Preconstruction vs. Move-In-Ready Condos in Cancún: Costs, Risks, and Tradeoffs

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Neither preconstruction nor a move-in-ready condo is automatically cheaper or safer in Cancún. Preconstruction can spread payments and let you choose a unit, but you are relying on permits, construction, delivery promises and contract remedies. A completed condo lets you inspect the actual apartment, finishes, view and building operations, yet it can still carry title, lien, tax, service-payment or defect problems. Compare the two paths using a property-specific total-cost sheet and independent legal and technical checks before you sign or transfer a deposit.

What the two purchase paths actually mean

Preconstruction

A preconstruction purchase is a contract for a unit that is not yet complete. Depending on the development, you may be buying from architectural plans, a scale model, a furnished model unit or a partially built structure. The agreement normally sets a reservation or deposit, staged payments, a target delivery date and specifications for the finished unit and common areas. Your central risk is that the finished property, timing or documentation may differ from what was promised.

Move-in-ready

A move-in-ready condo is physically complete enough for occupancy or immediate fit-out. You can inspect the actual unit, common areas, fixtures, view, noise and utility operation before closing. “Ready” does not, by itself, prove that title is clear, the condominium regime is properly documented, taxes and services are paid, or every advertised feature is included. Those matters still require documentary verification.

Quick comparison: time, evidence, risk and cash flow

Decision axis Preconstruction Move-in-ready
Time to occupancy Depends on construction progress and the contractual delivery date. Review milestones, extension rights, penalties and remedies for delay. Potentially available sooner, subject to closing, title transfer, utilities, inspections and any agreed repairs or furnishing.
What you can observe Plans, specifications, permits, construction status, model or sample unit and the developer’s record. The final unit cannot yet be inspected. Actual condition, finishes, fixtures, view, noise, common areas and service operation can be examined.
Main risks to investigate Execution and completion, permit or title readiness, changes from plans or marketing, delivery delay, deposit protection and refund terms. Hidden or visible defects, title or lien problems, unpaid taxes or services, undocumented alterations and mismatch between the contract and installed features.
Typical cash-flow questions Reservation amount, staged deposits, developer financing, carrying costs during construction and closing expenses. Purchase or loan funding, immediate repairs or furnishings, current condominium charges and closing expenses.
Key evidence Registered consumer contract, project documents, authorizations, plans, delivery date, penalties, guarantees and disclosures. Title and lien documents, condominium regime, condition report, written inventory, tax and service status, deed and warranty terms.

These are decision axes, not guaranteed outcomes. The contract, development and seller control the details of any particular transaction.

How to compare the real cost

Start with two identical worksheets—one for the proposed preconstruction unit and one for the completed unit. Use written, dated estimates rather than a headline price or an advertised “presale discount.” The official sources cited here do not establish a current, market-wide price premium, discount, delay rate or total-cost difference between the two paths in Cancún.

Purchase and payment timing

  • Record the reservation, initial deposit, each construction installment, the final balance and the date each amount is due.
  • Identify the currency, exchange-rate method, receiving account and consequences of a late or failed payment.
  • For a completed unit, include the date funds must be available and whether a lender, trust bank or notary imposes additional timing conditions.
  • Ask whether any developer financing has interest, administration charges, opening fees, insurance or early-payment restrictions.

Closing and transaction expenses

Profeco advises buyers to ask about expenses separate from the sale price. NOM-247 requires residential contracts to disclose deed expenses and, where applicable, contributions such as taxes and duties, appraisal, administration, credit-opening and investigation expenses, and the service providers who receive them. Obtain a buyer-specific quote from the notary, lender, appraiser and bank fiduciary; a provider’s disclosure is not a substitute for those quotes.

