Hong Kong has no blanket process for retrospectively legalizing unauthorized building works (UBWs). First identify the work and check the approved building records, then read any Buildings Department (BD) order or warning notice. If an order requires removal, comply with its scope and deadline using appropriately qualified professionals and contractors, reinstate the affected area, and report completion to BD for inspection. A narrow validation scheme may let certain eligible existing minor features remain, but validation does not turn them into approved building work.
The right route depends on the item, its date and location, the notice or order wording, and whether it affects common property. This guide explains the general BD process; it cannot establish that a particular structure qualifies to remain. Have a Hong Kong building professional review the approved plans, site, relevant documents and, where applicable, the Deed of Mutual Covenant (DMC).

What “unauthorized building works” means
BD regards additions or alterations as UBWs when they were made without the department’s prior approval or without following the applicable simplified procedures under the Minor Works Control System. The issue is how the work was approved or carried out—not simply how long it has been there. An old structure is not automatically lawful, and a minor-work process should not be treated as an after-the-fact approval route unless the relevant scheme expressly provides for it.

“Regularize” can mean different things in practice. An owner may be able to validate a narrowly eligible existing feature under a named scheme; comply with an order by removing specified work; or seek professional and BD guidance where neither route is clear. These outcomes are not interchangeable: validation under the Minor Amenity Feature Validation Scheme leaves the feature’s UBW status unchanged.

In particular, do not assume that having paid for an item, having a contractor install it, or having lived with it for years is proof of BD approval. Nor does the fact that a work appears minor by size establish that the required Minor Works Control System procedures were followed. The starting point is the approved record and the actual process used for the work, not a guess based on appearance or age.
Start with the paperwork and the approved layout
Before arranging work or assuming an item may stay, identify precisely what has been built and establish the approved baseline. BD’s guidance says owners may apply to view approved plans; the department also provides online building records services. Compare those records with the site and collect any correspondence, inspection reports, prior approvals, contractor documents and photographs that may clarify the work’s scope and history.
Then determine whether BD has issued a statutory removal order, a statutory warning notice, or neither. Read the document itself: it identifies the affected work and any stated requirements or deadline. A contractor’s informal view does not change an order. If its scope, the approved layout or a required step is unclear, contact the BD case officer named in the covering correspondence.
Keep the documents together as you work through the issue: the notice or order and covering letter, available approved plans, records of the structure and its location, and any professional or contractor records. This helps an appointed professional compare what is on site with what was approved and what BD has specified. Do not start removing or altering an item before understanding whether that would affect the ordered scope, safety measures or necessary reinstatement.
Removal order
BD may issue a statutory order requiring removal of actionable UBWs. The order is registered against the relevant property title. Follow the work description and compliance period in the actual order, and seek clarification from the case officer if either is uncertain. Do not substitute a general understanding of BD policy for the instructions in the notice.
An order is the operative document for the particular case: check exactly which item or part of the building it names, what work it requires, and when compliance is due. If more than one item is present, do not assume that a direction covering one item automatically describes all the others. Ask BD to clarify any uncertainty rather than relying on an informal interpretation.
Warning notice
BD may issue a statutory warning notice for UBWs that do not fall within its listed categories for removal orders. A warning notice may also be registered against the property title. It is not approval to retain the work, nor a general assurance that enforcement will never follow; respond to the requirements in the specific notice.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteThe distinction is about the enforcement route BD has taken, not a declaration that the structure is lawful. Read the warning notice carefully and obtain advice if its requirements or effect on the property are unclear. A notice registered against title can also be relevant when reviewing the property’s records, so retain the correspondence and any later BD documentation.
No order or notice identified
The absence of a notice does not establish that an item is approved or eligible to remain. If no clearly applicable validation scheme covers it, do not assume there is a general legalization application. Ask an appropriate building professional to review the item and approved records, then seek BD guidance on the particular facts where needed.
Which UBWs BD may target for removal
BD’s enforcement guidance identifies categories for which it may issue statutory removal orders. They include works that present an obvious hazard or imminent danger; new UBWs, apart from statutorily exempted work; certain exterior works on rooftops, podiums, yards and lanes or projecting from external walls, subject to stated scheme exceptions; interior works creating an obvious hazard or imminent danger; serious health or environmental nuisances, such as drainage misconnection; major standalone items; works selected for large-scale operations; and unauthorized alterations to green or amenity features where a gross-floor-area exemption was granted.

