Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →To prepare for federal construction work, make the company bid-ready before chasing an opportunity: choose a prime or subcontracting route, complete the right SAM.gov registration, align NAICS and size representations with each solicitation, price the applicable prevailing-wage and fringe requirements, verify bonding or payment-protection terms, and build a file-by-file review process. Federal requirements are not identical across agencies or projects; the solicitation, contract clauses, location, construction type, contract value and (for Department of Defense work) cybersecurity requirements control what applies.
What “federal-contracting ready” means
A commercial contractor can have excellent field performance and still be unprepared for a federal bid. Readiness means the business can prove its legal identity and eligibility, find opportunities under the right industry code, interpret the solicitation, price labor and risk accurately, and administer the resulting contract without treating compliance as a one-time paperwork exercise.

Use the following as an operating standard rather than a universal checklist. A federal construction solicitation may add, remove or modify requirements. The controlling documents are the solicitation, incorporated clauses, wage determination and any agency instructions issued for that opportunity.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Identity: The legal entity, address, payment information and representations are consistent across the company’s official records and SAM.gov.
- Eligibility: The selected NAICS code, size representation and any socioeconomic-program representation match the solicitation and the company’s actual facts.
- Execution: Estimators, project managers, payroll staff and finance personnel understand the clauses that affect the job they are pricing.
- Evidence: Capabilities, past projects, licenses and service areas in the company profile can be supported with records if an agency asks.
- Risk capacity: The company has reviewed bonding, payment protection, insurance, cash flow and cybersecurity obligations before submitting a price.
Choose the right entry route: prime or subcontractor
There are two legitimate ways to build federal experience. A prime contractor contracts directly with the agency and is responsible for the complete performance package. A subcontractor performs a defined scope for a prime and can develop federal past performance without carrying every direct-award responsibility.

| Entry route | What the company controls | Readiness emphasis | Typical limitation |
|---|---|---|---|
| Prime contractor | Bid submission, contract administration, agency communications, schedule, quality, payroll compliance and subcontract management | Active SAM.gov entity registration, solicitation-by-solicitation representations, bonding capacity, accounting and compliance systems | Greater administrative, financial and performance responsibility |
| Subcontractor | Its assigned trade or construction scope, pricing to the prime, records and flow-down compliance | Capability statement, reliable estimating and production records, ability to meet the prime’s clauses and reporting requirements | Less control over the prime’s contract decisions and agency relationship |
If the goal is a direct federal award, the firm must satisfy the registration requirement described below. A company that is still building public-sector references can target primes, introduce a specific trade capability, and ask which federal clauses will flow down before accepting a subcontract.
Some larger awards to businesses that are not small require a small-business subcontracting plan when subcontracting possibilities exist. FAR 19.702 states a $2 million construction threshold for covered negotiated acquisitions in that situation, subject to exceptions. The threshold is not a blanket rule for every federal construction purchase; review the solicitation and its exceptions.
Complete SAM.gov registration and understand the UEI
Do I need to register in SAM.gov to bid as a prime?
Yes. An entity that intends to apply directly for a federal award as a prime needs an active SAM.gov entity registration. SAM.gov assigns the company’s Unique Entity ID (UEI) during the registration process. A UEI-only record does not authorize an entity to apply directly for federal awards.
Registration must be renewed every 365 days. Assign one person as the registration owner, a second person as backup, and calendar the renewal well before expiration. Also update the record when the legal name, address, ownership, banking or other registration data changes.
Prepare the records before starting
- Confirm the exact legal name and entity type in the company’s official formation and tax records.
- Assemble the physical and mailing addresses, points of contact, payment information and ownership details that the registration asks for.
- Check that the information used by accounting, insurance, bonding and the company website is consistent with the legal record.
- Complete the entity registration through SAM.gov’s official instructions and checklist; do not pay an intermediary merely because it presents registration as mandatory.
- Save the UEI, registration status, renewal date and the person responsible for future updates in the company’s contract-administration file.
Businesses no longer obtain a DUNS number as the federal entity identifier. The UEI is assigned through SAM.gov. Keep a copy of submitted representations and confirmations so the company can identify what it certified for a particular bid.
Use the correct NAICS code and size representation
NAICS codes describe the work the firm offers. Start with the construction scope actually performed, then compare it with the NAICS code assigned to the solicitation. The applicable SBA size standard varies by NAICS code, so a company that is small under one code may not be small under another. SBA also notes that affiliates can affect the size calculation.
Run this check for every opportunity
- Read the solicitation’s assigned NAICS code and stated size standard.
- Describe the revenue, employees or other measure used by that standard using the correct SBA rule for the code.
- Identify affiliates and ownership relationships that may be included in the analysis.
- Compare the result with the representation the company will make in SAM.gov and in the offer.
- Document the conclusion and the records supporting it; escalate uncertainty to a qualified government-contracting adviser before certifying.
Do not select a code solely because it makes the company appear eligible. A mismatch can affect set-aside eligibility, representations, subcontracting goals and the agency’s evaluation of the offer.

