A seller’s description, estate listing or map screenshot is not proof that you can build a house, shop or other project. Verify the land in two separate tracks: first establish what the planning scheme allows on that parcel, then confirm that every existing or proposed building plan has the required approval and matches the same title and boundaries.
The safest sequence is to identify the parcel, obtain a current official planning record, test your intended use against all controls, authenticate permits and drawings with the issuing authority, check title and survey restrictions, resolve any uncertainty through a formal enquiry or certificate, and make the contract conditional on satisfactory results.

Why zoning and building-plan approval are separate checks
Zoning answers a land-use question: is a dwelling, retail unit, workshop, farm building or another use permitted, conditional or prohibited on this parcel? Building approval answers a construction question: do the submitted drawings and technical documents comply with the applicable planning, building and safety rules, and has the authority actually approved them?

An allowed use does not automatically authorise construction. A house may be a permitted use but still fail because of setbacks, height, plot coverage, access, drainage, heritage controls or utility limitations. Conversely, a plan stamped by an authority may relate to a different lot, an expired or amended scheme, or conditions that were never discharged. Treat the two investigations as linked but distinct.

Consumer Affairs Victoria states that all land is subject to a planning scheme run by the local council. NSW Planning Portal describes planning certificates as providing clear and accurate information about planning and other development controls applying to specific parcels. Those principles apply broadly, although the certificate names, authorities and statutory tests differ by jurisdiction.
Step 1: identify the parcel before requesting anything
Every search should begin with an unambiguous parcel identifier. Ask the seller for the legal lot or parcel number, title or reference number, registered survey plan, site address and evidence that the person signing the sale has authority to sell. Record these details exactly as they appear on official documents.
Build a parcel identity sheet
- Legal lot, section, block or parcel number.
- Current title or folio reference and the date it was issued.
- Registered survey or subdivision plan number.
- Street address, locality and any former address used in older approvals.
- Seller’s legal name and authority, including power of attorney or company authority where relevant.
- Any proposed new lot number if the land is still part of an unregistered subdivision.
Use the legal identifier, not just a street address, in every request to the council, planning office, building-control department, land registry and utility providers. Compare the parcel shape and dimensions on the survey with the title and an on-site inspection. If an approval, contract or advertisement names a different lot, stop and require a written explanation from the issuing authority.
Why an unregistered subdivision needs extra caution
Land marketed as a future lot may not yet have its own registered title. NSW buyer guidance recommends confirming registration and obtaining legal advice on linked contracts before commitment. Until registration occurs, the boundaries, access rights, services and ability to mortgage or resell may remain uncertain. Do not assume that a future lot number, marketing plan or building package creates a legally transferable parcel.
Step 2: obtain an official zoning and planning record
Request the document used by the responsible planning authority for parcel-specific information. Depending on the jurisdiction, this may be called a planning certificate, zoning certificate, written planning enquiry, zoning confirmation or official map extract. Ask what date the information is current to and whether the document records proposed as well as operative planning changes.
What the record should disclose
- The base zone and its permitted, conditional and prohibited uses.
- Planning instruments, local plans and amendments that apply to the parcel.
- Overlays for flooding, bushfire, environmental protection, heritage, coastal or other hazards.
- Minimum lot size, frontage, density, setbacks, height, floor-area or plot-ratio and site-coverage controls.
- Access, parking, drainage, water and sewer requirements or known service limitations.
- Whether a dwelling entitlement exists where the zone requires one to be established separately.
- Notices, reservations, development agreements or other controls recorded by the authority.
Use the authority’s current record rather than an estate listing or an informal online map. A map is useful for orientation, but it may be generalized, out of date or unable to show parcel-specific conditions. Keep the complete certificate or written response, including attachments and map legends, in the transaction file.
Check date sensitivity
Planning controls can change through adopted amendments, rezoning proposals, hazard updates or infrastructure decisions. Ask the authority whether an amendment is proposed or awaiting commencement and whether the certificate has a validity period or is simply a statement of the position on its issue date. If the purchase or construction will occur later, plan a fresh search before settlement or before lodging an application.

Write down the project you actually intend to build. “A house” is not sufficiently precise for a planning assessment: the number of dwellings, floor area, height, parking, access arrangement and whether a home business or secondary accommodation is included can change the approval pathway.

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
Classify the use
- Describe the primary use, such as one dwelling, multiple dwellings, a shop, office, workshop, agricultural building or short-term accommodation.
- List accessory uses, including a secondary dwelling, home occupation, storage, signage, parking structures or customer access.
- State the approximate floor area, number of storeys, height, site coverage, parking spaces and vehicle access point.
- Identify operating details that affect classification, such as hours, deliveries, employees, noise, waste, animals or hazardous materials.
Compare that description with the zone’s use table. Separate uses that are permitted outright from those requiring a conditional or discretionary application. A prohibited use cannot be made acceptable merely by changing the building design; it may require a rezoning or a different site.
Check physical development standards
Even where the use is allowed, calculate whether the concept fits the controls. Check front, side and rear setbacks, minimum frontage, maximum height, site coverage, floor-area ratio or plot ratio, landscaping, parking and loading. Confirm that the access point is lawful and that emergency or service vehicles can reach the building. Verify whether water, sewer, electricity, stormwater and road connections are available and what upgrade costs or easements they require.
Look for overlays and special constraints
Overlays can impose a second approval or stricter design rules. Examine flood, bushfire, landslip, environmental, coastal, vegetation, contamination, cultural-heritage and built-heritage controls where relevant. Kenya’s building-plan handbook identifies building lines and setbacks, access, utilities, environmental and heritage matters, height, plot coverage and plot ratio as matters for review. The same checklist logic is useful elsewhere, but the local authority’s rules govern.