Cost category Questions to put in writing Why the path may differ
Deposit and installments How much, when, to whom, in what currency and under what refund or cancellation rule? Preconstruction usually spreads payments; a ready unit may require faster funding.
Deed, taxes and duties Which party pays each item, and what does the notary’s current estimate include? The amount depends on the transaction, declared value and applicable authority, not on a generic percentage.
Appraisal and investigation Is an appraisal required by the lender or notary? Who orders and pays for title and document searches? A completed unit may be appraised for an immediate loan; a future unit may require different lender procedures.
Financing and administration List interest, credit-opening, administration, insurance and investigation charges. Developer or bank financing terms vary by project and borrower.
Fideicomiso What are establishment, annual administration, amendment, beneficiary and transfer charges? Foreign buyers in the restricted zone generally need the trust structure for residential use and enjoyment.
Condominium charges What is the current budget, dues, reserve contribution, special assessment history and unpaid balance? A completed building may have an operating history; a new project may rely on a provisional budget.
Fit-out and carrying costs Include furnishings, appliances, repairs, utilities, insurance and months of payments before occupancy. Preconstruction can create a construction-period carrying period; a ready unit can create immediate repair or furnishing costs.

Municipal information for condominium-regime authorization in Benito Juárez lists charges by category per exclusive unit and requires project-specific supporting documents. Those are administrative charges for authorizing or modifying a regime, not a full buyer closing-cost estimate. The municipality states a maximum response period of 20 business days on its service page; confirm the current standard and fee schedule for the specific filing.

What to verify before paying for a preconstruction condo

Profeco guidance says a provider should be able to show the complete construction project, relevant licenses or permits, plans, unit specifications, payment and delivery terms and contract protections. Treat a reservation form as a commitment, not as a harmless hold, and have an independent Mexican real-estate lawyer review every document before money leaves your account.

  1. Identify the provider and land. Confirm the legal name, authority of the person signing, ownership or development rights over the land and any restrictions or liens. Ask for evidence that the seller can convey the promised unit.
  2. Obtain the project file. Request permits and licenses, architectural, structural and installation plans, technical specifications, utility feasibility, project schedule, common-area description and the model or sample-unit specification. Confirm which documents are final and which remain conditional.
  3. Reconcile marketing with the contract. Attach the exact unit number, area and boundaries, orientation, view description, finishes, appliances, accessories, parking and storage rights, percentage or indiviso, amenities and common-area rights. A brochure or sales message should not be the only evidence of a promise.
  4. Set a precise delivery mechanism. The contract should state a delivery date or objectively defined milestone, permitted extensions, notice requirements, reciprocal penalties, cancellation or refund process and what happens if the unit or condominium regime is not ready.
  5. Check consumer-contract registration. Profeco’s 2025 guidance states: “Antes de firmar el contrato de compraventa, se debe verificar que esté registrado en la Profeco”. In context, verify the purchase contract’s registration before signing, not after a dispute begins.
  6. Define changes and substitutions. Require written consent for material changes to area, layout, finishes, equipment, views, amenities or common rights. Specify the remedy if an approved substitute is not equivalent.
  7. Protect the deposit. Identify the receiving account, conditions for release, evidence of construction progress and the exact refund route if a permit, financing, delivery or title condition fails. Do not assume a low entry price protects the deposit.
  8. Check condominium readiness. Ask whether the condominium regime is already authorized and registered or is a future condition. Benito Juárez’s authorization information refers to regime plans, service feasibility, property-tax status and completion documentation or bonds; determine which items exist for this project and who must obtain the rest.

What to inspect and document in a completed condo

A completed unit offers physical evidence, not a guarantee. Use an independent inspector or structural professional where appropriate, and make the inspection findings part of the negotiation and closing file.

Inside the unit

  • Check moisture, leaks, stains, cracks, balcony drainage, window seals, doors and cabinetry.
  • Operate electrical outlets, breakers, lighting, air-conditioning, plumbing fixtures, water pressure, hot-water equipment and drainage.
  • Test appliances, built-ins, smart systems and safety equipment that the contract says are included.
  • Measure rooms and compare finishes, fixtures and equipment with the signed inventory and specifications.
  • Record defects with photographs, dates and locations. Put each repair, responsible party and completion deadline in a signed document.

