Yes, a metro agency can acquire private property for a transit project, but it must follow a defined process and pay just compensation. For a federally assisted project, the baseline is the Uniform Relocation Assistance and Real Property Acquisition Policies Act (the Uniform Act), its implementing rules in 49 CFR Part 24, and the applicable state and local law. The agency normally identifies the property interest it needs, orders an appraisal, makes a written offer, negotiates with the owner, and uses eminent domain only if an agreement cannot be reached.
There is no national flat rate, per-square-foot amount, or guaranteed percentage for a taking. Your outcome depends on the interest acquired, the property’s fair-market value and highest-and-best use, any damage or benefit to the remainder, relocation eligibility, and the law governing the particular project.

Which rules govern a metro property acquisition?
When federal assistance is involved, transit agencies generally follow the Uniform Act and 49 CFR Part 24. The Federal Transit Administration (FTA) says recipients must treat owners and displaced people “fairly, consistently, and equitably.” State statutes, county or city procedures, and project-specific policies still control many details, including valuation disputes, condemnation steps, tax treatment, filing deadlines, and appeal rights.

That means federal guidance provides an important floor, not a complete answer for every parcel. Ask the project sponsor which federal funding rules apply and identify the state eminent-domain statute before accepting money or signing a deed, easement, release, or settlement.

Can the metro take my property?
A public agency may acquire private property for a public transportation use through a negotiated purchase or, when necessary, eminent domain. The agency cannot simply enter and take possession because a project is planned. It must identify the legal interest required, establish compensation, and follow the applicable acquisition and condemnation procedure.
The interest may be less than a full purchase
“Taking” does not always mean losing the entire parcel. A project may require:
- Fee title: ownership of all or part of the land.
- Permanent easement: a continuing right for tracks, utilities, drainage, access, construction, or maintenance while you retain some ownership.
- Temporary construction easement: a time-limited right to stage equipment, excavate, or build.
- Partial taking: a strip, corner, parking area, building area, or other portion of the parcel.
- Access or use changes: a project change that removes, relocates, or limits driveway access, circulation, parking, or other property rights.
FTA treats an easement as a real-estate acquisition. The documents should state exactly what the agency may do, for how long, and what rights remain with you.

How the acquisition process works
The sequence below is typical for a federally assisted transit project, although local law may add notices, hearings, board approvals, or different deadlines.
- Project and right-of-way definition. The sponsor maps the corridor, identifies the parcel and legal description, and determines the property interest needed. Request the plan sheet, parcel map, and a written description of every right the agency wants.
- Appraisal and inspection. The agency obtains an appraisal before negotiations. Under Uniform Act policy, the owner or a designated representative should have an opportunity to accompany the appraiser during the inspection. Be present if possible, point out improvements and access conditions, and preserve photographs of the property before construction activity begins.
- Written offer. The approved appraisal forms the basis of the offer of just compensation. Los Angeles County Metropolitan Transportation Authority guidance describes an offer, time for the owner to obtain an independent appraisal, and an opportunity to discuss value. A federally compliant offer cannot be below the approved fair-market valuation after allowable damages or benefits to the remainder are considered.
- Negotiation and settlement. Ask questions, provide factual corrections, and submit a counterproposal supported by evidence. A justified settlement may be higher than the initial offer; FTA guidance says an agency may not reduce a purchase price to an arbitrary percentage of an appraisal.
- Condemnation if needed. If negotiations fail, the agency may file an eminent-domain case under state law. Some agencies require a governing-board authorization before filing; Los Angeles County Metropolitan Transportation Authority identifies that approval in its process.
- Payment and possession. Federal policy says an owner should not surrender possession before receiving the agreed price or a court deposit of at least the agency’s approved appraisal or the condemnation award. The condemnation order and state procedure determine how disputed funds and possession are handled.
What can compensation include?
The central payment is just compensation for the property interest acquired, ordinarily tied to fair-market value as of the applicable valuation date. A partial taking requires more than pricing the land strip alone: the appraisal should analyze allowable damage to, or benefit of, the remaining property.
| Acquisition situation | What the valuation usually examines | What is not established nationally |
|---|---|---|
| Full parcel purchase | Fair-market value of the entire parcel, permitted use, improvements, and the valuation date. | No universal percentage, price per square foot, or tax result. |
| Partial taking | Value of the part acquired plus allowable damages or benefits to the remainder, including changes to access, parking, utility function, or site usability when recognized by governing law. | The exact damage formula and compensable items depend on state and project rules. |
| Permanent easement | Value of the rights transferred, restrictions imposed, and effect on the owner’s retained interest. | There is no standard easement percentage that applies everywhere. |
| Temporary construction easement | The value of the temporary use and any legally compensable physical or operational impact. | Duration, payment method, and additional damages vary by the easement terms and local law. |
| Access or circulation change | The property’s before-and-after utility and any recognized diminution in value. | Whether a particular access change is compensable is jurisdiction-specific. |
Separate relocation benefits may be available to a displaced owner-occupant, tenant, household, or business. Those benefits are not a substitute for the value of the property interest acquired. Eligibility, payment categories, replacement-site standards, and deadlines depend on federal, state, and project rules.