- Keep licenses, certifications, safety records and bonding information current where the profile or solicitation requests them.
- Remove outdated claims and unsupported credentials. The profile should withstand a request for supporting documents.
Build a solicitation-by-solicitation bid/no-bid review
Federal readiness is not a one-time approval. Before estimating labor or materials, assign a reviewer to identify every obligation in the solicitation, attachments, drawings, clauses and amendments.
Bid/no-bid gate
- Scope: Can the company self-perform the required work, staff the schedule and obtain any specialized trade support?
- Geography: Can the company mobilize to the project location and comply with the location-specific wage determination?
- Contract form: What pricing, change-order, schedule and payment risks are created by the contract structure stated in the solicitation?
- Eligibility: Are the NAICS code, size status, representations and any set-aside conditions satisfied?
- Labor: Are the applicable wage determination, classifications, fringe benefits and payroll-record obligations understood?
- Security: If the agency is the Department of Defense, what cybersecurity and CMMC level does the request for proposals require?
- Security for performance: Are bid guarantees, performance bonds, payment bonds or alternate payment protection required or permitted?
- Commercial capacity: Can the company finance mobilization, carry payroll and materials, and absorb retainage or delayed payment without destabilizing operations?
- Records: Can the project team produce the reports, payroll data, invoices, submittals and notices required by the clauses?
Have estimating, operations, payroll, finance and an executive owner sign the gate. A “no-bid” decision made before pricing is often cheaper than discovering an unpriced clause after award.
Price Construction Wage Rate Requirements (Davis-Bacon)
When the federal prevailing-wage rules can apply
FAR Subpart 22.4 describes the Construction Wage Rate Requirements statute, formerly known as Davis-Bacon, as applying to covered U.S. federal public-building or public-works construction, alteration or repair contracts over $2,000. Covered laborers and mechanics working on the site must receive at least the applicable prevailing wage rates set by the Secretary of Labor.
The dollar amount alone does not answer whether the rule applies. The solicitation and contract clauses determine coverage and incorporate the wage determination that governs the work. Treat the threshold as the scope stated in FAR Subpart 22.4, not as a claim that every construction purchase above that amount has identical labor terms.
Find the applicable wage determination
- Identify the project’s state, county or other geographic designation in the solicitation.
- Identify the construction type, such as building, residential, highway or heavy construction, as classified by the applicable determination.
- Open the wage determination incorporated by the solicitation and record its number, date and classifications.
- Map each planned crew role to a listed classification and include the basic wage and fringe obligation in the estimate.
- Check amendments and the final contract to ensure the determination used for pricing is the one incorporated into the award.
FAR distinguishes general wage determinations by geography and construction type. Archived determinations are informational; they cannot be used for a contract action without prior Department of Labor approval.
Handle missing classifications before payroll starts
If the crew plan requires a classification that is not listed, do not silently assign the work to a lower-paid category. SAM.gov’s Davis-Bacon Act conformance guidance explains that the awarded contractor may need to request approval for an additional classification and proposed wage and fringe-benefit rates. Build an internal escalation path so the project manager, payroll lead and contracting officer can address the issue promptly.
Keep compliance running during performance
Set up payroll coding, time records, fringe-benefit documentation and supervisor review around the actual clauses in the award. The Copeland Act provisions prohibit inducing construction workers to surrender compensation to which they are entitled under covered contracts. A wage review performed only at bid time will not protect the company if payroll practices later underpay a covered worker or misclassify the work.

In the General Services Administration commercial-acquisition context described in the cited guidance, construction contracts over $2,000 include an applicable wage determination. In that same context, a construction contract exceeding $30,000 uses Standard Form 1442 instead of Standard Form 1449, and the bonds or alternate payment-protection provisions in FAR 28.102 apply. This is context-specific guidance, not a universal statement that every federal construction project above that amount has identical forms or bond terms.
Prepare a surety review
- Send the actual solicitation, estimated cost, schedule, subcontracting plan and financial information to the company’s surety or qualified bonding adviser.
- Ask whether the requested bond amounts, penal sums, execution deadlines and warranty obligations fit the company’s current program.
- Identify collateral, indemnity, financial-statement or work-in-progress information the surety will require.
- Confirm whether an alternate payment-protection option is allowed and what evidence must accompany the offer.
- Include premiums, legal review, collateral cost and cash-flow effects in the bid decision.
No single bond rate, commission, insurance package or provider applies to every contractor. Capacity must be assessed against the actual solicitation and the company’s financial position.
Represent small-business status and subcontracting obligations accurately
SAM.gov is where firms make relevant eligibility representations, but the representation must be tested against SBA rules and the solicitation. Do not assume that a certification is required for every federal construction opportunity, and do not claim a set-aside status without confirming the program’s conditions.
For a prime contract, read the clause concerning small-business participation and any subcontracting plan. FAR 19.702 identifies circumstances in which a covered negotiated construction acquisition awarded to an other-than-small business, with subcontracting possibilities, requires a plan. The solicitation controls whether the requirement applies, what goals or reports are due, and which exceptions are available.
If the company is pursuing subcontract work, ask the prime for the clauses that flow down, reporting deadlines, payroll requirements, insurance limits, payment terms and any small-business participation documentation. A subcontract can still carry substantial federal compliance duties even though the agency contract is held by the prime.
Prepare for DoD cybersecurity and CMMC requirements
Small businesses seeking Department of Defense contracts must be able to safeguard systems and data. Each DoD request for proposals lists the CMMC level required to bid; there is no single level that can be assumed for every DoD construction opportunity.
Use the RFP as the authority
- Locate the cybersecurity, controlled-unclassified-information and CMMC language in the specific RFP and its amendments.
- Identify which systems, employees, subcontractors and data flows are in scope for the requested level.
- Compare the requirement with current access controls, device management, backups, incident response and vendor practices.
- Record gaps, owners and dates for remediation before making a representation in the offer.
- Ask the contracting officer or a qualified adviser how the requirement flows to subcontractors and suppliers.
SBA points small businesses to Project Spectrum for tools and training. Use that resource for preparation, but rely on the solicitation and current Department of Defense requirements for the level and compliance standard that govern a bid.

