Private Park or Public Right of Way? How to Check Access Rights Over Land in England and Wales

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A privately owned park can still contain a public right of way. Ownership and public access are separate questions. To establish what the public may legally do, identify the exact route and jurisdiction, inspect the relevant council’s definitive map and statement, read the recorded route category, and check any separate open-access or permissive-access arrangements. Use HM Land Registry records to investigate ownership and title information, but do not treat a title plan as a complete answer about access or exact boundaries.

This guide covers England and Wales. It cannot determine the status of a particular path without its location and the current local records.

What you need to establish

“Can I walk through this private park?” contains several different legal questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Is there a recorded public right of way along this particular line?
  • If so, is it a footpath, bridleway, restricted byway or byway open to all traffic?
  • Does a separate open-access designation apply to the surrounding land?
  • Is access merely permissive, meaning the owner has allowed it by permission?
  • Who owns the land, and where are the title and highway boundaries?
  • Are there current obstructions, temporary closures or legal orders affecting use?

Answer these questions in that order. A general walking map, a “private land” sign or the fact that people have used a path for years may be relevant evidence, but none is a substitute for checking the legal record and current authority information.

1. Pin down the route and the responsible authority

Start with the precise entrance, exit and line of the path. “The park” may contain several tracks, drives and informal desire lines with different legal statuses. Mark the route on a current map and note nearby roads, gates, buildings, streams and field boundaries. If you are assessing a construction access, record the section that would be affected rather than describing the whole estate generally.

Then identify the jurisdiction. In England, the relevant surveying and highway record is normally held by the county council or unitary authority. In Wales, it is usually held by the county or county borough council. A national park may also maintain relevant information or administer access functions within its area. The authority’s rights-of-way or public-rights-of-way team can tell you which office holds the definitive record.

Do not combine English and Welsh procedures casually. The underlying principles are similar, but the online viewers, contact points and administrative arrangements differ. If a route crosses an authority boundary, check both sides and confirm that the line has not been recorded differently in each authority’s documents.

2. Check the definitive map and statement

The definitive map and its accompanying statement are the key legal records for recorded public rights of way. The map shows the recorded route; the statement can describe its status, width, route details or other particulars. The relevant authority must make this information available, often through an online map and supporting documents, and can explain how to inspect paper records where online information is incomplete.

Search using the exact location rather than a park name alone. Compare the mapped line with the path on the ground. A route can enter a park through a gate, cross a driveway or continue beside a boundary, so a nearby line on a general map is not enough.

What to record from the authority’s map

  • The route reference or notation used by the authority.
  • The recorded category: footpath, bridleway, restricted byway or byway open to all traffic.
  • Any annotations, diversions, extinguishments, temporary closures or modification orders.
  • The statement’s description of the start and end points and any recorded width or limitations.
  • The date and source of the version you inspected, especially if a project decision depends on it.

Ordnance Survey and other general maps can help you locate a route, but they are planning aids, not the definitive legal record. If the online viewer is unclear, request clarification from the authority’s rights-of-way team and keep a copy of the response.

3. Read the route category, not just the line

Different categories carry different travel rights. A line marked as a public right of way does not give a general right to use every part of the private park or to travel by any preferred method.

Recorded category Travel described in GOV.UK guidance Practical implication
Footpath Walking, running, and use by mobility scooters or powered wheelchairs Do not assume cycling, horse riding or motor-vehicle use is included.
Bridleway Walking, horse riding and cycling, as well as use by mobility-device users Users must remain on the recorded route; a bridleway is not a general right to roam.
Restricted byway Non-motor transport It is broader than a footpath but does not provide a general motor-vehicle right.
Byway open to all traffic All transport Check the record and any current traffic regulation or closure before relying on vehicle access.

The category controls the kind of passage, not ownership. A landowner may own the soil beneath a bridleway or footpath while the public retains the recorded right to pass along it. Users must follow the route and comply with lawful restrictions, gates and temporary orders.

Why category matters for works

For a building, landscaping or utilities project, the category affects how a diversion, crossing, gate or closure should be assessed. A temporary barrier that prevents walkers is a problem on a footpath; one that also blocks horses, cycles or vehicles may create additional impacts on other categories. Obtain route-specific advice before placing materials, fencing, cabins or plant near the recorded line.

4. Check open-access land separately

Open-access rights are a different regime from a linear public right of way. Certain mapped areas can carry a right to enter on foot, subject to exceptions, restrictions and seasonal rules. GOV.UK guidance identifies parks and gardens among excepted land. That means the fact that an area looks like a park does not, by itself, establish an open-access right.

Check the current open-access map and guidance for the location. Read any restrictions on fires, dogs, camping, cycling, organised activities or seasonal closures that apply to the designated land. A public right of way may cross land that is excepted from open access; the route right and the wider access designation should not be conflated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Permissive access

A landowner can allow people to use a path by permission. Signs may describe the permission, hours, destinations, dogs, bicycles or a right to withdraw access. This is permissive access, not a recorded public right of way. Its conditions come from the owner’s permission, so record the wording and date of any sign that matters to your decision.

Do not infer that long-standing permissive use has the same status as a definitive-map route. Conversely, do not assume that a “private” sign cancels a recorded public right of way. Where signs and the authority record conflict, ask the highway authority to investigate.

5. Investigate ownership through HM Land Registry

Once you know the route, investigate the land separately. For registered land, HM Land Registry’s title register can identify the registered owner and may note rights of way, covenants or other interests. The title plan helps locate the title and its general boundaries.

Use the register to answer ownership questions, not to replace the definitive map. A register entry may refer to rights benefiting or burdening land, but the existence, alignment and current status of a public right of way are determined through the rights-of-way record and applicable legal orders.

