When a project runs late or the work is defective, protect your position before arguing about money. Read the signed contract, build a dated evidence file, notify the contractor precisely in writing, preserve any inspection or cure opportunity required by local law, and escalate through the contract’s dispute process. Do not assume that a late date is automatically a breach, that you can withhold the next payment, or that one jurisdiction’s lawsuit deadline applies elsewhere.
Start with a same-day triage
First decide whether the problem is an immediate safety or preservation issue. Stop unsafe work, isolate electrical or structural hazards, and call emergency services or the relevant building authority where there is an imminent risk. If water ingress, an open roof, an unsecured excavation or another condition will cause additional damage, take reasonable temporary measures and keep every invoice, photograph and instruction. Do not demolish or permanently repair disputed work before the contractor has had any inspection opportunity required by the contract or local law, unless emergency action is necessary; document why the work could not wait.

For a non-emergency, send a short written acknowledgment that you are investigating and that all rights are reserved. Avoid angry messages, admissions about fault, or instructions that change the scope without a written variation.
Read the contract before taking action
The signed agreement is the map for notice, payment, extensions and termination. NSW Government guidance likewise puts contract review first. Make a one-page schedule of the clauses below and note the exact notice address, email or portal specified; a message to a site supervisor may not satisfy a contractual notice clause.

If there is no signed contract, collect quotations, plans, invoices, text messages and proof of payment. A missing document does not eliminate rights, but it makes scope, price and notice questions harder to prove.
Build an evidence file that another person can understand
Keep one chronological folder, with original files preserved and a copy stored securely elsewhere. Consumer Affairs Victoria recommends retaining documents, recording conversations and photographing disputed work.
- Signed contract, amendments, plans, specifications, engineering documents, permits and inspection certificates.
- Invoices, payment confirmations, retention records, disputed claims and the account showing what remains unpaid.
- Baseline programme, updates, delivery records, weather information and site-access records.
- Site diary entries identifying who attended, what was done, instructions given and areas that could no longer be seen after covering-up.
- Dated, wide-angle and close-up photographs or video. Include a ruler, level or other scale where useful, and keep the original metadata.
- Every email, text, letter, meeting note and call record. After a call, email a factual confirmation of what was agreed and by when.
- Independent inspection reports, test results, engineer opinions, repair estimates and records of temporary protection.
Use a simple log with columns for date, event, contract clause, person responsible, evidence file name, proposed response and deadline. Do not edit an original photograph or overwrite an earlier diary entry; add a dated correction instead.

Separate delay analysis from defect analysis
When the issue is delay
Record the contractual completion or milestone date, actual progress, the date the cause began, the cause asserted by each side, the affected critical-path activity, mitigation attempted and every notice deadline. “Late” does not by itself establish breach. Entitlement commonly turns on causation, foreseeability, contractual risk allocation and timely notice.
Consumer Affairs Victoria describes a reasonable delay as one arising from circumstances beyond the builder’s control that the builder could not have foreseen when the contract was made. That is an example of a local standard, not a universal test. A contractor may still need to show that the event actually affected completion and that it took reasonable steps to reduce the impact.

When the issue is defective work
Describe the observable condition rather than a conclusion such as “bad workmanship.” Identify the location, date discovered, affected trade, specification or code requirement, functional consequence and whether the work is concealed. A useful defect record answers: what is wrong, how do you know, what damage or safety risk follows, and what repair would restore compliance?
Do not combine unrelated items into “the whole job is defective.” Number each item and attach the matching photograph, drawing detail, inspection result or invoice. Distinguish a defect in the contractor’s work from owner-supplied materials, design errors, later damage, normal settlement and maintenance issues; causation often determines who pays.
Send a precise written notice
After any conversation, send a dated letter or email with proof of delivery. Use a separate section for delay, each defect, payment questions and requested access. Refer to the exact contract or specification clause, state the facts without exaggeration, and give a reasonable response date that does not defeat a statutory notice period.
Subject: Notice of delay and defects — [project and contract date]
- Identify the property, parties, contract and notice address.
- List each delay event or defect by number, location and date discovered.
- Quote the relevant milestone, specification or clause.
- State the effect: days of slippage claimed, water entry, non-compliance, safety concern or other measurable consequence.
- Request a specific remedy: updated programme, protection, inspection, rectification method, credit or meeting.
- Propose two access times and ask the contractor to identify any consultant who will attend.
- Set a response date and reserve contractual and statutory rights without asserting a remedy you have not verified.
- Attach an indexed evidence list and retain the sent message, delivery receipt and attachments.
Continue giving necessary site access and avoid instructions that could be interpreted as accepting non-compliant work. If the contractor does not respond, send one follow-up referring to the first notice and the next contractual step rather than repeating the entire history.
Preserve inspection and cure rights
Many construction-defect regimes require notice before a claim, an opportunity for the contractor to inspect, and sometimes an offer to repair or pay. Skipping that procedure can delay or defeat a claim even when the work is poor.

