MCD Building Approval vs. Regularisation: What Homeowners Need to Know

MCD treats building-plan sanction and regularisation as separate services. The right route depends on the property, colony, work history, and current policy—not just an online record or the existence of an application service.

Building-plan sanction and regularisation are separate MCD routes. Sanction is the route to have a plan processed before relevant construction; regularisation is an application route concerning existing work. Neither an old approval nor the existence of an online regularisation service establishes that a particular property or alteration qualifies. The right next step depends on the property’s exact location, colony classification, plan and construction history, and the current policy that applies. Confirm those facts with the Municipal Corporation of Delhi (MCD) or a qualified building professional before choosing a route.

How building approval and regularisation differ

MCD lists “Building Plan Sanction (EODB)” and “Apply for Regularization” as distinct services on its service portal. The distinction is practical: one concerns processing a building plan for proposed work, while the other is an application concerning construction that already exists. The service listing does not say that every existing structure is eligible for regularisation, or that an application will be approved.

In other words, the first question is not simply, “Do I have a building?” It is: “What work is planned or already there, what records exist for this property, and which current MCD policy and process apply to this exact location and work?” The title of a form, a portal menu or a general description of a policy cannot answer those property-specific questions on its own.

Question Building-plan sanction Regularisation
What is the route for? Processing a building plan under applicable requirements before undertaking the relevant construction. Applying under an applicable policy for existing construction or work.
When should a homeowner consider it? When planning relevant new construction or alterations for which plan sanction is required. When construction or alterations already exist and the owner needs to determine whether a current regularisation policy covers them.
Does the route guarantee approval? No. A service listing or existing online record does not establish that the particular application complies. No. The existence of the service does not mean every property or type of work qualifies.
What determines the applicable process? The property facts and applicable rules, policies, forms, and clearances. The property facts and whether a current policy applies to the location and work.

This is a decision framework, not a universal legal test. MCD’s Town Planning and Online Building Plan Approval page brings together multiple policy notifications, colony lists, Unified Building Bye-Laws materials, amendments, forms, and area-related resources. The exact colony and property circumstances therefore matter more than the general label “unauthorised construction.”

The same general question can lead to different checks for two homes that appear similar. One may have a prior sanctioned plan that needs to be compared with the building as it stands; another may have no plan history readily available. A property’s colony classification or location may also affect which published materials are relevant. No single eligibility formula resolves every case, so treat the comparison as a way to identify questions for MCD—not as a decision that can be made from a headline or a short online description.

Work out which route to investigate first

If the work is proposed

Start by checking the applicable building-plan requirements before work begins. Identify what is proposed, where the property is, and whether any earlier sanctioned plan or completion record exists. Ask MCD or a qualified architect to confirm whether the proposed work needs plan sanction and which current forms, supporting material, or clearances apply. Do not treat an old plan as permission for later additions or changes without verifying its scope and status.

For this preliminary check, describe the planned work plainly and separately from the current building. A new proposal should not be confused with an existing alteration simply because both relate to the same property. Provide the available plan history and ask the relevant authority or professional to explain which current route and materials apply. The MCD service listing identifies a sanction service, but does not itself specify the requirements for every kind of work.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the work already exists

Check whether a current MCD regularisation policy covers the property and the specific work. An online application route is not an eligibility decision. The Town Planning page’s policy notifications and colony-related materials should be checked against the property’s location and facts, and the responsible MCD office or a qualified professional should confirm the route before an application is made.

Do not assume that the word “regularisation” means that every existing addition can be brought into compliance through that route. The existence of an application service establishes that MCD offers a separate path to apply; it does not establish eligibility for a particular structure, guarantee a favourable decision, or settle what supporting papers are needed. The relevant current policy and the facts of the property and work remain central.

If there is both existing and proposed work

Separate the two issues rather than assuming one application resolves both. Establish what was previously sanctioned, what was actually built or altered, and what is now proposed. Ask MCD or a qualified professional whether existing work and proposed work need different treatment under current rules and policy.

This distinction is useful even before any form is selected. A clear account can identify which part of the case concerns a proposed plan and which part concerns an already completed change. If the two are mixed together, it may be harder to compare the physical layout with the records or to ask a precise question about the right process. Do not infer that filing for one route automatically covers the other; confirm that point for the specific property.

