Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteUsually, you cannot demolish a house and simply rebuild on its old outline. A lawful project normally requires a demolition permit and site controls first, zoning and setback confirmation, then a new-construction building permit supported by a complete plan set. If the structure was removed to its foundation, the authority having jurisdiction may classify the work as a replacement dwelling subject to current building, fire, energy, septic, environmental and zoning rules. Reusing the foundation or matching the former footprint does not, by itself, preserve former setbacks or approvals.
What legally changes when a house is demolished?
Demolition and reconstruction are generally separate legal actions. The demolition authorization covers safe removal and site protection; the building authorization covers the new structure. Portland’s residential permitting guidance states: “You need a demolition permit before we can issue a building permit for the new building.” Other cities use different names or combined applications, but you should assume the approvals are separate until the local building department confirms otherwise.

The classification of the work controls the review. A limited alteration may retain some existing approvals, while a complete removal to the foundation can be reviewed as new construction or a replacement dwelling. That classification affects setbacks, height, lot coverage, fire separation, energy performance, utilities, septic capacity, stormwater, accessibility where applicable, and required professional documents.

- Reconstruction or alteration: retention of enough legal, code-compliant work that the local code allows an existing-building pathway.
- Replacement dwelling: demolition, often to the foundation, followed by a dwelling that must satisfy current requirements identified by the jurisdiction.
Do not choose the most favorable label yourself. Ask the building official or planning authority to classify the scope in writing before finalizing design fees or ordering demolition.

Can you rebuild on the same footprint?
Sometimes, but the old location is not a universal entitlement. Zoning remains controlling. A federal building-code reference states, “Nothing in this Code shall be construed to lower in any way existing zoning requirements.” That means a prior house location does not automatically override current front, side or rear setbacks, lot-coverage limits, height limits, slope rules, shoreline or flood regulations, access standards, parking rules, tree protections, or fire access requirements.
A same-footprint proposal is strongest when the building department confirms that the work qualifies for a specific reconstruction or replacement exception and the proposed dimensions remain lawful. A redesigned house, a changed roofline, a larger basement, new decks, retaining walls, or altered grading can move portions of the project outside any exception even when the main walls stay in place.
Questions to obtain before designing
- Is the parcel a legal lot under current subdivision and zoning rules?
- What are the current front, side, rear, slope, shoreline, floodplain, fire, height and lot-coverage standards?
- Does the code recognize a destroyed or demolished dwelling as an existing nonconforming use, or does demolition terminate that status?
- What is the official measurement point for each setback: property line, ordinary high-water mark, top of slope, road centerline, or another reference?
- Are survey, geotechnical, environmental, tree, stormwater, septic or public-works approvals required before building-plan review?
Request a zoning or land-use clearance, written zoning determination, or pre-application meeting record where the jurisdiction offers one. Keep the survey and the authority’s response with the project file.

