In England, start by deciding whether the proposal is “development” in planning law, then check for an existing permission, a permitted development right and any restriction on that right. If no permission or applicable right covers the work, a planning application to the local planning authority (LPA) will generally be required. Some permitted development rights still require the LPA’s prior approval. If the legal position remains uncertain, ask the LPA or apply for a lawful development certificate (LDC) describing the proposal precisely.
This article covers England only. Scotland, Wales, Northern Ireland and other countries use different legislation, authorities and terminology.

What “local approval” means in England
The relevant decision-maker is usually the LPA for the site. Planning law treats “development” broadly: it includes building operations and material changes of use, among other categories. However, development does not always require a conventional planning application. The government’s official guidance states: “Development does not in all instances require a planning application to be made for permission to carry out the development.”
A proposal may already be authorised by an existing planning permission or a local planning order. It may also fall within a national permitted development (PD) right, subject to that right’s detailed conditions and limitations. Conversely, a PD right can be removed or restricted by an Article 4 direction or by a condition attached to an earlier permission.

A planning law answer is not a complete sign-off for every other regime. An LDC, for example, addresses planning lawfulness only; it does not certify compliance with building regulations, highways requirements, environmental controls or other permits that may apply.
A six-step decision path
- Confirm the jurisdiction. Use this process only for land in England and identify the site’s LPA.
- Describe the whole proposal. Record the site, current and proposed uses, homes, building or conversion work, access and associated operations.
- Check the planning register. Review permissions, conditions, refusals, local orders and any restrictions affecting the land.
- Test every relevant PD right. Read the complete class, conditions and limitations; check for Article 4 directions and prior-approval requirements.
- Obtain formal certainty if needed. Ask the LPA or submit an LDC application for a precisely described proposed development.
- Apply through the appropriate route. Use an ordinary planning application where no permission or right covers the proposal; some housing-led schemes may be eligible for permission in principle.
Step 1: Confirm that England’s planning system applies
Before analysing the project, identify the country in which the site lies. The terms “local planning authority”, “permitted development”, “Article 4 direction” and “lawful development certificate” in this article are used in their England meaning. A housing proposal in another UK nation may have a different approval route, even if the building work looks identical.
For an English site, identify the LPA responsible for the address. That authority’s planning register and published local orders are the starting points for the site-specific checks. National rights do not override a local restriction that lawfully removes or limits them.

Planning status depends on what will actually be built or changed, not the project’s informal label. “A small housing development” could mean a new estate, a conversion, an additional dwelling in a garden or alterations to an already approved scheme. Each can trigger different tests.
Prepare a written description containing, at minimum:
- the exact site and its present use;
- the proposed use and the number and type of homes;
- whether the work is a new building, extension, demolition, conversion or a material change of use;
- the position, scale and external works proposed;
- new or altered access, parking, drainage and other associated operations; and
- any phased or linked work that forms part of the same project.
Use the same description when speaking to the LPA, checking a PD class or preparing an LDC application. Omitting an associated operation can produce an answer that does not cover the scheme you intend to build.

Step 3: Check planning history and existing permissions
Search the LPA’s planning register for the site and nearby parcels that form part of the proposal. Read the decision notice and the approved plans, not just the application title. Confirm that the proposed use, number of homes, siting, access and external works match what was authorised.
Look for:
- an extant planning permission that already covers the work;
- conditions limiting use, occupation, layout, access or future changes;
- a permission that has expired, been superseded or was granted subject to reserved matters;
- a local planning order or neighbourhood or community order that provides permission for the relevant development; and
- an Article 4 direction or a condition on an earlier permission that removes or restricts a PD right.
An existing permission is not a general licence to enlarge the project. A change in the number of dwellings, a different use or a materially different layout may fall outside it. Treat the approved drawings and all conditions as part of the legal permission.
Step 4: Test permitted development rights in full
Permitted development is a planning permission granted by national legislation, but only within the limits of the relevant right. The official householder technical guidance warns: “Where there is any doubt as to whether a development would be permitted development, advice should be sought from the local planning authority.”
Read the complete class, not a headline summary
Check every condition and limitation attached to the potentially relevant class. These can control dimensions, location, materials, use, protected areas, previous extensions and the relationship between several pieces of work. A proposal may need to satisfy more than one class of PD rules. Assess the combined project rather than treating each operation as an isolated shortcut.
The householder technical guide is about household development. It is useful for that scope but is not a comprehensive answer for larger housing schemes, estate development or every change-of-use route.

