Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →Short answer: a social value plan is usually the delivery and accountability document: it sets desired economic, social and environmental outcomes, actions, targets, evidence and review arrangements. A community benefit agreement (CBA) is an agreement in which identified parties negotiate and record benefits and obligations for an affected community. The labels are not universal legal categories. A plan can become contractually binding when incorporated into a contract or planning instrument, while a CBA has the legal force given by the jurisdiction and the signed agreement.
For a construction or development project, do not decide what a document does from its title. Read the procurement conditions, planning approval, statute, contract schedules, signatories, performance measures and remedies. Those operative documents determine what must be delivered, by whom, when and with what consequence for non-performance.

The practical distinction at a glance
| Question | Social value plan | Community benefit agreement |
|---|---|---|
| Primary purpose | Organises intended outcomes, delivery actions, targets, measurement, evidence and review. | Records negotiated benefits and commitments between specified parties. |
| Typical origin | Prepared by a supplier, developer, client, property team or other organisation; an authority may review or approve it. | Negotiated by the parties identified by the applicable legal or policy framework. |
| Legal status | The label alone does not decide enforceability. It may be an internal management document or an incorporated contract deliverable. | Depends on the jurisdiction and agreement. Queensland’s statutory planning model expressly makes its CBA legally binding. |
| Community input | Should reflect local needs and explain how priorities were selected and will be reviewed. | Benefits are negotiated for the affected community; Queensland requires them to be informed by a preceding social impact assessment. |
| Measurement | Usually contains indicators, baselines, reporting frequency, evidence and review points. | Should specify each commitment, milestone, monitoring arrangement and any remedy for breach. |
| Best document to check | The contract, procurement documents or planning instrument that incorporates the plan. | The signed agreement, enabling law or policy, and any linked planning approval. |
In other words, a plan is normally the how and how well of delivering value; an agreement is the who promises what to whom. The distinction is a useful starting point, not a substitute for reading the governing documents.

A social value plan translates broad commitments into a workable delivery system. Better Buildings Partnership guidance describes a practical cycle: select outcomes that fit the local context, set objectives, decide how progress will be measured, gather evidence and review the plan as community priorities change. The same logic works for a construction project, although the required format may be set by a client or contracting authority.

Typical contents
- Scope and baseline: the project, contract period, locations and existing conditions against which change will be assessed.
- Outcome priorities: for example, local employment, apprenticeships, supply-chain opportunities, skills, environmental improvements or community facilities.
- Actions and ownership: the activity, responsible organisation, named lead and delivery timetable.
- Targets and indicators: measurable commitments such as people trained, local spend, work placements, volunteering hours, carbon reductions or habitat improvements. The unit, baseline and counting rules should be stated.
- Evidence: payroll or apprenticeship records, supplier invoices, attendance logs, photographs, training certificates, monitoring data and community feedback, subject to privacy and verification requirements.
- Reporting and review: reporting dates, escalation routes, change control and a process for adjusting actions when circumstances or community priorities shift.
A plan may be prepared before a tender, submitted with a bid, or developed after award. Its status changes depending on what the procurement or contract says. If the contract requires the supplier to submit and implement a plan, sets targets and requires monitoring, the plan is a deliverable rather than merely an expression of intent.
What a community benefit agreement does
A CBA records a negotiated package of benefits for an identified community and the obligations of the parties that sign it. Parties may include a developer or other project proponent, a local authority, community organisations, representative groups or other bodies, depending on the legal setting. There is no worldwide template that determines who must sign or what remedies apply.
Features to look for in the agreement
- Defined parties and community: the signatories, the geographic or demographic community covered and the authority of each signatory.
- Specific commitments: benefits, standards, funding, facilities, jobs, training, environmental measures or other outcomes, with clear descriptions rather than aspirations.
- Milestones and duration: when an obligation starts, what event triggers it, how long it lasts and whether it survives completion or transfer of the project.
- Governance: meeting arrangements, community representation, information rights, decision rules and the process for agreeing changes.
- Monitoring and enforcement: reports, audits, notice provisions, cure periods, dispute resolution, financial security or other remedies.
Because a CBA is an agreement, the wording of each obligation matters. “The proponent will consider” is different from “the proponent must provide,” and a benefit without a delivery date or verification method may be difficult to enforce. The agreement should also identify how it interacts with planning conditions, permits, funding arrangements and the main construction contract.

