Start by contacting the building and planning authorities that govern the property. Ask them to identify the unpermitted work, check for open violations, confirm whether the existing use and construction can remain, and provide the current legalization checklist. Depending on local rules, you may need an as-built or retroactive permit, new plans and inspections, corrections to meet safety or zoning requirements, or removal of work that cannot be approved.
You may be able to sell or transfer a house with unpermitted work, but there is no nationwide rule that makes every sale legal or every disclosure sufficient. Permit requirements, disclosure duties, lender conditions, and closing consequences depend on the property’s jurisdiction, the work involved, and the transaction. Treat permit regularization and sale disclosure as separate issues and resolve both before you commit to a closing date.

What regularizing an unpermitted house actually means
Regularization is the process of bringing construction or a change in use into the local approval system. The authority may accept the work as built after reviewing plans and inspecting it, require alterations before approval, or determine that some or all of it must be removed. A permit application by itself does not make the work lawful.
Different jurisdictions use terms such as retroactive permit, as-built permit, legalization, or permit for existing unpermitted work. The label is less important than the written requirements issued by the authority with jurisdiction over the property.

- Planning or zoning approval: confirms that the use, setbacks, lot coverage, height, parking, easements, overlays, and other land-use rules allow the configuration.
- Occupancy approval: may be needed when space was converted into a dwelling, an accessory unit, or another use requiring a revised Certificate of Occupancy.
- Final sign-off: records that required inspections and corrections are complete. Until the required approvals are issued, the work remains unauthorized even if an application is pending.
One department may not be enough. A new dwelling unit, for example, can involve planning, building, fire, public works, utility, and occupancy reviews. Ask the primary building department which other agencies must sign off.
Can you sell or transfer a house with unpermitted work?
Possibly, but the answer is property-specific. Some authorities allow a transfer while a violation remains open; others, a buyer, a lender, or the contract may require correction and final inspection before closing. A pending permit does not automatically satisfy a buyer’s or lender’s condition, and disclosure does not automatically legalize the work.
The City of San Pablo Building Division’s handout, last updated March 30, 2021, states: “When selling a property, the buyer, realtor or lender may require that unpermitted work be properly permitted, corrected and inspected before closing.” The word may matters: that statement describes a possible transaction requirement, not a universal rule for every property or sale.

San Pablo’s guidance likewise says that if work is not brought into compliance, the seller or realtor must disclose it as illegal. Those are local statements. Your disclosure duty must be checked under the law governing the property and the actual transaction documents.
Before listing or signing a contract, tell the real-estate professionals involved what you know, request jurisdiction-specific disclosure guidance, and ask whether the buyer’s lender or insurer has additional requirements. Do not assume that an “as-is” clause eliminates a statutory disclosure duty or a known safety obligation.
Step 1: Build a complete record of the work
Make a room-by-room and system-by-system inventory before calling for an inspection. Include work that may not be visible from the street and work completed by previous owners.
Record each physical change
- Additions, enclosed patios, garages converted to living space, basement or attic conversions, and detached structures.
- Changes to bedrooms, kitchens, bathrooms, occupancy, or the number of dwelling units.
- Structural alterations such as removed walls, new beams, enlarged openings, foundations, decks, balconies, retaining walls, or roof changes.
- Electrical panels, new circuits, rewiring, generators, solar equipment, or service upgrades.
- New or relocated plumbing fixtures, water heaters, sewer connections, gas lines, or drainage work.
- Heating, ventilation, air-conditioning, fireplaces, chimneys, fuel-burning appliances, or energy-system changes.
- Windows, doors, stairs, guards, handrails, insulation, fire separations, smoke alarms, and egress changes.
Gather supporting evidence
- Existing permits, approved plans, inspection cards, certificates of occupancy, and prior notices.
- Invoices, contractor agreements, material receipts, financing records, insurance files, photographs, and dated listings.
- Utility bills, tax records, leases, and other documents that may help establish when a conversion or addition occurred.
- Letters, violation notices, liens, code-enforcement records, and correspondence with previous owners or contractors.
- Survey documents, title reports, easements, and transaction paperwork that identify shared or restricted areas.
Do not alter, cover, or demolish work merely to make it look finished. Concealed framing, wiring, plumbing, and fire-rated assemblies may need to be exposed for inspection, and premature changes can destroy useful evidence.

Ask specifically whether a change in use requires a planning review or a new Certificate of Occupancy. San Francisco’s code, for example, provides a screening process and required documentation for certain unauthorized dwelling units and says the dwelling is not lawful until all necessary approvals have been obtained. New York City Department of Buildings guidance for illegal conversions describes a process that may include a registered design professional, approvals, permits, licensed contractors, final sign-off, and a Certificate of Occupancy.
Those examples do not create a national procedure. They show why a permit search must include use and occupancy records, not just a search for a building permit number.
Step 3: Get planning and zoning clearance before commissioning plans
Planning review should come before you spend money on a full engineering package. Ask whether the existing configuration can legally remain on the lot and what must change to meet land-use rules.

