Report the damage to the authority responsible for that road. Use its urgent hazard channel if the condition is immediately dangerous; otherwise use the authority’s road-defect, roadworks, or construction-enquiry form. Give a precise location, explain what construction-related damage you found, and include the date, time, coordinates, and photographs if the local service requests them. If your vehicle, property, or person was harmed, start the authority’s separate compensation or public-liability claim process as well. A road report helps the authority investigate and make the site safe; it does not, by itself, prove who is legally responsible.
Start with safety, not paperwork
Stop only where it is safe to do so. Do not walk into a live traffic lane, an excavation, an unstable shoulder, or an active work zone to take a photograph. If the damage creates an immediate risk—such as an open trench, collapsed edge, missing barrier, exposed utility, debris in a traffic lane, or a surface defect likely to cause a crash—use the road manager’s urgent hazard channel. If people are in immediate danger, use your local emergency number.

Contact details are jurisdiction-specific. For example, Transport Victoria directs people to call 13 11 70 for urgent hazards and 000 for an emergency in Victoria. Those numbers are not general-purpose contacts outside Victoria. On a non-urgent road, use the authority’s ordinary defect or construction-reporting service instead of an emergency line.
- Move to a safe location before recording details.
- Give the operator the road name, travel direction, nearest junction or landmark, and the hazard’s position.
- Explain whether traffic, pedestrians, cyclists, drainage, or nearby property is at risk.
- Do not confront workers or enter a restricted site to establish who caused the damage.
Identify who manages the road
The correct recipient depends on the road’s location and classification. A local street, regional route, motorway, bridge, or special road can have a different manager, and a construction project may involve an authority, utility, licensee, or private contractor. Check the official road-authority directory, road-network map, or local-government website for the exact location before submitting a routine report.

| Location or road type | Likely first contact | What to verify |
|---|---|---|
| Local public street | Municipal or local-government road authority | That the council or municipality maintains the particular street, rather than a state or national agency |
| State, regional, or principal route | State or regional highway authority | The route number, direction of travel, and whether a separate motorway operator is responsible |
| Motorway, toll road, bridge, or tunnel | The designated road operator or highway authority | Whether the operator has its own emergency line and incident-report form |
| Street being excavated for a utility | Road authority for the public way, with the utility or licensee potentially involved | The work-zone sign, permit information, or utility name, without assuming that party is legally liable |
| Private access road or construction-site entrance | Landowner, site operator, or property manager | Whether the road is public and whether a public authority also controls the connecting road |
In the United Kingdom, responsibility varies by road and road type. In New South Wales, Transport for NSW manages state and regional roads while councils manage public roads in their local government areas. These are examples of how responsibility is allocated, not a rule that applies everywhere.
Distinguish road works from street works
The wording used by the authority can help you select the right form. GOV.UK describes road works as repairs or improvements to the highway. Street works generally means work by a statutory undertaker, utility, section 50 licensee, or contractor using equipment on or under a street. Both can leave a damaged surface, displaced kerb, blocked drain, or unsafe temporary reinstatement. The distinction helps the authority find the right team; it does not determine liability for your incident.
Clues that a utility or licensee may be involved
- Utility-branded barriers, plates, signs, or permit notices.
- A narrow trench crossing the carriageway or pavement.
- Temporary asphalt, settlement around a service connection, or an excavated verge.
- A work-zone sign naming a telecommunications, water, gas, electricity, or other operator.
Clues that the highway authority or its contractor may be involved
- Lane resurfacing, drainage, bridge, kerb, or junction reconstruction.
- Authority project signs or a road-maintenance crew.
- Missing or displaced traffic-control equipment around a public works site.
Record the identifying information if it can be done safely, but submit the report to the road manager even when you suspect a particular contractor or utility. The authority can route the matter through its own permit, contract, or claims system.
Choose the right reporting channel
Urgent hazard report
Use the urgent channel when the defect could cause an immediate collision, fall, flooding event, or other serious harm. State that the condition is dangerous and describe the active risk, not just the construction history. The operator may need to dispatch a crew, install barriers, close a lane, or notify emergency services.
Routine road-defect report
For a defect that is not an immediate emergency, use the road authority’s standard reporting form. Official service labels include “Report a pothole or damaged road” (Service NSW) and “Submit a roadworks or construction enquiry” (Transport Victoria). Select the construction or roadworks category when one is offered so the report reaches the appropriate inspection team.

