A labour agency can put a skilled person or crew in front of a UK construction contractor quickly, but it does not remove the contractor’s duties. The reliable sequence is to define the gap in writing, select the correct type of supplier, compare complete terms, verify competence, and prepare and supervise the worker on site.
Start with a precise definition of the gap
“We need labour urgently” is not a usable instruction for a supplier. Write a short scope that another person could use to identify the right worker without guessing. A precise brief reduces unsuitable CVs, prevents disputes about what was ordered and gives you a fair basis for comparing suppliers.

Specify the work, place and timing
- Trade or role: for example, groundworker, bricklayer, slinger/signaller, electrician or site supervisor.
- Tasks and boundaries: describe the work to be done and anything the worker will not do. Include plant, materials, drawings, systems or interfaces involved.
- Headcount: state whether you need one person, a named crew size or several interchangeable workers.
- Site and travel: give the project address or postcode, access arrangements, parking or public-transport constraints and any travel between locations.
- Start and finish: provide the intended start date, expected duration and whether the assignment may extend.
- Hours and shifts: list normal hours, nights, weekends, rotation, overtime expectations and mandatory breaks.
- Coordination: identify the supervisor, other trades, permits, sequencing constraints and meetings the worker must attend.
GOV.UK guidance on supplying agency workers says a hirer should provide the agency with its identity and location, assignment dates and duration, role, hours, required experience, training, qualifications and authorisations, plus known health-and-safety risks and the controls already in place. Treat those items as the minimum content of your written request.

Separate essential requirements from preferences
Mark each credential as legally required, required by the principal contractor or client, required by your risk assessment, or simply preferred. State the evidence you will accept, such as a current certificate, training record, professional membership, competence card or reference. Do not ask an agency to “send someone experienced” without defining what experience means for the actual task.

Record hazards and existing controls
List hazards that affect the assignment: excavation, lifting operations, work at height, live services, traffic management, confined spaces, temporary works or hazardous substances. Note the controls already established, such as exclusion zones, permits, edge protection, lifting plans, briefings and supervision. The agency needs this information to describe the assignment accurately; you still have to check that the person is competent and that the controls work on the day.
Understand which supplier you are appointing
In ordinary conversation, “agency” can describe two legally different arrangements. Establish the contractual chain before you accept a worker or rate.
| Arrangement | Who contracts with or employs the worker | Who directs the day-to-day work | What to confirm |
|---|---|---|---|
| Employment agency (introduction) | The hirer employs the candidate directly after an introduction. | The hirer, as employer and site operator. | Employment start date, payroll and right-to-work process, probation or notice terms, and any introduction or transfer fee. |
| Employment business (temporary supply) | The employment business engages the worker under a contract and supplies them temporarily. | Normally the hirer, under the assignment arrangement. | Who pays the worker, who records and approves hours, insurance and liability wording, replacement process, and the supplier’s charges. |
GOV.UK describes an employment business as responsible for paying a temporary work-seeker for all hours worked, even when the hirer has not paid the business or has not authorised the timesheet. Agree how hours will be captured and corrected, but do not assume an unauthorised timesheet allows the supplier to withhold pay.

The Agency Workers Regulations guidance describes an agency worker by reference to the contract with a temporary work agency, temporary supply to a hirer and work under the hirer’s direction and supervision. If the practical arrangement differs from its label, the reality may matter in a dispute. Ask the supplier to explain the chain in plain language and have your commercial or legal adviser review unusual structures.
Prepare one written brief for every prospective supplier
Send identical core information to each agency. You can discuss confidential project details separately, but changing the role description between calls makes quotes and candidates impossible to compare.