Questions for the planning division
- Is the current use allowed in the zoning district?
- Are the setbacks, lot coverage, height, floor-area limits, parking, and open-space requirements satisfied?
- Do easements, historic designations, flood zones, coastal rules, environmental overlays, or other special districts apply?
- Is the structure a separate dwelling unit, an accessory dwelling unit, a rooming arrangement, or another regulated use?
- Does the property’s legal lot, address, or parcel configuration match the existing buildings?
- Would legalization require a variance, conditional approval, lot-line adjustment, or other planning action?
San Pablo’s legalization handout starts with a Planning Division review. That sequencing is practical: a building plan cannot legalize a use or site layout that zoning prohibits. Washoe County also notes that some locations or technical conditions may prevent a permit from being issued.
Step 4: Request the current legalization checklist
Ask the authority to identify the exact application type, forms, drawings, fees, and inspections for your property. Requirements change by jurisdiction and by project scope, so do not rely on a checklist for a different city or an older application.
Documents commonly requested
- A site plan showing property lines, structures, setbacks, access, parking, utilities, and easements.
- Existing-condition floor plans, elevations, sections, roof plans, and details of the unpermitted work.
- Structural calculations, engineering drawings, energy documentation, or a report from a qualified professional.
- Trade permits for electrical, plumbing, mechanical, gas, or fire-protection systems.
- Proof of construction date where a local exception or streamlined program depends on when the work was built.
- Photographs, prior plans, survey information, title documents, and written explanations of unknown conditions.
- Application, plan-review, inspection, recording, and other locally imposed fees.
San Diego’s May 2026 Information Bulletin 242 illustrates the importance of eligibility details. It describes a streamlined retroactive route only for qualifying accessory dwelling units and junior accessory dwelling units within the City of San Diego that were built without a permit before January 1, 2020. The route still requires an application, applicable fees, review, inspections, life-safety improvements where required, and evidence of the construction date. It does not establish a path for every unpermitted house, every ADU outside the city, or every project built after that date.
Step 5: Plan for inspection of concealed work
Inspectors must be able to verify structural connections, fire separation, wiring, plumbing, insulation, drainage, and other work that is normally covered before final finishes are installed. Ask in writing how the authority wants concealed work handled.

Before opening walls or ceilings
- Obtain the inspector’s direction on the locations and extent of exposure.
- Photograph every exposed assembly with dimensions and identifying marks visible.
- Use a licensed professional when the authority requires engineering, testing, or certification.
- Correct unsafe conditions immediately if the inspector identifies an urgent hazard.
- Keep all inspection reports, correction notices, test results, and signed certifications with the project file.
Never assume that an inspector can approve work from photographs alone. Ask whether destructive testing, pressure tests, electrical testing, structural calculations, or additional fire and life-safety measures will be required.
Step 6: Compare the available outcomes
The authority’s findings determine whether the house can remain as built. Use the following framework to compare routes without assuming that one is available for your property.
| Route | When it may apply | Typical approvals and evidence | Possible transaction effect |
|---|---|---|---|
| As-built or retroactive permit | The existing work can meet zoning and applicable code, with documentation and inspection. | Application, site and floor plans, technical drawings or assessments, fees, construction-date evidence where required, and inspections. | May satisfy a buyer or lender only after required corrections and final sign-off; timing depends on review and inspection capacity. |
| Correction and alteration | The use can remain, but the construction needs life-safety, structural, zoning, or trade corrections. | Revised plans, licensed contractors or professionals where required, permits, staged inspections, and final approval. | Closing may need to wait for work, reinspection, and updated occupancy records, or the contract may allocate unfinished work. |
| Exposure and professional certification | Concealed work cannot be inspected normally and the authority allows an alternative method. | Selective demolition, testing, calculations, or certification from an appropriately licensed professional, subject to local acceptance. | Uncertainty remains until the authority confirms that the evidence is sufficient and issues approval. |
| Removal or demolition | The use or construction cannot be approved as built, or the owner elects not to complete required corrections. | Demolition or removal permit, safe disconnection of utilities, restoration plans, inspections, and possibly a separate permit for the lawful remaining structure. | May change the property’s usable area, occupancy, value, marketing description, and closing schedule. |
San Luis Obispo County states that unpermitted construction may result in enforcement or fines until it is properly permitted and inspected, and identifies an as-built construction permit or a demolition permit as possible options. The county’s alternatives are local; they should not be treated as a universal menu.
Step 7: Budget for the full compliance path
Do not budget only for the initial permit fee. Ask the authority and your professionals to identify every cost category that could apply.
- Planning, building, trade, plan-review, inspection, recording, and occupancy fees.
- Architectural, engineering, surveying, energy, fire, environmental, or other professional services.
- Selective demolition and restoration needed to expose concealed work.
- Construction to correct structural, electrical, plumbing, mechanical, egress, accessibility, fire, drainage, or energy deficiencies.
- Utility changes, testing, special inspections, laboratory reports, or certification.
- Demolition, hauling, site restoration, or replacement construction if approval is denied.
- Extended carrying costs, insurance changes, temporary relocation, and transaction expenses if the closing date moves.
No reliable universal average cost or timeline applies. The scope depends on the jurisdiction, age and condition of the work, inspection findings, professional availability, and whether the authority requires current-code corrections rather than approval of the original construction. Get the authority’s written checklist before requesting bids, and build a contingency for an alternative outcome.
Local examples and their limits
City of San Diego
Information Bulletin 242, issued in May 2026, describes a streamlined retroactive permit route for qualifying ADUs and JADUs in the City of San Diego that were built without a permit before January 1, 2020. It includes application and fee requirements, review, inspections, life-safety improvements, and evidence of the construction date. The program is limited by location, unit type, and date; it is not a general legalization rule for an entire house.
San Luis Obispo County
The county explains that unpermitted construction can trigger enforcement or fines until it is permitted and inspected. Its described options include an as-built construction permit or a demolition permit. Which option is feasible depends on zoning, code compliance, and the specific work.