The approval sequence, from demolition to occupancy
- Confirm ownership and site status. Assemble the deed or other ownership evidence, parcel number, legal-lot information, current survey, utility records and any prior permits. Confirm whether the work is demolition, alteration, reconstruction or a replacement dwelling.
- Screen constraints before spending on full design. Check zoning, setbacks, slope, shoreline, flood, fire access, tree, environmental and historic requirements. Determine whether the site needs a soils report, geotechnical review, septic evaluation, stormwater design, utility relocation or environmental permit.
- Obtain the demolition permit. Submit the demolition drawings and site-control documents required locally. Portland’s packet can include an asbestos survey, erosion controls, tree plans, sewer or septic closure information, and basement-fill or compaction documents. Seattle may require environmental review, stormwater and soil controls, and topographic or geotechnical material for environmentally critical areas.
- Complete demolition and close its conditions. Disconnect or cap utilities as directed, protect public rights-of-way, remove debris, stabilize exposed soil and document required inspections. Do not assume that a demolition approval authorizes excavation or new foundation work.
- Obtain zoning or land-use clearance. Submit the scaled site plan and supporting studies needed to establish that the proposed location, massing, access and site work are allowed.
- Prepare the construction set. Have the architect, structural engineer, surveyor, soils engineer and other specialists produce the documents triggered by the site and building. Use the local checklist for sheet names, scales, seals and digital-file standards.
- Submit for building-plan review. Pay the required fees, respond to correction notices, revise every affected sheet consistently and obtain the building permit before construction. A zoning clearance is not a building permit.
- Build under inspection. Schedule foundation, reinforcing, framing, rough utility, insulation, fire, life-safety and other inspections required by the permit. Keep approved drawings on site and request approval before covering inspected work.
- Close the project. Complete final inspections, submit as-built or special-inspection documents when required, and obtain the certificate of occupancy or equivalent final approval before occupying the dwelling.
What the permit office expects in a structural plan package
A permit reviewer must be able to understand the site, load path, materials, connections and code assumptions without reconstructing the design from scattered notes. Los Angeles County explicitly lists cross sections, framing plans, foundation plans, construction details, structural calculations and energy plans among the material it expects. Pennsylvania regulation similarly requires construction documents and a scaled site plan showing “the size and location of new construction and existing structures,” “accurate boundary lines,” “distances from lot lines” and grades.
Scaled site and survey information
- Property lines, bearings or dimensions, street and access points, easements and rights-of-way.
- Existing structures to remain, structures to be removed, and proposed construction.
- Distances from each relevant lot line and the setback reference used.
- Existing and proposed grades, finished floor elevations, retaining walls, driveways and drainage patterns.
- North arrow, drawing scale, parcel identification and a clear demolition limit.
Architectural drawings
- Dimensioned floor plans showing rooms, stairs, doors, windows, plumbing fixtures, fire separations and floor areas.
- Exterior elevations with height calculations, grade lines, roof form, exterior materials and openings near property lines.
- Building sections showing foundations, floor and roof assemblies, insulation, vapor control, fire-resistance layers and finished grades.
- Construction details for stairs, guards, handrails, waterproofing, flashing, decks, balconies and connections to retained work.
Structural documents
- Foundation plan identifying footings, walls, slabs, piers, piles, caissons, anchors, reinforcing and connection to the supported framing.
- Framing plans for each floor and the roof, including member sizes, spans, bearing points, beams, headers, shear walls, bracing and collectors.
- Connection details for hold-downs, anchors, posts, beams, joists, trusses, diaphragms and lateral-force-resisting elements.
- Design criteria and calculations for gravity, wind, seismic, snow, flood, soil pressure and other loads applicable to the site.
- Professional seals and signatures wherever the jurisdiction requires them. The exact threshold varies by building size, occupancy, construction type and local law.
Energy, fire and life-safety documents
- Energy-code calculations, insulation and fenestration values, heating and cooling equipment data, air sealing and ventilation information.
- Fire-resistance ratings, smoke and carbon-monoxide alarm locations, fire sprinklers where required, egress diagrams and fire-access information.
- Special-inspection, testing and observation requirements identified by the design professional or building official.
Site-specific studies and approvals
- Soil, slope, retaining-wall, seismic, flood or geotechnical design information when triggered.
- Septic replacement or capacity approval, well documentation and utility connection or abandonment records.
- Stormwater, erosion-control, tree-protection and landscaping plans where required.
- Environmental, shoreline, wetlands, historic-resource or public-works approvals when the site falls within those regulated areas.
Reusing the old foundation: what must be proved
An old foundation can reduce demolition and excavation, but it is not automatically grandfathered. Los Angeles County’s rebuild FAQ says, “Yes, the existing foundation may be utilized as long as it meets all building code requirements; including slope setback requirements.” The building official may require a qualified professional to establish that the foundation is adequate for the new loads and current code.
Typical foundation-reuse investigation
- Expose representative footings, walls, slabs, anchors and reinforcing without damaging them.
- Document dimensions, elevations, cracking, settlement, moisture damage, corrosion, water intrusion and prior repairs.
- Locate reinforcement and embedded hardware using drawings, scans, probes or other accepted methods.
- Review the original soil assumptions and compare them with current site conditions, including groundwater and slope movement.
- Have the structural engineer calculate whether the retained work supports the proposed gravity and lateral loads.
- Obtain a soils or geotechnical opinion when slope stability, expansive soil, fill, settlement, retaining walls, deep foundations or geologic hazards are involved.
- Submit the investigation, calculations, repair details and professional seals with the permit package.
A reused foundation must also fit the current site plan. A foundation wall can be structurally sound yet fail a current slope setback, flood-elevation, fire-separation or lot-line requirement. Los Angeles County notes that a reduced slope setback may be recommended by a soils engineer but is subject to building-official review; an engineer’s recommendation alone is not an approval.

