What is planned at 538 Fitzgerald Street?
The proposal is to demolish two existing grouped dwellings and build a four-storey, 15-dwelling apartment building with basement parking. The City of Vincent’s planning record identifies the site as 538 Fitzgerald Street, North Perth. This is a residential development, not the separate mixed-use proposal at 367–373 Fitzgerald Street and 103 Alma Road.
How did the approval reach the latest decision?
The City’s application record says the original proposal was approved in April 2014 and reconsidered in January 2015. A separate amendment lodged in 2017 was approved in May 2018. On 22 May 2024, the Metro Inner Development Assessment Panel (DAP) approved another amendment and an extension to the existing approval. The responsible-authority report valued the proposed amendment at $3.5 million.
The 2024 news coverage called the decision a “fourth extension,” referring to the longer sequence of extensions. That phrase is not the formal description of the May 2024 decision. The official minutes describe an amendment and further extension to the existing approval.

What changes were included in the 2024 amendment?
The planning material describes revisions to the approved scheme, not confirmation that those features have been built. The changes included:
- Layout and storeroom revisions, along with additional landscaping and deep-soil areas.
- Balcony doors designed to allow balconies to be enclosed, plus changes to the roof and basement.
- A second bathroom in eight apartments.
- Eight apartments reclassified as “small dwellings” and three as “gold level” universally designed apartments.
The responsible-authority report concluded that the amended proposal would continue to provide an appropriate planning outcome consistent with the local planning framework.

How long is the approval valid?
The Metro Inner DAP minutes state that the approval is valid for four years from 22 May 2024, through 22 May 2028. PerthNow’s contemporaneous report gives a different end date, saying the extension ran until May 2026. For the formal validity period, the minutes are the primary decision record.
What concerns were raised during consultation?
PerthNow reported that seven submissions were received, four of which raised concerns about the extension, building height, overdevelopment, privacy or design. Those figures and descriptions come from the news account; the official agenda contains the planning material and assessment for the decision.

Planning Solutions’ presentation to the DAP said Earlmist Pty Ltd acquired the project in December 2023 and had the funds and commitment to proceed. The presentation attributed earlier delays to financial non-viability, the COVID-19 pandemic and the 2021 bankruptcy of builder Pindan Constructions on another project. These were the proponent’s explanations, not independent findings.

That is a claim in sales material, not an official progress certification or a guaranteed completion date. No completion date should be treated as confirmed on the basis of the planning approval alone.