New York City
Department of Buildings guidance for illegal conversions describes a process that may involve a registered design professional, agency approvals, permits, licensed contractors, final sign-off, and a Certificate of Occupancy. This is a local example for illegal conversions, not a general rule for selling every house in New York City.
San Francisco
San Francisco’s code provides a screening process and required documentation for certain unauthorized dwelling units. The code says the dwelling is not lawful until all necessary approvals have been obtained. A screening pathway is not the same as automatic approval.

Prepare a factual disclosure file while the permit process is underway. Identify what work is known, when it appears to have occurred, which approvals are missing, what applications or notices exist, and what the authority has said about the next steps. Avoid describing work as legal, approved, permitted, or code-compliant until the responsible authority has issued the relevant approval.

Coordinate with the transaction team
- Give the listing professional and real-estate attorney the permit history, notices, plans, inspection reports, and correspondence.
- Ask which statutory forms and disclosures apply in the property’s jurisdiction.
- Ask the buyer’s side and lender, through the appropriate transaction professionals, whether final permits, a Certificate of Occupancy, insurance evidence, or corrections are conditions of closing.
- Review contract deadlines for inspections, permit contingencies, repair obligations, escrow holdbacks, and termination rights.
- Update disclosures if the authority discovers additional work or issues a correction notice.
Do not promise a buyer that a pending application will be approved. Do not represent that disclosure alone resolves a safety violation, title issue, occupancy problem, or lender condition. The transaction documents and local law control.
When to hire a professional
A locally licensed architect, engineer, surveyor, or other design professional is appropriate when the authority requires plans, structural calculations, a condition assessment, or certification. For complex applications, a permit consultant may help coordinate submissions, but the reviewed local procedures do not establish that an expeditor is necessary.
A real-estate attorney licensed where the property is located can advise on transaction-specific disclosure, contract allocation of correction work, title and occupancy concerns, and the effect of an open violation. Verify licenses, insurance, relevant experience, and exactly which services are included before signing an engagement.
Common failure modes and how to recover
Applying to the building department without planning review
Why it fails: The work may violate setbacks, use, lot coverage, parking, or an overlay that a building permit cannot cure.
Recovery: Ask planning to confirm the allowable use and site configuration, then revise the scope or pursue any required planning approval before resubmitting.

Assuming an old permit covers later changes
Why it fails: A permit may cover only the approved plans, while later additions, conversions, or trade work remain unpermitted.
Recovery: Compare the approved drawings with current conditions room by room and list every deviation for the authority.
Covering concealed work before inspection
Why it fails: Inspectors cannot verify connections, fire separation, wiring, plumbing, or insulation.
Recovery: Request written exposure instructions, document the opened areas, and ask whether testing or professional certification is allowed.
Relying on a different city’s program
Why it fails: Eligibility dates, unit definitions, evidence rules, and inspection standards are local.
Recovery: Obtain the current checklist from the authority with jurisdiction over the property and confirm every exception in writing.
Waiting until the closing date is fixed
Why it fails: Review, corrections, inspections, and reinspection can take longer than the contract allows.
Recovery: Start the authority review before listing when possible, disclose the known status, and have the transaction professionals address deadlines and contingencies explicitly.
Treating “as-is” as a substitute for disclosure
Why it fails: Contract language does not automatically remove statutory duties or cure known illegal work.
Recovery: Obtain jurisdiction-specific legal advice and provide accurate, timely information about the work and its approval status.
Quick Recap
A pre-listing decision checklist
- Identify every addition, conversion, structural change, and trade installation that may lack approval.
- Collect permits, plans, photos, invoices, notices, utility records, insurance records, and title information.
- Request the property’s permit, violation, lien, and occupancy history.
- Confirm zoning, setbacks, lot coverage, easements, overlays, and allowable use with planning staff.
- Obtain the current legalization checklist, fee schedule, inspection sequence, and application number or case reference.
- Ask how concealed work will be inspected and whether testing or licensed-professional certification is acceptable.
- Have qualified professionals prepare only the plans and assessments the authority requires.
- Obtain bids for corrections and a separate contingency for alteration or removal if approval as built is not possible.
- Coordinate disclosures, lender requirements, insurance questions, and contract deadlines with licensed local transaction professionals.
- Do not advertise the work as legal or permitted until final approvals and occupancy documents, if required, are issued.
