For active construction that appears unsafe, unpermitted, outside approved plans, underway after permitted hours, or continuing under a Stop Work Order, file the appropriate complaint through NYC311 (311 by phone or 311ONLINE). Keep the Service Request number you receive so you can check the case later.
The correct route depends on what is happening, whether the work is active, and how urgent the risk is. This guide explains which complaint to use, what to document, how construction hours and variances work, what tenants should see posted, and what follow-up the city actually promises.

Choose the right NYC reporting route first
New York City uses separate complaint categories for different construction problems. Choosing the closest match gives the Department of Buildings (DOB) the facts it needs without asking you to prove a violation yourself.

When to call 911 instead of 311
Use 911 when the danger is happening now and could injure someone or damage property before a routine inspection occurs. Examples identified by the city include:
- A strong gas odor or a possible gas leak.
- Falling debris that presents an immediate hazard to people below or nearby.
- An accident at the construction site.
Move away from the hazard if you can do so safely. Do not enter a restricted work area, confront workers, attempt a repair, or climb onto scaffolding to investigate. A routine complaint form is not a substitute for emergency dispatch. If you have already filed a 311 complaint and the situation becomes immediately dangerous, call 911 again rather than waiting for the existing request to be updated.
How to file an active construction complaint
1. Identify the condition while it is occurring
NYC311’s Building Construction Complaint route covers active unsafe work, suspected work without a permit, work outside approved plans, and other construction conditions. Report active work promptly, because the useful facts are often time-specific: what is being done, where it is happening, and whether workers are present.
If the issue is recurring, note several dates and times instead of describing it only as “ongoing.” A pattern can be reported along with the latest occurrence. Do not wait for a perfect record; an accurate address and a current description are more important than collecting evidence at personal risk.
2. Gather location and observation details
Record the street address, borough, and the part of the property involved (for example, rear yard, roof, sidewalk shed, or a particular apartment). Note the date and approximate time, the work you saw, and why it appears unsafe or unauthorized. Describe facts rather than conclusions: demolition of a load-bearing-looking wall, excavation next to a neighboring foundation, workers above an unprotected sidewalk, or construction continuing after a posted Stop Work Order.
Include the entrance, side of the building, floor, or neighboring lot when a large site has more than one work area. If you can see a contractor sign, permit placard, or order notice from a safe public location, report the identifying information exactly as displayed. The city sources do not require a reporter to conduct an inspection, identify the responsible contractor, or determine conclusively that a violation occurred. DOB decides whether an inspection, violation, or other action is appropriate.
3. Check the posted permit, if one is visible
NYC311 asks reporters to note whether a permit is posted and whether people live in the building. A permit is a document showing that a construction, demolition, or alteration job has met DOB requirements and complies with the Building Code and Zoning Resolution. A missing or unreadable permit is an observation to include; it is not proof by itself that every activity is illegal. Conversely, a posted permit does not establish that every part of the current work follows the approved scope.
The city separates active work into categories including:
Rank #2
- Ergonomically Designed: Work in tight areas with a compact design that gets into tough spots
- Both tools are designed to fit into difficult to reach spaces
- Complete a wide range of applications with a high-performance motor that delivers up to 300 UWO, and an impact driver delivering up to 1,400 in-lbs of torque
- Both the DEWALT impact driver and drill driver feature integrated LED work lights with a convenient 20-second delay, ensuring enhanced visibility in dimly lit or challenging work areas
- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
- Occupied buildings with three or more residential units.
- Occupied one- or two-family homes.
- Unoccupied or commercial buildings and new construction.
Select the category that matches the property when 311 asks for it. If apartments are occupied in part of a building, say so even if another floor is vacant. If you do not know the occupancy status, report what you can observe rather than guessing.
If you can safely read a permit, copy the displayed job or application number and the type of work. Do not enter the site or put yourself near machinery to obtain a number. A photograph from a public area may help you transcribe a placard, but safety takes priority and the complaint can still be filed without a photograph.
4. Describe work that appears outside approved plans
If the activity does not match the approved scope, explain the specific difference. For example, say that workers are removing a floor or extending an opening that is not shown in the posted plans, rather than simply writing “illegal work.” Include the nine-digit job application number if it is available. Note which portion of the building or lot is affected and whether the activity is demolition, alteration, excavation, structural work, or another visible operation. The more precisely you identify the apparent mismatch, the easier it is for DOB to compare the observation with its records.
5. Report after-hours work with the relevant facts
For activity outside normal construction hours, provide:
- The type of work, such as demolition, drilling, concrete placement, or delivery activity.
- When it is occurring, including the date and start and end times if known.
- Whether a permit is posted.
- The address and the affected side of the property.
Use the separate Noise from Construction complaint when the principal issue is jackhammering or other construction noise. You can also identify an after-hours concern through the Building Construction Complaint route when the work itself appears unauthorized. If the activity changes from noisy work to another operation, describe both the sound and the underlying construction activity.
Construction hours, weekend work, and variances
NYC311 states that DOB allows construction Monday through Friday from 7 a.m. to 6 p.m. It also describes a limited weekend allowance for alterations or repairs at one- and two-family homes: 10 a.m. to 4 p.m. when the home is more than 300 feet from a house of worship.
Work outside the standard hours requires an approved variance. Before treating nighttime or weekend activity as unauthorized, check the city’s Active After Hours Variance Map for a current site variance. A variance can explain work that otherwise appears to be outside the ordinary schedule. If no applicable variance is shown, report the time, activity, address, and permit information you observed; DOB determines whether the work complies. The map check is a way to add context, not a substitute for reporting a dangerous condition.

