How to Report Unsafe or Unauthorized Road Construction

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Call 911 or local law enforcement when road construction creates an immediate danger. Do not wait for an online complaint form; Texas Department of Transportation says, “IF YOU HAVE AN EMERGENCY, DIAL 911,” and warns that its online form is not monitored 24/7. North Carolina’s transportation department likewise tells the public to notify local law enforcement when a roadway unexpectedly becomes unsafe.

For a non-emergency, identify who owns or manages the road, then report the condition through that agency’s current public channel: a state department of transportation, city or county public works department, 311 service, or transportation office. A hazard affecting construction employees belongs with OSHA or the applicable state occupational-safety agency. If work looks unauthorized, report the project and location to the road agency and ask it to identify the project or permit authority; do not declare the work illegal solely because signs, permit papers, or familiar branding are not visible.

Choose the right reporting route first

The correct contact depends on three questions: how urgent the danger is, who controls the road, and whether the risk concerns the travelling public or workers at the site.

Situation First route What the official examples establish
Immediate danger to drivers, pedestrians or nearby property 911 or local law enforcement Texas transportation officials direct emergencies to 911. North Carolina officials say to notify local law enforcement when a roadway unexpectedly becomes unsafe.
Routine concern on a state highway or state-managed project State DOT portal or call center Indiana DOT accepts questions and concerns about most of its construction projects through its customer-service portal and directs urgent concerns to its call center.
Construction problem on a city street, sidewalk or local highway City 311, transportation department or public works office New York City directs construction reports involving sidewalks, roadways and highways to NYC311.
Hazard to employees working at the site OSHA or the applicable state occupational-safety agency OSHA’s complaint form routes users by state and notes that many complaints are handled through a State Plan. Its form and email are not for emergencies.
Unprotected street opening that could cause a crash 911 NYC311 specifically instructs callers to use 911 for an unprotected street opening that could cause an accident.

These agencies are examples of how the system works, not a nationwide directory. The United States has no single public intake route for every road or construction project, and procedures can change. Confirm the current instructions for the location involved.

When to call 911

Use 911 when waiting for a routine complaint review could expose someone to immediate harm. Examples include an open excavation or street opening without protection, a work-zone barrier that has fallen into live traffic, a sudden washout or slide, debris creating an imminent collision risk, a collapsed travel lane, or any condition in which people are already in danger.

Make the emergency call safely

  1. Get out of the hazard. If you are driving, pull over only where it is legal and safe. Do not stop in a travel lane, walk into the work area, or approach equipment to obtain a better view.
  2. Give the dispatcher a precise location. State the road or route, nearest address or intersection, direction of travel, and the lane, shoulder, sidewalk or frontage area involved.
  3. Describe the immediate threat. Explain what could happen now—for example, an uncovered opening beside the lane, a barrier in traffic, or a lane that has washed away—and whether people or vehicles are currently exposed.
  4. Say whether the condition is still active. Tell the dispatcher if crews are present, traffic is moving through the hazard, or the danger is changing.
  5. Follow instructions and remain clear. Emergency responders may need you to stay in a safe location or provide additional directions. Do not attempt traffic control yourself.

Do not substitute a web form, email or social-media message for an emergency call. Texas DOT expressly says its form is not monitored around the clock. OSHA also states that an emergency must not be reported through its online form or email.

Identify who owns or manages the road

Road ownership determines which agency can inspect the project, coordinate a contractor and check permits. A road that passes through a city may still be state-managed; a county route may have a different maintenance authority from a nearby municipal street.

State roads and highways

Look for a route number, state highway shield, mile marker or distinctive state-maintained sign. Use the state DOT’s customer-service portal for a routine construction concern. Indiana DOT, for example, accepts concerns about most of its construction projects online and provides a call center for urgent matters. If the condition is immediately unsafe, use 911 or the state agency’s urgent telephone channel rather than waiting for portal processing.

