How to Report Unsafe Conditions or Damage Near a U.S. Road Construction Site

Use the route that matches both the urgency and the person or property at risk. Call emergency services for an immediate threat to life or an active serious crash. For a non-emergency pothole, damaged barrier, missing sign, unsafe detour, or other condition affecting road users, report it to the state, county, city, or other agency that owns or maintains the road. For a hazard exposing construction employees, use the Occupational Safety and Health Administration (OSHA) complaint process or the applicable OSHA-approved State Plan.

Do not enter a work zone to investigate, and do not use an online OSHA form or email for an emergency. A useful report identifies the road and travel direction, a precise location, what you observed, when you saw it, who is exposed, and whether the danger is continuing.

Choose the right reporting route first

The same construction site can create two different kinds of complaints. A driver may encounter a displaced cone or open trench; a worker may face an unguarded excavation or a hazardous piece of equipment. Those concerns go to different organizations. Immediacy is a separate decision: a condition that could injure someone now requires emergency response rather than a routine web submission.

When to call emergency services

Call 911 when waiting for an agency’s routine response could allow someone to be killed or seriously injured. Examples include a live collision in the work zone, a person in the roadway, a collapsed structure, an exposed electrical or gas line, a fire, a hazardous-material release, or traffic-control equipment that has suddenly failed while vehicles are passing.

  1. Get out of the hazard. Stop or park only where you can do so lawfully and safely. Do not cross traffic lanes, climb barriers, walk into an excavation, or enter an active work area.
  2. Give dispatch a precise location. State the road name, direction of travel, nearest intersection, exit, address, or mile marker. Mention the lane, shoulder, ramp, bridge, or side of the roadway if known.
  3. Describe the immediate threat. Say what is happening now, whether anyone is injured, whether traffic is moving toward the hazard, and whether fire, utility, chemical, or structural dangers are present.
  4. Follow the dispatcher’s instructions. Do not attempt traffic control, rescue, firefighting, or utility isolation unless trained and directed to do so.

OSHA’s published instruction is explicit: “Do not report an emergency using this form or email!” For a fatality or imminent life-threatening situation, OSHA directs callers to 1-800-321-OSHA (6742). That number is an OSHA reporting instruction, not a substitute for 911 when immediate emergency response is needed.

How to report a non-emergency road hazard or damage

1. Identify who owns or maintains the road

Look for route shields, street signs, project signs, or a construction notice naming the owner. A state route is commonly handled by a state transportation department; a residential or city street may be a municipal public-works department; a county road may have its own road division. A toll road or bridge can have a separate authority. If the project sign names a public owner, start with that owner’s current official reporting page or telephone contact.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not assume the contractor is the correct first recipient. Contractors may be able to correct a condition quickly, but the public agency or road owner normally controls the roadway and its traffic-management requirements. If a project sign supplies a 24-hour project or incident number, you may provide the same information there while also notifying the owner for a formal record.

2. Use the agency’s current official channel

Search the responsible government agency’s official website for terms such as “road condition,” “report a problem,” “construction project,” “maintenance request,” or “traffic incident.” Agencies may offer a web form, telephone line, mobile application, or contact center. The exact channel varies by location and can change, so use the current page rather than an old bookmark, social-media post, or unverified directory entry.

If you are unsure which jurisdiction owns the road, tell the first agency you reach that you need an ownership or maintenance referral. Keep the date, time, confirmation number, and name of any representative who accepts the report.

3. Describe the condition in observable terms

Separate what you saw from what you suspect. “The right lane is closed by a concrete barrier that has shifted approximately one lane width” is more useful than “the contractor caused a dangerous setup.” If you do not know whether a utility line is energized, say that a line is down or exposed; do not label it safe or live without confirmation.

Explain how the condition affects travel: vehicles are forced into an open lane, pedestrians cannot reach a crossing, water is undermining the shoulder, a sign contradicts the detour, or debris is entering traffic. State whether the condition appears ongoing, intermittent, or already corrected.

