Protect your property by treating road construction as a documented, coordinated project—not as an unexpected landscaping event. Before crews arrive, identify who controls the work, confirm the limits and schedule, photograph every vulnerable feature, disclose private utilities, and obtain driveway-access and restoration terms in writing. During construction, stay out of the work zone and report access, drainage, or damage problems through the project contact. Afterward, photograph the same views, report defects promptly, and keep all records. The exact right-of-way, restoration duty, and claim process depend on your municipality, utility, easement documents, and project contract.
Start with the project authority and its work limits
Read the mailed notice, posted sign, or project webpage and identify the road authority, utility, general contractor, and resident-concern contact. A road project may be led by a municipality, a utility, or both. The UK Department for Transport distinguishes utility “street works” from road works that repair or improve a highway; that distinction can change who answers damage and access questions. Its street-works collection includes operational guidance, including a coordination code updated in March 2026.

Do not assume the visible pavement edge is the property boundary. Montgomery Township explains that a public right-of-way can extend several feet behind the road edge, curb, or sidewalk, and that widths vary. Check the project plan, your parcel or easement records, and the authority’s written answer before moving plants, installing barriers, or claiming that a feature is entirely private. The township’s roadwork FAQ is a local example, not a universal rule.

Will the contractor damage my driveway? Reduce the risk before work starts
Photograph the existing condition
Build a dated baseline before machinery arrives. Take wide photographs from the street and house, then close views of each vulnerable feature. Include the driveway surface, apron, curb, sidewalk edge, expansion joints, retaining edges, lawn, planting beds, trees, irrigation heads, sprinkler controls, fences, invisible-fence markers, drain inlets, downspouts, low spots, and any existing cracks, rutting, settlement, or patched areas.
Photographs are practical evidence preservation, not a universally mandated legal step. Keep the original files with their dates and make a cloud folder or email the set to yourself. Save the project notice, plan, emails, text messages, and notes from calls in the same folder. A short inventory is useful: list each sprinkler head, valve box, lighting cable marker, tree, edging section, and distinctive plant bed so you can check the same items later.
Ask how heavy loads will reach the site
Driveway damage often occurs during repeated loading, turning, or delivery rather than during the visible excavation. Ask whether trucks, rollers, excavators, or concrete deliveries will use your apron or driveway, how long they will remain there, and whether the contractor will keep loads on the roadway. Tell the project representative about soft subsoil, recently repaired pavement, buried drains, septic components, or retaining structures near the route.

How do I protect sprinklers, lighting, and invisible fences?
Disclose every private feature near the work
Tell the authority and contractor about irrigation pipes and heads, sprinkler controllers, low-voltage lighting, invisible dog fences, private drains, landscape wiring, tree roots, wells, and other buried or fragile features. Public utility markings do not necessarily identify private lines on your lot. Give the project contact a sketch or photographs showing valve boxes, control panels, cleanouts, and unusual routing.
Follow the project’s instructions for marking. Montgomery Township recommends marking underground sprinklers and dog fences with white paint or flags after a project start notice. That is a local recommendation; ask your project contact what color, spacing, and marking method it accepts. Marking is not a guarantee that a private feature will be protected, so request written confirmation of whether the contractor will avoid it, temporarily disconnect it, or require you to remove it.
Remove or relocate conflicting private improvements only after checking authority
The Town of Ajax advises removing irrigation or landscaping that conflicts with its right-of-way and warns that its contractor will not be responsible for damage to private irrigation or landscaping within that right-of-way. This does not establish the rule in another municipality. Before digging or relocating a feature, verify the right-of-way or easement and ask whether the authority wants the owner, contractor, or utility to perform the work.
Do not dig to expose a line until you have checked buried-service requirements. In federally regulated pipeline areas in Canada, the Canada Energy Regulator’s contractor guidance requires written consent for specified activities in a prescribed area and recommends contacting a one-call centre before ground disturbance. That guidance applies to the regulated pipeline context, not automatically to every road project or every country.

