Manage waterway construction risk as a chain: an activity creates a hazard, a pathway carries it, and people, property, infrastructure, water quality, habitat or wildlife become exposed. A workable plan breaks that chain before mobilisation, then keeps checking it as flow, weather and site conditions change.
Start with a site-specific risk assessment, identify the regulator and watercourse classification, secure land access and approvals, and define stop-work and contingency actions. The correct requirements depend on jurisdiction: England, Ontario, Canada and the United States do not share one universal permit system.

1. Map the hazard–pathway–receptor chain
Write the risk assessment around what the project will do, how an effect could travel and what could be harmed. This is more useful than listing generic hazards because each control must interrupt a specific link in the chain.

| Excavation, piling, plant loading or temporary structures beside the channel | Bank erosion, bed scour, redirected flow or undermining | Banks, flood defences, culverts, river-control structures, adjacent land and buildings | Check stability and loading; keep equipment outside exclusion zones; inspect after flow changes; define when temporary works are removed or reinforced. |
| Cofferdam installation, dewatering, breach or removal | Mobilised sediment, turbid discharge, trapped fish or sudden release of stored water | Downstream water quality, aquatic life, habitat and people using the waterway | Plan sediment handling, filtration or treatment, fish rescue or relocation where required, gradual release, inspections and a breach response. |
| Material storage, refuelling and construction runoff | Rainfall or drainage carries sediment, debris, fuel or chemicals to receiving water | Water quality, aquatic organisms, downstream users and land drainage | Use secondary containment and runoff controls; inspect them after changing conditions; stop the source and deploy the incident plan if a control fails. |
| Temporary obstruction or diversion during high flow | Raised upstream level, changed flood route or sudden overtopping | Workers, nearby residents, roads, utilities, property and floodplain land | Set flood-warning triggers, safe shutdown steps, evacuation routes and a clear decision on when temporary works must be removed. |
| In-water access, lighting, noise, vibration or equipment movement | Blocked passage, disturbance, injury, habitat fragmentation or invasive-species transfer | Fish, protected species, spawning areas, riparian habitat and wildlife | Complete ecological checks; set timing and buffer limits; clean and decontaminate equipment; provide fish passage or relocation measures where required. |
The Environment Agency’s risk-assessment framework expects applicants to consider flood risk, land drainage and environmental effects and to explain what they will do when the work does not go according to plan. Use that contingency requirement as a minimum planning test even where another authority is the regulator.

2. Complete the pre-mobilisation checks
- Define the water body and site. Record the river, stream or other waterway, ordinary or main-river status where that distinction exists, floodplain, banks, bed, outfalls, culverts, control structures and upstream and downstream receptors.
- List every water-affecting activity. Include access, temporary bridges, cofferdams, sheet piles, excavation, pumping, discharge, concrete work, fuel storage, spoil placement, restoration and removal. A short task that changes flow or water quality still belongs in the assessment.
- Identify the responsible regulator. Confirm whether the authority is national, provincial, state, local, a drainage board, a fisheries agency or a combination. Ask for current permit, registration, notification and inspection requirements in writing.
- Check land and access rights. Secure landowner permission, access routes, working-space limits and rights to place, inspect and remove temporary works. Confirm who can enter private banks or flood-defence land during an emergency.
- Complete ecological and water-body assessments. Check fish passage, spawning grounds, protected species, habitat continuity, invasive-species risks, noise, vibration and lighting. Establish any seasonal or location restrictions before the programme is fixed.
- Set hold points. Do not start a water-affecting activity until design, permits, ecological controls, weather and emergency arrangements have been checked by the named competent people.
3. Confirm the legal pathway by jurisdiction
Use the following as orientation, not as a substitute for a project-specific determination.
| Jurisdiction | Relevant official framework | What the team must establish |
|---|---|---|
| England | Environment Agency and DEFRA flood-risk-activity permitting guidance | Specified work on or near a main river, flood defence or floodplain can require an environmental permit. Work on an ordinary watercourse may instead need local-council or internal-drainage-board land-drainage consent. Confirm the classification, activity, location, permit or exemption and any registration before mobilisation. |
| Ontario | Ontario Ministry of the Environment, B-6 Guidelines for Evaluating Construction Activities Impacting on Water Resources | Use the provincial guidance to plan cofferdams, sediment control, water-quality protection and restoration, then confirm the approvals and local requirements that apply to the site and method. |
| Canada | Fisheries and Oceans Canada, Standard: In-water site isolation | Check fisheries and habitat obligations, fish rescue or relocation needs, isolation design, inspection, filtered-water release and breach response. Federal, provincial, territorial and local requirements can overlap. |
| United States | United States Environmental Protection Agency Construction General Permit (CGP) Frequent Questions | Verify whether the project is covered by the current CGP and what the local permitting authority requires. Covered operators must use stormwater controls and prepare a Stormwater Pollution Prevention Plan (SWPPP). |
Permit conditions are controls, not paperwork to be filed and forgotten. Put each condition on the construction sequence, inspection form and handover record. If the design, duration, location or discharge changes, reassess whether the approval still applies.
4. Compare methods before fixing the design
Evaluate feasible methods and locations on the same axes. The cheapest or fastest method can create the greatest downstream exposure if it has a larger in-water footprint or a difficult failure mode.