These categories explain why location, condition and effect matter alongside the approval history. For example, BD identifies obvious danger, serious nuisance and certain exterior or major standalone works among actionable categories. That does not mean an owner can determine the outcome by applying a checklist in isolation: the department’s current enforcement policy, the actual condition and the specific order or notice control the individual case.

Other UBWs may instead receive statutory warning notices. This distinction means owners should not assume every existing item receives the same enforcement treatment—or that a warning is permission to keep it. The actual notice or order, current BD policy and site conditions determine what is required in an individual case.
When a validation scheme may apply
Validation is a limited, scheme-specific option, not a general retrospective approval pathway. BD’s Minor Amenity Feature Validation Scheme lets owners apply to have eligible existing minor amenity features inspected and, where necessary, strengthened and certified for structural safety. The scheme covers features that existed before 1 September 2020; work commenced after that date must follow the law and is outside this scheme.
Even a feature validated under this scheme remains a UBW because it did not receive BD approval before it was erected. BD says it will not take enforcement action against a validated feature unless it becomes dangerous. The distinction matters: validation addresses specified safety and enforcement conditions; it does not convert the feature into approved building work.
That means validation should not be described as “legalizing” an extension in the ordinary sense. It is available only where a particular scheme’s feature definitions, date limits, professional requirements and submissions are met. Owners should also understand the continuing safety point: the feature’s validated status does not make it immune from action if it becomes dangerous.
How the Minor Amenity Feature Validation Scheme works
The scheme guidance describes appointing an eligible Prescribed Building Professional and/or Prescribed Registered Contractor to inspect and certify the feature, with strengthening if required. It also sets out notification and submission steps. Where strengthening minor works are required, the page describes advance notification for Class I and Class II works and completion notification for all classes. Forms and supporting material are due within 14 days after inspection or completion, as applicable.
This is not simply a form-only application. The relevant eligible professional or contractor must inspect the feature, consider whether strengthening is necessary, and provide certification and the specified supporting material. Where strengthening work is involved, the applicable class affects the notification steps. Confirm the current process before commissioning the work so that the required advance notification, completion notification and submissions are not missed.
The exact forms, work classes, item definitions and criteria should be confirmed with BD for the proposed feature. Do not rely on the name of a structure alone to establish eligibility; the scheme’s detailed requirements govern.
Household Minor Works Validation Scheme
BD’s removal guidance also points owners to the Household Minor Works Validation Scheme for specified household items erected before 31 December 2010. Examples given include drying racks, canopies, and supporting structures or metal frames for air conditioners. This is a defined route for qualifying items, not a general means to retain an extension or substantial alteration. Verify current scheme criteria and definitions with BD before proceeding.
A canopy is therefore not automatically eligible merely because it is a canopy: the relevant scheme must cover the item as defined, and its date and other requirements must fit. If BD has issued an order concerning it, do not assume that looking at a validation scheme pauses or satisfies the order. Clarify the relationship with BD and comply with the actual document unless BD confirms otherwise.

Shared areas and building management
Validation or remedial work may affect an exterior or common part. In that case, liaise with affected owners, the Owners Corporation or management company, and observe the building’s DMC obligations. Those obligations may include third-party liability insurance. A single owner should not assume they can authorize work on common property without resolving the relevant ownership and management requirements.
Coordination matters both when an item is to be retained under a scheme and when it is to be removed. A structure may be within a flat owner’s use or near a particular premises while still affecting shared property. Confirm who must be consulted, what access is needed and what the DMC requires before arranging inspection, strengthening, removal or reinstatement.
Validation or removal: how the routes differ
| Decision point | Validation under an applicable scheme | Removal or order compliance |
|---|---|---|
| What it covers | Only item types and work meeting a named scheme’s eligibility rules and dates. | The work specified in a removal order, or other work selected for removal. |
| Resulting status | A validated minor amenity feature remains a UBW; the scheme does not grant prior approval. | The unauthorized item is removed; BD inspection and compliance documentation follow completion. |
| Safety work | Inspection and certification, with strengthening where required. | Safe demolition and reinstatement; professional appointments depend on the scope. |
| Timing | Scheme cut-off dates and submission deadlines apply. | The actual order’s deadline controls; ask BD to clarify it if necessary. |
| Shared property | Common-part rights, DMC duties, coordination and possible insurance obligations may apply. | Ownership, management and DMC issues also need to be addressed, especially for common areas. |
If an order requires removal, do not treat a possible validation scheme as a reason to disregard it. First ask BD or a qualified professional whether the named scheme applies and how it interacts with the specific notice or order. Until clarified, comply with the document’s stated requirements and deadline.