City and county streets

For a municipal street, sidewalk, alley or local bridge, start with the city’s 311 service or public works/transportation department. New York City’s guidance sends reports about hazardous construction and other construction problems on sidewalks, roadways and highways to NYC311. In a county, the equivalent may be a public works or highway department. Use the agency’s current website or published contact instructions for that jurisdiction.

Private roads and access roads

A private development road, shopping-center access lane or utility-owned access route may not be maintained by the public road agency. You can still report a danger affecting public traffic to 911. For a non-emergency, identify the property or road manager from posted signs, the nearest address or the local government office, then send the concern to the entity responsible for that route.

How to submit a non-emergency road-construction report

Once you have determined that the condition is not an immediate emergency and identified the likely road owner, prepare one clear report. A precise report is easier for an inspector to locate than a general statement that “construction is dangerous.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Record the location. Provide the street or route name and number, nearest street address or intersection, direction of travel, and the exact place within the work zone—such as the eastbound shoulder, south sidewalk or entrance to a marked detour.
  2. Describe the hazard, not just your conclusion. State what you observed: a missing barricade, a blocked sidewalk, loose material in a lane, an abrupt pavement edge, inadequate lighting, or a sign that directs traffic into an obstruction. Avoid labeling the work “illegal” unless the responsible authority confirms that status.
  3. State when you saw it. Include the date and approximate time, and say whether the condition remains active. OSHA’s worksite form specifically asks for the date a hazard was last observed.
  4. Explain who is exposed. Identify whether the risk affects motorists, cyclists, pedestrians, nearby residents, workers, school traffic or emergency access. Mention changing conditions such as darkness, rain, heavy traffic or a recurring obstruction only when you personally observed them.
  5. Use the agency’s designated channel. Submit through the state DOT portal, city or county 311 system, public works office or transportation department. Follow required fields and save the confirmation number or email.
  6. Escalate only when appropriate. If the hazard becomes immediately dangerous after you submit a routine report, call 911; do not assume the online submission has been seen.

Information agencies commonly need

  • Road, route or highway name and the nearest address or intersection
  • Travel direction and lane, shoulder, sidewalk or roadside location
  • A factual description of the obstruction, defect or unsafe traffic control
  • Date and time last observed, plus whether it is still present
  • Whether people, vehicles or workers face an immediate or continuing risk
  • Any project sign, contractor name or work-order number that is plainly visible from a safe location

NYC DOT recommends specific location information, and OSHA’s form asks for the worksite address, hazard description, hazard location and date last observed. Give the agency enough detail to find the spot without entering the work area.

Reporting hazards to construction workers

A danger that primarily threatens employees at a worksite should be reported to OSHA or the state occupational-safety agency with jurisdiction. OSHA’s online complaint form asks for the site address, hazard description, exact hazard location and date last observed. The form routes the complaint by state and notes that many states operate an OSHA-approved State Plan.

Do not use OSHA’s online form or email for an emergency. Its notice says, “Do not report an emergency using this form or email!” Imminent, life-threatening situations should be directed to OSHA’s emergency telephone instructions or 911, depending on the immediate circumstances. A road hazard that threatens both workers and passing traffic may require two reports: emergency services for the immediate public danger and the occupational-safety agency for the workplace condition.

How to handle suspected unauthorized construction

Construction can look unauthorized for ordinary reasons: permits may be posted away from the public view, a utility or emergency project may use temporary arrangements, and work may occur at night under a valid approval. Missing signs, unfamiliar machinery, nighttime activity or the absence of visible paperwork do not by themselves prove that a project is illegal.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use an inquiry-based report

  1. Send the project location and observed activity to the agency responsible for the road.
  2. Ask which public agency, permit office or project authority is responsible for the work.
  3. Request confirmation that the project is identified in the agency’s records, if that information is available to the public.
  4. Describe any objective safety or access problem separately from your question about authorization.
  5. If the agency directs you to another office, submit the same factual information there and retain the referral or case number.

There is no universal permit-lookup system established for every US road. The responsible agency may be a state DOT, city transportation department, county highway office, utility regulator or another authority. Asking the road owner to identify the project avoids making an unsupported accusation while still creating a record for review.