Can they block my driveway?
Get an access plan in writing
Ask exactly when a vehicle may be unable to enter or leave, how much notice you will receive, where temporary parking is permitted, and who to call if the crew blocks access outside the stated window. Discuss deliveries, caregivers, disability access, school transport, trash collection, and emergency vehicles. If you need continuous access, say so before the schedule is finalized rather than relying on a crew member’s informal assurance.
Ajax warns that driveway access can be temporarily blocked and says its contractor maintains emergency access. That is an example of local policy, not a guarantee for every project. Keep the project number and after-hours contact accessible. Never move barricades, cones, signs, or traffic-control devices yourself; report the problem to the project representative or emergency service as appropriate.
Understand what “in kind” means
Ajax states: “The contractor is responsible for completing sod and driveway restoration, in kind.” In that municipal context, “in kind” generally means restoration comparable to what was removed or disturbed, not an automatic upgrade to a newer or more expensive finish. Ask the authority to define the surface, thickness, seed or sod type, edging, grading, and timing in your project documents. A different municipality may assign responsibility differently or exclude private items in its right-of-way.

Road work can change grades, curb elevations, swales, shoulder material, or the path water takes across your frontage. Before work, photograph drain inlets, downspouts, splash blocks, channel drains, low spots, and the direction of existing runoff. Note whether water already ponds after rain and where it flows toward the street, your house, or a neighbor.

During and after construction, report standing water, sediment blocking an inlet, water entering a garage, erosion, or runoff redirected toward a building or adjoining property. Describe the location, date, weather, and duration, and attach photographs. Do not fill a new low spot or alter a curb yourself before the authority inspects it.
For driveway design, UK government guidance says the drive should slope away from the house where possible and should not direct water toward a neighbor. The UK front-garden surfacing guidance is a design recommendation for that jurisdiction; it does not decide responsibility for runoff from a road project elsewhere.
Should you use ground-protection mats?
If construction equipment must cross a sensitive lawn or planting bed, ask the contractor whether temporary ground-protection mats are appropriate. Manufacturer and retailer descriptions identify reusable high-density polyethylene (HDPE) mats as temporary access surfaces or work platforms for vehicles and equipment. The category is legitimate, but a homeowner should not choose a model from a generic load-rating number.
Before any crossing, obtain the contractor’s written plan for:

