How to Prepare Your Property for a New Road Construction Project

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a proposed road may cross your land, change your driveway, move utilities or restrict access, contact the named road authority or project liaison before altering the site. Request the current parcel-specific right-of-way plan, survey information, schedule, acquisition and temporary-access requirements, utility-relocation plan, permits and environmental constraints. Compare those documents with your deed, survey and easements; preserve notices, correspondence, agreements and dated photographs; and obtain written answers to unclear points. Do not clear, grade, excavate, move utilities or enter a work zone until the authority confirms the limits and permissions in writing.

There is no universal owner checklist or deadline. Public-road projects proceed under local plans, funding conditions, permits and property laws, and the effect on each parcel can differ. The steps below organize the questions and records that help an owner or occupant prepare while leaving legal, valuation and access decisions to the responsible authority and qualified local professionals.

Start with the project identity and the right contact

Begin by turning a general notice—such as “a road is planned nearby”—into a traceable project record. Write down the road authority, project name or number, the named property-owner liaison, the date of every notice and the best method for receiving updates. A city, county, state or other public agency may be responsible for different portions of one corridor, so confirm which office controls right-of-way, construction access and utility coordination for your parcel.

  • Proposed permanent acquisitions, easements and temporary construction or access easements, with the area and duration for each.
  • Driveway, gate, parking, delivery and emergency-access changes, including any planned closures or detours.
  • The current schedule for design, property acquisition, utility work, permits, clearing and construction, identifying dates as estimates when they are not fixed.
  • A utility-conflict and relocation plan naming the affected service, responsible utility owner, anticipated interruption and notice procedure.
  • The construction manager or field contact, after-hours emergency number and process for reporting damage, blocked access or unsafe conditions.
  • Applicable permit, drainage, erosion-control, tree, wetlands, historic-resource or other environmental requirements for the parcel.

Ask the liaison to identify the plan revision date. A plan can change as surveys, utility information, permits or design reviews progress; relying on an older exhibit may give you the wrong limits.

Understand the project phases and when your input matters

Road work normally moves through related phases: scoping and survey, preliminary and final design, right-of-way and utility coordination, permitting, then construction. The names and order vary by agency, but a property impact can change between phases.

Scoping and survey

At this stage the authority evaluates alternatives, traffic needs, terrain, drainage and environmental constraints. Preliminary survey work may establish the roadway centerline, parcel boundaries and existing features. Ask whether survey crews need permission to enter private land, what notice will be provided and how any temporary disturbance will be restored. Do not assume that a conceptual line is a final taking or that a preliminary drawing guarantees a particular alignment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Design review

Some agencies invite affected owners to review preliminary design. For example, the Virginia Department of Transportation describes owner participation during review of preliminary design. Ask when comments are due, which design elements are still open and whether your written concerns will be placed in the project record. Focus comments on measurable effects—driveway geometry, sight distance, drainage, slope stability, deliveries and emergency response—rather than only on a broad objection to the road.

Right-of-way and utility coordination

Once a preferred design develops, the agency identifies property rights needed for the road and coordinates with utility owners. This is when a parcel-specific plan and written acquisition proposal become especially important. Ask whether the agency seeks fee ownership, a permanent easement, a temporary construction easement or permission to use an existing public right-of-way.

Permits and construction

Permits can impose erosion, hydraulic, stormwater, tree-protection, wetland, historic-resource or other conditions. VDOT lists erosion and hydraulic plans and environmental permits among project tasks, but that general description does not establish which restrictions apply to your parcel. Get the actual permit conditions or a written explanation from the authority before removing vegetation, changing grades or disturbing soil.

Map exactly how your property could be affected

Use the current plan to mark every permanent and temporary effect. A road can affect land without taking a building: a slope easement may reach behind a structure, drainage work may alter a low area, or a temporary access route may occupy a yard during construction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Separate permanent rights from temporary use

Ask the authority to label each area and purpose separately:

  • Permanent acquisition: land or an interest that remains with the road project after construction.
  • Permanent easement: a continuing right for roadway, drainage, utilities, access or maintenance while ownership may remain with you.
  • Temporary construction easement: a time-limited right for staging, grading, access, equipment or restoration.
  • Construction access: a route workers may use to reach the site, which may be distinct from the final public road.