Documenting the condition without creating another hazard

The reviewed agency guidance does not establish a universal requirement to provide photographs or video. Written location and hazard details may be enough. If an agency requests documentation, collect it only from a safe and lawful place.

  • Never enter an active work zone, cross barriers or stand on a live shoulder to take a picture.
  • Do not confront workers, supervisors or members of the public at the site.
  • Do not handle a phone, camera or reporting app while driving.
  • Do not stop in a travel lane or block emergency access.
  • Do not move cones, barricades, signs or equipment yourself.
  • Do not infer a permit violation from equipment, clothing, work hours or branding alone.

If you already have a lawful, safely obtained image, provide it only through the agency’s approved channel and explain when and where it was taken. Avoid publishing identifiable personal information about workers or bystanders.

Agency examples and what they mean for your report

Agency example Use it for Important limitation
Texas Department of Transportation State-road issue reporting and guidance on emergencies The agency states that emergencies belong on 911 and that its online form is not monitored 24/7.
North Carolina Department of Transportation Unexpectedly unsafe roadway conditions, such as a slide or washout Its guidance tells the public to notify local law enforcement immediately so public-safety measures can be taken.
Indiana Department of Transportation Questions and concerns about most state construction projects Use its customer-service portal for routine matters and its call center for urgent concerns.
New York City Department of Transportation and NYC311 Construction problems involving city sidewalks, roadways and highways NYC311 directs an unprotected street opening that could cause an accident to 911.
OSHA and state plans Hazards affecting construction employees The online complaint form is not an emergency channel; many complaints are handled by a state occupational-safety plan.

These examples show the decision pattern—emergency versus routine, road owner, and public traffic versus workplace safety. They do not make one agency responsible for roads in another state or city.

After you report

Save the confirmation number, submission time, agency name and a copy of the description you sent. If the agency asks for clarification, answer with the same precise location and observations rather than speculating about motives or legal violations.

No source establishes a nationwide response deadline, inspection standard or guaranteed outcome. A portal may acknowledge receipt without providing a completion time. If the condition worsens, becomes an immediate danger or remains unaddressed while people are exposed, use the appropriate urgent channel again. For a state project, that may be the DOT call center; for a municipal street, it may be 311 or public works; for an emergency, it remains 911.

Common mistakes and better alternatives

Mistake Why it fails Better action
Submitting an online form during an active emergency The form may not be monitored continuously. Call 911 or local law enforcement first.
Reporting to the wrong road owner The receiving office may lack authority to inspect or alter the work. Identify the state, county or city manager of the route and use its channel.
Writing only “unsafe construction” Inspectors cannot reliably locate or understand the condition. Give the route, address or intersection, direction, exact hazard and observation time.
Calling work illegal because no permit is visible Permit displays and project records vary by jurisdiction. Ask the road agency to identify the project or permit authority.
Entering the site to gather proof You could be struck, injured or interfere with operations. Report from a safe location and provide documentation only if safely obtained or requested.
Using OSHA’s form for an emergency OSHA expressly excludes emergencies from its form and email process. Use emergency services or OSHA’s emergency telephone instructions as appropriate.

A quick decision checklist

  1. Is anyone in immediate danger? Call 911 or local law enforcement. For an unprotected opening that could cause a crash, NYC311’s instruction is also 911.
  2. If not, who controls the road? Determine whether it is state, county, city or privately managed.
  3. What kind of risk is it? Use the road agency for public traffic, access and construction conditions; use OSHA or the state plan for worker safety.
  4. What can you state precisely? Prepare the route, nearest address or intersection, direction, hazard location, factual description, date and whether it remains active.
  5. Can you document it safely? Do not enter, confront, stop in traffic or use a device while driving.
  6. Do you suspect unauthorized work? Ask the responsible road agency to identify the project or permit authority instead of asserting illegality.
  7. Did the danger change? Escalate a routine report to the emergency route if the condition becomes immediately unsafe.