Construction or roadworks enquiry
Some authorities separate a defect report from a question about an active project. Use the construction-enquiry option when you need to identify the project, report poor temporary reinstatement, ask about traffic management, or notify the authority that work has left a road unsafe. You can still file a separate damage claim if you suffered a loss.
Prepare a report that an inspector can act on
A vague description such as “the road is damaged near the building site” can delay an inspection. Write the report so someone unfamiliar with the area can find the exact point and understand what changed.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsLocation details
- Full road name and, if relevant, route number.
- Travel direction or the side of the road.
- Nearest intersection, house number, business, bridge, bus stop, or other permanent landmark.
- Lane, shoulder, footpath, cycleway, verge, drainage channel, or driveway affected.
- Coordinates or a map pin when the form requests them. Malaysia’s MYJalan service, for example, lists defect coordinates and a photo among its report details.
- Whether the defect is inside a signed work zone, at its edge, or away from the visible site.
Description of the damage
- Describe the physical condition: pothole, rut, sunken trench, broken edge, loose aggregate, mud, debris, standing water, damaged kerb, blocked drain, missing plate, or displaced barrier.
- Give approximate dimensions only if you can estimate them safely; do not enter traffic to measure.
- Explain how road users are affected: sudden drop, loss of traction, reduced sightline, narrowed lane, forced diversion, or pedestrian obstruction.
- Say whether the condition is worsening, recurring after rain, or spreading across a lane.
- Identify visible construction signs, company names, permit numbers, or utility markings without asserting that they prove fault.
Date, time, and conditions
Provide when you first observed the damage and, if known, when the construction activity occurred. Add the time of any incident involving your vehicle or property. Note weather, darkness, flooding, traffic conditions, and whether the defect was already marked or barricaded. Authorities may request a specific date and time for both the road report and any claim.
Photographs and other records
Take photographs from a safe position showing the wider context and a closer view of the defect. Include a landmark or sign in at least one image so the location is identifiable. Preserve the original files and note when they were taken. Attach only what the form permits; some services request photos or coordinates, while others may ask for different evidence. Keep repair invoices, tow records, medical records, and witness details separately if you are making a loss claim.
Submit the report: a practical sequence
- Make the area safe for yourself. Pull over or stand away from moving traffic. If the situation is immediately dangerous, call the urgent hazard service before completing an online form.
- Confirm the road manager. Use the official road map or authority directory for the road’s location and classification. If you choose the wrong body, submit the report anyway if necessary and ask where it should be redirected.
- Open the defect, roadworks, or construction-enquiry form. Select the category that best matches the condition. Do not use a general contact form when the authority provides a dedicated hazard channel.
- Enter the exact location. Include road, direction, nearest junction or landmark, lane or path, and coordinates or map pin where requested.
- Describe the damage and risk. State what construction activity appears connected, what road users face, and whether the hazard is expanding or obstructing passage.
- Add date, time, photographs, and identifiers. Follow the form’s file-size and format rules. Include work-zone or permit information only if visible and safely recorded.
- Submit and save the confirmation. Record the submission date, confirmation screen, email, and reference number. A reference proves that a report was made; it is not an admission that the authority or contractor caused the damage.
- Open a separate claim if you suffered a loss. Use the authority’s public-liability, vehicle-damage, or compensation instructions rather than assuming the road-defect report is also a claim.
Report the hazard and claim compensation separately
A road-condition report asks the authority to inspect, repair, or manage a public hazard. A claim asks an organisation to compensate you for a particular loss. The two processes can require different forms, evidence, and correspondence.

When making a claim, explain what was damaged, why you believe the organisation may be responsible, the precise location, and the date and time. GOV.UK’s guidance for claims asks for those kinds of details. In New South Wales, road-damage reporting and a public-liability route for vehicle damage are listed separately. Follow the current instructions for the authority that manages your road; the examples do not create a universal deadline or evidentiary rule.