4. Attach evidence only when it is safe and lawful

Photographs can show a missing sign, damaged pavement, or barrier position, but never stop in a live lane, use a shoulder that is closed, stand behind a temporary barrier, or enter the work zone to obtain a better view. Take a picture only from a lawful, protected location. Do not use a phone while driving. If taking a photograph would increase your risk, provide a detailed written description instead.

5. Request a confirmation and monitor the danger

Ask whether the agency has logged the issue and how to provide an update if conditions worsen. A routine report is not an emergency warning system; if the hazard becomes immediately dangerous, call 911 even if you already submitted a form. If the agency gives a case number, save it with your notes and any photographs.

How to report a construction-workplace safety hazard

OSHA and OSHA-approved State Plans address hazards to employees at a worksite. This route is appropriate when the concern involves working conditions such as an unprotected trench, fall hazard, unsafe machinery, inadequate protective equipment, exposure to chemicals, or a traffic-control arrangement that places employees in danger. It is not the general intake channel for every pothole or damaged public roadway.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the federal or state process that applies

OSHA’s complaint process asks you to select the state and indicates whether the complaint should be filed through that state’s program. In a State Plan jurisdiction, most complaints are handled by the state program rather than directly by federal OSHA. Follow the routing shown on the current OSHA form instead of sending the same complaint indiscriminately to multiple offices.

Prepare the information OSHA requests

  • The employer or establishment name, if known.
  • The worksite address or the best location description available.
  • A specific description of each hazard and where it appears at the site.
  • The date you observed the condition and whether it is continuing.
  • The approximate number of employees exposed.
  • Any injury, illness, hospitalization, or death connected with the hazard.
  • Your contact information if you want the agency to clarify details or provide follow-up.

Describe conditions you personally observed. If you are reporting information supplied by someone else, identify it as second-hand and explain when and how you received it. Do not enter the site, confront a supervisor, or collect evidence in a way that could expose you or workers to additional danger.

Emergency workplace events still require emergency action

For a fatality or imminent life-threatening situation, OSHA directs callers to 1-800-321-OSHA (6742), and its instructions say not to use the online form or email for an emergency. Call 911 when local responders are needed immediately. After the scene is secure, the appropriate OSHA or State Plan report can preserve the workplace-safety record.

What to write down before submitting a report

Make notes from a safe location as soon as practical. The following checklist covers the details most likely to help an agency locate and prioritize the problem.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Date and time: Include the time zone if you are reporting later or traveling between jurisdictions.
  • Road and direction: Give the route or street name and whether you were traveling northbound, southbound, eastbound, westbound, or toward a named destination.
  • Exact location: Provide the nearest cross street, address, exit, bridge, ramp, mile marker, or visible landmark. For a long work zone, identify the lane and side of the road.
  • Condition: Name the damaged or missing item—pavement, curb, drainage, cone, barrier, sign, signal, light, fence, utility, or equipment—and describe its position and extent.
  • Exposure: Explain whether people are injured, workers are present, vehicles are being diverted, or pedestrians and cyclists are forced into traffic.
  • Duration: Say whether you saw it once, observed it repeatedly, or believe it is continuing.
  • Previous notice: Record any agency, project office, police department, or emergency service already contacted, including a case number if one was provided.

For an OSHA complaint, add the worksite, hazard description, hazard location, observation date, and approximate worker exposure. For a road-maintenance report, emphasize the traveling public, the infrastructure affected, and the action needed to make the location safe.

How to describe common work-zone problems

Damaged pavement, shoulder, curb, or drainage

Report the lane or shoulder, approximate size or depth if it can be estimated safely, water or debris, and whether vehicles are swerving or losing control. Explain whether the defect is inside the signed work zone or outside it but appears related to construction traffic. Avoid assigning responsibility unless you have direct evidence.

