The Federal Transit Administration (FTA) has proposed—not adopted—a change to its Capital Investment Grants (CIG) guidance that would use birth and marriage rates near a proposed transit corridor as factors in calculating the federal share. The proposal also reports earlier financing commitments and added design and project-development milestones. Public comments are due November 16, 2026; FTA says it will review comments before issuing final guidance, which the agency intends to make effective immediately without generally grandfathering projects already in the pipeline.
What FTA proposed to change
CIG is a discretionary FTA program that helps fund major transit capital investments, including heavy rail, commuter rail, light rail, streetcars and bus rapid transit. Its project categories include New Starts, Small Starts and Core Capacity. Sponsors must progress through defined development stages before seeking a construction grant agreement, and FTA evaluates projects under statutory criteria that include project justification and local financial commitment. FTA says the proposed guidance is intended to streamline the CIG process, improve sponsor accountability and make the guidance easier to read. The Federal Register notice says the proposal incorporates suggestions received after an FTA request for information published in August 2025. How birth and marriage rates would affect the proposed federal share
According to ENR’s account of the proposal, rates of births and marriages within one mile of a proposed transit corridor would be factors in the federal-share calculation. In the high-rate case described by ENR, a project with both measures more than 1% above their respective national averages could receive five percentage points for each measure—a possible combined increase of 10 percentage points. ENR also reports smaller increases for rates at or slightly below national averages.

That is an account of the proposed formula, not a complete formula that can be independently reconstructed from the official notice excerpts. The underlying demographic dataset, calculation details and treatment of other cases are not established here. The percentages describe possible percentage-point adjustments to the federal share, not a guaranteed award or a change in total project cost.
What financing and project-development requirements are reported to change
ENR reports that the proposal would alter when sponsors of larger New Starts and Core Capacity projects must secure non-CIG funding commitments, and would add design and documentation milestones. These specifics are attributed to ENR’s review of the proposal.

The reported 30% to 50% change concerns the timing of commitments, not the total required nonfederal project share. It would require sponsors to demonstrate a larger portion of planned non-CIG funding earlier in the process.
Is the proposal in force, and when do comments close?
No. The proposed guidance remains open to public comment, with comments due November 16, 2026. FTA says it will review and address comments before finalizing the guidance. The notice says the final version is intended to take effect immediately when published, rather than after a transition period. What the timing could mean for projects already in the pipeline
The Federal Register notice says the proposal would not generally grandfather projects already in the CIG pipeline. ENR reports different practical implications depending on a project’s stage:
- Project Development: Projects still at this stage could face the proposed financing, design and documentation requirements if the guidance is finalized as described.
- Engineering: ENR reports that projects already in Engineering would retain previously approved federal shares but face proposed annual oversight.
These are reported effects of the proposal, not final determinations for any particular project. Sponsors will need to assess the final guidance and any project-specific direction from FTA.

How many projects could be affected?
ENR reported that the American Public Transportation Association’s pipeline dashboard, in 2026, identified 47 projects across 21 states seeking $34.5 billion in CIG funding without construction grant agreements. This is the dashboard figure as reported by ENR; it does not mean that every listed project would receive the requested amount or be affected in the same way.

FTA’s stated case: streamlining and accountability
FTA presents the revisions as a way to streamline the process, strengthen sponsor accountability and improve readability. Earlier funding commitments, clearer design progress and updated estimates could give the agency more information about a project’s readiness and financial plan before it advances.

Sponsor concerns: midstream costs and delays
Earlier commitments and additional milestones could require sponsors to secure financing and complete work sooner, potentially affecting project schedules and costs. APTA President and CEO Paul P. Skoutelas said the proposal “could significantly change the federal share, local financial commitment requirements and the project rating system midstream for each of these 47 projects,” as quoted by ENR.
A disputed appropriations question
ENR reports that Sen. Patty Murray objected that the proposed formula could conflict with fiscal 2026 transportation appropriations language restricting the use of federal funds to impede advancement or approval of certain CIG projects seeking contributions above 40% of project costs. ENR also notes that the law does not expressly guarantee a minimum 40% award. The appropriations text and its application have not been independently established here, so this remains an attributed dispute—not a settled conclusion that the formula is lawful or unlawful.
