The answer depends on the legal entity named in your purchase or construction documents, the warranty enrollment or insurance policy for your specific home, any documented assumption or successor arrangement, and the law where the home is located. A builder, vendor, parent company, warranty administrator and insurer can have different roles.
Verify those roles using your home’s records, the local regulator and the warranty administrator or insurer. If you already have a defect, notify the required parties immediately while you investigate ownership. Waiting for a corporate answer can allow a notice deadline to expire.

What a builder acquisition does—and does not—tell you
An acquisition, merger, rebrand or sale of a builder may leave warranty obligations with the original legal entity, move them to a successor that expressly assumed them, or involve a warranty insurer or administrator that provides a separate claim route. The public announcement alone does not establish which result applies to your home.

Also distinguish a builder acquisition from a sale of the home. In some schemes, coverage follows the home and remains available to later owners. In others, the policy, contract date or transfer paperwork determines the result. Your home’s address, contract, enrollment record and policy control the investigation.
Start with the jurisdiction where the home sits
Warranty law is territorial. Begin with the province, state or country of the property, not the acquired company’s headquarters. Identify three official bodies:
- the regulator that licenses builders or sellers;
- the warranty administrator or statutory program; and
- the insurer, if the warranty is insurance-backed.
Use the scheme’s current rules and the dates that applied when your contract was signed, the home was enrolled, occupancy occurred and title transferred. Transition provisions can split responsibility by contract date. Victoria, Australia, for example, began its new Home Warranty scheme on July 1, 2026 for eligible domestic building contracts signed on or after that date. Domestic Building Insurance policies issued before July 1, 2026 remain with the insurer that issued them under their existing terms; they do not move into the new scheme. The Building and Plumbing Commission provides the new cover from July 1, while older policies continue with their original insurers.

Do not generalize from another jurisdiction. Ontario’s program, British Columbia’s statutory insurance and Victoria’s transition rules answer different questions.

- Letters or emails announcing the acquisition, merger, rebrand, closure or change of service contact.
- Any assignment, assumption, transfer, settlement or court document supplied to you.
Keep the documents in date order and preserve the originals. A practical file is more useful than a company-name search because a brand can represent several legal entities.
Check official records for both the home and the companies
Search the regulator or warranty provider’s directory using the property address and every legal name in your contract. Record what you searched, the result and the date. A directory entry can confirm licensing or enrollment, but it does not by itself prove that a later acquirer assumed liability.
In Ontario, the Home Construction Regulatory Authority (HCRA) licenses builders and sellers and maintains a public Builder Directory containing licensed builders and homes enrolled in the warranty program. Tarion remains responsible for homeowner warranty protection. HCRA’s role and Tarion’s role are different: HCRA deals with licensing and regulatory oversight, while Tarion administers and backstops statutory warranty protection.
When a listing has disappeared or a name has changed, save archived correspondence and ask the regulator whether the record has a successor name. Do not treat a matching telephone number, website or parent-company listing as proof of legal succession.
Ask the warranty administrator or insurer for a written, case-specific answer
Send a concise written request through the official channel shown on your certificate or policy. Include the address and enrollment or policy number, then ask:

- Which legal entity is currently recorded as the builder or vendor for this home?
- Which entity receives defect notices, repair requests and formal claims?
- Has the file recorded an assignment, assumption, merger, successor or change of insurer?
- What are the coverage periods and notice deadlines for each unresolved defect?
- Is the answer about the builder’s statutory or contractual duty, the administrator’s process, insurance coverage, or more than one of these?
- Will you issue an updated certificate, policy endorsement or written contact instruction?
Request the legal name, not merely a trading name. Ask the respondent to identify the document or rule on which it relies if it says another entity is responsible. A registry can show enrollment; it may not reveal the terms of a private acquisition or assumption.
Compare every entity by role, record and claim function
When several names appear, use a side-by-side comparison instead of treating them as interchangeable.
| Entity or record | Question to answer | Evidence to keep |
|---|---|---|
| Builder or vendor named in the contract | Who promised to build or sell the home? | Signed agreement, amendments and legal name |
| Developer or project company | Did it contract with you or only develop the land? | Contract, disclosure and title records |
| Parent or acquiring company | Did it expressly assume this obligation, or only acquire shares or assets? | Written assumption, notice or transaction document |
| Warranty administrator | Who administers enrollment, inspections, dispute steps and claims? | Certificate, policy and written instructions |
| Insurer or statutory backstop | Who pays or arranges covered benefits if the builder does not perform? | Insurance certificate, policy wording and claim number |
| Regulator | Who licenses the builder and handles regulatory complaints? | Directory result and complaint reference |
Shared branding is not evidence that the parent assumed an affiliate’s warranty. If a company says the original builder is no longer responsible, ask for the successor’s full legal name and the basis for that position.
Protect a defect claim while responsibility is being checked
Do not wait for the corporate question to be settled. Follow the notice method in your certificate, policy and governing law.
- Describe each defect separately, with its location, discovery date and observable effect.
- Send notice to the builder and the warranty provider or insurer when the scheme requires both.
- Use the official email, portal or address in the policy; send by a trackable method when appropriate.
- Save the sent message, attachments, delivery confirmation and every reply.
- Ask the administrator to confirm in writing the applicable deadline, inspection process and claim number.
- Take reasonable temporary steps to prevent urgent damage, documenting what you did and keeping invoices. Do not authorize permanent work that could prevent an inspection unless necessary for safety or to limit loss.
British Columbia provides a clear example of why dual notice matters. Its regulation requires written notice to both the warranty provider and the residential builder within a reasonable time after discovery and before the applicable coverage expires. That is a jurisdiction-specific rule, not a universal deadline; check your own policy and law.

