Property Tax, Penalties, and Demolition: What Can Happen After Unauthorized Construction Is Found

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a city, county, or other authority discovers construction that was never properly permitted, several different processes may begin. A building official can require work to stop or be corrected; a tax assessor can add an unreported improvement to the taxable assessment; and, where local law allows it, a municipality can order repair, removal, or demolition. None of those outcomes is automatic, and one agency’s action does not decide the other agency’s case.

The property’s country, state or province, municipality, zoning, the work performed, safety conditions, and the wording of the notice control the result. Read the actual notice, identify every issuing agency and deadline, and get local professional advice quickly if a formal order, major assessment, safety concern, or demolition threat is involved.

What “unauthorized construction” can mean

People use “unpermitted,” “unauthorized,” and “illegal” interchangeably, but an authority may distinguish among them. Work might have started without a required building permit, exceeded an issued permit, violated zoning, failed inspection, or been built in a location where the use is prohibited. A tax assessor may describe the same work as an undeclared improvement without deciding whether it meets the building code.

That distinction matters because building-code enforcement and property taxation normally have different legal bases, decision-makers, evidence, and appeal routes. Paying additional tax does not legalize construction. Conversely, a building-code order does not by itself state how the property will be assessed or what tax is due.

The main consequences, in order of likelihood

Stop-work or correction requirements

A building official may issue a notice of violation, require an inspection, order construction to stop, or specify corrections. The notice may require approved drawings, opening concealed work for inspection, engineering reports, zoning relief, or removal of work that cannot comply. Continuing construction after a stop-work order can create additional violations and make voluntary resolution harder.

After-the-fact permit or legalization review

Some jurisdictions accept a permit application after work is complete. That is usually an investigation and compliance process, not an amnesty. The owner may have to expose framing, wiring, plumbing, foundations, or fire-separation details that would normally be inspected during construction. Plans may need to show the work as built, and a designer or engineer may have to certify structural or life-safety elements.

Approval can still be impossible if the work violates setbacks, height limits, lot coverage, environmental rules, easements, historic protections, or a use restriction. A variance, conditional approval, redesign, or partial removal may be required. Do not cover, alter, or demolish evidence before asking the building official what inspection and correction procedure applies.

Tax-list addition and back taxes

A taxing authority can discover an improvement through an inspection, permit data, an owner filing, an assessor’s review, or another source. It may issue a new or revised assessment and calculate additional tax for earlier periods, together with interest or a statutory penalty. The tax process can continue even if the building department is still deciding whether the work can remain.

Repair, removal, or demolition

Removal or demolition generally requires specific authority and procedural steps. A municipality may need to establish a dangerous condition, serve notice, provide a hearing or appeal opportunity, obtain a governing-body decision, and follow rules for entering the property and recovering costs. An order to correct is not an automatic demolition decision. The risk is greater when a structure presents an immediate danger, cannot be brought into compliance, or remains after a final order and missed deadlines.

How the building-code and tax tracks differ

Question Building-code or zoning process Property-tax process
Primary authority Building official, code agency, planning or zoning office, or municipal governing body County, municipal, provincial, or national taxing authority or assessor
What is decided Whether work may proceed, remain, be corrected, altered, removed, or demolished Whether an improvement belongs on the assessment and what tax, interest, or penalty is due
Typical evidence Permits, plans, inspections, site conditions, measurements, zoning rules, and safety reports Improvement description, construction date, cost or value, assessment records, ownership, and statutory tax periods
Possible outcome Permit, correction order, stop-work order, variance process, removal, or demolition order where authorized New or revised assessment, back taxes, interest, penalty, or an assessment appeal
Does one decide the other? No. A code order does not determine tax treatment. No. A tax assessment does not prove the work is lawful.

Because the tracks are separate, respond to each notice. An appeal to an assessment board may not pause a building-code deadline, and negotiating a permit correction may not stop tax accrual unless the applicable law says so.

Jurisdiction-specific examples

Ohio: an unreported improvement can bring a 50 percent statutory penalty

Ohio Revised Code §5713.17 addresses improvements costing more than $2,000 in localities without a system of building registration and inspection. It requires written notice to the county auditor within 60 days after construction commences. If a qualifying improvement was not reported, the auditor must appraise and add it to the tax list at taxable value and impose a penalty equal to 50 percent of the taxes that would have been charged on the improvement from construction to discovery if notice had been given. The auditor or deputy may examine buildings during reasonable hours.

This is a specific Ohio rule with defined conditions, not a nationwide penalty or a percentage that applies to every unpermitted project. Ontario: an order can lead to a stop-construction or stop-demolition direction

Ontario’s Building Code Act, 1992 provides a conditional example of how an enforcement order can escalate. Under section 14(1), the official statutory wording states:

“If an order made under section 12 or 13 is not complied with within the time specified in it, or where no time is specified, within a reasonable time, the chief building official or registered code agency, as the case may be, may order that all or any part of the construction or demolition cease.”

The cited provision also describes serving orders on affected persons and posting them at the site. Ontario legislation separately gives municipalities property-condition powers involving repair or site clearance and possible recovery of municipal costs. The exact consolidated text, local bylaw, service method, hearing rights, and deadline must be checked for the property; an Ontario example is not a rule for another province or country.

The available remedy, notice, hearing, exceptions, and cost-recovery or civil-penalty lien depend on the applicable subsection and facts. The quoted lead-in does not mean every unpermitted shed, addition, or building may be demolished. Confirm the current state law and municipal procedure, especially if the alleged problem is ordinary permitting rather than a dangerous condition.

