Verify a construction contractor’s labor and payment records by first confirming that the project is covered by the Davis-Bacon and Related Acts (DBRA), then reconciling each weekly certified payroll to the contract’s wage determination, time records, work actually performed, fringe-benefit support, deductions, and proof of payment. Check subcontractors and lower tiers the same way. A signed certification is required, but it does not replace checking the underlying records.
DBRA is not a requirement for every construction project. Coverage depends on the federal or federally assisted funding, the prime contract’s labor-standards clauses, the incorporated wage determination, and the laborers or mechanics performing covered work. State, local, owner, and funding-program rules may add requirements, so use the project documents and agency instructions as the controlling sources.

Start by proving which rules apply
Do not begin by assuming that a payroll form makes a project a Davis-Bacon project. Establish the legal and contractual scope before judging wages or hours. Assemble the prime contract, funding information, DBRA clauses, every subcontract and lower-tier flow-down clause, the applicable wage determination and revisions, and the agency or funding recipient’s payroll-submission instructions.

Confirm the project and work covered
- Identify the funding source and whether the contract is a specified federal or federally assisted contract subject to DBRA.
- Confirm the construction type and project location used by the wage determination.
- Identify which portions of the work are covered and whether a worker also performed noncovered work that must be separated in the records.
- Check the wage-determination revision incorporated into the contract. The contract and applicable determination control the required base wage and fringe amounts.
- Look for project-specific classification decisions, conformance actions, or agency instructions that affect how labor is reported.
- Review state, local, owner, and funding-program requirements separately; they can impose obligations in addition to federal DBRA rules.
If the contract, funding, location, or wage determination cannot be established, label the review as incomplete rather than applying a generic prevailing-wage rate.

Build a complete payroll file for every tier
Request a period-by-period file from the prime contractor, each subcontractor, and every lower-tier firm that performed covered work. The file should let you move from a certified payroll entry to the underlying time, wage, deduction, fringe, and payment evidence without gaps.
Documents to request
| Record | What to verify | Why it matters |
|---|---|---|
| Weekly certified payroll | Contractor identity, project, workweek, worker names, classifications, daily and weekly hours, rates, fringes, deductions, gross wages, and net wages | Provides the worker-level compliance assertion that must be tested against source records |
| Statement of Compliance | Present for each certified payroll and signed by the contractor or an authorized person responsible for supervising wage payment | Confirms that the submission is certified; it is not a substitute for corroboration |
| Regular payroll register | Same worker, pay period, rate, gross pay, deductions, and net pay fields used to issue wages | Shows whether the certified figures agree with the employer’s ordinary payroll |
| Timecards or timesheets | Daily start, stop, or total hours; classification splits; project and nonproject time where relevant | Supports the reported hours and reveals rounding, omissions, or unexplained changes |
| Personnel and classification records | Worker identity and contact identifier, job assignment, and evidence of the work actually performed | Helps test classification rather than relying on a job title |
| Project attendance or daily reports | Presence on site, dates worked, crew or activity, and supervisor records | Provides an independent comparison for reported attendance and hours |
| Fringe-benefit records | Bona fide plan documents, contribution or cost support, and cash paid in lieu where applicable | Shows that claimed fringe credits satisfy the required amount |
| Payment evidence | Payroll disbursement records or other records showing actual net payment | Tests whether wages reported as paid were actually delivered |
| Subcontracts and flow-down clauses | Firm identity, scope, tier, and labor-standards language | Establishes who performed the work and the prime’s oversight chain |
Account for every week
List each contractor and subcontractor, the dates it worked, the payroll week, the regular pay date, and the date the certified payroll was received. Submissions should be sequentially accounted for. Investigate a missing week, a duplicated week, a payroll covering dates when the firm was not on site, or a contractor that appears in daily records but not in the payroll set.
Covered payrolls generally must be submitted within seven days after the contractor’s regular payroll payment date. Use the agency or funding recipient’s electronic-submission procedure where one exists. The WH-347 is a convenient optional form; using a different format does not remove the reporting obligation if it contains the required information and certification.
Check the certification before relying on the numbers
Each certified payroll should identify the project and contractor, state the correct workweek, identify the applicable wage determination, and include a valid signature from the contractor or authorized person responsible for supervising wage payment. A typed name without the required certification, an unsigned submission, or a signature from someone with no responsibility for wage payment requires clarification.