Recognize the two types of order
DOB issues a Stop Work Order when inspectors determine that a site has unsafe work or conditions. A full order bars all work except authorized remedial work needed to make the site safe. A partial order prohibits specified work or work in a particular area, so activity elsewhere may not automatically violate the order.

When the order concerns work without a permit, the covered work cannot resume until a permit is issued and DOB rescinds the order. NYC311 says no work may occur at the site until DOB issues an order rescinding it; for a partial order, read the order’s scope carefully. Authorized remedial work may look like activity at a site under a full order, so describe exactly what workers are doing instead of assuming that every movement is prohibited.
File the Stop Work Order complaint
- Note the address and the exact activity you saw continuing.
- Describe whether the work appears to be in the area or category covered by the order.
- Record the date and time, and whether workers, equipment, deliveries, or demolition were active.
- Submit the report through the NYC311 Stop Work Order complaint route.
You can check the order’s status on DOB’s Stop Work Order Map. The city says DOB issues violations when appropriate; it does not promise that every report will result in a particular penalty. If the map and the posted order appear inconsistent, mention both facts in the complaint and let DOB reconcile the records.
Past conversions and occupancy problems
Use the separate Building Conversion or Occupancy Complaint route for a past or existing change in how a building is used, such as an unapproved conversion or occupancy condition. This is different from reporting active construction. A conversion or occupancy report is appropriate when the central question is how space is being used, even if the construction that created the condition ended earlier.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Describe the apparent use, the affected floors or rooms, how long the condition has existed if known, and whether people currently occupy the space. Explain observable facts such as additional dwelling units, a changed commercial use, or rooms being occupied in a way that differs from the building’s apparent layout. If the condition creates an immediate danger to life or property, call 911 rather than waiting for the conversion complaint process.
Worker-site and neighboring-property safety
The Building Construction Complaint category includes unsafe conditions affecting workers and unprotected neighboring property or safety netting. Explain the visible hazard without approaching it: missing edge protection, unsecured materials, debris falling toward a neighboring lot, or absent netting where it appears necessary.
NYC311 says a report about an unsafe site for workers can be anonymous. Anonymous reporting can be useful when you are concerned about retaliation, but provide as much location and observation detail as possible because follow-up questions may not be possible. Even when you give contact information, avoid entering a hazardous area or attempting to interview workers. A clear address, time, and description are more useful than a risky close inspection.
What tenants should look for during ongoing work
For ongoing construction, the owner must post or distribute a Safe Construction Bill of Rights and a Tenant Protection Plan notice. The Bill of Rights should explain:
Recommended Free Tools
- The work being performed.
- Building services that may be interrupted.
- Construction hours.
- A projected completion timeline.
- An owner employee’s contact information.
- How to make complaints.
If these notices are missing, incomplete, or inconsistent with the work you see, include that fact in your NYC311 report. Note where a notice should be posted, which information is missing, and whether services such as heat, water, elevators, or access appear affected. Keep copies or photographs only when you can do so safely and without entering a restricted area. The notices do not replace a 911 call for an immediate hazard or a construction complaint for unsafe work.

What information makes a complaint actionable
Use a short factual record before you call or submit online:
- Where: exact address, borough, entrance, side, floor, or yard.
- When: date, time, and whether the activity is still happening.
- What: work type, equipment, materials, noise, debris, or occupancy condition.
- Permit details: whether a permit is posted and any readable nine-digit job application number.
- Occupancy: whether people live in the building and which residential category applies.
- Order or plan issue: Stop Work Order information or the specific difference from approved plans, if known.
- Safety impact: who or what may be exposed, without estimating technical risk you cannot verify.
Photos or video may help explain a condition, but do not delay an emergency call to collect evidence. Never trespass, move barriers, touch equipment, or put yourself beneath suspended loads or falling debris. Do not confront an owner, contractor, tenant, or worker; the city’s complaint channels are designed to receive observations without requiring a resident to investigate.

Whether you call 311 or use 311ONLINE, DOB says the person who files receives a Service Request number. Save it with the address, date, and a copy of what you reported. Use the number to follow up through 311ONLINE. If you make separate reports about different conditions, keep each number linked to the specific issue rather than assuming one request covers every new event.