- Texas: Property Code §27.004 generally requires written notice at least 60 days before a residential construction-defect action. After receiving notice, the contractor generally has a 35-day opportunity to inspect, subject to statutory conditions. Confirm the current text and exceptions for the project type.
- Ohio: For a dwelling action or arbitration, the statute generally requires written notice of the defect at least 60 days beforehand and notice of the contractor’s right to offer repair or payment. Follow the statutory content and delivery rules.
- Oregon: A notice-of-defect procedure applies before court or arbitration; noncompliance can result in dismissal without prejudice, meaning the case may have to be restarted after the procedure is completed.
These are jurisdiction-specific examples, not a general 60-day rule. Before opening walls, hiring a replacement contractor or filing, ask a local construction lawyer or tribunal service whether your notice must identify defects, invite inspection, include estimates, use certified delivery or wait a stated number of days.

Use an independent inspection strategically
When facts are contested, an independent building inspector, engineer or relevant trade specialist can separate workmanship, design and maintenance issues. Choose someone with no financial connection to either party and experience with the building type and local code.
Give the inspector the contract, plans, variation history and your numbered issue log, but ask for an independent opinion. Request a report that states:
- areas inspected, areas inaccessible and inspection date;
- observed conditions, measurements and photographs;
- applicable plans, specifications, codes or standards, with edition where relevant;
- probable cause and competing explanations;
- urgency, safety or damage-progression risk;
- recommended repair scope, sequencing and any further testing needed; and
- whether the opinion is limited by concealed work or missing records.
In NSW, government-assisted inspectors are reported to handle approximately 2,500 disputes a year. The cited NSW service statistics say about 70% of building disputes are resolved at the initial mediation or inspection stage and more than 80% are resolved without enforcement action. Those figures describe that service, not the likely result of every project.
Decide whether to withhold payment, suspend or terminate
Do not simply stop paying because work is late or defective. A payment may be due under a statutory payment regime even while a defect claim is disputed, and an unlawful withholding can let the contractor suspend or terminate. Check whether the contract permits withholding, set-off or retention; whether a payment schedule is required; and whether a notice must be served within a short period.

