A MahaRERA complaint is designed for an alleged breach of the Real Estate (Regulation and Development) Act, 2016 (RERA), its rules or regulations. A consumer commission hears a consumer dispute under the Consumer Protection Act, 2019. RERA does not, by itself, create a blanket ban on consumer commissions, while its civil-court exclusion is a separate rule. The right forum depends on the relief sought, the facts, the project and agreement, jurisdiction, limitation and any case already filed.
This is general information, not a case-specific legal opinion. Before filing, withdrawing or pursuing overlapping proceedings, obtain advice from a qualified lawyer who can check the current law and your procedural history.

Where should homebuyers file?
Start with the remedy, not the name of the forum. Write down the outcome you need—such as possession, refund, interest, compensation, correction of a project disclosure, or an order addressing a promoter’s conduct—and then identify which statutory decision-maker can grant or adjudicate that relief. A complaint alleging contravention of RERA, Maharashtra’s rules or regulations normally points toward the Maharashtra Real Estate Regulatory Authority (MahaRERA). A broader claim that you purchased a service and suffered a consumer-law deficiency may be brought before the appropriate district, state or national consumer commission, subject to that forum’s current jurisdiction and procedure.

What a MahaRERA complaint covers
RERA-based contraventions
MahaRERA’s FAQ explains that an aggrieved person may apply online regarding a violation or contravention of the RERA Act, the applicable rules or regulations. The allegation should therefore be tied to a statutory obligation or project-related compliance issue, rather than stated only as a general grievance. The agreement for sale, registered-project information, payment history and communications help show what obligation was allegedly breached.
Read the current statute and Maharashtra directions together. The official text of RERA is available from India Code’s Real Estate (Regulation and Development) Act, 2016. MahaRERA’s explanatory FAQ was published on 23 July 2019; it is useful orientation, but current circulars, regulations and binding court decisions must be checked for a live dispute.
Relief and the adjudicating officer
RERA assigns different functions within its framework. The Authority, an adjudicating officer and the Appellate Tribunal do not have identical powers. The relief you request matters: a claim described as compensation may fall within the adjudicating officer’s role, while another request may concern the Authority’s regulatory jurisdiction. Do not assume that placing the word “compensation” in a pleading determines the forum. State the legal basis, the event that caused loss and the exact order sought.

Online filing and hybrid hearings
MahaRERA currently describes web-based filing of complaints and related submissions. Its 2025 Standard Operating Procedure for Hybrid Mode of Hearings permits parties or their representatives to attend physically or virtually. Before submitting anything, check the live portal, the applicable form, fee, document-upload, service and bench instructions, and the current cause list. The procedure is available at MahaRERA’s Standard Operating Procedure for Hybrid Mode of Hearings.
Online availability does not remove the need to serve the other side correctly, state a coherent cause of action or comply with directions after filing. Keep the acknowledgement, filing number, uploaded version and every subsequent order in one case file.
What the 60-day statement means
MahaRERA’s FAQ describes section 29 as requiring complaints to be disposed of as expeditiously as possible and not later than 60 days, with reasons recorded if that period cannot be met. That is a statutory expectation with an express qualification, not a guaranteed order date, a promise of recovery or a reliable average duration for every matter.

Can I file a complaint in consumer court if my project is covered by MahaRERA?
Coverage by MahaRERA does not, on the material available here, automatically disqualify a consumer complaint. MahaRERA’s FAQ states: “However, the consumer forums (National, State or District) have not been barred from the ambit of the Act.” This is the Authority’s FAQ wording, published on 23 July 2019—not a substitute for checking current binding judgments and the facts of your case.
The consumer-protection framework is governed centrally by the Consumer Protection Act, 2019. A consumer commission will still need jurisdiction over the parties and dispute, a legally sustainable consumer relationship, and a claim within the applicable limitation and procedural rules. Current pecuniary limits, filing fees, e-filing mechanics and territorial requirements are not supplied here; verify them from the relevant commission and current rules rather than relying on an old website or a forum post.
Why the civil-court bar is a different question
Section 79 of RERA addresses ordinary civil courts. The statutory text says: “No civil court shall have jurisdiction to entertain any suit or proceeding” in respect of a matter that the Authority, adjudicating officer or Appellate Tribunal is empowered to determine. Read in context, that provision concerns a civil court’s jurisdiction; it does not say that district, state or national consumer commissions are civil courts for this purpose.
Accordingly, avoid the shortcut “RERA bars every other forum.” The relevant questions are whether the proposed consumer case is legally maintainable, whether another proceeding creates duplication or inconsistent relief, and what the current controlling decisions say about the particular claims. The MahaRERA FAQ and section 79 should be read together, with case-specific legal advice where the routes overlap.
Compare the routes on the issues that actually decide a filing

