Start with the signed agreement and every document it incorporates. Look for a clause that specifically allows an adjustment, ask the contractor to identify it in writing, and request the calculation and supporting records. Whether the price can change depends on the governing jurisdiction, the contract wording, the project facts, and any applicable statutory requirements. Federal procurement rules and model forms illustrate how contracts can allocate price risk, but they do not decide the rights of every homeowner.
What to do first
Take these steps before agreeing to an increase, signing a change order, or changing how you perform under the contract. They help establish what was agreed and what the contractor is asking you to change; they do not replace advice about your local law.

- Collect the complete contract package. Keep the signed agreement and every exhibit, specification, estimate, proposal, allowance schedule, bid document, incorporated email or term, and later written modification. Note which documents are signed or expressly incorporated and any clause that says which document controls if terms conflict.
- Identify the pricing model. Check whether the agreement is a lump-sum or fixed-price contract, unit-price contract, cost-plus arrangement, or another form. Note who purchases the materials, what costs are included, and whether any allowances are estimates or guaranteed amounts.
- Search for relevant terms and read the full clauses. Look for “price escalation,” “economic adjustment,” “material price,” “allowance,” “change order,” “written authorization,” “notice,” “delay,” “force majeure,” “substitution,” and “termination.” Read definitions, exceptions, notice rules, approval requirements, and document-precedence language—not just the heading.
- Ask for the clause and a written calculation. Request the exact contract provision the contractor relies on and an itemized explanation of the amount, with supporting records.
- Check deadlines and approval rules. Find out whether the contract sets a deadline for notice, requires written approval before procurement, or specifies how a proposed change must be authorized. Until you have decided, avoid wording that could be read as accepting the increase.
- Keep a factual record. Save the request, your response, supplier quotes or notices, invoices, delivery records, relevant schedule information, and subsequent communications. Record dates and who said what.
If work is at risk of stopping, a notice deadline may be near, a lien may be threatened, or the disputed amount is substantial, seek prompt advice from a construction lawyer or local consumer agency familiar with the applicable jurisdiction.

Does signing a fixed-price contract settle the question?
Not by itself. The phrase “fixed price” is a starting point for reading the agreement, not a complete answer to whether this particular request is permitted. The key questions are what the signed documents say, whether a stated condition has occurred, whether the contractor followed the agreed process, and what law governs the project.

As an example of how a contract can allocate this risk, US Federal Acquisition Regulation (FAR) 16.203-1 states: “A fixed-price contract with economic price adjustment provides for upward and downward revision of the stated contract price upon the occurrence of specified contingencies.” FAR Part 36 says firm-fixed-price contracts are generally used for federal construction and describes circumstances in which federal agencies may use economic price adjustment provisions. These are federal procurement rules, not a blanket rule governing private homebuilding or construction agreements in other countries.
The Federal Highway Administration’s Construction Program Guide, updated January 27, 2025, treats price escalation as a construction contract-administration subject and includes a link to January 2025 design-build guidance. That context can help explain why contracts sometimes set out an adjustment process; it does not establish that a homeowner is entitled to an adjustment or must pay one.
Work out what kind of price request you received
Before assessing a proposed change, separate the reason given from the contract mechanism that might authorize it. A statement that a supplier raised prices describes a circumstance; it does not, on its own, show which term applies or how much the owner owes.
Contract-wide price adjustment
An escalation or economic-adjustment clause may allow the stated contract price to move when defined conditions are met. Read for the particular materials or costs covered, the baseline and comparison date, the trigger, the calculation method, eligible quantities, notice and approval procedure, any cap or exclusion, and whether a price decrease also changes the contract amount. A clause may cover only certain inputs or purchases rather than the whole project.

Allowance reconciliation
An allowance is a contract-defined amount or estimate for an item whose final selection or cost may not yet be fixed. Check the allowance schedule and the language explaining what happens when the actual selection or cost differs. A change to an allowance is not necessarily the same as an escalation to a fixed contract price. Confirm what the allowance includes—such as material only or additional components—and how any difference is documented and approved.
Change in scope or specification
If the request follows an owner-selected upgrade, a substitution, a revised design, or other scope change, compare it with the original scope and the contract’s change-order procedure. Ask the contractor to distinguish the cost of that change from any increase attributed to materials in the unchanged work. The agreement may prescribe who can authorize a change, what it must contain, and whether authorization is required before the work or purchase proceeds.
Cost-plus or unit-price accounting
For cost-plus terms, check which costs are reimbursable, how the contractor’s fee is calculated, and what records or approvals the contract requires. For unit pricing, compare the requested adjustment with the agreed unit rates and the quantities the contract says are payable. Neither label alone supplies the details: read the definitions, exclusions, and accounting or measurement provisions.

Delay, force majeure, or other provisions
A contractor may refer to a delay, supply disruption, or force-majeure term. Read the actual wording and its relationship to price, time, notice, and mitigation. A provision addressing schedule relief does not necessarily set a price adjustment, and a price clause may have separate conditions. The effect depends on the particular agreement and applicable law.