Use this brief structure
- Project: client or principal contractor (where disclosure is permitted), site address and access contact.
- Assignment: trade, tasks, quantities or outputs, plant and materials, reporting line and limits of authority.
- Dates and hours: start date, estimated end date, daily hours, shifts, overtime and expected continuity.
- Competence: essential experience, qualifications, cards, training, authorisations, language or communication needs and any client-mandated schemes.
- Safety information: principal hazards, controls, PPE expectations, permits, welfare arrangements and induction requirements.
- Commercial basis: requested pay or charge basis, timesheet cycle, overtime rules, minimum booking, cancellation window and whether direct hire may follow.
- Response format: ask the supplier to state the proposed worker’s availability, location, evidence supplied, charge rate and assumptions in the same order.
Ask each supplier how it checks trade history, qualifications and availability; what documents it can share before the start; who handles pay and timesheets; and how it manages absence, a changed start date or an unsuitable match. These questions test the service you are actually buying, not a generic promise that the agency is “specialist”.
Compare the complete offer, not just the hourly figure
A low headline charge can become expensive if the worker lacks the required authorisation, travels too far to remain reliable, or cannot be replaced when absent. Put each response into a comparison sheet and record assumptions beside every number.

The official guidance reviewed for this subject does not establish a standard construction-agency rate, response time, minimum booking or replacement period. Obtain a quote for the particular vacancy and read the contract for the particular assignment. Do not present a local quotation as a market benchmark.
Check the arithmetic and assumptions
Ask whether the quoted amount is per hour, per shift or per worker; whether holiday pay, employer costs, travel, accommodation, PPE, certification or administration are included; and whether overtime, nights and weekends use a different basis. Confirm the timesheet cut-off, invoice timetable, VAT treatment and the process for correcting an error. Have the person with purchasing authority approve the same written terms that the site manager expects.
Verify competence before the first shift
Outsourcing recruitment does not outsource the contractor’s competence duty. HSE’s CDM 2015 guidance says contractors must “check that all workers they employ or appoint have the skills, knowledge, training and experience to carry out the work, or are in the process of obtaining them”. That applies when you appoint an employment business, agency-introduced employee, subcontractor, individual or self-employed worker.

Use a proportionate evidence check
Match the depth of checking to the task’s complexity and risk. HSE identifies the following as possible evidence:
Outdated Drivers Are Slowing You Down
One free scan finds every outdated or missing driver and matches the right update for your exact hardware.Free scan · exact hardware matchWindows Errors? Fix Them Before They Spread

- Professional or trade memberships.
- References for previous construction work, ideally involving comparable tasks.
- Certificates, competence cards and task-specific authorisations.
- A practical assessment, supervisor interview or verified work history where paperwork alone does not demonstrate ability.
Check expiry dates, name consistency and the scope of each document. A generic construction card does not by itself prove competence for every activity. If a qualification is being obtained, document what the person may do under supervision, who provides that supervision and the date by which the gap will be reviewed.
Decide who owns each check
The supplier may pre-screen a worker and provide evidence, but your organisation decides whether the person is suitable for the actual site and task. Record who reviewed the documents, what was accepted, any restrictions and the approving manager. Where a principal contractor or client sets a higher standard, apply that standard as well as your legal baseline.
Book the worker and make the site ready
Once you select a supplier, turn the verbal agreement into a booking confirmation. Include the worker’s name (or the agreed crew description), trade, task, site, start date, hours, charge basis, supervisor, competence conditions and cancellation or replacement terms. Ask the supplier to confirm the worker has received the same assignment information.
Complete these steps before arrival
- Confirm identity and access: give the gate contact, reporting point, parking instructions, access restrictions and documents needed to enter.
- Prepare welfare and PPE: make sure facilities are available and state what the worker must bring versus what the site supplies.
- Plan the induction: reserve time for site rules, emergency arrangements, reporting lines, traffic routes, restricted areas, welfare, first aid and the project’s risk controls.
- Assign supervision: name the competent person who will brief and observe the worker, especially while a new starter learns the site.
- Provide information and instructions: issue current risk assessments, method statements, permits, lifting plans, drawings and interfaces relevant to the task.
- Record attendance and competence: keep the induction record, toolbox talks, authorisations, timesheets and any restrictions in the project file.
HSE’s contractor guidance requires appropriate induction and supervision. A supplier’s screening call cannot replace a site-specific induction unless that induction has genuinely already been delivered and remains current for the assignment.

