Project Deposit Seven Months Early: What to Check Before You Pay

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A deposit for work that will not begin for seven months is neither automatically refundable nor automatically lost. Your outcome usually turns on the signed agreement, what the payment is meant to cover, whether the provider has incurred documented costs, the type of project, and the law where the contract was made. Because the project type and jurisdiction are not specified here, no single refund rule or “safe” percentage applies.

Before paying, make the start date, deposit purpose, cancellation terms, refund process, and later payment milestones explicit in a signed contract. A large unexplained advance creates more risk than a payment tied to identifiable pre-start work or completed stages.

What a seven-month delay means for your deposit

Seven months between payment and work is not, by itself, proof that a contractor is acting improperly. Some projects require design, permits, engineering, custom materials, seasonal scheduling, or a reserved crew. The important question is what your money secures during that period.

Ask whether the deposit is:

  • a credit toward the final contract price;
  • payment for drawings, permits, surveys, ordering or storing custom materials;
  • a reservation of a specified start window; or
  • a cancellation charge intended to compensate the provider for a stated loss.

The label alone may not decide the legal result. In France, Service-Public distinguishes acompte, arrhes and avance, with different consequences under French law; the contract terms and, in some cases, default legal rules determine which regime applies. Those French categories should not be imported into another country.

In any location, read the clauses dealing with non-start, rescheduling, cancellation by either side, supplier failure, insolvency, and refunds. If the contract is silent, local law may supply terms, but the answer can be difficult to predict without knowing the jurisdiction and project type.

What to put in writing before paying

For a home-improvement project, the U.S. Federal Trade Commission (FTC) recommends a written contract identifying the contractor and setting out the scope, price, estimated start and completion dates, and applicable cancellation information. Leave no blank spaces that could later be completed by someone else.

Essential contract details

  • Legal business name, physical address, phone number and the individual authorized to sign.
  • License or registration number where your jurisdiction requires one, plus insurance details.
  • A precise description of the work, materials, allowances, exclusions, plans and specifications.
  • Total price, taxes, treatment of allowances and the exact deposit amount.
  • Estimated start and completion dates, the reserved time window, and a procedure for updating dates when permits, materials or other dependencies change.
  • Whether the deposit is held, placed in a trust account, applied to specified purchases, or used as general working capital.
  • Every payment date or stage, with an objective description of the work or deliverable that triggers it.
  • Rules for customer cancellation, contractor cancellation, non-start, rescheduling, substitutions, price changes and termination.
  • How a refund is calculated, which expenses may be deducted, what proof of those expenses is required, and when the balance must be paid.
  • Dispute-resolution procedure, governing law, notices and the address for formal cancellation.

Do not rely on a promise that the provider will “hold your place” unless the contract says what that promise means and what happens if the promised window is missed.

How much should you pay up front?

There is no universal deposit percentage. A reasonable amount depends on the work, the provider’s genuine pre-start expenses, local caps and the protection available if the provider fails. The FTC’s home-improvement guidance states: “Don’t pay the full amount for the project up front.” It also says, “Some states actually limit the amount of money a contractor can ask for as a down payment.” Check your own state, territory or local consumer agency rather than treating a figure from another place as a benchmark.

Location and context Rule or guidance What it does not establish
United States, home improvement FTC recommends a detailed written contract, warns against full payment up front, and notes that some states limit down payments. It is not one nationwide deposit cap or a universal refund rule.
Victoria, Australia, domestic building work Consumer Affairs Victoria states that the deposit cannot exceed 10% for contracts under AUD 20,000, or 5% for contracts of AUD 20,000 or more. Payments are linked to legally specified building stages. These limits apply to the specified Victorian domestic-building contracts, not projects elsewhere.
France, goods or services Service-Public distinguishes acompte, arrhes and avance; the written terms affect the legal consequences. French treatment is not a general rule for other countries.
United Kingdom Older CMA/OFT guidance says deposits should be proportionate, advance payments should reflect expenses while leaving a reasonable amount due on completion, and cancellation charges should represent a genuine estimate of direct loss. Confirm current law and sector-specific rules before relying on this guidance.

In Victoria, Consumer Affairs Victoria also warns that excessive deposits can expose consumers to loss and that domestic-building insurance or the Building and Plumbing Commission may not cover advance payments. Its guidance says: “Don’t pay the deposit until the builder gives you a certificate of currency for your property.” That instruction is specific to the Victorian domestic-building context.

Use milestones instead of an unexplained advance

A seven-month lead time is easier to manage when later payments correspond to work you can verify. A schedule might require a modest signing payment, a documented amount when approved plans or permits are delivered, payment when custom materials are received and inspected, and stage payments after defined construction work is complete.