Confirm dwelling entitlement
Some rural, environmental or small-lot zones do not grant a dwelling automatically. NSW buyer guidance specifically advises purchasers to confirm dwelling entitlement. Ask the planning authority to state whether the parcel can lawfully contain a dwelling and what evidence is required, rather than inferring entitlement from nearby houses or the seller’s statement.
Step 4: verify approved building plans and permits
Ask for the permit or approval number and a complete, legible copy of the approved set. The issuing authority—not the seller, builder or agent—should confirm that the approval is genuine, current for the proposed work and attached to the same parcel identifier.
Documents to request
- Development, planning or building permit number and issue date.
- Approved site or block plan showing boundaries, setbacks, access and services.
- Approved floor plans, elevations, sections and schedules.
- Structural, civil, fire, energy or other engineering documents required for the project.
- Conditions of approval, staging requirements and evidence that pre-commencement conditions were met.
- Approved amendments, variations or substitutions; do not rely on an earlier drawing set.
- Inspection, occupancy, completion or compliance records for work already built.
Match the approval to the physical proposal
Walk the site and compare the building, foundations, driveway, retaining walls and outbuildings with the approved drawings. A permit for a smaller footprint or different position does not legalise the structure that exists. Ask the authority whether any enforcement notice, expiry, lapse, cancellation or outstanding inspection affects the approval. If work is incomplete, obtain a written statement of what remains before occupation or completion can be certified.
Distinguish planning approval from building regulations
A planning or lawful-development certificate does not replace building regulations, structural approval, fire requirements, environmental permits or utility consents. UK planning guidance says a certificate under section 192 confirms that a proposed use or development is presumed lawful if the statutory tests are met, unless a material change occurs before the use or development begins; it does not replace building regulations or other permits. Request every approval that the local authority identifies as separate.

Restrictions that can change feasibility
- Easements for drainage, water, sewer, power, access or telecommunications.
- Rights of way and obligations to construct or maintain a shared road.
- Restrictive covenants limiting building materials, height, use, subdivision or the number of dwellings.
- Development agreements, infrastructure charges or owners’ association rules.
- Mortgages, leases, options, caveats or notices that affect the seller’s ability to transfer clear title.
- Boundary discrepancies between the registered plan, occupation on the ground and the proposed site plan.
Have a licensed surveyor mark boundaries where fences, walls or driveways do not match the plan. Ask a conveyancer or property lawyer to explain which restrictions bind a purchaser, which can be released, and which make your design impossible. Planning approval does not override a private covenant or an easement.
Step 6: resolve uncertainty through a formal process
Pre-application meeting or written planning enquiry
Use a pre-application meeting or written enquiry when the project is unusual, the map is unclear or several controls interact. Submit the parcel identifier, a concept site plan, dimensions, access proposal and a concise use description. Request written notes identifying the likely application type, missing studies, referral authorities and issues that could prevent approval. Treat preliminary comments as guidance, not a guarantee of consent.
Lawful-development certificate
Where available, apply for a lawful-development certificate for an existing or proposed use. In the UK, the section 192 route can establish that a proposed use or development is lawful when the statutory tests are satisfied. The certificate is evidence of planning-lawfulness only; building regulations, listed-building controls, environmental permissions and other consents remain separate. A later material change before commencement can affect the presumption described in the guidance.

