Modular home warranties: what they cover and who handles claims if a builder closes

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The written warranty controls. It identifies covered defects, coverage periods, exclusions, notice deadlines and the party that must respond. If a modular-home builder closes, there is no single nationwide agency or company that automatically takes over every warranty claim. Start by confirming that the home is modular rather than HUD-code manufactured, then find the signed warranty and closing documents and contact the warrantor or administrator named in them.

A builder’s closure can make a claim harder to pursue, but it does not by itself prove that the warranty ended or that another company assumed the obligation. State law, a recovery fund, a bond, or a third-party warranty contract may provide another route, depending on the home’s location and documents.

What a modular-home warranty usually covers

A new-home warranty is a contract with defined coverage, not a promise that every defect will be repaired forever. The Federal Trade Commission (FTC) describes builder warranties as limited protection for workmanship and materials on specified components. The exact booklet or certificate for your home determines whether a defect is covered, how long coverage lasts and how a claim must be submitted.

Common coverage periods are examples, not a universal schedule

FTC consumer guidance gives these examples of periods found in some builder warranties:

Category Example period in FTC guidance What the figure means
Workmanship and materials on many components One year A general example of a limited period; your contract may use different dates, definitions or exclusions.
Heating, ventilation and air-conditioning, plumbing, and electrical systems Two years An example for specified systems, not a guarantee that every system defect receives two years of coverage.
Major structural defects Up to 10 years in some warranties A maximum found in some programs or contracts, usually with a narrow definition of “major structural defect.”

Coverage normally starts on the date stated in the warranty, which may be closing, title transfer, substantial completion or another defined event. A defect reported after a deadline can be denied even if the underlying problem began earlier, so check both the coverage term and the notice rule.

Items that may be excluded

Read the exclusions and definitions as closely as the covered-items list. Builder warranties often exclude appliances and components that have their own manufacturer warranty. The FTC also notes that certain small cracks may be outside coverage, as may consequential costs such as temporary housing. A warranty may require the homeowner to maintain systems, use specified materials or allow reasonable access before a repair obligation applies.

“Major structural defect” is usually narrower than any visible crack or movement. It may require damage to a load-bearing element that threatens structural integrity, while cosmetic settlement, ordinary wear, improper maintenance or damage caused after completion may be excluded. Do not assume that a serious-looking symptom automatically meets the contract’s definition.

Builder warranties and paid home-service contracts are different

A builder warranty is tied to the construction contract or a separate new-home warranty certificate. A paid home-service contract is a service agreement purchased for an additional fee, commonly covering selected appliances or systems subject to a service-call fee, caps and exclusions. The FTC distinguishes these products because a service contract can overlap with a manufacturer warranty and is not automatically a substitute for construction-defect coverage.

If you have both documents, treat them as separate contracts. The service-contract company is not presumed to administer the builder’s workmanship or structural obligations. Use the claim procedure for the specific product or defect, and do not cancel or ignore one contract because you found the other.

First determine whether the home is modular or manufactured

“Modular” and “manufactured” describe different legal and regulatory categories. A modular home is generally built in sections to a state or local building code and installed on a permanent foundation. A HUD-code manufactured home is built under the federal Manufactured Home Construction and Safety Standards and is handled through a different regulatory framework. A home can be factory-built without being a HUD-code manufactured home.

Documents that can establish the classification

  • The purchase or construction contract and closing package.
  • The certificate, warranty booklet and any manufacturer documents.
  • Serial-number plates, HUD labels or other identification affixed to the home.
  • The title, permit file and state or local property records.

Do not use HUD’s guidance for a manufactured-home retailer or manufacturer as though it were a rule for every modular residence. HUD’s described federal protections concern manufactured homes. A modular-home claim usually turns on the construction contract, the written warranty, state law and any state new-home program.

Who may handle a claim after the builder closes?

There is no automatic national fallback handler for modular-home warranties. Identify the warrantor first, then follow the contract’s notice and escalation terms. The possible routes are different in authority and eligibility:

Possible handler When it may apply What to verify
The builder or its warranty department The builder is named as warrantor and still has an operating entity or designated claims contact. Notice address, response deadline, required forms and whether the builder remains legally active.
A third-party warranty company or administrator The builder purchased a warranty from an independent issuer or administrator. The certificate or booklet naming the issuer, administrator, claim address, deadline and dispute process.
A state program, recovery fund or agency State law creates a guaranty, security fund, bond or complaint process that covers the home and circumstances. State, eligibility, filing window, proof of builder responsibility and any required prior notice.
A state administrative agency for manufactured homes The home is confirmed as HUD-code manufactured and the retailer or manufacturer is out of business. The state agency’s current procedure, bonding or recovery-fund rules and any authorization requirement.

A builder’s closure may leave an insolvent estate, dissolved company or successor entity. None of those possibilities establishes coverage by itself. The contract and applicable law determine whether a claim can be presented to a third party, an estate, a bond or a state fund.