Replacement dwellings and the current-code burden
Napa County guidance treats “demolish to foundation and rebuild” as a replacement dwelling. Its listed requirements include current residential, building, fire, energy, septic, green-building and planning or zoning rules. Other jurisdictions use different definitions, so confirm the trigger locally.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Clear out junk files and repair common Windows errorsFree Scan →Replacement status can affect more than the new walls. The authority may require a current fire-access route, updated septic design, stormwater treatment, energy compliance, flood-resistant construction, tree mitigation or accessibility features. Existing nonconforming conditions may be tolerated only under a specific provision; demolition can end that tolerance.
Repair or alteration versus replacement dwelling
| Decision point | Repair or alteration | Replacement dwelling |
|---|---|---|
| Existing work retained | Enough legal, code-compliant construction remains for an existing-building pathway, subject to local definitions. | Most or all of the dwelling is removed, often to the foundation. |
| Setbacks | Some existing conditions may be treated under nonconforming-building rules; confirmation is required. | Current zoning and site constraints commonly apply unless a specific exception exists. |
| Engineering | Focused evaluation of altered or retained components. | Full foundation, framing, lateral and site design, plus studies triggered by the parcel. |
| Code scope | Existing-building provisions may limit the upgrades required. | Current residential, fire, energy, septic and other applicable codes are generally evaluated. |
| Risk of misclassification | Work can be stopped or re-permitted if the scope is larger than declared. | Design and fees may increase, but the approval path is clear. |
Like-for-like and disaster exceptions
Some jurisdictions create narrow reconstruction programs after disasters. The City of Los Angeles describes a wildfire “Like for Like” pathway allowing up to 110% of the former building area, with a target of reviewing complete applications within 30 days under an executive order. The page was accessed in 2026; verify that the executive order and its eligibility rules remain in force before relying on it.

Such programs are not nationwide rights. They may limit the disaster date, location, building type, floor-area increase, prior lawful status, application completeness, fire-hardening measures or deadline. A like-for-like label does not waive every requirement: structural safety, utility approvals, environmental controls and current fire provisions may still apply.
Ordinary review versus a disaster pathway
| Issue | Ordinary review | Disaster-specific review |
|---|---|---|
| Eligibility | Based on current zoning and construction code. | Limited to properties and losses defined by the active order or program. |
| Size | New massing must satisfy current limits unless another exception applies. | Los Angeles describes a limit of up to 110% for its stated wildfire pathway. |
| Review target | No nationwide review time is established; ask the local authority. | Los Angeles describes a 30-day target for complete applications under the cited executive-order program. |
| Evidence | Survey, zoning analysis, plans and studies for the proposed work. | Additional proof of the prior lawful dwelling, disaster loss and program eligibility may be required. |
| Expiration | Normal code remains in force until amended. | Orders can expire or change; verify the current text before design or demolition. |
Site controls that can stop a project even after demolition approval
Demolition disturbs soil and exposes neighboring property, so the demolition permit may carry conditions that remain relevant during reconstruction.

Environmental and soil controls
Seattle may require environmental review, stormwater and soil controls, and topographic or geotechnical information for environmentally critical areas. Portland guidance identifies a 24-inch replacement-fill threshold at which soil-compaction requirements apply. These are local rules, not universal standards; use the thresholds stated by your jurisdiction.