| Decision axis | Questions to answer |
|---|---|
| Flood and flow effect | Will the method obstruct, divert or store water? What happens during the design flow and a forecast high-flow event? |
| Bank and bed disturbance | How much excavation, loading, scour or reinstatement is required? Could the work undermine a defence, culvert or control structure? |
| Sediment and discharge | Where will turbid water go? Can it be contained, filtered, treated, monitored and released without erosion? |
| Fish and habitat | Does the method block passage, trap fish, disturb spawning habitat or increase noise, vibration, light or invasive-species risk? |
| Duration and seasonal limits | How long will the waterway be affected, and does the programme fit ecological, flood or permit timing limits? |
| Access and land rights | Can plant, pumps, inspection staff and emergency equipment reach both banks without creating new exposure? |
| Failure, monitoring and recovery | What is the first sign of failure, who can stop work, how quickly can the site be made safe and what materials are needed? |
Minimise the in-water footprint and duration whenever the approved design allows. Document why the selected method is proportionate to the flow, receptors and recovery arrangements.
5. If you use isolation or cofferdams
Isolation can create a dry work area and reduce workers’ exposure to flowing water, but it transfers risk to installation, pumping, inspection, breach and removal. Fisheries and Oceans Canada describes the purpose precisely: “In-water site isolation creates a temporary dry working environment in order to manage sediment laden water.”
Installation
- Install in the sequence approved for the site, protecting the bed and banks from unnecessary disturbance.
- Keep a defined flow path and emergency access. Do not assume a cofferdam will withstand a forecast event outside its design basis.
- Stage pumps, backup power, screens, hoses, treatment or filtration equipment and spill materials before water is enclosed.
- Confirm fish-management arrangements before closure. Isolation can trap fish and other aquatic organisms even when the structure appears intact.
Dewatering and inspection
- Inspect cofferdams, seals, pumps, discharge lines and containment during all in-water work and after changing flow or weather.
- Control sediment-laden water before discharge. Do not send visibly turbid water directly to the receiving channel without the treatment or filtration required by the approval.
- Record water levels, pump status, discharge condition, turbidity or other required indicators, defects and corrective actions.
- If isolation breaches, stop the affected work, protect people, control the release and carry out additional fish capture and relocation where required.
Release and removal
- Release filtered water gradually to reduce erosion, as advised by Fisheries and Oceans Canada.
- Remove the structure in a controlled sequence so sediment is not released as a single pulse and fish are not stranded.
- Ontario guidance identifies sediment-containment devices such as silt curtains as a possible control during cofferdam removal. A silt or turbidity curtain is site-specific equipment, not a universal substitute for sound sequencing, containment and monitoring.
- Restore banks, bed and access areas to the approved condition and keep erosion and pollution controls in place through cleanup.
6. Manage temporary dewatering correctly in England
England’s FRA7 is an exemption for eligible temporary dewatering of a main-river work area lasting no more than four weeks. It is not a general permission to pump beside any river. The exemption must be registered and every condition must be met; if one is not met, a permit may be required.

Environment Agency and DEFRA guidance describes conditions that include:
- not dewatering the full channel width;
- fitting pumps with 20 mm mesh intake screens;
- taking reasonable steps to protect aquatic plants and animals and managing stranded fish or other species;
- observing specified seasonal limits;
- staying within limits for affected bank length, proximity to river-control works, water depth and channel projection;
- meeting protected-site, habitat and other location restrictions; and
- removing excavated material that is not reused on site from the floodplain.
The exact dates, distances, depths, projections and other criteria are regulatory conditions, not universal engineering limits. Check the current FRA7 wording and registration instructions for the precise site before relying on the exemption. Do not transfer these England-specific conditions to Ontario, another part of Canada or the United States.
7. Control sediment, runoff and pollution
Sediment and materials become a pollution pathway when rain, groundwater, pumping or a breach carries them into the channel. Design controls for the source, route and receiving water rather than relying on a single barrier.