New Jersey illustrates why location matters

New Jersey’s new-home warranty program expressly includes modular residences. Under that program, the builder is the warrantor. The State New Home Warranty Security Fund can cover the cost of repairs in specified circumstances when the builder has been found responsible but does not make the repairs. That is a New Jersey example, not a nationwide entitlement; other states use different programs, definitions, deadlines or no comparable fund.

Step-by-step: making a claim when the builder is unavailable

  1. Confirm the home category. Compare the contract, title, labels, permits and state records. Record whether the home is identified as modular or HUD-code manufactured and note the state where it is installed.
  2. Assemble every warranty document. Locate the signed warranty booklet or certificate, construction agreement, closing package, change orders, inspection reports and separate manufacturer warranties. Write down the warrantor, administrator, start date, expiration date, covered component, exclusions, notice deadline and dispute clause.
  3. Document the condition before altering it. Take dated photographs and video, note when the symptom began, record weather or operating conditions that may be relevant, and keep inspection and repair estimates. Preserve failed parts when practical.
  4. Send notice exactly as required. Use the address, portal, form, certified-mail method or other channel specified in the warranty. Describe the defect, location, dates and requested inspection. Keep a complete copy and proof of delivery.
  5. Contact the named administrator or issuer. If the builder’s phone and website are inactive, use the certificate’s administrator or claims address. Ask in writing whether the warranty remains in force, who is assigned to inspect and what additional documents are required.
  6. Ask the state agency about applicable programs. Contact the state housing, building, manufactured-housing or warranty-program office. Provide the home classification, builder name, installation address and closure information, and ask about a fund, bond, guaranty, complaint process and filing deadline.
  7. Wait for repair authorization when the contract requires it. Do not begin covered work merely because the builder is unreachable. Obtain written authorization or a written reimbursement agreement before hiring a contractor unless emergency action is necessary to prevent imminent damage.
  8. Escalate a denial or nonresponse. Request the denial and its contractual basis in writing. Follow mediation, arbitration or appeal steps in the warranty, and ask the state agency which consumer complaint route applies. Keep a timeline of every call, email, inspection and deadline.

Repair authorization, emergencies and reimbursement

Many warranties allow the warrantor to inspect, select a contractor or propose a repair before you incur costs. Starting work can destroy evidence or give the issuer a reason to dispute causation and price. A written authorization should identify the approved scope, contractor, payment method and any deductible or cap.

If a condition threatens immediate injury or major property damage, take reasonable temporary steps to make the home safe and prevent worsening. Photograph the condition first when possible, keep receipts, and notify the warrantor and relevant agency promptly. Emergency mitigation is not the same as authorization for a full replacement; ask in writing what permanent work will be reimbursed.

Common claim problems and practical responses

The warranty booklet cannot be found

Request a copy from the closing attorney, lender, title company, builder’s registered agent, installer or the state program that handled the home. Search for a certificate number in closing emails and inspection files. Do not rely on a sales brochure or a generic “one-two-ten” description as a substitute for the signed terms.

The builder says the manufacturer is responsible

Separate the defect by component and contract. An appliance or packaged system may have a manufacturer warranty, while installation, framing, flashing or other workmanship remains governed by the builder warranty. Ask each party to identify the exact clause and send the notice required by that clause.

The administrator says the builder’s closure cancels coverage

Ask for the contract language supporting that position. A closure can affect performance and solvency, but it does not automatically prove that all warranty rights vanished or that the administrator assumed them. Check whether the warranty contains a continuation, insolvency, insurance or state-program provision.

The claim is rejected as “maintenance”

Request the inspection findings and the definition used. Provide maintenance logs, service invoices, photographs showing the timing of the defect and evidence that the condition existed within the coverage period. An independent home inspector or structural engineer can document observed conditions, but that professional does not decide contractual coverage.

Questions to ask every agency or warranty administrator

  • Is this home classified as modular or HUD-code manufactured in your records?
  • Who is the legal warrantor, and is there a separate administrator or insurer?
  • What is the coverage start date and the deadline for this type of defect?
  • Which notice method and documents are mandatory?
  • Must the issuer inspect or authorize work before repairs begin?
  • Is there a state fund, bond, guaranty or complaint process for a closed builder?
  • Does the warranty require mediation or arbitration before court action?
  • What limitation period or filing window applies?

Bottom line for a closed modular-home builder

Use the signed warranty and the home’s legal classification as your map. A modular-home warranty may cover defined workmanship, systems or structural defects for different periods, but the FTC’s one-year, two-year and up-to-10-year figures are only examples. The builder’s closure does not name a replacement handler. The responsible party may be the builder, a documented third-party administrator or a state program, while HUD’s state-agency route is for confirmed manufactured homes. Preserve evidence, give written notice, obtain repair authorization and ask the relevant state office about funds, bonds and dispute procedures before paying for permanent work.