The table identifies the dimensions to investigate; it is not a prediction that one forum will be faster, cheaper or more favourable in your case.
Match common homebuyer objectives to the legal question
Possession or delay
Set out the promised date, extensions or revised commitments, actual construction status, notices exchanged and the possession-related order you seek. Then ask whether the requested direction is being pursued as a RERA remedy, a consumer remedy, or both. A lawyer should test whether the relief is within the chosen decision-maker’s power and whether an earlier proceeding already covers the same period.

Refund, interest or cancellation
Identify the contractual payment schedule, amounts paid, demand for refund, deductions proposed and the legal provision relied on. Do not assume that a refund request can be copied unchanged into two forums. The forum must be able to grant the specific monetary and consequential relief, and limitation must be calculated from the legally relevant events.
Compensation for loss
Separate the underlying breach from the compensation calculation. Explain the direct loss, supporting records and causal link, and determine whether RERA assigns the compensation issue to its adjudicating officer or whether the consumer commission is the proposed forum. The label “compensation” alone does not resolve that allocation.
Disclosure, registration or regulatory conduct
For an alleged project-registration, advertisement, disclosure or other regulatory contravention, identify the exact RERA rule or regulation and the evidence showing the departure. A consumer pleading that omits the statutory connection may not present the issue clearly; a RERA complaint that asks for relief outside the Authority’s power faces a different problem.

- Define the outcome. Use one sentence for the order you want and list any monetary amount, interest period, possession date or corrective direction involved.
- Classify the legal basis. Mark each allegation as a possible RERA, consumer-law, contractual or other issue. Have counsel check whether the classifications can coexist.
- Check the project and agreement. Record the MahaRERA registration details, promoter and allottee names, unit, promised milestones, clauses on termination or dispute resolution, and amendments.
- Map jurisdiction. Confirm the correct MahaRERA bench or officer and, for a consumer case, the commission level, territorial connection and current pecuniary rule. Do not rely on a threshold copied from an outdated article.
- Search your procedural history. List every complaint, notice, order, appeal, execution or settlement involving the unit or the same cause of action.
- Check limitation and strategy. Calculate dates with legal advice. Decide whether one complete proceeding is safer than overlapping claims and what happens to any earlier case if a withdrawal is proposed.
- Prepare a consistent remedy statement. The facts, dates, amount and relief should not change between pleadings without an explained legal reason.
How to prepare a MahaRERA filing
- Confirm the current portal route. Use MahaRERA’s live website and current instructions for a complaint or related submission. The 2025 hybrid-hearing procedure confirms that web-based filing continues, but portal labels and document requirements can change.
- Identify the respondent accurately. Use the legal name and address shown in the agreement and project records. Include the relevant promoter or other party only where the facts and law support doing so.
- Draft the chronology. Present booking, agreement, payments, promised milestones, defaults, notices and responses in date order. Link each alleged breach to the RERA provision, rule or regulation relied on.
- State relief in numbered form. Distinguish possession, refund, interest, compensation, directions or penalties, and identify the decision-maker whose power you invoke.
- Upload legible evidence. Combine the agreement, receipts, bank statements, correspondence, photographs or inspection records, project-registration material and calculation sheet with an index and page numbers.
- Complete payment, verification and service steps. Follow the amount, electronic-signature or verification and service instructions displayed at filing; retain proof of each step and the final acknowledgement.
- Monitor the case. Check notices, hearing links, cause lists and orders. If attending remotely, test the connection and keep the filed record available for reference.
These are practical preparation steps, not a claim that every listed document is a mandatory form attachment in every case. The portal’s current instructions control.
Preparing a consumer-commission complaint
Begin with the commission’s current official rules and filing system for the place and amount involved. Confirm the applicable district, state or national level, territorial basis, pecuniary jurisdiction, limitation, prescribed format, fee and service method before drafting. Because those details can change, an old form or a general online guide is not a reliable substitute.
Organize the pleading around four questions: What housing service was purchased? What act or omission was deficient or unfair? What evidence proves the event and resulting loss? What order can this commission lawfully make? Attach the agreement, payment proof, promised specifications or schedule, correspondence, possession or delay records, project details and a calculation of the relief. Keep the consumer-law theory distinct from any RERA allegation while explaining the same chronology.