Request dimensions, the planned duration of temporary use, restoration obligations and the document that would grant each right. Do not treat a verbal statement that “the road will stay within the corridor” as a parcel-specific commitment.

Compare the plan with your own records

Gather your deed, prior surveys, recorded easements, title documents, permits, utility-provider information and records of fences, wells, septic systems, landscaping, outbuildings, irrigation, drainage features and access agreements. Mark the records with the plan revision date and note conflicts. Owner records are a starting point, not a substitute for the agency’s survey; ask whether the authority will conduct or provide a boundary or improvement survey.

If a boundary, access right or easement location is disputed, use a locally licensed land surveyor or property attorney. Aerial imagery and a handheld measuring device can help you organize questions, but they do not establish a legal boundary.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check driveways, gates, parking and emergency access

Access problems often affect daily life before earthwork begins. Ask for a drawing and written operating plan covering normal and emergency conditions.

  • Will the existing driveway remain, move, narrow or close?
  • Where will residents, tenants, customers, deliveries, school transport and service vehicles enter during each construction stage?
  • When will gates be closed, and who will provide keys, escorts or temporary access?
  • How will emergency responders reach the property if the usual route is blocked?
  • Will parking, loading zones, mail service, waste collection or agricultural access change?
  • What signs, barriers, lighting and traffic-control devices will be used, and who can change them?
  • How much notice will you receive for a closure or a change in the temporary route?

Have the authority identify an individual to call if a barricade blocks essential access or a contractor uses an unapproved route. Keep the approved access sketch with your contact log and provide it to occupants, tenants and regular delivery providers.

Find out what happens to utilities and private systems

Road projects commonly require coordination among the road authority and utility owners. A utility map may not show every private line, so disclose wells, septic systems, private water or gas lines, irrigation, electric service, communications cables, fuel tanks and drainage pipes that you know about.

Questions for the authority and utility providers

  • Which public or private utilities conflict with the proposed roadway, drainage or grading?
  • Who will design, schedule and pay for relocation, protection or abandonment?
  • Will service be interrupted, and how much notice will be given?
  • Will temporary service, generators, water supply or alternate communications be provided when needed?
  • Who reconnects appliances, meters, wells, septic components or private lines?
  • How will the location of a private system be verified before excavation?
  • What restoration standard applies to pavement, landscaping, fencing and other disturbed features?

Keep account numbers and provider contacts, but do not authorize a relocation solely on a contractor’s informal request. Confirm the responsible party, approved limits and schedule in writing. Never move, cap, expose or excavate a utility yourself unless the utility owner and authority expressly authorize the work and required permits are in place.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Review acquisition, valuation and relocation information carefully

If the project needs property rights, ask for the written offer, plan, legal description, appraisal or valuation basis used by the authority, and the deadline for responding. Confirm whether the offer concerns a fee acquisition, easement, temporary use or a combination. Ask how damage to the remainder, loss of access, severance, business interruption or restoration is addressed under the applicable law; these issues are jurisdiction-specific and may require an independent valuation review.

Federal acquisition and relocation requirements can apply when federal money supports any part of a project. The Texas Department of Transportation states that its federal Uniform Relocation Assistance and Real Property Acquisition Policies Act requirements apply in that circumstance. North Carolina’s transportation department describes its process as treating owners impartially, explaining legal rights, paying just compensation for acquired property rights and furnishing relocation assistance. Those descriptions concern the named agencies and their processes; they are not a promise that every owner in every location qualifies for a particular payment or benefit.

“Ideally, all right of way is acquired, utilities adjusted and all necessary coordination with affected railroads is completed before construction begins.”

