unusual contact and timing. Nevada officials denied that the governor’s office or political actors directed the withdrawal. The strongest supported conclusion is that high-level contact occurred around the time the citations disappeared, creating legitimate transparency concerns, but improper political direction has not been substantiated by the state or the federal review.

What federal OSHA concluded in 2026

Federal OSHA conducted an independent review under Nevada’s state-plan oversight process. In findings published by Nevada’s Department of Business and Industry on February 12, 2026, federal OSHA concluded that Nevada OSHA had reasonable justification for withdrawing the citations and that the citations did not satisfy the legal criteria for a willful violation.

The review also found that Nevada OSHA’s case-file handling and documentation needed improvement. Nevada said it subsequently implemented policies concerning legal review, documentation of critical decisions and modification of case files when citations are withdrawn.

What remains unresolved?

Several important questions remain open in the public record:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What exact product or chemical compound was present in the slurry?
  • Were firefighters clearly told about the accelerant hazard and the possibility of slurry exposure?
  • Was the required protective equipment worn by every participant?
  • Was the equipment appropriate for wet chemical contact, rather than ordinary structural-fire conditions?
  • What were the firefighters’ long-term medical outcomes?
  • What procedural changes did The Boring Company make afterward?
  • How many company employees experienced burns, rashes or other exposure injuries, and how fully were those incidents reported?

The public record supports the occurrence of the firefighter injuries and the subsequent regulatory dispute. It does not support a precise chemical identification, a definitive finding of personal involvement by Elon Musk, or a conclusion that the Vegas Loop is unsafe for passengers.

Broader scrutiny of the Vegas Loop

The firefighter incident became part of wider scrutiny of safety, chemical handling, environmental compliance, wastewater and regulatory oversight at Boring Company tunnel sites. Later reporting also described a separate employee crushing injury in September 2025. That incident was not the same event as the December 2024 firefighter burns and should not be combined with it.

The broader lesson is procedural as well as physical: a construction-site injury, an OSHA citation and a final legal finding answer different questions. Here, the burns and hospital treatment are one question; whether Nevada OSHA could prove a willful violation under the law is another.