“Each certified payroll must be accompanied by a signed ‘Statement of Compliance’ (e.g., page 2 of the WH-347 or another document with identical wording) indicating that the certified payrolls are accurate and complete, and that each laborer or mechanic has been paid not less than the required Davis-Bacon prevailing wage rate(s) (including any fringe benefits) for the work performed.” — U.S. Department of Labor, Wage and Hour Division
Treat the statement as an attestation to test, not as independent proof. Trace a sample of entries to the records below and expand the sample when discrepancies appear.
Reconcile each worker to the work actually performed
Worker-level reconciliation is where many errors become visible. Use a consistent key, such as the worker’s name plus a contact identifier, and compare the same person across the certified payroll, regular payroll, timecards, personnel records, and project attendance records.
Validate classification
Compare the labor classification with the tasks the worker actually performed, not merely the employee’s title or the contractor’s customary label. Review daily reports, supervisor notes, crew assignments, and descriptions of work. If the person performed more than one classification, the payroll should separate the hours by classification and apply the corresponding rates. A single blended title or rate can conceal an underpayment.

Validate hours
- Re-add the worker’s daily hours and compare the total with the weekly certified total.
- Compare those hours with timecards, timesheets, gate or attendance records, and project daily reports.
- Separate covered and noncovered project time when the records or contract require that distinction.
- Follow any overtime or other premium calculation required by the contract or applicable law rather than assuming the straight-time rate is sufficient.
- Investigate edits, identical daily totals across long periods, missing days, and hours that exceed a worker’s plausible presence on site.
A recurring identical split of hours between two classifications is a warning signal, not proof of misconduct. Compare the pattern with the worker’s actual assignments and time records before reaching a conclusion.
Recalculate the wage and payment picture
For every sampled worker and workweek, create a calculation that can be reproduced from the contract and source records.
Base wage and fringe comparison
| Check | Method | Evidence to retain |
|---|---|---|
| Classification rate | Match each classification and covered hour to the wage determination in force for the contract | Applicable determination and revision, plus the payroll line |
| Fringe requirement | Compare the required fringe amount with supported bona fide plan contributions or costs, or with cash paid in lieu | Plan terms, contribution reports, invoices, and cash-pay detail |
| Multiple classifications | Calculate each classification separately instead of applying one average rate | Daily allocation and worker-level arithmetic |
| Gross wages | Recalculate hours multiplied by applicable rates, plus any required premium or fringe treatment | Payroll register and independent calculation |
| Deductions | Check that each deduction is documented and permitted, and that the amount agrees with payroll records | Deduction authorization, payroll register, and contract or legal basis |
| Net payment | Compare the certified net amount with the regular payroll and payment evidence | Disbursement record or other proof of payment |
Do not accept an unexplained difference because the totals look close. Trace whether it arose from a classification change, an hourly split, a fringe credit, a deduction, a pay-date mismatch, or an arithmetic error. Record both the contractor’s explanation and the document that supports it.

A fringe credit must be supported by the underlying plan or cost. Request the plan description, contribution calculations, payment or remittance records, and the period to which the contribution relates. If the contractor pays cash instead of providing a benefit, verify the cash amount in the payroll and ensure it is treated consistently with the applicable wage determination. An unsupported label such as “fringe” is not enough.