Neither label decides whether the promise is binding
Calling something a “plan” does not make it non-binding. A public contract can require a supplier to submit and implement a social value plan, attach targets to key performance indicators and make the supplier’s commitments contractual. Conversely, calling a document a “community benefits agreement” does not, by itself, give it the same legal effect everywhere.
Questions that establish legal force
- Does a statute, regulation, procurement policy or planning rule require the document?
- Who signed it, and did each signatory have authority to create the obligation?
- Does the main contract, deed, planning condition or approval incorporate the document by reference?
- Are targets expressed as mandatory obligations or as aims subject to reasonable endeavours?
- Are there dates, acceptance criteria, reporting duties and evidence requirements?
- What happens after a missed target: a cure period, payment adjustment, damages, termination, enforcement notice or no specified remedy?
- Can the obligation be changed, assigned or transferred if the project or contractor changes?
For a live project, the operative text is more important than a general definition found online. Keep the signed agreement, incorporated schedules, amendments and approval documents together so the project team can identify the controlling version.
How the documents relate to community needs
A strong plan starts with a reasoned account of local needs and then connects each need to an action and a measure. A CBA goes a step further by negotiating which benefits the parties will guarantee and how they will be governed. The two can therefore sit in sequence: assessment and engagement identify priorities, a CBA fixes agreed obligations, and a social value plan manages day-to-day delivery and reporting.
That sequence is not mandatory in every jurisdiction. Some procurements ask only for a plan; some developments require a statutory assessment and agreement; some projects use both without either document having a prescribed name. Do not import the process from one country into another.

UK public procurement: what the terms mean there
Social Value Act considerations
UK Public Services (Social Value) Act guidance says an in-scope authority must consider how a relevant service procurement might improve the economic, social and environmental wellbeing of the relevant area, how the procurement could secure that improvement and whether consultation is appropriate. The guidance also sets limits: below-threshold procurements are outside the Act, and specified contract categories are excluded. Scope must be checked for the particular procurement rather than assumed from the word “public.”
Cabinet Office PPN 002
Cabinet Office Procurement Policy Note (PPN) 002 defines social value as additional benefit arising from the way a supplier works with its staff, suppliers, community or the environment while delivering a contract. It is additional to the contract’s core deliverable. Criteria must relate to the contract and be proportionate.
PPN 002 is central-government policy, not a blanket rule for every public or private organisation. For in-scope central-government procurements under the Procurement Act 2023, it sets a minimum 10% weighting and requires supplier commitments to appear in contract terms, key performance indicators or performance indicators. A bidder’s plan therefore matters most when the tender and resulting contract turn its promises into measurable obligations.
PPN 026 timing
PPN 026 was updated on 5 August 2026 and is scheduled to apply to covered procurements commenced on or after 1 January 2027. It applies to in-scope central-government organisations and qualifying procurements, with award criteria required to relate to the contract subject matter, be proportionate and treat suppliers equally. On 17 October 2026 it is not yet in effect, so a procurement team should verify the commencement date and current scope before relying on it.
What this means for a UK construction tender
- Read the invitation to tender and specification for the required social value themes, scoring method, minimum weighting and evidence format.
- Make commitments that the project can control and measure, rather than generic promises about the wider economy.
- Price the labour, supervision, data collection and reporting needed to deliver the plan.
- Ensure every scored commitment is copied accurately into the contract schedule and assigned to a responsible party.
- Set realistic baselines and definitions, especially for “local,” “new,” “sustained,” “trainee” and “spend.”
Queensland planning: a statutory CBA example
Queensland provides a different model. Its planning framework, introduced in July 2025, pairs a social impact assessment (SIA) with a CBA for prescribed developments. The proponent must generally complete the SIA and enter into a CBA with local government, at minimum, before lodging the development application.
Developments covered by the stated thresholds
| Development type | Queensland threshold in the guidance |
|---|---|
| Wind farm | Prescribed development; the cited guidance does not state an additional capacity threshold. |
| Solar farm | Maximum instantaneous output of 1 MW or more. |
| Battery storage facility | Maximum instantaneous output of 50 MW or more. |
Queensland’s guidance says its CBA is legally binding between the development proponent and the relevant local government, with negotiated benefits targeted to affected people and communities. It describes the purpose as ensuring development leaves a positive, place-based legacy. The application generally needs the SIA report and executed CBA unless a specified waiver or notice applies.
“A CBA is a legally binding agreement between a proponent and the relevant local government, intended to ensure that development delivers tangible, place-based benefits to the host community – leaving a positive legacy.”