Use qualified independent advisers
A local conveyancer or planning lawyer can interpret title instruments, contract conditions and statutory rights. A licensed surveyor can verify boundaries and easements. An architect or planning consultant can test a concept against the controls and prepare a compliant submission. Ask each adviser to identify the parcel and documents reviewed, assumptions made and issues still requiring authority confirmation.
Step 7: protect the purchase contract
Do not rely on a verbal promise that approvals will be supplied after exchange. Ask your lawyer to make the offer and contract conditional on satisfactory due diligence.
Useful conditions to discuss
- Receipt and acceptance of a current official title and survey.
- Written confirmation of zoning, overlays, dwelling entitlement and intended-use compatibility.
- Authentication of every permit, approved drawing, amendment and completion record.
- Confirmation of lawful access, required services and acceptable easement or covenant terms.
- Delivery deadlines for documents and a defined period for professional review.
- A right to cancel and recover the deposit if a material approval, access right or intended use cannot be confirmed.
- Allocation of responsibility for obtaining subdivision registration, outstanding approvals or infrastructure works.
Have independent legal advice before signing either a land contract or a linked building contract. If the land is part of a new subdivision, make registration of the separate title an express condition rather than accepting a marketing plan as proof.
Which evidence route should you use?
| Route | Legal authority and parcel specificity | Information and reliance | Timing, cost and date risk | What it does not replace |
|---|---|---|---|---|
| Official planning or zoning certificate | Issued by the responsible planning authority for the identified parcel; generally the strongest routine record of zoning and controls. | May list zones, instruments, overlays, hazards and other parcel controls. Read the issue date and any stated validity or reliance limits. | Fee and turnaround vary by jurisdiction. It records the position when issued, so obtain an updated record if circumstances change. | Building permits, engineering approval, environmental or heritage consent, utility connection and private covenant review. |
| Map or informal enquiry | Useful for orientation but may be generalized, unofficial or unable to prove the legal parcel. | Can suggest a zone or overlay; normally offers limited reliance and may omit conditions or proposed amendments. | Often quick or free, but date and accuracy risks are higher. Never make it the sole basis for payment. | Parcel-specific certification, title due diligence, permit authentication and technical design review. |
| Pre-application meeting or written planning enquiry | Authority feedback on a described proposal; strength depends on the formality and jurisdiction. | Can identify the likely application, studies, referrals and design issues. It is not usually a development approval. | May require a fee and concept material; advice remains tied to the proposal and rules in force at the time. | Final planning permission, building regulations approval, title rights and construction inspections. |
| Lawful-development certificate | Formal statutory decision where available. In UK section 192 cases, a qualifying certificate establishes planning-lawfulness for the described proposal. | Provides stronger evidence of lawfulness than an informal view, subject to the statutory test and the exact description. | Application fee and decision time vary. A material change before commencement can affect the presumption. | Building regulations, structural safety, environmental, heritage, highway and utility approvals. |
Jurisdiction and terminology differences
The responsible authority and document names differ. NSW guidance directs buyers to determine zoning through the NSW Planning Portal and describes planning certificates as parcel-specific records. Victoria’s consumer guidance directs buyers to investigate council permits and encumbrances, while Planning Victoria identifies a current title, registered restrictions and the plans and information council requests as part of the process. Kenya’s building-plan handbook emphasizes conformity with approved plans and zoning, access, services, environmental and heritage matters. UK guidance explains the limited purpose of a lawful-development certificate.
These examples are not interchangeable procedures. Before relying on a checklist, identify the country, state or county, local council and edition of the planning scheme that governs the plot. Ask that authority which certificate, permit search, title product and appeal or review rights apply. Use local terminology in the contract so a condition refers to the document the authority actually issues.

Common failure modes and practical fixes
Relying on the listing description
Failure: treating “residential,” “commercial” or “ready to build” as a legal conclusion. Fix: obtain the authority’s parcel-specific record and test the exact proposal.
Checking the zone but not the overlays
Failure: seeing a residential zone and overlooking flood, bushfire, heritage, environmental or access controls. Fix: request the full certificate and map layers, then list each additional approval or design limit.
Accepting a permit copy without authentication
Failure: relying on an old drawing, an unapproved amendment or a document for a neighboring lot. Fix: give the permit number and parcel identifier to the issuing authority and request confirmation of current status and conditions.
Ignoring private title restrictions
Failure: assuming planning permission overrides an easement or covenant. Fix: read every instrument on the current title and obtain legal advice on whether it binds the proposed work.
Signing before subdivision registration
Failure: treating an unregistered future lot as an ordinary titled parcel. Fix: make separate-title registration and satisfactory access and service arrangements express contract conditions.
Confusing preliminary advice with approval
Failure: treating a meeting, email or lawful-development certificate as permission to build. Fix: identify which planning, building, environmental, heritage and utility approvals remain outstanding and obtain each one.
Frequently asked questions
Is a zoning map screenshot enough to buy a plot?
No. A screenshot may be useful for locating the parcel, but it may not show parcel-specific controls, amendments, hazards or the legal boundary. Obtain the responsible authority’s current official record and match it to the title and survey.
Can I rely on an approved plan if the seller gives me the permit number?
Only after the issuing authority confirms the number, parcel, approved drawing set, conditions and current status. Ask whether amendments, expiry, cancellation, outstanding inspections or completion requirements affect it.

What should I do if the title and planning records use different lot numbers?
Pause the transaction. Ask the authority and land registry to explain the relationship in writing, and have a conveyancer confirm that the approval legally attaches to the parcel you will receive. Do not assume that a street address or proposed subdivision label resolves the mismatch.
Does a lawful-development certificate mean I can start construction?
No. It addresses planning-lawfulness for the described use or development where the statutory test is met. Building regulations, structural, fire, environmental, heritage, highway and utility approvals may still be required.
How current should the checks be?
Use records current to the date of your decision and ask the authority about proposed or recently adopted changes. If settlement or construction is delayed, repeat date-sensitive searches before committing funds or lodging plans.
Who should interpret a complicated result?
Use a local conveyancer or planning lawyer for title and contract issues, a licensed surveyor for boundaries and easements, and an architect or planning professional for design feasibility. Give each adviser the same parcel sheet and complete document set.