Before engaging a replacement contractor, verify default and cure provisions, termination notice wording, ownership of unfixed materials, insurance, security and the duty to mitigate. Photograph and inventory the site, secure permits and obtain a written scope and price for emergency work. Paying another contractor can make causation and recovery harder if the original contractor was denied a contractual chance to inspect or cure.
Escalate in proportion to the problem
Use the least formal process that can produce a binding, timely result, while preserving statutory rights. The governing contract and local law control whether a step is available and enforceable.
| Process | Speed and cost | Evidence and formality | Enforceability and urgent work | Relationship impact |
|---|---|---|---|---|
| Direct negotiation | Usually fastest and least costly. | Informal, but use a written agenda and outcome record. | Only as enforceable as the signed settlement; cannot replace mandatory notices. | Best chance of keeping the project moving. |
| Independent inspection | Often quicker than a proceeding; fee varies by expert. | Technical evidence, not a final legal decision. | Clarifies repair scope; does not itself compel payment or work. | Can reduce arguments over facts. |
| Mediation | Usually faster and cheaper than a hearing; mediator fees are shared or allocated by agreement. | Confidential, structured and less formal than court. | Settlement is enforceable when documented correctly; mandatory notice rules still apply. | Supports a negotiated continuation or exit. |
| Adjudication | Designed for a relatively rapid payment or progress dispute where available. | Document-driven with strict notice and response windows. | Often produces an interim or immediately enforceable payment result, subject to review rights under local law. | Can preserve cash flow but may harden positions. |
| Tribunal or court | Most formal, expensive and slowest, especially for expert-heavy defects. | Rules of evidence, pleadings, experts and disclosure apply. | Can award money, declarations or orders for work where jurisdiction permits; emergency relief may be available. | Usually ends the commercial relationship. |
How mediation, adjudication and formal claims work
Mediation
Prepare a short chronology, defect schedule, programme impact, payment ledger, expert opinion and a settlement range. Separate what must happen immediately from what can be priced later. New Zealand Building Performance explains that the parties can agree to mediation even when the contract does not provide for it or there is no written contract. A mediator facilitates agreement; they do not normally impose a technical decision.
Adjudication
Check the statute and contract before serving notice. Ontario’s Construction Act, for example, specifies written adjudication-notice contents. A notice commonly needs the parties, contract, amount or issue in dispute, requested determination and adjudicator or nominating authority. Missing a required field or deadline can invalidate the referral. Adjudication may decide payment temporarily while the underlying defect or final-account dispute proceeds elsewhere.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsTribunal or court
Use formal proceedings when the amount, safety issue, evidence or need for a binding order justifies the cost. Organize pleadings around numbered defects or delay events, not a narrative of every disagreement. Obtain advice on expert evidence, limitation, pre-action protocols, service and recoverable costs before filing.

Deadlines: there is no universal time to sue
Potential deadlines include contractual notice periods, statutory defect or warranty periods, limitation periods, payment-response windows, adjudication windows and pre-action protocols. They may run from practical completion, discovery, the date of the negligent act, the last repair, or another statutory event. A warranty period is not always the same as a limitation period.
NSW Government guidance gives an example for qualifying contracts signed on or after 1 February 2012: six years for major defects and two years for other defects. That example does not apply automatically to another NSW contract, another project type or another country. Texas, Ohio and Oregon also impose different pre-suit procedures, while local building tribunals may have their own filing windows. Record the earliest plausible deadline and obtain local advice well before it.
Special situations that change the strategy
Builder appears insolvent or has abandoned the site
Secure the property, notify the insurer, lender and licensing or warranty body if relevant, and preserve evidence before materials are removed. Check whether your contract has a bond, retention, security of payment, step-in or termination mechanism. Do not assume an insolvency filing pauses every deadline.

Notify the contractor immediately and request a joint opening or non-destructive test. If opening is necessary, agree in writing who pays and how reinstatement will occur, or obtain an independent protocol before proceeding. Photograph each layer as it is exposed.
Safety or code concern
Ask the local building authority or a qualified engineer about interim occupancy, shoring, electrical isolation and required permits. A private settlement cannot legalize work that the authority requires to be corrected.
A practical decision checklist
- Is anyone in immediate danger or is damage progressing? Make safe, document and notify the appropriate authority.
- What does the signed contract say about the exact issue, notice, payment and dispute path?
- Have you created a dated evidence file and a separate delay or defect schedule?
- What written notice is required, to whom, by what method and by what date?
- Must the contractor receive inspection, testing or a cure opportunity before repair or filing?
- Would an independent inspector or engineer resolve causation and scope more cheaply than arguing?
- Is negotiation, mediation or adjudication available and does it preserve your statutory rights?
- Before withholding, suspending, terminating or replacing the contractor, has a local professional checked the consequences?
- What is the earliest warranty, limitation, payment or pre-suit deadline, and how will you prove service?
Communication habits that prevent escalation
- Use one project email thread and a numbered issue register.
- State facts, requested action and dates; avoid accusations and speculation.
- Confirm oral agreements in writing the same day.
- Give reasonable access for inspection while recording who attends and what was inspected.
- Keep paying undisputed amounts on time unless a verified contractual or statutory right permits another course.
- When agreement is reached, sign a document describing scope, price, completion date, releases, warranty and what happens if the promise is missed.
A disciplined record, contract-compliant notice and preserved inspection opportunity usually give you more leverage than an immediate threat of court. The correct remedy still depends on the project, contract and law where the work is located.