- how the authority approves placement near a sidewalk, curb, drainage inlet, or traffic lane.
SIGMA Ground Mats describes HDPE mats for temporary equipment access over sensitive or soft ground, while Mytee Products’ product information describes heavy-equipment mats with connectors. These are manufacturer or retailer descriptions, not independent performance tests. Mats can be heavy, can shift on unsuitable ground, and can trap water or debris if installed incorrectly. Do not buy or place them in a public right-of-way without the project authority’s approval.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to do while crews are working
- Keep the contact details handy. Record the project number, representative’s name, phone number, and email. Log each incident with the date, time, exact location, photographs, and the response you received.
- Stay out of the work zone. Do not walk behind reversing equipment, enter an excavation, or move barricades and traffic-control devices. Ask the representative to escort you if an inspection is necessary.
- Check access at the start of each workday. If a vehicle cannot enter or leave, use the stated procedure immediately. Mention emergency, medical, disability, or time-sensitive needs.
- Watch for changes in runoff. Report blocked inlets, exposed pipes, sediment, erosion, or water flowing toward the house or a neighbor while the crew can still correct the temporary condition.
- Confirm lawn crossings before they occur. If the equipment route changes, ask whether the approved matting or another protection method will be used. Do not direct operators or place your own materials in their path.
What to do immediately after the work
Repeat the baseline inspection
Photograph the same viewpoints and close-ups you captured before construction. Look for driveway cracks, broken edges, tire marks, rutting, settlement, heaving, damaged curbs or aprons, compacted soil, dead or buried plants, broken irrigation, severed lighting, damaged fencing, exposed roots, clogged drains, and changed water flow. Photograph incomplete sod, mismatched materials, and areas that remain inaccessible.
Report concerns through the written process
Send the project contact a concise description with dates, locations, before-and-after images, and the result you are requesting. Ask for an inspection and a written description of the planned repair. Keep contractor estimates, invoices, receipts, and all correspondence. Do not assume a universal claim deadline, reimbursement right, or payment for consequential losses: municipal policies differ and your jurisdiction may impose its own notice rules.
If the authority disputes responsibility, ask it to identify the controlling right-of-way, easement, contract clause, or restoration policy in writing. For a substantial unresolved dispute, obtain advice from a local property or construction lawyer, engineer, or surveyor who can review your documents and local law.
Who is responsible for the lawn, driveway, and private improvements?
Responsibility depends on the land status, the work owner, and the local policy. The examples below show why you must obtain project-specific terms rather than rely on a general promise.
| Issue | Montgomery Township, New Jersey | Town of Ajax, Ontario |
|---|---|---|
| Right-of-way extent | The FAQ says the right-of-way can extend several feet behind the road edge, curb, or sidewalk; widths vary. | The road information describes the town’s right-of-way policy; exact limits must be confirmed for the project. |
| Private irrigation or landscaping in the right-of-way | The township says it does not reimburse owners for certain private items damaged within the right-of-way. | The town advises removing conflicting irrigation or landscaping and says its contractor will not be responsible for private irrigation or landscaping within the right-of-way. |
| Sod and driveway restoration | Rules and compensation depend on the township’s stated policy and project facts. | The town states that “The contractor is responsible for completing sod and driveway restoration, in kind.” |
| Driveway access | Obtain the project-specific access arrangement. | The town warns that temporary driveway blockages can occur and says its contractor maintains emergency access. |
Read the full local documents: Montgomery Township’s roadwork FAQ and the Town of Ajax road information. Neither policy automatically governs a different city, county, province, state, utility, or private easement.
A practical homeowner checklist
Before work
- Save the project notice and identify the authority, utility, contractor, and resident contact.
- Request the work limits, schedule, equipment route, driveway-access plan, emergency procedure, and restoration terms.
- Check parcel, easement, and right-of-way records; do not infer the boundary from the visible lawn edge.
- Photograph and inventory the driveway, curb, lawn, beds, trees, irrigation, lighting, fences, drains, and existing defects.
- Disclose private buried features and mark them exactly as instructed.
- Ask whether any feature must be removed and who is responsible for disconnecting or restoring it.
- Check one-call and permit requirements before digging or installing a barrier.
During work
- Keep the project number and contact available.
- Stay outside the work zone and never move traffic controls.
- Record blocked access, runoff, dust, vibration, or damage with time-stamped notes and photographs.
- Confirm any lawn-crossing or matting plan with the contractor before equipment moves.
After work
- Repeat the before-and-after photographs from the same positions.
- Test irrigation and lighting only when it is safe and the contractor has finished in the area.
- Check grades, inlets, downspouts, ponding, erosion, driveway settlement, and sod establishment.
- Report defects promptly under the project’s written procedure and request a documented inspection.
- Keep estimates, receipts, photographs, and every communication together.
When a dispute needs professional help
Escalate when the project contact will not identify the work limits, refuses to record a documented hazard, leaves a driveway or drainage defect unresolved, or denies a claim without explaining the governing policy. A surveyor can clarify a disputed boundary; a drainage professional can evaluate changed grades; and a local lawyer can explain notice requirements, easement rights, and available remedies. Bring the project notice, photographs, parcel records, correspondence, and repair estimates. Because no universal remedy, deadline, or reimbursement entitlement applies to every road project, local advice is essential when the financial or safety consequences are significant.