Do not sign an easement, release or possession agreement under time pressure without understanding the legal description, rights retained, restoration terms, access provisions and payment conditions. A property-acquisition attorney, land surveyor or qualified valuation professional in your jurisdiction can explain disputed boundaries or an offer. Keep the original proposal and every revision.

Document the property before anyone disturbs it

Create a dated condition record before survey, clearing, utility relocation or construction. Photograph and, where useful, video the exterior and interior areas that could be affected. Include wide views that establish location and close views of existing conditions.

Record these features

  • Driveways, pavement edges, curbs, sidewalks, parking and gate hardware.
  • Fences, walls, retaining structures, decks, sheds, signs and other improvements.
  • Trees, gardens, landscaping, irrigation, drainage channels, culverts and low areas.
  • Foundations, wells, septic components, utility meters, visible lines and private service equipment.
  • Cracks, settlement, water stains, leaning structures or other pre-existing damage.
  • House numbers, access points and landmarks that allow each image to be located later.

Keep the original files with capture dates and a simple map or index. Store copies in more than one secure location. A photo log is prudent owner practice, not a universal legal requirement; ask the authority whether it has a formal preconstruction inventory or inspection process.

Compare alternatives or property arrangements using the same criteria

If the authority presents more than one alignment or asks you to consider different easement arrangements, make a parcel-specific comparison. Generic assumptions about compensation or schedule are not reliable.

Temporary area and duration Where will staging, access or grading occur, for how long and with what restoration obligation?
Driveway and emergency access What route serves residents, deliveries, customers and emergency responders during each phase and after completion?
Utilities Which services conflict, who performs the work, what interruptions are expected and how will notice be given?
Drainage, trees and site constraints How do grades, runoff, erosion controls, wetlands, trees, septic systems or other features change?
Timing and disruption What are the estimated acquisition, utility, closure and construction windows, and which are subject to change?
Written terms and valuation What document grants each right, how is value or damage assessed, and what assistance process applies?

Ask the project liaison to confirm unresolved differences in writing. If an alternative affects a legal boundary, access right or valuation, obtain local professional advice before accepting it.

Prepare occupants, tenants and operations

Owners should share confirmed information with everyone who relies on the property. Give occupants and tenants the approved access map, closure notices, emergency contact and rules for staying outside work zones. Businesses, farms and institutional properties should identify delivery windows, oversized vehicles, customer routes, fire lanes, accessible parking and critical utility loads.

Maintain a short internal procedure for reporting a blocked gate, loss of service, vibration damage, flooding or unsafe condition. Record the date, location, photographs, contractor or vehicle identification if safely observable, and the authority contact notified. Do not confront workers or enter a restricted area to investigate; use the designated reporting channel.

Know what not to do before authorization

  • Do not clear trees, grade soil, excavate, fill drainage areas or remove fences in a proposed work area without confirming permits and property limits.
  • Do not move, disconnect or expose utilities based on a map, assumption or informal instruction.
  • Do not enter a work zone, cross barricades or direct contractors to use a different route.
  • Do not promise a tenant, buyer or contractor that access, compensation, a schedule or restoration is guaranteed unless the authority has documented it.
  • Do not discard notices, superseded plans, offers or signed agreements; they help establish what was communicated and when.

Private improvements outside the project limits may still need local permits, utility locates or environmental review. Ask the authority and the relevant local permitting office before undertaking owner-directed work near the proposed road.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep a project file and communication log

Use one chronological file—paper, digital or both—for notices, plans, surveys, deeds, easements, photographs, emails, letters, meeting notes, offers and receipts. For every call or meeting, record the date, participants, questions, answers, promised follow-up and plan revision discussed. Send a short written confirmation after material conversations and invite correction if your understanding is wrong.

Track deadlines separately: comment periods, survey-entry requests, acquisition responses, utility shutdown notices, permit applications and planned closures. A calendar reminder is useful, but the controlling date is the one in the applicable notice or agreement. If a deadline is unclear, ask the authority to state it in writing.