Information commonly needed for a loss claim
- Your contact details and the vehicle, property, or person affected.
- The incident date, time, direction of travel, and exact location.
- A factual account of the road condition and the construction context.
- Photographs, dash-camera footage, witness details, and any report reference.
- Repair estimates or invoices, towing and recovery costs, and other documents the claim form requests.
Do not repair or discard damaged parts before checking whether the claims process requires an inspection, unless leaving the damage creates a safety risk. Keep copies of everything you submit. The authority may ask for more information or direct you to another organisation.
Who may handle a construction-related claim?
You do not always need to contact the contractor first. Oxfordshire County Council says that when it considers road conditions were caused by contractors working on its behalf or by a utility company, it may refer the claim and tell the claimant which organisation received it and why. British Columbia’s guidance says public claims arising from highway construction or maintenance may be made to the ministry, which may forward the claim to the responsible contractor.
Those are examples of administrative routing, not a promise that every authority handles claims that way. A referral does not establish that the contractor, utility, road authority, or another party is legally liable. British Columbia’s government guidance, for example, says proof of negligence is required for the province to pay a claim. That is a jurisdiction-specific statement, not a universal legal test. Obtain local legal advice if the loss is substantial, disputed, or subject to a formal deadline.
What different jurisdictions illustrate
| Jurisdiction or service | Useful official guidance | How to use the example |
|---|---|---|
| United Kingdom | Road responsibility varies by road and road type. GOV.UK distinguishes highway road works from street works by utilities, licensees, and contractors. | Identify the highway authority first; use its defect or works channel, then follow its separate claims instructions. |
| New South Wales | Transport for NSW manages state and regional roads; councils manage public roads in their local government areas. Service NSW uses “Report a pothole or damaged road,” and vehicle-damage claims have a separate route. | Check whether the route is state, regional, or local before choosing the form. |
| Victoria | Transport Victoria accepts non-urgent road issues and roadworks or construction enquiries. Its urgent-hazard example is 13 11 70; emergencies use 000. | Use the urgent number only for a Victorian urgent hazard or emergency; use the ordinary service for routine matters. |
| Hong Kong | The road-reporting form asks for road, district, direction, and nearby location. | Mirror those fields in your description so the inspector can locate the defect quickly. |
| Malaysia | The MYJalan service lists defect coordinates and a photograph among report information. | Prepare a map position and safe photograph when the local form requests them. |
| British Columbia | Public claims for highway construction or maintenance damage may be sent to the ministry and then forwarded to a responsible contractor; the 2021 guidance says negligence must be proven for the province to pay. | Verify the current procedure and do not treat the routing example or legal standard as universal elsewhere. |
Track the report and follow up safely
Keep the reference number and submission date in one place. If the condition worsens, submit an update quoting the original reference rather than creating several conflicting reports. For an urgent change—such as a newly opened hole, removed barrier, flooding, or a collision risk—use the urgent channel again and state that it is an escalation.

If an inspector or claims officer contacts you, answer the specific questions and distinguish what you observed from what you infer. “A trench had settled across the left lane at 16:20” is stronger than “the contractor was negligent.” Ask which organisation now holds the matter if the authority transfers it, and record the new reference number.
There is no single worldwide response time, filing deadline, or guaranteed repair schedule established for this topic. Check the current instructions of the responsible authority, particularly before relying on older claims guidance such as British Columbia’s page dated 2021.
Common mistakes and how to avoid them
Sending an ordinary form for an immediate danger
Online queues may not be monitored as an emergency service. Call the designated urgent hazard channel when the condition presents an immediate risk.
Reporting to the contractor but not the road authority
A site sign can identify a contractor without proving that it controls the public road. Notify the road manager so the hazard enters the authority’s inspection and traffic-management system.

Assuming the defect report is a compensation claim
File the separate vehicle, property, personal-injury, or public-liability claim and comply with its evidence requirements.
Overstating what the evidence proves
Photographs can show the road condition and context. They do not automatically establish which party caused it or whether a legal duty was breached. Describe observations accurately and let the authority or claims process assess responsibility.
Taking unsafe photographs
Never stand in a live lane, cross barriers, or enter an excavation. A photograph is not worth creating another incident.

- Immediate danger assessed; urgent or emergency channel used when necessary.
- Road manager identified from the road’s location and classification.
- Correct defect, roadworks, or construction-enquiry category selected.
- Road name, direction, lane or path, nearest junction or landmark, and coordinates supplied where requested.
- Defect, construction context, traffic risk, date, and time described factually.
- Safe photographs or other requested files attached.
- Submission confirmation and reference number saved.
- Separate compensation or public-liability claim started if a loss occurred.
- Repair records, invoices, witness details, and original photographs retained.
- Any transfer to a contractor, utility, or ministry recorded, without assuming that transfer decides liability.
Key takeaway
Find the authority that manages the specific road, use its urgent channel for immediate hazards and its ordinary road-defect or construction-enquiry service for routine damage, and make the location easy to identify. Treat a hazard report and a compensation claim as separate steps. The authority may pass a claim to a contractor or utility, but only the applicable local process and evidence can determine responsibility.
