Planning permission versus permitted development: what homeowners in England need to know

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

In England, permitted development is not a completely separate alternative to planning permission. It is a national grant of planning permission for defined types of work, provided the proposal meets every applicable limitation and condition. If your project falls outside those rules—or a local or property-specific restriction removes the right—you need a planning application. Either way, building regulations, listed-building controls, Party Wall Act duties and other consents may still apply.

This guide explains how to make that decision for a house in England. The dimensional rules in the government’s householder guidance do not apply in Scotland, Wales or Northern Ireland; homeowners there should use the relevant national planning system and contact their local planning authority.

Planning permission and permitted development: the difference in one table

Question Permitted development Planning application
What is it? A national grant of planning permission for specified development classes. A request to the local planning authority to decide whether the particular proposal should receive permission.
When can you use it? Only when the work fits the relevant statutory class and satisfies every limitation and condition. When permitted development rights do not cover the work, have been removed, or the proposal exceeds a permitted limit.
Is there always no paperwork? No. Some rights involve prior approval, neighbour consultation, a notification or other procedural step. Yes. You submit the prescribed application, plans and supporting information for a formal planning decision.
What does it decide? Planning lawfulness of the qualifying development, subject to the conditions attached to that class. Whether the authority grants permission, potentially with conditions.
What else might be needed? Building regulations approval, listed-building consent, Party Wall Act compliance and other permits can still be required. The same separate approvals can still be required; planning permission does not replace them.

The Ministry of Housing, Communities and Local Government describes permitted development rights as a national grant of planning permission that allows certain building works and changes of use without a planning application. The householder technical guidance explains that the rights allow proportionate improvement or extension of homes without an application. Neither statement means that every extension, loft conversion or garden building is automatically exempt.

What is permitted development?

Permitted development (PD) rights are written into the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended. The Order groups qualifying work into classes and grants permission in advance, subject to limits and conditions. You must comply with all the rules that apply to your proposal; meeting most of them is not enough.

The government’s householder guidance covers common work to a house and its curtilage. It identifies:

  • Class A: enlargement, improvement or alteration of a house, including many forms of extension.
  • Class B: additions or alterations to a roof, such as a dormer.
  • Class C: other roof alterations, including some rooflights.
  • Class D: porches.
  • Class E: buildings and other development within the curtilage of a house, which can include some outbuildings.
  • Separate classes covering hard surfaces, chimneys, flues, soil and vent pipes, and microwave antennas.

The class that sounds closest to your project is only the starting point. A scheme combining an extension, roof alteration and dormer may have to satisfy Classes A, C and B separately. Drawings that resemble an example in the guidance do not grant approval for your individual property.

How do I know if my extension is permitted development?

Use this sequence before commissioning construction or ordering materials. It is designed to expose the issues that most often change the answer.

1. Define the work accurately

Describe the proposal in construction terms rather than calling it simply “an extension”. Record whether it changes the footprint, adds a storey, alters the roof slope, creates a balcony or raised platform, changes access, removes a chimney, adds a porch, or places a building elsewhere in the garden. Include all connected work in one description. A project that combines several elements may need to satisfy several PD classes at the same time.

2. Confirm that the property is eligible

The detailed householder guidance applies to houses in England. Householder PD rights do not apply in the same way to flats, and they may not apply to certain dwellings created through specified Part 3 change-of-use permitted development classes. A building’s appearance as a “house” is not enough: check how it was created and how it is legally occupied.

3. Identify every relevant class and limitation

For each element, read the class description, its limitations and its conditions in the current legislation. Depending on the class, rules can control the position of the work, height, depth, width, roof form, materials, windows, balconies, hard-surface coverage, the proportion of the curtilage covered by buildings and the relationship to the original house.

Do not carry one familiar measurement from an online example into a different project. The statutory limits differ by class and can be affected by the property’s original dimensions, previous additions and location. For outbuildings, for example, the Order contains restrictions on height and location and excludes some structures and listed-building sites from the class.

4. Establish the “original house” and planning history

Many householder rules measure additions against the original dwelling or against earlier permitted development. Find the approved plans and decision notices for previous extensions, loft work and alterations. A previous extension may reduce what remains available under a class, and a condition attached to an earlier permission may remove a PD right entirely.

5. Check local and property-specific restrictions

Ask the local planning authority whether an Article 4 direction removes the relevant right in your area. Also check every planning permission for the property: a condition on the original or a later approval can restrict development that would otherwise be permitted nationally.

Protected locations can have additional limits. The practice guidance identifies conservation areas, Areas of Outstanding Natural Beauty (now commonly called National Landscapes), National Parks, the Broads and World Heritage Sites as article 2(3) land. The applicable restriction depends on the class and the designation, so confirm the current status and wording with the authority.

6. Separate planning from other approvals

PD only answers the planning-permission question. You may still need building regulations approval, listed-building consent, Party Wall Act procedures, highway permission, a drainage approval, or another specialist consent. A building-control approval does not make unauthorised planning work lawful, and a lawful planning certificate does not certify structural or fire safety.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Obtain certainty before starting

If the rules are clear and every condition is met, you may proceed on the basis of PD, subject to any required procedure. If there is doubt, ask the local planning authority for written advice or apply for a lawful development certificate for the proposed work. Do not rely solely on a builder’s verbal assurance.