Follow the subcontractor chain
Prime contractors have oversight responsibility for subcontractor and lower-tier DBRA compliance. Build a tier map from the prime contract, subcontracts, purchase orders, daily reports, invoices, and site observations. Every firm that performed covered work should appear in that map and in the payroll accounting.
Questions for each lower-tier firm
- What work and dates did the firm perform?
- Which workers and classifications were used?
- Which wage determination and revisions were applied?
- Were weekly certified payrolls and Statements of Compliance submitted for every covered week?
- Do the firm’s time, payroll, fringe, deduction, and payment records reconcile?
- Did the prime review and resolve discrepancies, or simply collect the forms?
Compare lower-tier payrolls with the prime’s site records and payment applications. A subcontractor can report compliant wages while the prime’s records show different workers, dates, or hours; treat that conflict as an exception requiring evidence.

Classify issues by effect. Missing payrolls, apparent underpayments, unsupported fringe credits, impermissible deductions, classification concerns, and unexplained hour differences should be escalated promptly. Notify the contracting agency or funding recipient according to the contract’s procedure, and obtain qualified labor-compliance counsel when the facts or remedy are uncertain. The U.S. Department of Labor describes withholding accrued payments as a possible remedy in relevant cases; withholding is not an automatic result of every discrepancy.

Recognize red flags without treating them as proof
| Pattern | Possible explanation | Verification response |
|---|---|---|
| Same split of hours between classifications every week | Routine assignment, inaccurate allocation, or misclassification | Compare the split with daily tasks, supervisor records, and timecards |
| Certified hours differ from regular payroll | Late adjustment, payroll correction, or inaccurate certification | Trace the adjustment to a dated payroll correction and payment evidence |
| Fringe amount appears with no plan or contribution support | Unsubstantiated credit or incomplete file | Request plan terms and contribution or cost records; recalculate |
| Worker appears on site records but not payroll | Different employer, omitted payroll, or identity mismatch | Trace the worker through subcontract, time, personnel, and payment records |
| One classification used for visibly different tasks | Convenient title, mixed duties, or misclassification | Document actual work by day and compare with wage-determination definitions |
| Unsigned or late certified payroll | Administrative failure or missing supervision | Obtain a corrected submission and document the reason and receipt date |
| Net pay does not match payment evidence | Unpaid wages, deduction error, or timing difference | Reconcile the pay date, deduction detail, and disbursement record |
Retain records and control access
Covered payroll and basic labor records generally must be preserved for at least three years after all work on the prime contract is complete. The record set should include worker identity information, classifications, hours, rates, deductions, wages, contract information, certified payrolls, and supporting evidence.
Use a consistent file naming system by contractor, payroll week, and record type. Preserve the original certified submission and any corrected version, retain the discrepancy log with its supporting correspondence, and restrict editing access. Electronic systems can help organize submissions, but the agency or prime contractor’s instructions govern the accepted format and transmission process. A system’s existence does not prove that its data is complete or accurate.
A practical sign-off sequence
- Coverage: Contract, funding, clauses, wage determination, revision, location, construction type, and covered work are identified.
- Participants: Prime, subcontractor, and lower-tier firms are mapped to their scopes and dates.
- Payroll completeness: Every covered week is accounted for, with the required certification and receipt date recorded.
- Worker match: Names, identifiers, classifications, daily hours, weekly hours, and covered status agree across source records.
- Wage calculation: Base rates, classification splits, fringe treatment, gross wages, deductions, and net payment are independently recalculated.
- Evidence: Every fringe credit, deduction, correction, and payment is supported by a source document.
- Exceptions: Differences are logged, investigated, resolved or escalated, and linked to the applicable contract requirement.
- Retention: The final file is stored for the required period with an audit trail of changes and responses.
What a complete review can and cannot establish
A well-supported reconciliation can show whether the records presented for the sampled weeks are internally consistent and appear to meet the applicable contract and wage-determination requirements. It cannot establish DBRA coverage for a project whose funding or clauses have not been confirmed, and it cannot replace a formal agency determination where the classification, fringe plan, or remedy is disputed.
When federal DBRA rules apply alongside state, local, owner, or funding-program requirements, apply the stricter or additional obligation only when the governing documents require it. Keep those authorities identified in the review file so a later reviewer can see which rule supported each conclusion.