A practical readiness checklist
- Decide whether the company is pursuing prime awards, subcontract work or both.
- If bidding directly, complete the SAM.gov entity registration, record the UEI and assign the 365-day renewal owner.
- Select NAICS codes that describe actual construction capabilities and verify the solicitation-specific size standard, including affiliate considerations.
- Make the SAM.gov capability profile specific, current and evidence-based.
- For each opportunity, read the solicitation, agency instructions, amendments, clauses, drawings and incorporated wage determination before final pricing.
- Map crew roles to wage classifications and include prevailing wages and fringe obligations in the estimate.
- Set up payroll and timekeeping controls; pursue a classification-conformance request when a needed classification is missing.
- Review bid guarantees, performance and payment bonds, and alternate payment protection with the surety or qualified adviser.
- Check small-business representations and any subcontracting-plan requirement against the solicitation and FAR.
- For DoD work, identify the requested cybersecurity and CMMC level and document readiness against the RFP.
- Assign owners for contract records, notices, payroll, quality, schedule, invoices and cybersecurity evidence.
- Use an APEX Accelerator for government-contracting assistance when the company needs help interpreting registration, opportunity or small-business procedures.
Common preparation mistakes and how to correct them
Using a UEI-only record to submit a prime offer
Why it fails: A UEI identifies the entity but does not replace an active SAM.gov registration for direct applications.
Correction: Complete the entity registration, verify its active status and calendar renewal before the next solicitation deadline.
Choosing the company’s favorite NAICS code instead of the solicitation’s code
Why it fails: Size standards vary by code, and affiliates may affect the calculation.
Correction: Re-run the NAICS and size analysis for every solicitation and preserve the supporting reasoning.
Pricing ordinary commercial wages
Why it fails: A covered project may require the wage and fringe rates in the incorporated determination, by classification and location.
Correction: Verify geography, construction type and classifications before finalizing the estimate, then configure payroll to the awarded clauses.

Assuming one CMMC level applies to all DoD work
Why it fails: The required level is stated in the individual RFP and can vary by opportunity.
Correction: Treat each RFP and amendment as the source of truth and document the systems and data in scope.
Treating payroll compliance as a closeout task
Why it fails: Covered wage, fringe and Copeland Act obligations continue during performance.

Where to get official assistance
APEX Accelerators are identified by SAM.gov and SBA as government-contracting assistance resources for small businesses. They can help a company understand registration, opportunity research and contracting procedures. They are an assistance route, not a guaranteed contract-winning service or an affiliate endorsement.
For legal, tax, accounting, surety, labor or cybersecurity questions that depend on the company’s facts, use a qualified professional who can review the actual solicitation and records. The final decision should be based on the current official registration record, solicitation, clauses, wage determination and agency instructions.
Final pre-submission review
Before the authorized signer submits an offer, confirm that the company can answer “yes” to each of these questions:
- Is the direct-bid entity’s SAM.gov registration active, and is the UEI recorded?
- Do the NAICS code, size representation and any program representation match the solicitation and the company’s documented facts?
- Does the estimate include the correct labor classifications, wage rates, fringe obligations, supervision, payroll administration and potential conformance work?
- Has the company’s surety or qualified adviser reviewed every bond or payment-protection term stated in the solicitation?
- Can operations produce the records, notices, reports and invoices the clauses require?
- For DoD work, has the team identified the RFP’s cybersecurity and CMMC requirement and verified that the offer will not overstate readiness?
- Has an independent reviewer checked amendments, signatures, representations, forms and submission timing?
If any answer is “no” or “unknown,” pause the bid and resolve the gap or document a deliberate no-bid decision. That discipline protects margin, eligibility and the company’s reputation more effectively than adding federal work to a commercial process that was never designed for it.