At the source
- Keep spoil, cement, fuels, oils, chemicals and waste outside the flood-prone work area where practicable.
- Use covered or contained storage, refuelling controls and spill kits sized for the equipment on site.
- Prevent concrete washout, drilling fluids and contaminated water from entering drains or the waterway.
Along the pathway
- Use suitable silt fences, settlement or treatment systems, inlet protection, diversion channels, bunds and containment around pumps and stockpiles.
- Design discharge points to avoid bank scour; release treated water gradually where required.
- Inspect controls after rain, rising water, plant movement, maintenance or any change in the work area. Repair or replace failed controls immediately.
At the receiving water
- Define acceptable visual and measured conditions in the permit or environmental plan and identify who can stop discharge.
- Investigate changes in clarity, sheen, odour, foam, fish behaviour or flow before work continues.
- Keep records of inspections, samples, discharges, incidents, notifications and corrective actions.
For United States projects covered by the EPA CGP, the SWPPP and applicable permit requirements govern stormwater controls. Confirm the current permit, coverage, local authority conditions and any additional state or tribal requirements before earth disturbance.

- Provide a named ecological contact who can stop work when wildlife is found or a permit condition is at risk.
10. Run the work with hold points and stop-work triggers
Put the controls into the method statement, briefing and inspection forms. A practical sequence is:
- Brief the crew. Explain the hazard–pathway–receptor chain, exclusion zones, pump and discharge arrangements, ecological constraints, emergency signals and who has stop-work authority.
- Verify conditions at the hold point. Check permits, weather and flow forecasts, access, fish measures, containment, pumps, screens, treatment equipment and communications.
- Start in stages. Install or excavate only as far as the next inspection point allows. Do not create a larger isolated area than the approved sequence requires.
- Inspect and record. Check flow, levels, banks, structures, sediment controls, discharge and wildlife at the frequency set by the plan and after changing conditions.
- Escalate deviations. Stop the affected activity for flood warnings, unexpected flow, water-quality change, control failure, wildlife findings, damaged infrastructure or a permit-condition uncertainty.
- Recover deliberately. Stabilise the site, protect people and downstream receptors, notify the required authorities, capture or relocate fish where required, repair controls and document the decision to resume.
- Close out. Remove temporary works in the approved order, restore the channel and banks, remove surplus material from restricted areas and continue inspections until the site is stable.
11. Common failure modes and corrective actions
| Failure mode | Why it matters | Immediate correction |
|---|---|---|
| Starting work before confirming the watercourse classification or regulator | The selected consent or exemption may not cover the activity or location. | Pause mobilisation, map the activity and obtain a written determination or approval before proceeding. |
| Treating a dewatering exemption as a generic pumping permission | One unmet FRA7 condition can remove the exemption and expose the project to enforcement and environmental harm. | Check every condition, registration and location restriction; apply for a permit if the exemption does not fit. |
| Relying on a cofferdam without a breach plan | A breach can release turbid water, flood the work area and trap or strand fish. | Stop work, protect people, control the release, inspect the isolation and implement fish rescue or relocation measures where required. |
| Releasing pumped water too quickly | Even filtered water can erode a bank or mobilise bed sediment. | Use the approved discharge point and release gradually; inspect for scour. |
| Leaving spoil or materials on the floodplain | Floodwater can carry them into the channel or obstruct drainage. | Move, contain or remove them in accordance with the approval and flood-risk plan. |
| Inspecting only at the start of the shift | Rain, rising flow, plant movement or a failing pump can defeat controls between inspections. | Add inspections after changing conditions and record corrective actions. |
| Using a silt curtain as the only sediment measure | A curtain may not control runoff, a breach, discharge scour or sediment already in the work area. | Combine it with source control, containment, treatment, inspection and a removal sequence suited to the site. |
12. Records that make the plan defensible
Keep one controlled record set containing the risk assessment, drawings and calculations for temporary works, permits and registrations, land permissions, ecological surveys, method statements, SWPPP where applicable, inspection logs, weather and flow checks, discharge observations, fish records, incidents, notifications, changes and closeout photographs. Record who made each decision and the condition that triggered it.
A strong plan can answer five questions at any time: what activity is happening, what could carry the hazard to a receptor, which control is working, what evidence shows it is working and what the team will do if it is not. Recheck those answers whenever the method, location, duration, flow, weather or ecological conditions change.