What to do when information or work does not match the plan

An unclear or conflicting plan

Mark the exact location and document versions that conflict. Ask the liaison which plan controls, whether a revision is pending and how the change affects the parcel boundary, access, utilities or restoration. Avoid relying on a contractor’s field interpretation for a property-rights question.

Unannounced entry or blocked access

From a safe location, document the condition and contact the project’s designated field or emergency number. State the essential access affected, the time, the location and the immediate risk. If emergency access is threatened, contact emergency services as appropriate while notifying the authority. Preserve all notices and responses.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Damage, flooding or utility interruption

Prioritize safety and follow utility or emergency instructions. Photograph the condition when safe, note weather and timing, and report it through the documented process. Do not make permanent repairs that could destroy evidence or violate the project’s claims procedure without asking who must inspect and authorize the work.

A disputed boundary, easement or offer

Request the legal description, survey basis and written explanation. Then consult a locally qualified surveyor, attorney or valuation professional. Agency staff can explain their process, but they cannot provide independent advice for your particular property dispute.

A practical checklist before construction starts

  1. Record the authority, project number, liaison and every notice date.
  2. Obtain the current parcel plan, right-of-way limits, temporary areas, grading, drainage and driveway exhibits.
  3. Ask for the schedule, acquisition documents, utility plan, permits, environmental conditions and construction contacts.
  4. Compare the plan with the deed, survey, easements and site records; list every mismatch in writing.
  5. Confirm who surveys, relocates and restores utilities and how interruptions will be announced.
  6. Agree in writing on resident, tenant, delivery, parking and emergency access for each construction stage.
  7. Photograph existing conditions with dates, locations and identifying landmarks.
  8. Distribute confirmed information to occupants, tenants, employees and essential service providers.
  9. Secure professional advice before signing disputed acquisition documents or changing a boundary or access arrangement.
  10. Do not clear, grade, excavate, move utilities or enter restricted areas until the authority confirms permission and limits.

Questions to ask the project liaison

  • Which current drawing shows my parcel, and what is its revision date?
  • Exactly which permanent and temporary rights are requested, and for how long?
  • Will you provide or review a survey showing the parcel boundary and improvements?
  • What happens to each driveway, gate, parking area, delivery route and emergency route?
  • Which utilities conflict, who coordinates them, and what interruption notice will I receive?
  • Which permits and environmental restrictions apply before I alter vegetation, drainage or grades?
  • What will be removed, what will be restored and to what standard?
  • Who is the field contact for damage, flooding, unsafe conditions or blocked access?
  • What are the response deadlines, and where should I send written comments or documents?
  • Which acquisition, valuation and relocation rules apply to this project and this property?

Answers should identify the responsible office and document whenever possible. If the answer depends on funding, jurisdiction, eligibility or a future design decision, ask the liaison to state that qualification rather than treating an estimate as a commitment.

Frequently Asked Questions

Can the road authority enter my property to survey it?

Entry rules depend on local law, project authority and the notice or permission provided. Ask the liaison what authority or consent is required, the dates and areas of entry, and how disturbed features will be restored. Do not assume that a survey request authorizes construction access.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How can I tell whether the project will take part of my land?

Request the current parcel-specific right-of-way plan and legal description, then compare them with your deed, survey and recorded easements. A conceptual corridor map is not enough to establish the final acquisition.

Who pays to move a utility?

Responsibility varies by utility ownership, project agreements, permits and local law. Ask the road authority and each affected utility who designs, schedules, funds and restores the relocation, and how service interruptions will be handled.

Am I guaranteed compensation or relocation assistance?

No universal guarantee applies. Eligibility and valuation depend on the jurisdiction, property rights, project funding and individual facts. Federal acquisition and relocation requirements may apply when federal money supports part of a project; obtain the applicable written explanation and professional advice.

What if construction blocks my driveway unexpectedly?

Use the project’s field or emergency contact, report the location and essential access affected, and document the condition from a safe place. If emergency access is threatened, contact emergency services as appropriate. Do not cross barricades or direct workers to improvise a route.
