If construction uphill or next door is sending muddy water toward your home, document what happens, contact the site operator, and ask your local stormwater or building authority how to report it. Keep water away from the home without blocking public drains or redirecting runoff onto another property. Construction-site controls should be selected, installed, and maintained by the responsible operator for the site’s conditions.
What to do when construction runoff reaches your property
- Document the flow. Take dated photos or video from your property during or after rain. Note when it happened, how long it lasted, where the water appeared to come from, where it entered or crossed your property, visible mud or debris, and whether it reached a building. This record helps describe the problem; the appearance of muddy water alone does not establish a permit violation.
- Contact the builder, developer, or site operator. Share your observations and ask what downhill perimeter controls and storm-drain inlet protection are in place, how they are inspected after rain, and who handles repairs and sediment removal. EPA’s small-site guidance says to remove sediment from inlet controls when it reaches halfway up the control (EPA, Stormwater Pollution Prevention for Small Residential Construction Sites, December 2015).
- Ask the local authority about reporting. Contact your city or county stormwater program, building department, or environmental enforcement office for the local process. Explain where the runoff comes from and provide your dated observations. Requirements and enforcement channels vary by location.
- Protect your home without changing drainage unsafely. Maintain your own gutters and clear only private drains you are allowed to maintain. Do not dam a public storm drain, trespass on the construction site, or divert water onto a neighbor’s land. If water reaches a foundation, flooding recurs, or grading appears to have changed, seek guidance from the relevant authority and a qualified local drainage professional.
Runoff moving across exposed construction soil can carry sediment, debris, and other pollutants toward storm drains or nearby waters. The concern is both the water’s path and what it carries (EPA, “Stormwater Discharges from Construction Activities”).

What construction-site controls can reduce mud and runoff
Controls belong to the construction operator, who should choose and maintain them for the site. EPA’s small-residential-site brochure describes preserving existing trees and areas intended for vegetation or infiltration; protecting soil piles and stored materials from run-on and runoff; designating waste areas; and placing sediment controls at downhill boundaries and storm-drain inlets. It also describes a crushed-rock construction exit over geotextile and stabilizing exposed soil when work will pause for 14 or more days (EPA, Stormwater Pollution Prevention for Small Residential Construction Sites).
Downhill boundaries
Sediment filter logs or silt fences can be used along downhill lot boundaries to slow or capture sediment. They need appropriate placement and upkeep; a barrier is not a substitute for controlling erosion across the site.

Storm-drain inlets
Sediment-control logs, gravel barriers, or sand or rock bags are examples of inlet protection in EPA’s small-site guidance. They must not obstruct the drain in a way that creates unsafe flooding, and accumulated sediment needs removal. The operator should maintain access to the inlet and follow local specifications.
Exposed soil, stockpiles, and slopes
Protect small soil piles where suitable and keep stored materials from being washed by incoming or outgoing flow. For exposed ground, possible erosion-control practices include mulch, seeding, sod, erosion-control matting, grading, temporary slope drains, and vegetated buffers. The appropriate choice depends on the soil, slope, rainfall, layout, nearby waters, available space, safety, and local rules.

Choosing and maintaining controls
EPA’s construction BMP menu also includes compost filter socks, filter berms, sediment basins, silt fences, inlet protection, and vegetated buffers; its examples are not exhaustive (EPA, “National Menu of Best Management Practices (BMPs) for Stormwater-Construction”). No single control is best for every site. Some controls use plastic netting; EPA encourages consideration of natural or biodegradable alternatives and removal of netting when it is no longer needed, with wildlife impacts in mind.

Installation and maintenance matter as much as the choice of control. A homeowner can ask who inspects the controls after rain and who removes captured sediment, but should not install or alter controls on someone else’s site.

When construction stormwater permits may apply
Under the federal NPDES construction-stormwater framework, permit coverage generally applies when construction disturbs at least 1 acre, including a smaller site that is part of a common plan of development or sale that will ultimately disturb at least 1 acre. Covered earth disturbance can include clearing, grading, and excavation. Permit authority rests with EPA in some areas and authorized states in others; covered operators obtain permit coverage and develop a stormwater pollution prevention plan (SWPPP) (EPA, “Stormwater Discharges from Construction Activities”; EPA small-site brochure).
The federal 1-acre threshold does not mean smaller projects are free of stormwater or drainage requirements. State permits, municipal rules, local ordinances, and property-specific drainage requirements may apply independently, and states can impose more stringent requirements. Check with the authority responsible for your location rather than inferring compliance from the project’s apparent size (EPA, “Construction General Permit (CGP) Frequent Questions”).