Ontario: builder, vendor and Tarion roles
Ontario separates licensing, builder responsibility and warranty administration. HCRA licenses and regulates builders and sellers. Tarion administers homeowner warranty protection and provides a claim route when the builder does not resolve an issue. HCRA states that the builder or vendor is responsible for resolving warranty issues directly, while Tarion remains responsible for homeowner warranty protection.
Ontario coverage begins when the Agreement of Purchase and Sale is signed and can remain in effect for up to seven years, subject to the warranty’s limits and obligations. HCRA says that period can continue even if the home is sold. That does not mean every defect is covered for seven years; the type of defect, the applicable warranty period and required notice still matter.
HCRA Advisory 4, updated February 1, 2021, states that once a home is enrolled, the builder—considered a vendor for warranty purposes—remains responsible for the statutory warranty even if a contract changes or responsibilities change. The advisory cautions that coverage may be jeopardized if the changes mean the builder is no longer effectively in control of construction. That is Ontario guidance and must be tested against current law and the facts of the project.
HCRA Advisory 5, also updated February 1, 2021, describes circumstances in which the originally licensed vendor continues to be the vendor for warranty purposes even when another person sells or transfers the home, including a receiver-related context. It quotes Ontario law stating that a person licensed as a vendor who acts as vendor of a covered new home continues to be the vendor even if another person later sells or transfers the home as prescribed. The advisory does not decide every acquisition, asset sale or insolvency dispute.
British Columbia: insurance benefits and owner transfers
British Columbia’s Homeowner Protection Act requires home warranty insurance for covered new homes. The statutory minimums described in the Act are at least two years for materials and labour, five years for building-envelope defects including water penetration, and ten years for structural defects. The protection benefits whoever owns the home during the relevant period.

The regulation states: “All of the applicable unused benefits under home warranty insurance are automatically transferred to any subsequent owner on a change of ownership.” No notice to the provider is required for that automatic transfer under the quoted rule, but you should still update the provider and obtain confirmation for your file. The policy wording, exclusions, expiry date and claim procedure remain important.
The same scheme illustrates the notice risk: written defect notice must reach both the provider and builder within a reasonable time after discovery and before the applicable coverage expires. If the builder has been acquired, send the notice to the official provider address and the builder contact listed in the policy while asking the provider how it records the successor.
Victoria, Australia: identify the policy by contract date
Victoria’s new Home Warranty scheme commenced July 1, 2026 for eligible domestic building contracts signed on or after that date. Existing Domestic Building Insurance policies issued before July 1 remain with their issuing insurer under the existing policy terms. Therefore, the contract date and insurance certificate are decisive when identifying the responsible warranty entity. A builder’s later rebrand does not move an older policy into the new scheme.

Check whether your contract falls before or after the commencement date, then contact the insurer or scheme administrator named on the certificate. Ask for written confirmation of the claim route and the treatment of any builder acquisition.
Common mistakes and the better response
- Relying on the acquisition announcement: Treat it as a lead, not proof. Match the home address and legal names to the warranty record.
- Contacting only the new brand: Send formal notice through the policy’s official channel and to the builder contact required by law.
- Confusing parent ownership with assumption: Request an express legal basis and the successor’s legal name.
- Assuming a registry decides liability: Use the directory to verify enrollment or licensing, then obtain a written case-specific answer.
- Waiting while a defect worsens: Preserve the claim first; investigate corporate responsibility in parallel.
- Applying another province or state’s deadline: Use the certificate and law for the home’s location and contract date.
- Discarding evidence after repairs: Photograph conditions, retain reports and invoices, and document emergency mitigation.
Escalate when the written answers conflict
If the builder, administrator and insurer give inconsistent answers, send each party the relevant contract page and policy number and ask them to respond to the same numbered questions. Contact the local warranty administrator and regulator using their official contact details. A licensing complaint process is not necessarily the same as a warranty claim or dispute process, so open the correct file with each body.
Obtain advice from a lawyer licensed where the home is located if the issue involves insolvency, a receiver, an asset sale, disputed assignment language, limitation periods or a refusal to recognize a claim. A lawyer can review transaction and contract documents that a public directory cannot disclose. Keep pursuing the administrator’s claim process while obtaining advice unless the administrator instructs otherwise.