Philippines: assessment notices can state deficiency, surcharges, interest, and penalties

Philippine Local Government Code provisions describe an assessment notice that states the nature and amount of a tax deficiency, surcharges, interest, and penalties. The rules also contain assessment and collection periods, with an exception involving a longer period where fraud or intent to evade is established.

A 1992 Department of Finance local-assessment regulation describes back taxes for undeclared buildings, service of a new or revised assessment, an appeal period of 60 days from receipt, and interest tied to payment by the end of the quarter following receipt. These are Philippines-specific provisions. Verify the current law, the assessment class, the date of receipt, and the local treasurer or assessor’s instructions before relying on those periods or amounts.

What determines whether the work can stay

Safety and code feasibility

Officials will look at structural stability, fire separation, exits, electrical and gas work, sanitation, drainage, accessibility, flood or environmental exposure, and any immediate hazard. A project that can be inspected and upgraded may follow a correction path. Concealed defects, unsafe occupancy, or a foundation in a prohibited location can make removal more likely.

Zoning and land-use limits

Even technically sound construction may violate setbacks, height, lot coverage, parking, use, shoreline, heritage, or conservation rules. Building-code approval cannot substitute for a required zoning approval. Ask whether a variance, conditional-use approval, site-plan amendment, or other land-use decision is available and whether construction must remain stopped while it is pending.

Procedural history

Authorities consider whether the owner responded, allowed inspections, met correction dates, appealed, or continued work after notice. A missed deadline can produce a final order, additional penalties, or municipal work under local law. A timely appeal may preserve rights, but it does not necessarily suspend every obligation.

Compare the practical response paths

Path Legal basis and decision-maker Cost and time issues Likely result
After-the-fact approval Permit or code process with the building official; zoning approval may be separate Application and inspection fees, design or engineering fees, opening concealed work, and upgrades; timing depends on reviews and inspections Permit or certificate if the work can meet current or permitted standards
Correction or alteration Compliance order specifying repairs, redesign, or partial removal Construction and professional costs; deadline is set by the notice or applicable law Existing work remains only after required corrections pass inspection
Removal by the owner Owner elects or is ordered to remove noncompliant work Demolition, disposal, utility-disconnection, and site-restoration costs Violation may be resolved, but tax or penalty issues can remain separate
Municipal repair or demolition Municipal governing body or authorized official, usually after statutory findings and notice Potential municipal charges, liens, civil penalties, and legal costs where authorized Work is performed or ordered under the jurisdiction’s dangerous-building or property-condition law
Tax assessment appeal Assessor review, local board, tribunal, or court specified in the assessment notice Filing deadline, evidence of value and dates, and possible professional representation Assessment may be confirmed, corrected, or reduced; it does not legalize construction

What to do when a notice arrives

  1. Record the controlling details. Write down the issuing agency, officer, property address, legal section, notice date, response date, inspection instructions, hearing or appeal deadline, and stated consequences for noncompliance. Keep the envelope, email headers, photographs of posted notices, and every attachment.
  2. Separate the issues. Ask whether the notice concerns a permit, building code, zoning, tax assessment, dangerous condition, or more than one. Request the case number and the name of the official responsible for each track.
  3. Use independently verified contact information. Call the agency through its official published telephone number or visit its public office. Confirm whether work must stop, whether an inspection can be scheduled, and which forms and plans are required. Do not rely solely on a contractor’s interpretation of the notice.
  4. Assemble a factual file. Gather permits and permit applications, plans, surveys, contractor agreements, invoices, inspection records, dated photographs, utility records, property-tax bills, closing documents, and evidence of when construction began and ended. Preserve original files and make a dated chronology.
  5. Ask before exposing or changing work. Concealed work may need to be opened under controlled conditions. Obtain written instructions about demolition, temporary protection, utility disconnection, and required inspections so that an attempted repair does not create a new violation or destroy evidence.
  6. File the correct response on time. A permit application, written correction plan, assessment objection, hearing request, or appeal usually has a specific form and deadline. If a deadline cannot be met, ask in writing whether an extension is legally available; do not assume an informal conversation stops the clock.
  7. Get local advice for high-stakes cases. A locally qualified building-code professional can document existing conditions and coordinate plans. A lawyer familiar with the property’s jurisdiction can evaluate notice, service, appeal rights, tax exposure, liens, and demolition authority. Seek help promptly when safety is disputed, the assessment is substantial, or demolition is threatened.

Common mistakes that make the situation worse

  • Assuming tax payment cures the violation. Taxing an improvement and approving it are separate decisions.
  • Continuing work after a stop order. New work can add violations, undermine an appeal, and increase the eventual correction cost.
  • Relying on a “grandfathered” claim without proof. A prior use or older structure may have protection, but the owner normally must establish the date, scope, and continuity required by local law.
  • Missing the appeal window. Assessment and code deadlines can be short and may run from receipt or service, not from the date the owner first learns about the problem.
  • Removing evidence casually. Demolition before an inspection can prevent an official from determining what was built and may complicate both compliance and insurance questions.
  • Ignoring liens or cost notices. Where authorized, municipal work or unpaid charges can become a lien or other charge against the property even after the immediate construction issue appears resolved.

Questions that cannot be answered without the property’s location

No universal percentage of discovered projects ends in demolition, and there is no single nationwide penalty schedule. The decisive facts are the country, state or province, municipality, property type, work performed, construction dates, permit history, safety condition, and exact notice. Until those facts are known, an owner cannot reliably predict whether legalization, correction, removal, a tax adjustment, or a municipal action is available.

The safest course is to treat every notice as time-sensitive, keep the building and tax matters organized as separate files, and obtain the applicable current law and local procedure before choosing a response.