If you cannot find a title

An unsuccessful address or map search does not prove that no owner exists. Consider an index-map search. It can identify the title or titles covering a parcel, or confirm that the land is unregistered. Unregistered land and gaps in online property searches require additional care before you approach an owner or rely on a boundary assumption.

What a title plan does not show

HM Land Registry generally uses red edging to show general boundaries, not a surveyed line accurate to every centimetre. Where land borders a public highway, the title plan will not ordinarily show the exact boundary between private land and highway land. Do not use the thickness or position of the red line to decide whether a gate, verge, ditch or path lies on one side of the boundary.

6. Reconcile the map, signs and physical conditions

Walk the route only where you are lawfully entitled to do so, and compare what you see with the authority record. Photograph signs, locked gates, stiles, barriers, missing waymarks and obstructions from a lawful position. Note the date, weather or seasonal condition and the precise location.

When the path is blocked

Report an obstruction to the local highway authority, giving the route reference, grid location or clear landmarks and photographs. The authority can advise on the responsible party, enforcement process and any temporary closure. Do not remove a gate, cut a lock or divert around an obstruction across private land.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When the line is unclear

Ask the rights-of-way team for the definitive map, statement and any relevant modification, diversion or extinguishment orders. A path may appear to stop at a driveway on an online viewer while the statement continues it to another point. Conversely, a visible track may be an estate road, permissive path or historic route that is not recorded as a public right of way.

When a route is absent from the online record

Absence from an everyday or incomplete online map is not proof that no right exists. Historic or unrecorded rights may require documentary evidence, evidence of public use and formal authority review. Do not tell users that a path automatically becomes public solely because it has been used for 20 years. GOV.UK describes 20 years as a legal-use period relevant to some claims, but the facts and legal process determine the outcome.

Ask the authority how to submit historical evidence and what formal route-record amendment process applies. Until the record is clarified, avoid representing an uncertain route as either definitely public or definitely private.

7. Compare alternative routes consistently

If a project, event or access plan has more than one possible route, assess each against the same evidence. A shorter route is not necessarily the lawful or lower-risk route.

Practical examples

A footpath crosses a privately owned park

The title register identifies the park owner, while the definitive map records a footpath across it. The owner’s title does not erase the public route. Walkers may use the recorded line in the manner allowed for a footpath, but they do not gain a right to wander across lawns, enter buildings or choose a shortcut.

A signed “private” track appears on a walking map

The sign is evidence of the owner’s position, not a final legal determination. Check the council’s definitive map and statement. If a public right of way is recorded, report any obstruction or misleading sign to the authority rather than removing it yourself. If no route is recorded, ask whether the track is permissive, subject to a closure, or potentially supported by historic evidence.

A proposed construction entrance crosses a bridleway

Confirm the bridleway’s recorded line and users before design work. A vehicle entrance, fencing layout or compound must account for walkers, riders, cyclists and mobility-device users entitled to use the route. If the route must be diverted or temporarily closed, contact the highway authority about the formal process; an informal sign or agreement is not a substitute for the required order.

The title plan seems to put the path inside the private boundary

That is not surprising. Public rights can run over privately owned land, and title plans normally show general boundaries. Use the definitive map for the recorded route and the title register for ownership and interests. Obtain a professional boundary or legal opinion if the exact line affects a dispute or construction setting-out.

Construction and land-management checklist

Before acquiring, designing or working on land containing a park, track or estate, complete this record:

  1. Mark the exact proposed works and every route that could be affected.
  2. Identify the English county or unitary authority, or Welsh county or county borough authority, responsible for the record.
  3. Download or inspect the definitive map and statement; save the route reference and access date.
  4. Record the category and permitted users for each route.
  5. Check current diversion, extinguishment, temporary-closure and traffic-regulation information.
  6. Check whether any surrounding land has an open-access designation and whether exceptions or seasonal restrictions apply.
  7. Photograph and transcribe permissive-access signs without treating them as definitive-map evidence.
  8. Search HM Land Registry for the register and title plan; use an index-map search where a parcel is not found.
  9. Mark title boundaries as approximate unless a suitably accurate survey establishes more.
  10. Ask the authority about obstructions, misleading signs or an absent route before works begin.
  11. Keep written responses, maps, photographs and dates in the project file.

This paper trail helps distinguish a confirmed right from an assumption and gives the authority enough detail to investigate a problem efficiently.

Common mistakes to avoid

  • Equating ownership with exclusive access. Private title can coexist with a public right of way.
  • Using a consumer map as the legal record. Use it to locate the route, then verify the council’s definitive map and statement.
  • Reading only the line. The category determines who may travel and how.
  • Confusing open access with a path. A mapped open-access right and a linear right of way are separate regimes.
  • Treating permission as a permanent public right. Permissive access depends on the owner’s terms.
  • Assuming 20 years of use settles everything. Evidence and the formal legal process still matter.
  • Using a title plan to set out a highway boundary. Red edging ordinarily indicates general boundaries, and the private/highway line may not be shown exactly.
  • Removing an obstruction yourself. Report it to the highway authority and follow its process.

Where to get a definitive answer

For a route-specific answer, give the local rights-of-way or highway authority the exact location, route reference if known, photographs and a clear description of the issue. Ask which definitive map and statement apply and whether any order or temporary restriction changes the current position. For ownership, obtain the HM Land Registry register and title plan and consider an index-map search if the land cannot be found.

Where a dispute concerns an exact boundary, an alleged historic right, development risk or a proposed diversion, a solicitor, rights-of-way specialist or chartered land professional may be needed. The authority’s map establishes the recorded access status; it does not by itself resolve every ownership, boundary or evidence question.