How to evaluate an escalation clause
If the agreement appears to allow an adjustment, test the request against each part of the mechanism rather than treating the clause as permission for an unspecified surcharge.
| What to check | Question to answer |
|---|---|
| Covered inputs | Does the clause identify the material, equipment, labor, or other cost at issue? Does it exclude anything relevant? |
| Baseline | What price, date, bid, quote, or index establishes the starting point? |
| Current comparison | What source and date does the clause use to establish the later price or cost? |
| Trigger or threshold | Must the change exceed a stated threshold or meet another condition before an adjustment applies? |
| Calculation method | Does the agreement use established prices, actual documented costs, a named index, or another formula? |
| Eligible quantities | Does the method apply to all project quantities, only documented quantities, or only work not yet purchased or installed? |
| Direction of change | Does the same method account for price decreases as well as increases? |
| Procedure and timing | What notice, evidence, review, and written-approval steps and deadlines apply? |
| Limits and effects | Are there caps, exclusions, schedule consequences, or other limits on the adjustment? |
FAR Part 16 describes federal procurement mechanisms based on established prices, actual labor or material costs, and specified cost indexes. Those categories are useful for recognizing different calculation approaches, not as a substitute for the formula in a private agreement. If the contract offers multiple methods, compare the actual covered costs, source data, thresholds, eligible quantities, treatment of decreases, deadlines, limits, and schedule effects under each one.
Ask for evidence you can check
Request information that connects the proposed amount to the contract’s wording. You can write:
Please identify the contract provision you believe allows this increase and provide an itemized calculation. For each material, please include the quantity, baseline price and date, current price and date, supporting source documents, any threshold or formula applied, and the amount attributable to work not yet purchased or installed. Please also identify the notice and approval steps you believe apply.

Where relevant, request supplier quotations, invoices, price notices, delivery records, or the published index named in the contract. If the contractor relies on actual cost, ask how the records map to the project quantities and whether the calculation includes freight, taxes, fees, waste, markup, or other components. Compare those items with the contract’s definitions rather than assuming all are included or excluded.
This is a practical way to understand and document the request, not a guaranteed legal prerequisite to an adjustment in every jurisdiction. The contract or local law may specify different evidence or procedure. Keep the exchange neutral: ask for the basis and calculation, and avoid declaring that the increase is automatically valid or invalid before reviewing them.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Compare the request with the agreement
Make a side-by-side record of the relevant clause and the contractor’s support. For each condition in the clause, record the exact wording, the evidence provided, and anything still unresolved. This makes it easier to identify whether the disagreement concerns entitlement, arithmetic, quantity, timing, or documentation.
- Covered item: Is the material or cost named or otherwise included?
- Baseline and comparison: Do the dates and price sources match the contract’s method?
- Trigger: Does the evidence establish the specified event or threshold?
- Quantity and timing: Does the calculation use the quantities and purchase status the clause permits?
- Arithmetic: Can you reproduce the calculation from the records and formula?
- Procedure: Was notice given in the required way and time, and was any required approval obtained?
- Limits and offsets: Does the amount respect caps, exclusions, decreases, or other adjustments required by the contract?
If a document is missing or the calculation cannot be reproduced, identify the specific item needed rather than debating a general claim that prices rose. If the written terms conflict or are unclear, do not assume a heading, estimate, or email overrides the signed agreement; the result may depend on document order, incorporation, and local law.

If you decide to negotiate
A negotiation can resolve uncertainty without either side treating an unsupported figure as settled. Keep any proposed compromise distinct from your reading of the existing contract. Before accepting a revised amount or formula, define the full change in writing.
- Identify the affected scope, materials, and quantities.
- State the new fixed amount or the complete formula, including any baseline and evidence source.
- Specify when the adjustment applies and whether it is one-time or applies to later purchases.
- Record who is responsible for procurement and any agreed timing or schedule effect.
- State how later price decreases, substitutions, or unused quantities will be handled if relevant.
- Follow the contract’s amendment requirements and obtain signatures from the parties authorized to change it.
Do not rely on an incomplete text-message understanding where the contract requires a signed change or where the amount, scope, or schedule remains uncertain. A clear amendment should resolve what the parties have agreed to change and leave no ambiguity about what remains governed by the original agreement.
Understand what model contracts can—and cannot—show
Contract forms demonstrate that price-risk terms can be designed in different ways, but a form from another procurement system does not decide a homeowner’s rights. The Chinese government’s 2017 model construction contract, for example, offers optional approaches to adjusting material and equipment prices using price-index or cost-information methods. Its sample provisions include a threshold mechanism and call for the contractor to submit quantities and a new material price for advance checking and employer confirmation. This is an illustration of how a written process may be specified; it does not govern a project outside its legal context.
The useful lesson is narrower: look for a defined mechanism and follow the version actually included in your agreement. Neither a federal construction rule nor a foreign model contract supplies a missing term or makes a general materials-cost increase payable under an unspecified private agreement.
When to get local help promptly
Seek jurisdiction-specific advice rather than relying on a general online explanation if the agreement is ambiguous, the contractor threatens to stop work, a lien is threatened, a notice or response deadline may expire, or the sum is large enough to affect your project or finances. A construction lawyer can review the entire contract package and applicable law; a local consumer agency may explain relevant complaint or dispute-resolution routes. Bring the signed documents, the contractor’s request, itemization, correspondence, schedule information, and any supplier records so the adviser can assess the actual issue.
Conclusion
Treat a post-signing materials increase as a contract question to verify, not a bill to accept or reject on a slogan. Locate the complete signed terms, identify the pricing and adjustment mechanism, request the clause and a checkable calculation, and preserve the record. The enforceable answer comes from the agreement read in its governing legal context.