Each milestone should identify the evidence required: an issued permit, delivery receipt, inspection record, progress photograph, certificate or signed completion checklist. Avoid wording such as “payment when substantially complete” unless the contract defines that phrase.

For Victorian domestic building work, the published guidance describes legally specified stages and says customers pay for completed stages. Do not transfer that schedule to another jurisdiction without checking its law.

Check the provider before transferring money

Verify the provider’s identity independently of the contact details in an advertisement or invoice. For home improvement, FTC guidance recommends checking licensing, insurance and complaint records, and obtaining references. Ask the relevant licensing or consumer authority whether the business is registered and whether disciplinary or unresolved complaint information is available.

  • Confirm that the named contracting entity matches the entity on the license and insurance certificate.
  • Call the insurer or licensing body using contact information obtained independently.
  • Speak with recent customers about whether the provider started when promised and handled changes properly.
  • Ask who will actually perform the work and whether subcontractors are covered by the contract.
  • Be cautious if the provider demands the entire price immediately, refuses a written agreement, pressures you to decide, or will not explain the seven-month schedule.

Use a payment method that creates a clear record and retain the receipt. FTC repair guidance warns consumers in cited scam situations against cash, wire transfers, gift cards, payment apps and cryptocurrency. No payment method guarantees a refund, so the contract and local protections still matter.

If the provider cannot start on time

  1. Compare the promise with the contract. Find the estimated start date, any range or force-majeure language, notice requirements and rescheduling rights.
  2. Preserve evidence. Keep the signed agreement, estimates, invoices, receipts, messages, plans, permit records and a dated log of every promised update.
  3. Write a specific request. Ask for a confirmed start date, the reason for the delay, the effect on price and the proposed remedy. Follow telephone conversations with an email or letter.
  4. Set a reasonable written response date. Do not invent a legal deadline; use the contract’s notice procedure and any deadline imposed by local law.
  5. Choose the contractual remedy. Depending on the terms, you may accept a revised schedule, agree to a documented change, cancel under the stated clause, or demand repayment of amounts not properly earned.
  6. Escalate locally. If the provider will not resolve the issue, contact the relevant consumer-protection office, licensing authority or a qualified local adviser before declaring the deposit forfeited or refundable.

The source guidance does not establish a universal number of days after which a delayed start automatically creates a refund right. The contract and applicable law control.

Cancellation and refund questions to resolve now

Can the provider keep money spent before work starts?

Possibly, if the contract authorizes the expense and the provider can show it was reasonable, necessary and connected to your project. Require receipts or other documentation for custom materials, permit fees, design work or nonrefundable supplier charges. A vague “administration fee” is harder to evaluate than a defined, proportionate charge.

What if you cancel because seven months is too long?

Read the customer-cancellation clause first. It may permit cancellation with a stated charge, require reimbursement of documented costs, or restrict cancellation after materials are ordered. If the contract says nothing, local law may determine whether the payment is recoverable and what loss can be retained.

What if the provider cancels?

Look for a provider-cancellation or non-performance clause. It should state whether the deposit is returned, whether the provider may offer a replacement date, and how prepaid materials are transferred or refunded. If the business is insolvent, ordinary contractual rights may be difficult to enforce, making local statutory protection and the provider’s financial safeguards important.

Is there a three-day cooling-off period?

The FTC says a written statement of a right to cancel within three business days should be included where a contract was signed in the consumer’s home or away from the seller’s permanent place of business. That is not a universal cancellation right for every contract. Check whether your transaction and location qualify and follow the required cancellation method exactly.

A practical decision test

Before paying, proceed only when you can answer “yes” to all of these questions:

  • Do I know the legal entity receiving the money and have I checked its credentials?
  • Does the contract state a realistic start window seven months from now and a completion target?
  • Is the deposit amount lawful locally and proportionate to documented pre-start costs?
  • Does the agreement say exactly when the deposit is credited, spent or refunded?
  • Are future payments tied to observable milestones rather than dates alone?
  • Can I cancel or obtain a remedy if the provider misses the start window?
  • Do I have proof of insurance and information about any statutory protection or trust arrangement?
  • Can I afford the money to remain unavailable for seven months?

If any answer is no, pause the payment and request a contract amendment or independent local advice. A provider who will not explain the deposit or schedule is giving you information about the risk before the project begins.

Bottom line for a project starting in seven months

Paying a deposit months early can be sensible when it reserves a clearly defined slot or funds documented, necessary preparation. It is risky when the amount is large, the purpose is vague, the start date is noncommittal, or the refund clause is missing. Get the entire deal in writing, check local deposit limits and cancellation rules, verify the provider and insurance, keep payment records, and link subsequent payments to completed work. For a substantial or disputed deposit, obtain advice from the consumer authority or a qualified adviser in the place where the contract applies.