  • One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
  • Power drill cordless with 1/2" single sleeve ratcheting chuck provides tight bit gripping strength, making bit changes faster and more secure
  • Exact location: the full property address and colony name, so the relevant area and colony materials can be checked.
  • Ownership and authority papers: records showing who owns the property and who is authorised to act for it, if someone else is handling the matter.
  • Plan and completion history: any sanctioned building plan, permit, completion or occupancy-cum-completion record, and prior applications or decisions.
  • Current layout: a clear account of the building as it stands now, including additions or alterations, compared with any plan or approval on file.
  • Construction timeline: a concise history of when the original construction and later changes took place, to the extent known.
  • Proposed work, if any: a description of what the owner intends to build or change, kept distinct from existing construction.

These facts help turn a broad enquiry into a property-specific one. For example, “Which route is right for my house?” is difficult to assess without knowing the colony, what work is involved and whether any plan or completion record exists. A concise construction history and a comparison of the actual layout with available records can help identify the points that need confirmation. This preparation list is editorial guidance based on the structure of MCD’s published services and policy resources; it is not represented as MCD’s official checklist.

Use these facts to examine the applicable materials on the MCD Town Planning page and identify the relevant service through the MCD service portal. Then ask the relevant authority or a qualified architect to confirm the current route and its actual document requirements. The portals’ service and policy structure does not establish one checklist that applies to every homeowner.

Check the location, policy and route—not just the service name

MCD’s Town Planning resources include policy notifications, colony lists, Unified Building Bye-Laws for Delhi, 2016 materials and amendments, forms, and area-related resources. The variety of materials is a reason to check which ones apply, not a reason to assume that one notice or one form covers every property. Start with the exact address and colony name; then use the relevant published resources to identify the policy, rules and process that may be pertinent.

When comparing the routes, consider five questions: Is the work proposed or already completed? Is there a prior sanctioned plan or completion record? What colony or land-use category applies to the property? Does the current policy cover the location and the particular work? What forms, clearances and charges are currently published for that route? These questions help organise the investigation, but the reviewed MCD materials do not offer a universal scoring system or a guaranteed answer for an unspecified home.

Keep the date and version of any policy or form you consult. MCD’s portal and policy materials can change, and the fact that a resource was available on a particular date does not establish that its details remain current. If you are unsure whether a notification, colony list or form applies, ask MCD or a qualified professional to confirm before relying on it. Do not select a process solely because its label sounds close to your situation.

Verify any existing approval or application record

Do not assume that an online record, permit, or application belongs to the current owner, covers the present building, or remains valid for the work now on site. Compare the property identity and plan details with the address, ownership or authorisation records, and actual layout. If a professional or representative filed an application, confirm that the owner authorised it and that the submitted material is accurate and current.

It is useful to distinguish several records that can otherwise be blurred together: an application record shows that material was submitted; a sanction or permit is an approval record; a completion or occupancy-cum-completion record is another type of record; and the building as it exists today is a physical condition that must be compared with the relevant documents. The existence of one item does not, by itself, establish the status of every other item or show that later changes are covered. Confirm the identity, scope and status of each record that matters to the case.

MCD’s enforcement orders illustrate why careful verification matters, but they are individual cases rather than predictions about every application. A West Zone order dated 28 September 2025 records revocation proceedings under Section 338 of the DMC Act after scrutiny of an online plan sanction and allegations of misrepresentation. The order reproduces a warning attributed to provision 2.9.1 of the Unified Building Bye-Laws, 2016: “The sanctioning authority shall revoke any building permit including sanction of building plan and / or occupancy-cum-completion certificate and take action as per law, if there has been any false statement or any mis-representation of material facts in the application on which the building permit was based.” Read the MCD West Zone order in context; it documents a specific matter and does not show that every error results in revocation.

The practical lesson is to take care with statements and supporting material rather than to infer a universal enforcement outcome from one order. Check that the application corresponds to the right property, that the owner or representative is authorised, and that the facts provided match the plans and records available. The cited order concerns a particular sanction and allegations; it does not answer whether a different owner’s work can be sanctioned or regularised.

A separate MCD order dated 28 July 2025 concerning building-plan and regularisation submissions records an owner’s statement that they had never applied, alongside concerns including absent authorisation and an old fire clearance. It is a reason to check identity, authority, and the status of supporting records in your own case—not evidence that the same clearance is required for every property. The MCD order concerning those submissions describes that specific matter.

What to confirm before filing or starting work

  1. Pin down the property: confirm the exact address and colony name, and identify any location or colony classification relevant to the property.
  2. Describe the work accurately: distinguish proposed construction from work already completed and list later alterations.
  3. Reconcile the records: compare the current layout with any sanctioned plan, permit, or completion record, and verify who filed any earlier application.
  4. Check current MCD materials: review the relevant policy notifications, colony lists, bye-law materials, amendments, forms, and area resources on the Town Planning page.
  5. Confirm the route and requirements: use the service portal and confirm with MCD or a qualified building professional which application, documents, and clearances apply now.
  6. Submit accurate, authorised material: ensure the owner or authorised representative has checked the application and that its statements match the property and supporting records.