Do I need planning permission to extend my house?

Possibly. Many domestic extensions are capable of falling within Class A, but the answer depends on the complete proposal, the property and its planning history. An extension can fail because of its size, position, height, roof design, materials, relationship to the original house, curtilage coverage or a local restriction. A design that would be permitted on one house may require an application on the next street.

When assessing an extension, document:

  • Whether it is single-storey or adds another storey.
  • Its location in relation to the front, side and rear elevations.
  • How far it projects and how wide and high it is.
  • Its roof shape, eaves and ridge treatment.
  • Whether it creates a balcony, veranda or raised platform.
  • The materials and external appearance.
  • How much of the garden or other curtilage would be covered by buildings.
  • Every previous extension or alteration that affects the original house.

Where any part does not satisfy Class A, the whole proposal may need a planning application, or the design may need to change. A planning application can also be the more practical route when the homeowner wants a design outside the PD envelope.

Can I build an extension without planning permission?

You can build without a conventional planning application only when the work has the benefit of PD and all required procedures have been completed. “No planning application” does not mean “no planning rules”. Starting construction first and checking later can expose you to enforcement.

Larger rear extensions and prior approval

Some larger single-storey rear extensions use a neighbour consultation and prior-approval process. This is still permitted development, but it is not a completely process-free route. The authority may need a notification and may assess the impact on adjoining neighbours under the applicable procedure. The exact dimensions, forms, consultation period and deadlines should be checked against the current legislation and your local authority’s instructions before work starts; do not rely on an old diagram or a historic web page.

When a planning application is the sensible route

Apply when the proposal exceeds a class limit, falls outside the eligible property type, is affected by an Article 4 direction or planning condition, or cannot be shown clearly to comply. An application also gives you a formal decision on the design rather than leaving future purchasers or lenders to interpret whether the work was lawful.

What the householder permitted development classes cover

Class or subject Typical work What to verify
Class A Enlargement, improvement or alteration of a house; many extensions. Location, dimensions, height, roof, materials, previous additions and all class conditions.
Class B Roof additions such as dormers. Position, roof volume, height, projection, windows and restrictions in protected locations.
Class C Other roof alterations, including some rooflights. Whether the work changes the roof plane or creates an enlargement and whether the class conditions are met.
Class D Porches. Position, size, height, access and any restrictions on the house.
Class E Some buildings and development within the house curtilage, including certain outbuildings. Use, location, height, curtilage coverage, listed-building status and exclusions for particular structures.
Other householder classes Hard surfaces, chimneys, flues, soil and vent pipes, and microwave antennas. The specific class, siting, appearance, technical limits and any protected-area restriction.

This table is a map, not a permission. The current text of the 2015 Order and any amendments control the legal result.

Restrictions that can remove or narrow permitted development

Article 4 directions

A local planning authority can make an Article 4 direction removing specified PD rights in a defined area. The direction may apply only to particular classes or types of work. Check the authority’s map, the direction itself and its effective date for your address.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Conditions on earlier permissions

A planning permission for the house may include a condition removing or limiting PD rights. Look at the original permission as well as approvals for later extensions, conversions or changes of use. The existence of a national right does not override a lawful site-specific condition.

Conservation areas and other protected land

Article 2(3) land can carry additional restrictions for some classes. Conservation areas, National Parks, National Landscapes, the Broads and World Heritage Sites are not interchangeable categories: identify the designation affecting your property and then read the class-specific rule.

Listed buildings and their curtilage

PD is not a substitute for listed-building consent. Listed buildings and structures within their curtilage can be subject to specific exclusions or limitations, and works affecting historic fabric may require consent even when a similar alteration to an unlisted house would be permitted. Contact the local planning authority’s conservation or listed-building service before preparing construction details.

Flats and unusual dwelling histories

Do not apply householder guidance written for houses to a flat, maisonette or dwelling created through a particular change-of-use right. The building’s title, planning history and physical form matter, especially where work affects shared structure or communal areas.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do I still need building regulations approval if my work is permitted development?

Usually, yes. Planning permission and building regulations answer different questions. Planning controls land use, appearance, location and the effect on neighbours. Building regulations address matters such as structural stability, fire safety, insulation, ventilation, drainage and accessibility. The government’s householder guidance expressly says PD rights do not remove building-regulations or Party Wall Act requirements.

Before construction, ask building control what application or notice is required for the specific work. Your designer or contractor should coordinate structural calculations, inspection stages and completion documentation. Keep the building-control completion certificate with the planning records; they prove different things.

Party Wall Act and boundary matters

If work affects a party wall, party structure, boundary wall or excavation near an adjoining owner’s building, the Party Wall etc. Act 1996 may require notice and a written award. This is a private-law process, not a planning decision. A neighbour’s agreement under the Party Wall Act does not legalise a planning breach.

Other consents

Depending on the site, you may also need listed-building consent, highway approval, a drainage or sewer connection approval, environmental permissions, or an agreement with a leaseholder, freeholder or management company. Identify these before the contract is signed.