Removal addresses the unauthorized work specified for removal and requires safe execution and completion reporting. Where the facts do not clearly fit a scheme, obtain professional advice instead of treating an uncertain application as a regularization right.
How to comply with a BD removal order
1. Confirm the scope and deadline
Read the order and identify the precise UBW and required work. Compare its description with the approved plans and the physical site. If the order is ambiguous, contact the case officer identified in the covering letter. Record the stated deadline and any instructions on reporting completion.
Use the approved baseline to understand what reinstatement may involve, and ask the professional reviewing the site to identify any safety or structural implications of the specified removal. If the order’s wording and the observed work appear not to match, seek clarification promptly; do not let uncertainty lead to an assumed extension of the deadline.
2. Arrange the right professional appointments
BD’s “How to remove UBWs?” guidance distinguishes appointments by demolition scope. Demolition of a building, or a substantial or significant part of one, calls for an Authorized Person (AP), a Registered Specialist Contractor (RSC) and a Registered Structural Engineer (RSE). For demolition not involving such a part, BD describes appointing a Registered Contractor (RC), with an AP or RSE to ensure necessary safety measures. Work falling within minor works may instead be carried out under the Minor Works Control System. Confirm the applicable appointments for the specific order and scope rather than treating this summary as a substitute for the BD requirements.

The key decision is the actual scope, not merely whether the item looks small. An owner should not choose a contractor category without checking the BD requirements applicable to the work. A building professional can assess whether the removal amounts to demolition of a substantial or significant part, whether minor works procedures apply, and which appointments and safety oversight are required.
3. Plan safe removal and reinstatement
Removal is not a do-it-yourself shortcut. The appointed professionals should plan the work and any necessary reinstatement in light of the building, the order and the work class. BD’s management guidance highlights safety measures for external works and attention to asbestos removal guidance. For substantial or structural work, BD may require an AP to prepare remedial proposals and supervise registered contractors.
Plan how the work will protect occupants, workers and people around the building, particularly for external work. Do not treat ordinary tools or protective equipment as a substitute for prescribed appointments, an appropriate work plan or asbestos-related requirements where relevant. The removal method and reinstatement should be set by the professionals responsible for the actual scope.

Where work is in a common area or affects another owner’s property, resolve access, coordination and DMC issues before work begins. A safe method for removing an item does not itself settle who has authority over the affected part of the building.
4. Keep records as the work proceeds
Retain relevant professional reports, required forms, photographs and contractor records. The necessary documents will depend on the order and the work class. Keep evidence of the completed removal and reinstatement so the owner or AP can report the outcome and respond to BD’s inspection.
Organize records by the required work and the stages completed: professional advice and proposals, relevant notifications or forms, contractor details, and photographs or other evidence of the site after completion. The exact record set depends on the job; this is not a substitute checklist for a particular order. Ask the appointed professional what BD requires for that case.
5. Report completion and obtain BD documentation
After removal and reinstatement, the owner or AP should report completion to BD so the department can arrange a compliance inspection and issue a compliance letter. Keep that letter with the property records and check that the order’s compliance status has been addressed. Physical demolition alone is not the final administrative step.
Do not assume that a contractor’s completion invoice or photographs alone close the BD case. The compliance inspection and subsequent letter are the documented follow-through described in the guidance. Keep the letter available for future property or building management records, along with the order and evidence of the completed work.