Manage agency-worker rights in Great Britain
The GOV.UK Agency Workers Regulations guidance updated on 25 March 2026 applies to England, Scotland and Wales. Northern Ireland has separate agency-worker regulations, so confirm the rules for the site’s jurisdiction before relying on this section.
Day-one rights
From the first day of an assignment in Great Britain, an agency worker must have access to shared facilities and information about vacancies with the hirer. Make sure the site explains how to use canteens, toilets, parking, transport or other shared services on the same basis as comparable workers, subject to lawful access rules. Give the worker a practical way to see internal vacancy information.
Equal treatment after 12 weeks
After 12 weeks in the same job with the same hirer, equal treatment applies to pay and basic working conditions, including annual leave and rest breaks. If an assignment may run beyond 12 weeks, tell the temporary work agency early about the relevant terms and update it when those terms change. Keep an accurate record of start dates, role changes and breaks in assignments so the supplier can administer the entitlement correctly.
Do not assume that moving a person between labels or minor task variations removes the 12-week issue. The guidance focuses on the same job and the same hirer; obtain advice on complex rotations, connected assignments or changes in the contracting chain.

Control changes, absence and a poor match
Urgent labour is most valuable when the booking remains controlled after the first day. Agree a simple change process with the supplier and put it in the booking confirmation.

If the start date or scope changes
Pause the worker’s arrival if the site, hazards, hours or required authorisation has materially changed. Send the revised brief, ask the supplier to reconfirm suitability and update the induction and risk controls. Do not let a worker start a different task merely because they are already at the gate.
If the worker is absent
Notify the named agency contact, record the missed shift and request a replacement under the agreed terms. Check that any substitute has been assessed for the same task and receives the same induction. Avoid allowing an unverified substitute to fill a safety-critical role just to preserve production.
If competence is unsuitable
Stop the task safely, explain the specific shortfall and record what happened. Ask whether the supplier can provide a better-matched worker or whether the assignment should end. Follow the contract’s notice and cancellation process, but never continue unsafe work to avoid a charge.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsKnow when an agency is the wrong solution
Temporary supply is useful for a defined surge, a short absence, a specialist phase or a programme recovery measure. It is less suitable when the work is indefinite, the role requires deep project knowledge that takes weeks to acquire, or the site cannot provide the supervision and induction required for a new person.
Use the immediate booking to identify the underlying capability problem. HSE treats training records as competence evidence, and CITB’s February 2021 report discusses the importance of developing the domestic construction workforce. That report drew on survey fieldwork from September to November 2020: 72% of employers surveyed said the end of free movement and introduction of the points-based immigration system would affect the industry’s ability to secure a skilled workforce. It is historical context, not a 2026 measure of vacancies, agency availability or current shortage levels. For recurring gaps, plan apprenticeships, accredited training, mentoring and a permanent recruitment route alongside any temporary cover.
Urgent-booking checklist
- Role, tasks, limits and headcount are written down.
- Site, travel, start date, duration, hours and shifts are confirmed.
- Required experience, qualifications, training and authorisations are identified.
- Known hazards and existing controls are included in the brief.
- The supplier model is clear: introduction or temporary employment business.
- Pay, timesheets, charges, overtime, minimum booking, cancellation, replacement and transfer terms are written.
- Worker evidence has been checked against the actual task and risk.
- A competent supervisor, induction, welfare, information and instructions are ready.
- Great Britain day-one access and 12-week equal-treatment information is being managed where applicable; Northern Ireland rules are checked separately.
- A named contact and escalation route exist for changes, absence or an unsuitable match.
Final decision rule
Choose the supplier that can demonstrate the closest match to the defined work, provide credible competence evidence, explain the employment and payment chain, and accept clear written terms. The fastest “yes” is not a successful booking if the worker cannot perform the task safely or the site is unprepared. Treat the agency as a sourcing and administration partner; retain control of competence, induction, supervision, information and instructions at the construction site.