Why the number may differ from your tax assessment
A property-tax assessment is not automatically the acquisition value. The agency’s appraisal considers market evidence, the legally permissible highest and best use, the rights being acquired, and the effect on the remainder. Ask for the valuation date, comparable sales, land-use assumptions, and any special assumptions used by the appraiser.
How to review or challenge the appraisal
You are not required to accept the first number without analysis. You can discuss the valuation with the agency and obtain an independent appraisal. A useful review tests the assumptions rather than arguing only that the offer “feels low.”
Request these documents in writing
- Parcel map and complete legal description.
- Identification of the interest: fee, partial taking, permanent easement, temporary easement, or access change.
- Approved appraisal, valuation date, comparable sales, zoning and highest-and-best-use analysis.
- Calculation of damages to, or benefits for, the remainder.
- Any special assumptions, conditions, plans, or environmental facts that affect value.
- Written offer, response deadline, and the agency’s negotiation contact.
- Relocation eligibility rules, advisory contact, moving-cost procedure, and comparable replacement sites.
Compare an offer and an independent appraisal on the same axes
| Decision axis | Questions to ask |
|---|---|
| Property interest | Do the deed, easement, plans, and appraisal describe the same area and rights? |
| Valuation date | Is the date appropriate for the project and consistent with the governing law? |
| Highest and best use | Did the analysis use legally permitted, physically possible, financially feasible use? |
| Comparable sales | Are the sales nearby, recent, similar in size and use, and adjusted transparently? |
| Remainder damages or benefits | Does the after-value reflect lost access, parking, shape, visibility, utilities, or construction restrictions? |
| Relocation | Are moving costs, replacement-site needs, and eligibility evaluated separately from real-estate value? |
| Terms | What are the possession date, construction obligations, releases, waivers, and payment conditions? |
Give the agency factual corrections promptly and keep proof: surveys, permits, leases, rent rolls, repair estimates, tax records, photographs, business-interruption records, and correspondence. An independent appraiser familiar with public acquisitions can test the valuation; a licensed eminent-domain lawyer can explain rights, deadlines, and release language in your jurisdiction.

What happens if I refuse the offer?
Refusing an offer does not automatically stop the project. It generally moves the matter into continued negotiation or an eminent-domain case. Do not ignore a notice, summons, appraisal exchange deadline, or court filing. Missing a statutory deadline can limit your ability to contest valuation or recover costs.
In condemnation, the agency asks a court to determine its authority to acquire the interest and the compensation owed. State law controls the pleadings, valuation date, right to a jury, interest, attorney-fee rules, and distribution of deposited funds. Under the federal acquisition policy quoted in 42 U.S.C. §4651(4), “No owner shall be required to surrender possession of real property before the head of the Federal agency concerned pays the agreed purchase price, or deposits with the court … an amount not less than the agency’s approved appraisal of the fair market value of such property, or the amount of the award of compensation in the condemnation proceeding for such property.”
That protection does not mean every dispute ends with the agency’s appraisal being paid to you permanently. It addresses possession and the required payment or deposit; the final award and any additional amounts are determined under the applicable condemnation process.

Do I receive relocation money?
Potentially. Relocation assistance is separate from the acquisition price and may cover eligible owners, tenants, households, and businesses displaced by the project. FTA environmental guidance says displacement analysis should identify the characteristics and needs of people and businesses, comparable replacement dwellings and sites, likely relocation problems, and mitigation measures.
What to confirm before moving
- Whether you are an eligible owner-occupant, tenant, household, or business.
- Which moving expenses, replacement costs, searching expenses, or business-related items are reimbursable.
- Whether you must obtain agency approval before incurring a cost.
- Required receipts, inventories, applications, and deadlines.
- Comparable replacement housing or commercial sites and how affordability is measured.
- Whether an appeal is available if the agency denies eligibility or sets an amount.
How much notice do I have?
Notice is project-specific. Los Angeles County Metropolitan Transportation Authority’s owner-facing guidance states that eligible owner-occupants or tenants receive at least 90 days’ written notice to move. That is a jurisdiction- and process-specific figure, not a universal national deadline. A local project may provide longer notice or additional protections, so obtain the written relocation schedule before making a commitment.
Owner checklist: what to do now
- Identify the project contact. Get the real-estate representative’s name, phone number, email, and the state statute or local procedure being used.
- Define the taking. Mark the requested area on your own copy of the plan and determine whether the proposal affects buildings, parking, access, utilities, signage, landscaping, leases, or business operations.
- Preserve records. Keep your deed, title documents, leases, permits, plans, photographs, repair estimates, tax records, rent rolls, business records, and every letter or email.
- Attend the inspection. Accompany the appraiser or appoint a representative, and identify features that affect use and value.
- Request the appraisal package. Confirm the valuation date, comparables, highest-and-best-use assumptions, special assumptions, and remainder analysis.
- Separate compensation categories. Track real-estate value, damages to the remainder, temporary-use payments, relocation benefits, and business or household costs independently.
- Set a response plan. Calendar the offer deadline, relocation applications, inspection dates, condemnation deadlines, and any appeal period.
- Get specialized advice. Consider an independent public-acquisition appraiser and a licensed eminent-domain or property-rights attorney before signing any conveyance or release.
Common mistakes that reduce an owner’s leverage
- Signing an easement without checking its duration, access rights, restoration duties, insurance, and construction limits.
- Assuming the tax assessment or a neighbor’s sale proves your value without adjusting for use, timing, size, and rights transferred.
- Discussing only the land area and overlooking access, parking, circulation, visibility, tenant impacts, or remainder damages.
- Moving, closing a business, or disposing of fixtures before documenting conditions and confirming relocation procedures.
- Missing a written deadline because negotiations are continuing informally.
- Accepting a settlement or release without understanding whether it waives future claims, relocation benefits, interest, fees, or construction damage.
The practical bottom line for an affected owner
A metro project may acquire all or part of your property, including an easement, but a federally assisted acquisition normally requires an appraisal, a written offer of just compensation, good-faith negotiation, and payment or a court deposit before possession is surrendered. The amount cannot be predicted from a national formula. Check the exact property interest, valuation assumptions, remainder effects, relocation eligibility, notice period, and state procedure before deciding whether to accept, counter, or defend the case.