Missing, displaced, or confusing traffic control

Identify the missing cone, drum, arrow board, sign, barrier, pavement marking, or signal. Quote conflicting sign messages when possible, state which lane drivers are entering, and note whether visibility is reduced by darkness, weather, dust, or a curve. A report that distinguishes “sign is absent” from “sign is present but faces the wrong direction” helps the agency send the right crew.

Debris, spills, or exposed utilities

Do not touch debris, approach a spill, or handle a cable or pipe. State the material only if it is obvious, describe its location relative to traffic, and report fumes, fire, pooling liquid, or downed lines as emergency information. If there is any possibility of an energized electrical or gas line, keep away and call emergency services.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Pedestrian, bicycle, and accessibility problems

Explain whether a sidewalk, crossing, curb ramp, bus stop, or accessible route is closed; where the signed detour sends people; and whether the detour ends in traffic, mud, a drop-off, or a locked gate. Give the nearest usable crossing or landmark without attempting to create your own route through the work area.

California as a jurisdiction-specific example

California’s transportation department provides an example of an agency incident procedure, not a nationwide public-reporting rule. Its construction manual lists serious injury, death, high-potential near misses, hazardous utility breaks, hazardous-material incidents, hazardous spills, major facility damage, and other events among reportable construction incidents.

For serious injury or a fatality, that procedure directs staff to call 911 first. After responders secure the scene, staff contact district transportation management or communications channels. A member of the public should still use 911 for an immediate emergency and the responsible road authority’s current public contact for a non-emergency condition. Procedures for another state, county, city, or project may differ.

What happens after you report

The receiving agency may dispatch maintenance or traffic personnel, refer the issue to another owner, request more information, or determine that the condition is already scheduled for repair. A report does not guarantee a particular repair time. Weather, utility coordination, traffic volume, and the severity of competing incidents can affect response.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the condition remains and creates a new immediate threat, make a fresh emergency call rather than relying on the original case number. For a continuing non-emergency problem, provide the prior reference number and explain what changed. Keep your follow-up factual; avoid repeated assumptions about who is legally responsible.

Why work-zone reporting matters

Federal Highway Administration data cited in a November 5, 2024 rule announcement found that four out of five work-zone fatalities involved drivers or passengers. That dated figure describes the importance of protecting road users as well as workers; it should not be presented as a newly verified 2026 statistic.

In the same announcement, Acting Federal Highway Administrator Kristin White said: “With USDOT’s commitment to Vision Zero – a future where no one dies on our roads – it’s critical that we keep people safe in work zones, including travelers and those constructing our roads.” Reporting a dangerous condition promptly gives the road owner or emergency responders a chance to address a hazard before it becomes a collision or injury.

Frequently Asked Questions

Who do I call about a dangerous road construction zone that is not an emergency?

Contact the agency that owns or maintains that roadway—such as the state transportation department, county road division, city public-works department, or a toll-road authority—using its current official road-condition or construction reporting channel. The responsible agency depends on the road’s location and ownership.

Should every road-construction complaint be sent to OSHA?

No. OSHA and an applicable State Plan are for hazards affecting employees at a workplace. Road damage, missing barriers, detours, debris, and similar public-road conditions should go to the responsible road authority unless the situation requires emergency services.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I take photos of a work-zone hazard?

Only from a safe, lawful location outside the active work area and without using a phone while driving. Never cross traffic, stand on a closed shoulder, climb a barrier, or enter the site for a better image.

What if I do not know which agency owns the road?

Provide the road name, direction, nearest intersection or mile marker, and any route or project sign to the first government transportation or public-works contact you find. Ask for an ownership referral and retain the confirmation or case number.

Is the OSHA complaint form appropriate for an active emergency?

No. OSHA says not to report an emergency through its form or email. Call 911 when immediate local emergency response is needed; OSHA directs callers reporting a fatality or imminent life-threatening situation to 1-800-321-OSHA (6742).