Utilities and septic
Obtain written instructions for electrical, gas, water, sewer and communications disconnection or capping. A private septic system may require abandonment, replacement or capacity approval before the new dwelling is occupied. Do not cover a capped line or septic component until the required inspection is complete.
Asbestos, trees and neighboring property
An asbestos survey may be required before removal. Tree-protection fencing, arborist reports, pruning limits and replacement planting can affect the demolition route and the new footprint. Protect sidewalks, party walls, excavations and adjoining foundations according to the permit and engineering plans.
How to prepare a permit package that survives review
- Use one coordinated base plan. The survey, architectural site plan, structural foundation plan, grading plan and utility plan should show the same property lines, elevations and proposed location.
- Dimension every controlling relationship. Show each setback, building height reference, finished-floor elevation, driveway width, retaining-wall location and distance to retained structures.
- Separate existing, demolition and proposed work graphically. Use the jurisdiction’s legend and clearly identify what remains, what is removed and what is new.
- Explain unusual conditions. Add a code summary and written narrative for foundation reuse, nonconforming setbacks, slope constraints, flood design, phased work or disaster-program eligibility.
- Coordinate consultants early. Resolve conflicts between architectural dimensions, structural reactions, geotechnical recommendations, septic locations, trees, stormwater facilities and utility corridors before submission.
- Check seals, dates and revisions. An unsigned calculation package, mismatched revision number or missing professional seal can produce a correction even when the design itself is sound.
- Submit the requested format. Some authorities require bookmarked PDFs, separate calculation files, naming conventions or an online application. Follow the local intake checklist exactly.
Common failure modes and practical fixes
| Failure | Why it causes trouble | Fix |
|---|---|---|
| Demolishing before confirming replacement rules | Removal may end a nonconforming-right or trigger current-code review. | Obtain written classification and zoning advice before demolition. |
| Assuming the old foundation preserves setbacks | Current slope, flood, fire or zoning setbacks may control. | Show the foundation on a current survey and obtain building-official and professional review. |
| Submitting architectural drawings without structural calculations | Reviewers cannot verify load paths, connections or foundation adequacy. | Submit foundation, framing, connection details and calculations as one coordinated set. |
| Ignoring site work | Grading, retaining walls, trees, stormwater or septic work may need separate approvals. | Include every disturbance and utility change in the permit strategy. |
| Relying on an expired disaster order | Eligibility and review targets can change. | Verify the active order, date, area and documentation requirements immediately before filing. |
| Using a generic checklist | Terminology, scales, seals and thresholds differ by authority. | Use the current city or county checklist and ask which local amendments apply. |
| Changing plans after approval without review | Moving a wall, window, grade or foundation can alter setbacks and structural design. | Submit revisions and obtain approval before constructing the change. |
How to choose between the main rebuild strategies
| Strategy | Best fit | Main advantages | Main risks |
|---|---|---|---|
| Repair or limited alteration | Much of the lawful structure remains usable. | May preserve existing-building provisions and reduce demolition. | Hidden damage, scope creep or nonconforming conditions can force a broader review. |
| Same-footprint replacement | The former location remains desirable and a local exception or current setbacks permit it. | Known access, utility and grading pattern. | Old location may fail current setbacks, slope or flood standards. |
| Redesigned new construction | The old house is inefficient, unsafe or poorly located. | Allows a coordinated current-code design and improved site planning. | May require more zoning relief, engineering, grading and review. |
| Reuse of foundation | Investigation shows adequate capacity and legal location. | Can reduce excavation and concrete work. | Unknown reinforcing, settlement, moisture, geometry or geotechnical limitations. |
| New foundation | The old foundation cannot meet current loads, setbacks or site conditions. | Clean structural design and easier coordination. | More demolition, excavation, soil control and cost; exact cost is not established by the cited authorities. |
| Disaster-specific expedited review | The property and application meet an active disaster program. | Potentially larger rebuild allowance or expedited review. | Strict eligibility, documentation and expiration rules; not a general entitlement. |
What is not universal
There is no nationwide setback distance, permit fee or universal review time established for these projects. The governing city or county controls those values, along with whether a surveyor, architect, structural engineer or soils engineer must seal particular documents. Even neighboring jurisdictions can use different definitions for “replacement dwelling,” “demolition,” “like for like” and “existing nonconforming structure.”

A practical pre-demolition checklist
- Written confirmation of ownership, legal-lot status and the proposed work classification.
- Current boundary and topographic survey, including the old foundation and all relevant slopes or water features.
- Written zoning and setback determination, including any nonconforming-building or disaster-program rule.
- Utility disconnection, sewer or septic closure and access plan.
- Asbestos, tree, erosion, stormwater, environmental and geotechnical requirements identified.
- Demolition permit issued, with every condition understood before work begins.
- Preliminary architectural, structural and site concept demonstrating that the desired footprint can comply.
- Budget and schedule allowance for professional investigations, plan corrections, inspections and possible foundation replacement.
Bottom line
Plan a post-demolition rebuild as a new regulated project unless the local authority confirms a narrower existing-building or disaster pathway. Secure demolition approval and site controls, prove that the proposed location satisfies current zoning and setbacks, and submit a coordinated package of site, architectural, structural, energy, fire and site-specific documents. A former footprint or foundation can inform the design, but only the current code, qualified professionals and the building official can establish whether it may legally and safely be reused.