What is a lawful development certificate?

A lawful development certificate (LDC) is a formal decision about planning-lawfulness. For proposed work, it asks the local planning authority to confirm that the described operations would be lawful under planning legislation, usually because they qualify as PD. You submit a precise description, plans and the information required by the authority. The decision relates to that proposal; changing the footprint, roof, materials or other material detail can change the answer.

An LDC is not planning permission for a design that falls outside PD, and it does not replace building regulations approval, listed-building consent, Party Wall Act compliance or other regimes. Its value is certainty: it creates an official record that can help with construction decisions, conveyancing and future questions about lawfulness.

If you apply, make the drawings unambiguous. Show the existing and proposed plans, elevations, levels, measurements, site boundaries, previous additions and the relationship to neighbouring properties. Ask the authority which form and evidence it requires.

What happens if you build without required permission?

The local planning authority can investigate suspected breaches and take enforcement action. An enforcement notice can require unauthorised work to be altered or undone. Enforcement risk can arise years after completion, including when a property is sold and a buyer’s solicitor asks for evidence that an extension or loft conversion was lawful.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not assume that the passage of time automatically solves every problem, or that paying building-control fees creates planning immunity. If work has already started and you are unsure, stop the affected construction where safe, gather the plans and permissions, and obtain professional planning advice. The authority may explain whether a retrospective application or certificate route is available, but there is no guarantee of approval.

How to apply when permitted development does not cover the work

  1. Confirm the correct application type. The Planning Portal’s householder application covers work such as extensions, conservatories, loft conversions, dormers, garages, outbuildings, pools, walls, fences, access, porches and satellite dishes when permission is required. If you are unsure which form applies, ask the local authority.
  2. Prepare accurate drawings. Include location and block plans, existing and proposed floor plans and elevations, site boundaries, levels, materials and the relationship to neighbours. The authority may request additional information.
  3. Check local validation requirements. Councils can publish local lists specifying documents, statements or surveys needed to validate an application.
  4. Submit and monitor the application. The authority will consult as required and assess the proposal against the development plan and other material considerations. Respond promptly to requests for clarification.
  5. Read every condition. A permission may control materials, drainage, windows, construction timing or future alterations. Discharging a condition can require a separate submission before work begins.

Application fees, processing periods and validation requirements change. Confirm the current position with the local planning authority rather than relying on an old guide.

Common homeowner scenarios

“My neighbour has the same extension, so mine must be allowed.”

Not necessarily. The other property may have planning permission, an LDC, a different planning history or different measurements. Compare the legal documents and site conditions, not just the appearance.

“The builder says it is permitted development.”

Treat that as a starting opinion, not a formal decision. Ask the builder to identify the relevant class and provide drawings showing compliance with every limitation. Where the consequences of error are significant, obtain an LDC or written advice from the local authority.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“It is only a garden room, so no permission is needed.”

A garden building may fall within Class E, but its use, location, height, curtilage coverage and the property’s designation all matter. A building used as separate living accommodation or affected by listed-building restrictions needs particularly careful assessment.

“I am only replacing the roof.”

Routine repair may be different from an alteration that changes the roof shape, volume, height or appearance. Rooflights, dormers and other additions can fall under different classes. Describe the work fully before deciding that no application is needed.

“Permitted development means I can ignore my lease or mortgage.”

Planning rights do not override a lease, freeholder covenant, mortgage condition, estate management rule or insurance requirement. Check those private obligations separately.

When should you use a planning consultant or residential architect?

Professional help is useful where the proposal combines several classes, the planning history is incomplete, the property is listed or in a protected area, an Article 4 direction may apply, or the design is close to a statutory limit. A consultant or residential architect can prepare drawings, identify the consents in parallel and support an LDC or planning application. Choose someone who will identify the exact legal basis for the advice and state what remains outside their scope, such as structural design or Party Wall Act representation.

Final pre-construction checklist

  • Is the property a house in England, rather than a flat or a dwelling with a special change-of-use history?
  • Have you described every element of the project, including roof work, hard surfaces, access and outbuildings?
  • Have you identified every relevant PD class and checked all of its limitations and conditions in the current legislation?
  • Have you measured against the correct original house and accounted for earlier additions?
  • Have you checked Article 4 directions, protected-area status and every condition on previous planning permissions?
  • Is the property listed, or within the curtilage of a listed building?
  • Does a prior-approval, neighbour-consultation or notification procedure apply?
  • Have you arranged building-regulations advice and checked Party Wall Act duties?
  • Do you need listed-building consent, highway, drainage, leaseholder or another specialist approval?
  • Would a lawful development certificate provide useful certainty before work or sale?
  • Do your contract, drawings and schedule of works match the proposal that was assessed?

The detailed England householder technical guidance was last updated on 10 September 2019, while the Planning Inspectorate’s lawful-development-certificate appeals procedure was updated on 20 May 2026. Because the General Permitted Development Order is amended, confirm the current class wording, measurements, prior-approval procedure and local restrictions immediately before relying on PD. The local planning authority is the right place to resolve an address-specific question.