This is a Queensland-specific statutory example. It does not establish that every CBA elsewhere is legally binding, that every agreement is between a developer and a council, or that every project needs an SIA before a CBA.
How to choose the right document for a project
Use a social value plan when
- the client or tender requires a delivery plan with targets and reporting;
- several subcontractors need coordinated actions and evidence;
- outcomes will be refined as design, programme or community circumstances change;
- the organisation needs an internal management tool even without a statutory agreement.
Use a CBA when
- the applicable framework requires negotiated, community-specific commitments;
- multiple parties need enforceable reciprocal obligations;
- the project needs a durable governance and monitoring arrangement beyond a contractor’s internal plan;
- planning approval or public accountability depends on recorded community benefits.
Use both when
Use a CBA to establish the commitments and a plan to explain how the delivery team will meet them. Cross-reference the documents so that each CBA obligation has an owner, programme milestone, budget, indicator, evidence source and reporting date in the plan.
A practical drafting and review workflow
- Identify the regime. Record the country, state or local authority, project type, procurement route, contract value, threshold, edition of the policy and commencement date.
- Map the controlling documents. Gather the statute or policy, tender documents, planning approval, signed CBA, main contract and every schedule that incorporates a plan.
- Define the community and baseline. State the geography or population, existing conditions, data source and any exclusions or privacy limits.
- Translate priorities into obligations. For each outcome, specify the action, owner, deadline, quantity or quality standard, evidence and acceptance process.
- Set governance. Name the reporting recipient, meeting frequency, escalation route, change-control process and dispute procedure.
- Check proportionality and deliverability. Confirm that requirements relate to the project, are proportionate to its scale and can be delivered within the programme and budget.
- Incorporate commitments correctly. Put scored tender promises into the contract, KPIs or performance indicators; do not leave them only in a bid narrative.
- Test enforcement. Identify notice, cure, payment, audit, termination or other remedies, and confirm who can invoke them.
- Plan close-out. Specify final evidence, retention periods, handover of continuing obligations and publication or community feedback arrangements.
Measurement that stands up to scrutiny
Numbers are useful only when the counting rule is clear. A target such as “support local jobs” should identify the location boundary, employment status, duration, baseline and evidence. “Local spend” should say whether it is measured by supplier headquarters, place of performance or another rule. “Training delivered” should distinguish attendance from completion and explain how duplicate participants are treated.
For environmental outcomes, state the baseline year, boundary, calculation method, responsible verifier and treatment of purchased or transferred benefits. For social outcomes, protect personal data and report aggregated results where individual disclosure is unnecessary. A plan should also explain what happens when a metric cannot be collected: replacement evidence, a corrective action and an approved change record are better than silently dropping the target.

Examples for construction teams
Public building procurement
A council tender asks bidders for a social value plan. The successful contractor proposes apprenticeships, local supplier engagement and a school safety programme. The tender weighting and contract schedule convert those proposals into KPIs, monthly evidence and a remedy for missed reporting. The plan remains the management document; the contract supplies its enforceability.

A prescribed solar development meeting the 1 MW threshold must follow the Queensland SIA-and-CBA process. The SIA identifies affected interests; the proponent and relevant local government negotiate benefits; the executed CBA accompanies the development application unless an applicable waiver or notice applies. The construction contractor may deliver some commitments, but the proponent remains responsible for the obligations assigned to it by the CBA and planning framework.
Private development without a statutory CBA
A developer may still publish a social value plan covering workforce, supply chain and environmental outcomes. Unless the plan is incorporated into a contract, planning agreement or other legal instrument, its enforceability depends on the wording and applicable law. The developer should state plainly which commitments are contractual and which are voluntary.
Questions to ask before signing
- Which obligations are mandatory, and which are aspirations?
- What is the exact community boundary and who represents it?
- Are targets outputs, outcomes or both?
- What baseline and definitions will be used?
- Who owns the data and who can audit it?
- What happens if a target becomes impossible for reasons outside the party’s control?
- Do planning conditions, the CBA and the construction contract say the same thing?
- Which obligations continue after practical completion or a change of contractor?
Conclusion
A social value plan is normally a structured method for delivering, measuring and reviewing agreed outcomes. A community benefit agreement is normally the negotiated record of who will provide which benefits to an affected community and on what terms. The distinction becomes legally meaningful only when read with the governing regime and operative documents. UK procurement examples show how a plan can become a contractual deliverable, while Queensland’s planning framework shows a CBA that is expressly legally binding and linked to an SIA. For any construction project, verify the jurisdiction, thresholds, dates, signatories, incorporated terms, indicators and remedies before relying on either label.
Frequently Asked Questions
Is a social value plan legally binding?
Sometimes. The label does not decide. A plan is binding to the extent that a contract, planning instrument or other legal document incorporates its obligations, targets and remedies.
Is every community benefit agreement legally binding?
No universal rule applies. Queensland’s planning framework expressly describes its CBA as legally binding; another jurisdiction may use the term differently. Check the governing law and signed agreement.
Does a CBA replace a social value plan?
Not necessarily. A CBA can establish the negotiated commitments, while a social value plan can manage delivery, evidence and reporting. The project documents should state how the two interact.
What should a contractor do with a client’s social value commitments?
Identify which commitments are contractual, assign each an owner and programme milestone, define evidence and reporting, budget for delivery, and raise any ambiguity before signing.