The cited city guidance does not guarantee a specific inspection date, enforcement result, or resolution time. A pending status therefore does not establish that work is approved, and a closed request does not by itself explain every condition at the property. If a new or more dangerous condition develops, make a new report—or call 911 if it has become an immediate emergency. Do not treat the absence of an immediate update as permission to approach the site or continue monitoring from an unsafe location.
What the city’s Stop Work Order data does—and does not—show
DOB’s 2026 second-quarter top-conditions list reported that 21.7% of listed Stop Work Order violations were categorized as “WORK WITHOUT A PERMIT,” 17.6% as “MISCELLANEOUS VIOLATIONS,” and 12.6% as work not conforming to approved construction documents or amendments.
Those percentages describe the agency’s Q2 2026 list of Stop Work Order violations; they are not shares of all construction violations in New York City. Use them as a snapshot of categories appearing in that list, not as a forecast of what will happen in an individual complaint. The figures also do not determine whether a particular address has a violation; only the property’s records and DOB’s response can do that.
Common mistakes to avoid
- Using 311 for an emergency: gas odors, dangerous falling debris, and accidents belong with 911.
- Choosing a noise complaint for every issue: use Building Construction Complaint when the central problem is unsafe or unauthorized work, even if it is noisy.
- Assuming after-hours work is automatically illegal: check the Active After Hours Variance Map and report the facts.
- Assuming a posted permit settles the question: describe work that appears outside the approved scope and provide the nine-digit application number when available.
- Ignoring the scope of a partial Stop Work Order: identify the area or operation covered by the order.
- Trying to prove the case personally: do not enter the site, move barriers, or inspect structural conditions.
- Discarding the Service Request number: it is the reference DOB says you can use for online follow-up.
A practical decision checklist
- Is someone in immediate danger? Call 911 for a gas odor or possible leak, hazardous falling debris, or an accident.
- Is active work unsafe, unpermitted, outside approved plans, or occurring at questionable hours? File a Building Construction Complaint through 311 or 311ONLINE.
- Is work continuing under a Stop Work Order? Use the Stop Work Order complaint route and check the DOB Stop Work Order Map.
- Is the issue a past conversion or occupancy condition? Use the Building Conversion or Occupancy Complaint route, unless it is an immediate danger.
- Is the principal problem construction noise? Use the Noise from Construction complaint and state the type and timing.
- Before submitting: capture the address, timing, activity, occupancy, permit visibility, and any job or order number you can obtain safely.
- After submitting: retain the Service Request number and use 311ONLINE for follow-up.
Frequently Asked Questions
Can I report construction without knowing whether a permit exists?
Yes. Report the address, activity, timing, occupancy status if known, and whether a permit is visible or unreadable. You do not have to prove that a violation occurred; DOB decides whether further action is appropriate.
What if construction is happening after 6 p.m. or on a weekend?
NYC311 states that ordinary construction hours are Monday through Friday, 7 a.m. to 6 p.m. Alterations or repairs at one- and two-family homes may be allowed from 10 a.m. to 4 p.m. on weekends when the home is more than 300 feet from a house of worship. Check the Active After Hours Variance Map, then report the observed time and work if it still appears unauthorized.

Does a Stop Work Order always mean no activity at all?
A full order bars all work except authorized remedial work needed to make the site safe. A partial order prohibits specified work or work in a particular area. Describe the exact activity and location so DOB can compare it with the order’s scope.
Can an unsafe construction report be anonymous?
NYC311 says a report about an unsafe site for workers can be anonymous. Even without contact information, provide a precise address, date, time, and factual description because anonymous reporters may not be available for clarification.
What should tenants do if the Safe Construction Bill of Rights is missing?
Note that the notice is missing, where it should have been posted, and what work or service interruption you observe. Include that information in a construction complaint. Call 911 instead if the condition is an immediate danger to life or property.
How do I report a conversion that happened in the past?
Use NYC311’s Building Conversion or Occupancy Complaint route. Describe the apparent use, affected floors or rooms, how long it has existed if known, and whether people occupy the space. Use 911 for an immediate danger.
Will DOB guarantee an inspection date or a violation?
No. The cited city guidance says you receive a Service Request number for follow-up, but it does not promise a particular inspection date, enforcement result, or resolution time. DOB issues violations when appropriate.
What should I do if the hazard gets worse after I file?
Make a new 311 report for a changed or additional condition. If it becomes an immediate danger—such as a gas odor, hazardous falling debris, or an accident—call 911 rather than waiting for the existing request.
The Bottom Line
Use 911 for immediate danger. Use the NYC311 Building Construction Complaint route for active unsafe, unpermitted, after-hours, or out-of-plan work; use the dedicated Stop Work Order, conversion or occupancy, and construction-noise routes when those are the central issues. Report the address, timing, activity, occupancy, permit and order details you can safely observe, then keep the Service Request number for 311ONLINE follow-up.