Building and surroundings

  • Inspect elevators, parking, storage, pools, gyms, roofs, corridors, fire systems, access controls, generators and water systems.
  • Visit at different times, if possible, to assess traffic, construction noise, nightlife, odors, heat and neighboring activity.
  • Ask the association for budgets, dues, reserve funding, special assessments, meeting minutes, rules and known major repairs.
  • Confirm the promised view, access and common-area rights are legally attached to the unit rather than merely shown in marketing.

Structure and technical records

Ask for structural plans or a structural-condition opinion. Profeco’s 2025 guidance discusses plans or a structural opinion, and NOM-247 requires relevant disclosures. If specified documentation for a used property is unavailable, the absence should be disclosed in the contract. Missing records are a negotiation and risk issue, not proof that the building is unsafe.

Title, condominium regime and payment-status checks for either path

For any unit, verify the seller’s identity and authority, title, liens, ownership limitations, unpaid property taxes, water and other service debts, and the process for delivering the deed. Ask for the registered condominium regime, unit boundaries, parking and storage rights, common areas, percentage or indiviso, association rules and current dues.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Have the notary or independent lawyer obtain current title and lien information from the relevant registry.
  2. Compare the registered owner and unit description with the seller, contract, plans and physical apartment.
  3. Request receipts or certificates showing property-tax and service payments through the agreed closing date.
  4. Confirm that alterations, terraces, parking spaces and storage areas are authorized and included in the legal description or governing documents.
  5. Review the regime authorization and association documentation, including any pending amendment, special assessment or common-area restriction.
  6. Make release of the final payment conditional on the agreed title, lien, tax, service and delivery documents.

Contract terms that deserve line-by-line attention

Read the Spanish contract and compare it with any translation, reservation agreement, annex, inventory and marketing material. Profeco’s consumer-rights guidance states that where bilingual versions differ, the Spanish contract governs. Have a qualified translator explain provisions you cannot read; do not rely on a salesperson’s oral interpretation.

  • Price and payment: total price, currency, taxes, payment means, dates, bank details and consequences of default.
  • Property definition: unit area, boundaries, indiviso, parking, storage, fixtures, finishes, appliances and common rights.
  • Delivery: objective date or milestone, inspection and acceptance process, utility status, punch-list procedure and delay remedies.
  • Reciprocal penalties: consequences for provider delay or nonperformance as well as buyer default.
  • Cancellation and refunds: events that trigger cancellation, timing, deductions, interest and the account to which funds return.
  • Warranty: covered components, duration, notice method, response times and exclusions.
  • Deed and possession: notary selection, title delivery, closing conditions, keys, access and risk of loss.
  • Dispute process: notice addresses, applicable law, consumer remedies and jurisdiction.

Foreign buyers: the Cancún restricted-zone framework

Cancún is within Mexico’s restricted coastal zone. The Secretaría de Relaciones Exteriores (SRE) explains that foreign nationals cannot hold direct title to land within 50 kilometers of the coast for residential purposes. Residential use and enjoyment is generally provided through a fideicomiso—a bank trust authorized by SRE and formalized in a public deed. The trust gives the foreign beneficiary use and enjoyment under the trust terms; it should not be described as direct ownership of coastal land.

SRE’s guidance states that permits for these trusts are intended to allow foreign individuals or entities to use and enjoy residential property in the restricted zone for a maximum term of 50 years. The same official page reports technical problems with the SIPAC27 processing system and longer-than-normal resolutions. Processing conditions can change, so confirm current timing, fees, beneficiary structure, renewal, transfer and termination implications directly with SRE, the bank and the notary before relying on a closing date.

Questions to ask about a fideicomiso

  • Who will be the trust beneficiary and what identification or corporate documents are required?
  • Which bank will act as trustee, what are establishment and annual administration charges, and when are they payable?
  • How will the trust handle resale, inheritance, beneficiary changes, amendments and eventual renewal?
  • Is the permit and trust deed a condition to closing, and what happens to the deposit if approval is delayed or denied?
  • Does the unit’s condominium documentation match the property described in the proposed trust deed?