BD states that failure to comply with a statutory order is an offence. Its owner-responsibility guidance gives a maximum penalty of one year’s imprisonment and a fine of up to HK$200,000, plus a further fine of up to HK$20,000 for each day a continuing offence persists. These are the maximum penalties stated in that guidance, not a prediction of the outcome in an individual case; check the current law and the actual order.
BD may arrange removal through a government contractor and recover the costs from the owner, together with supervision charges and a surcharge. The order is registered against the property title, and a mortgage lender may be notified. These consequences are additional reasons to address an order within its stated period instead of waiting for enforcement action.
Ignoring an order can therefore lead to more than a requirement to arrange the work later: it can involve criminal consequences, costs for government-arranged works and an entry against the property title. If an owner cannot determine how to comply, the safer next step is to contact the named BD case officer and obtain professional advice, not to leave the order unanswered.
Co-owners, common parts and assistance
Owners are responsible for taking the initiative to remove UBWs in their premises. For works in common areas, co-owners or the Owners Corporation should coordinate. BD recommends consulting co-owners, the Owners Corporation and/or property management for minor works on common parts; the validation scheme also calls for liaison and compliance with DMC duties. Seek advice on rights and responsibilities under the DMC where work affects shared property or obstructs building repairs.

Work may require agreement, management coordination and attention to insurance obligations, depending on the building’s arrangements.

BD says owners may apply for the Building Safety Loan Scheme to carry out UBW removal works. Current eligibility, terms and availability are not established here, so check the current official scheme information before relying on financial assistance. Do not assume an application changes an order’s deadline.
Practical decision checklist
- Identify the work and compare it with the approved plans or building records.
- Locate and read any BD order or warning notice; note the specified work, requirements and deadline.
- Check whether a specific validation scheme covers the exact item, its location and the date it was erected. Do not infer eligibility from age or item name alone.
- For shared or exterior property, address co-owner, Owners Corporation, management company and DMC requirements before work proceeds.
- For removal, confirm the required professional and contractor appointments, safety measures and reinstatement scope.
- Keep records and report completed removal and reinstatement to BD for compliance inspection and the resulting letter.
If the first review leaves a key question unanswered—whether the work matches approved plans, whether a date cut-off is met, or whether an order covers a particular item—resolve that point with the relevant professional or BD before acting. There is no general application that makes every existing UBW lawful, and a decision to keep or remove an item should follow the applicable scheme or the actual order.
Frequently Asked Questions
Can I legalize an illegal extension in Hong Kong?
There is no blanket retrospective legalization route for UBWs. A narrow validation scheme may cover specified existing minor features that meet its criteria, but validation does not turn the feature into BD-approved work. If no scheme clearly covers the extension, have a building professional review the approved plans and site and seek BD guidance on the specific facts.

Do I have to remove an unauthorized canopy?
It depends on the canopy, its location, date, applicable scheme and any BD notice or order. BD’s Household Minor Works Validation Scheme is described for specified household items erected before 31 December 2010, including qualifying canopies, but this is not a general exemption. Check the current scheme definitions and follow the requirements of any actual order.
What should I do after receiving a BD removal order?
Read the order’s scope and deadline, compare the specified work with approved plans and site conditions, and contact the named BD case officer if anything is unclear. Appoint the professionals and registered contractors required for the demolition scope, plan safe removal and reinstatement, then report completion to BD for a compliance inspection and letter.
Can I keep an existing minor structure if I validate it?
Only if it meets a named scheme’s current eligibility criteria and required inspection, certification and submission steps. Under the Minor Amenity Feature Validation Scheme, eligible features must have existed before 1 September 2020. A validated feature remains a UBW, and BD says it will not take enforcement action unless it becomes dangerous.
Does a BD warning notice mean the work is approved?
No. A warning notice is an enforcement notice for UBWs that may not fall within the listed categories for a removal order; it is not approval or general permission to retain the work. Read and respond to the specific notice, which may be registered against the property title.
Can I remove a UBW myself to comply with an order?
Do not assume that DIY removal is suitable. Required appointments depend on the demolition scope: substantial or significant demolition calls for an AP, RSC and RSE; other demolition may call for an RC with an AP or RSE ensuring necessary safety measures, while minor works may follow the Minor Works Control System. Confirm the requirements for the particular work with BD and an appropriate professional.
The Bottom Line
Hong Kong does not offer a general route to retrospectively legalize UBWs. Check the approved records and the exact BD notice or order; use a validation scheme only if the particular item meets its narrow criteria. If removal is required, meet the order’s deadline with the appropriate professionals, complete safe removal and reinstatement, and report the result to BD for inspection and a compliance letter. Validation leaves a feature unauthorized, and a warning notice is not approval.