Before submitting, make sure you can explain the difference between the building as it exists and any work proposed next. Keep the relevant records together and note any uncertainty—for example, a missing plan, a discrepancy between the layout and a plan, or an application whose filer is unclear. These are useful points to raise with MCD or a qualified professional. They are not, on their own, proof of eligibility or a substitute for the current application requirements.

If you are preparing to start work, first confirm whether the relevant plan-sanction route applies and what current requirements govern the proposal. If work is already present, first establish whether an applicable regularisation policy covers the property and the specific work. If both conditions apply, ask how each part should be addressed. In all cases, do not treat a portal menu, a prior application, or the absence of a visible issue as a determination of compliance.

Fees, timelines, and eligibility are property-specific

The MCD pages and orders cited here do not establish a universal regularisation eligibility test, document checklist, charge, processing time, or likelihood of approval for an unspecified property. Those details may depend on the current policy, location, work, and application route, and policies or portal procedures can change. Check the current MCD materials and confirm the details directly before relying on a figure or beginning work.

No general success rate, average processing duration, or fee figure is established by the reviewed material. Avoid relying on a number unless it is published for the specific route and confirmed as current. Likewise, do not assume that a particular clearance mentioned in an individual order is required in every case. Verify the requirements for the relevant property, work and policy with MCD or a qualified building professional.

MCD’s Town Planning page includes the Unified Building Bye-Laws for Delhi, 2016, amendments, notifications, forms, colony lists, and layout resources. The cited portals and orders were accessed on 9 October 2026; that access date does not establish that a particular form, policy, fee, or portal flow remains unchanged. Recheck the live MCD resources when preparing an application.

When professional help is useful

A qualified Delhi architect or building professional can help compare the property’s existing layout with available plans, identify which MCD materials may apply, and prepare a case for the appropriate route. That assistance does not guarantee sanction or regularisation. The owner should still verify authorisation, property identity, and the accuracy of all material submitted, and confirm requirements with MCD.

Professional help is especially useful when the records and physical layout do not appear to match, the construction history is unclear, someone else filed an earlier application, or you cannot tell which policy or colony resource applies. A professional can help assess and prepare the case; it is not a promise of approval and does not replace the authority’s decision. If a service referral is offered, it should be clearly disclosed and framed as assistance with assessment or preparation rather than a route to guaranteed approval.

Frequently asked questions

Can I regularise any unauthorised construction through MCD?

No universal eligibility conclusion follows from the existence of MCD’s “Apply for Regularization” service. Check whether the current policy applies to the exact property, colony and work, and confirm the appropriate route with MCD or a qualified building professional.

Does an old sanctioned plan cover additions made later?

Do not assume that it does. Compare the plan’s scope and status with the building as it stands, including later additions or alterations, and ask MCD or a qualified professional how the differences should be treated under current requirements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What should I do if there is both existing work and a new proposal?

Describe and document each separately. Establish what was previously sanctioned, what is already built or altered, and what is proposed. Confirm whether the existing and proposed work need different treatment rather than assuming one application covers both.

Is a portal record proof that my building is approved?

Not on its own. Verify that the record relates to the right property and owner, identify what kind of record it is, check its scope and status, and compare it with the current layout. An application record, permit and completion record are not interchangeable.

Which documents and clearances will MCD require?

The available material does not establish one complete checklist for every homeowner. Gather the property address and colony name, ownership or authority papers, any plan and completion records, the current layout, a construction history and details of proposed work. Then confirm the actual current requirements for the specific route with MCD or a qualified professional.

How much does regularisation cost, and how long does it take?

The reviewed sources do not provide a universal charge or processing time. Check the current MCD materials and confirm any applicable fees and timelines for the property’s location, work and route before relying on a figure.

Does a mistake in an application always lead to revocation?

No. The cited West Zone order is an individual matter involving allegations of misrepresentation and records proceedings under Section 338 of the DMC Act. It is a caution to submit accurate, authorised information, not evidence that every error has the same outcome.

The Bottom Line

Bottom line: MCD building-plan sanction is the route to investigate for relevant proposed work; regularisation is a separate application route for existing work, not a guarantee that it can be approved. Start with the property’s exact location, colony, ownership and plan history, compare the actual building with available records, and verify the current policy and requirements with MCD or a qualified professional before filing or starting work.