Withdrawal, parallel cases and appeals
RERA contains a specified withdrawal mechanism that should not be treated as a general permission to duplicate claims or switch forums casually. MahaRERA’s FAQ describes withdrawal from consumer proceedings for matters under sections 12, 14, 18 and 19, followed by filing before the RERA adjudicating officer. The statutory text and procedural posture must be checked before relying on that description.

Before asking to withdraw or filing elsewhere, obtain advice on whether the subject matter is the same, what orders have already been passed, whether evidence has been adopted, how limitation is affected, and whether any settlement or undertaking restricts the next step. Disclose the prior case in the new pleading. A second case can create objections, inconsistent positions or enforcement complications even where both statutes are relevant.
An appeal, execution or compliance application is not the same as starting a fresh complaint. Identify the order being challenged, the prescribed appellate route and any time limit. Do not abandon an existing proceeding until counsel explains the legal and practical consequences.
Documents and facts to assemble
- Signed agreement for sale, allotment letter, booking form and all addenda.
- Payment receipts, bank statements, demand letters, tax or charge records and a reconciled amount paid.
- Promised possession or construction milestones, revised schedules and records of actual progress.
- Emails, letters, messaging records, notices, replies and proof of delivery.
- Project registration number, approved or advertised specifications and relevant public disclosures.
- Photographs, inspection reports, snag lists, handover records or cancellation communications, where applicable.
- A dated chronology and a calculation showing each component of refund, interest, compensation or other relief.
- Copies of every complaint, written statement, order, appeal, execution filing, withdrawal request or settlement concerning the dispute.
- Identity, address and contact details needed for the selected forum’s current filing and service rules.
This checklist is practical preparation. The forum’s current rules determine what must formally accompany a filing.
Frequent mistakes and how to avoid them
Calling consumer commissions “civil courts”
That wording blurs section 79’s civil-court rule and MahaRERA’s FAQ position on consumer forums. Name the forum precisely and cite the provision relevant to the issue.
Choosing a forum by speed alone
There is no verified comparative statistic here showing that MahaRERA or consumer commissions generally resolve homebuyer cases faster. A 60-day statutory expectation in the MahaRERA FAQ is not a service guarantee. Choose based on jurisdiction, relief, evidence and procedural posture.

Using an outdated fee or jurisdiction figure
Consumer thresholds, fees, portals and practice directions can change. Verify the current official source for the commission that would receive the complaint.
Filing a second case without disclosing the first
Prior proceedings, withdrawals and orders can affect maintainability and strategy. Give counsel the complete record before taking a new step.
Asking for relief the forum cannot grant
Separate regulatory directions, compensation, refund, interest and possession requests, then confirm which statutory decision-maker has authority over each. A well-organized chronology cannot cure a jurisdictional mismatch.

Submitting a changing factual story
Keep dates, amounts, unit details and the stated remedy consistent. If a later event changes the claim, record when it occurred and amend through the proper procedure rather than silently replacing the earlier version.
What current sources establish—and what they do not
The official sources establish the distinction between RERA’s statutory bodies, civil courts and consumer forums, MahaRERA’s online and hybrid-hearing operations, and the FAQ’s qualified 60-day disposal statement. They do not establish a universal winning forum, average case duration, success rate, outcome statistic, current consumer pecuniary threshold or filing-fee amount. Any website asserting those figures should be checked against the current official rules and the date of the information.
For the controlling text, consult RERA on India Code, MahaRERA’s FAQ dated 23 July 2019, the 2025 MahaRERA hybrid-hearing procedure and the Consumer Protection Act, 2019 record. Check later amendments, circulars and binding decisions before relying on an older statement.
Bottom line for a homebuyer
File where the chosen decision-maker has jurisdiction over the precise relief and legal theory, after checking limitation and every existing proceeding. MahaRERA may be the natural route for a RERA contravention and offers an online process with hybrid hearing options. A consumer commission may also be legally available; RERA’s civil-court exclusion does not itself answer the consumer-forum question. Because withdrawal and parallel proceedings can have lasting consequences, get case-specific legal advice before moving, duplicating or abandoning a claim.