Delivery, defect and delay risk: how the two paths differ

Preconstruction risk controls

You cannot eliminate execution risk before a building exists. Reduce it by verifying the developer’s authority and permits, checking construction milestones independently, requiring written specifications and remedies, and tying payment stages to objectively documented progress where the contract permits. A target date without a remedy, refund path or clear extension limit is not a dependable occupancy plan.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Completed-unit risk controls

Inspection shifts the risk from “will it be built?” to “what condition and legal status am I accepting?” A unit can look finished while concealing moisture, installation defects, unpaid charges or title problems. Make repairs, document delivery and clear title conditions precedent to closing, and retain evidence of the condition at handover.

Choosing based on your actual objective

Preconstruction may fit when

  • You can tolerate an uncertain occupancy date and have reserves for construction-period payments.
  • You value selecting a floor, orientation or finish that may not be available in completed inventory.
  • You are prepared to review permits, plans, contract remedies and the developer’s documentation with independent professionals.
  • Your financial plan works without assuming a discount, appreciation or guaranteed rental income.

Move-in-ready may fit when

  • You need a usable home on a defined schedule and can inspect before committing the final funds.
  • You prefer evidence of actual views, noise, finishes, utilities and association operations over renderings or promises.
  • You have budgeted for immediate repairs, furnishing, insurance and current condominium charges.
  • You are willing to make the purchase conditional on title, lien, tax, service and regime verification.

Neither path fits without more evidence when

  • The seller will not provide a complete contract, title information, permits or a clear payment schedule.
  • A reservation deposit is described as nonrefundable before the property, delivery date and cancellation terms are defined.
  • The price depends on an undocumented discount, a verbal promise or a generic closing-cost percentage.
  • The project or completed building lacks a credible explanation for missing condominium, structural, utility or tax records.

A practical decision process

  1. Set the use and deadline. Decide whether the condo is for personal occupancy, a future move, occasional use or another lawful purpose, and how much date uncertainty you can absorb.
  2. Build the two cost sheets. Include every payment and transaction category, plus a reserve for repairs, furnishing, delays and exchange-rate movement. Use quotes dated for the specific unit.
  3. Collect documents before negotiating price. For preconstruction, obtain project, permit, plan and contract materials. For a ready unit, obtain title, regime, condition, tax and service records.
  4. Use independent professionals. A Mexican real-estate lawyer should review title, liens, permits, contract and fideicomiso terms. An inspector or structural professional can assess a completed unit.
  5. Write the protections into the contract. Do not assume a brochure, email or verbal assurance will alter the signed Spanish agreement.
  6. Set closing conditions and a walk-through. Release final funds only after the agreed documents, repairs, inventory, possession and deed process are satisfied.
  7. Recheck volatile items immediately before signing. Confirm municipal charges and procedures, SRE processing status, lender terms, association balances and any tax or service certificates.

Questions to ask before signing

  • ¿Quieres comprar una casa o un departamento? State the intended use and ask which documents, restrictions and operating costs apply to this specific condo.
  • ¿Qué debo tener en cuenta antes de firmar? Ask for the registered Profeco contract, Spanish version, annexes, total price, all additional costs, penalties, cancellation terms, warranty and deed process.
  • What exactly is included in the price, and where is each inclusion documented?
  • What event allows the buyer to cancel and recover the deposit?
  • Which title, lien, tax, service and condominium documents must be delivered before closing?
  • For a foreign buyer, who is responsible for the SRE permit and trust deed, and what happens if processing exceeds the planned date?
  • Who pays each condominium charge, municipal fee, notary item, appraisal, financing expense and fideicomiso cost?

What the evidence does—and does not—establish

Official guidance supports a disciplined comparison of documents, condition, timing and total costs; it does not support a universal claim that one route costs less or carries less risk. No authoritative current statistic establishes a Cancún-wide preconstruction discount, completed-unit premium, average closing cost, delivery rate or delay rate for these two paths. A property-specific written estimate and independent verification are therefore more reliable than a market slogan.

Profeco, NOM-247, the Benito Juárez municipality and SRE describe disclosure, contract, condominium and restricted-zone requirements. They do not replace individualized legal, tax, engineering or financial advice. Have the relevant professionals confirm the current rules and documents for the unit, development, buyer nationality and intended use.