Separate permitted development from prior approval
Some PD rights require an application for prior approval before work starts. The LPA then considers only the matters specified for that particular right, such as the listed impact or technical issues. Prior approval is narrower than a full planning application, but it still requires local authority action and a decision before the relevant work proceeds.
Step 5: Choose the route that answers your legal question
These routes are not interchangeable. Select the one that resolves the uncertainty you actually have.
| Route | Question it answers | LPA action before work | Scope and continuing limits |
|---|---|---|---|
| Existing planning permission or applicable local order | Whether the development is already authorised by an instrument covering this site and proposal | The permission or order already exists; you must comply with its conditions and approved details | Only the authorised development is covered; a materially different scheme may need a new route |
| Permitted development with no prior approval | Whether the proposal fits the relevant national right | No prior-approval decision, but every condition, limitation and any required notification must be met | The right’s class controls what is permitted; local restrictions can remove it |
| Permitted development with prior approval | Whether the specified prior-approval matters are acceptable | Yes. Submit the prior-approval application and wait for the LPA’s determination required by that right | Only the listed matters are assessed; the underlying PD conditions still apply |
| Lawful development certificate for a proposed development | Whether the precisely described proposed operation or use would be lawful for planning purposes | Obtain the certificate from the LPA before relying on it | It confirms planning lawfulness for the description submitted, not compliance with other regulatory regimes |
| Conventional planning application | Whether permission should be granted for development not covered by another route | Yes. The LPA validates and determines the application | The decision may impose conditions and does not replace unrelated consents |
| Permission in principle | Whether the principle of some housing-led development is acceptable | Yes, followed by a separate technical-details stage | Available only in circumstances allowed by the relevant rules; technical details still have to be approved |
Step 6: Use a lawful development certificate when certainty matters
An LDC is the formal route for confirming planning lawfulness. For a project that has not yet been carried out, apply for a certificate for a proposed development to the LPA. The application must describe the operations or use with enough clarity and precision for the authority to understand exactly what is proposed.
What an LDC can establish
The certificate addresses whether the described proposal would be lawful for planning purposes—for example, because it is covered by a PD right or does not amount to development requiring permission. It gives you a formal planning-law answer rather than an informal view.
What the certificate does not establish
An LDC is not a general construction approval. It does not determine building-regulation compliance, private rights, environmental permits, highways consent or other controls. A section 192 certificate also concerns the proposal as described and carries a statutory material-change caveat: if the facts or proposal materially change, the certificate may not answer the new situation.
When an LDC is sensible
- the project appears to rely on a complicated or borderline PD right;
- the planning history is unclear or several permissions interact;
- you need documentary certainty before committing to construction or a transaction; or
- you want the LPA to decide lawfulness rather than relying on an informal interpretation.
If the proposal needs a planning application
Where no existing permission, local order or PD right covers the complete proposal, an application to the LPA is generally necessary. The appropriate form and supporting material depend on the development and the route available.

Ordinary planning application
Submit the application to the LPA with a description and drawings that match the development you intend to carry out. The authority first validates it, then determines it under the applicable planning process. The official guidance on determining a planning application, updated 8 April 2026, gives different statutory periods for different application types and exceptions. There is no single timetable that safely applies to every housing proposal; an applicant and LPA can agree in writing to a longer period.

For some housing-led development, permission in principle can address whether development is acceptable in principle before technical details are considered. It is not a way to bypass the technical-details stage. Check that the site and proposal fall within the route’s eligibility rules, then expect a separate technical approval process before construction can proceed.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.How to assemble a defensible decision record
Keep a short project file so that your conclusion can be checked when the design changes or ownership changes. Include:
- the dated description of the proposal and a plan identifying the site;
- the planning-register entries, decision notices, approved drawings and conditions you relied on;
- the text of the PD class, including all limitations and any prior-approval requirement;
- the result of the Article 4 and local-order checks;
- any written response from the LPA; and
- an LDC, prior-approval decision or planning permission where you need a formal determination.
Update the record if the number of homes, footprint, access, use or phasing changes. A conclusion reached for one description should not automatically be applied to a revised scheme.
Common mistakes and how to correct them
“It is small, so it must be permitted development”
Size alone does not establish a right. Identify the exact class and test every condition and limitation. If the proposal fails one requirement, the PD route may not cover it.

“There is an old permission, so the new scheme is covered”
Compare the current proposal with the decision notice, plans and conditions. A different dwelling count, use, access arrangement or layout can take the work outside the permission.

“No full application means no local step”
Prior approval is still a local-authority process. Check whether the applicable PD right requires an application and a decision before starting.
“The household guide answers every housing project”
That guidance is limited to household development. Larger or housing-led schemes need route-specific analysis rather than an assumption that a householder example applies.
“An LDC covers all approvals”
An LDC confirms planning lawfulness only. List the other permits, consents and regulatory checks separately before construction.

Illustrative scenarios
Adding two homes to an approved scheme
Start with the permission and approved plans for the existing scheme. The additional dwellings are not automatically authorised merely because the original development has permission. Check whether a separate PD right genuinely applies; if not, an application—or, where eligible, a permission-in-principle route followed by technical details—may be needed.
Changing an existing building into homes
Record the current use, proposed number and type of homes, structural work and access changes. Test the precise change-of-use PD class, any conditions and local restrictions. If the route requires prior approval, obtain the LPA’s decision before proceeding; if the legal status is uncertain, an LDC can address the described proposal.
Extending a house as part of a wider project
Use the householder guidance only for the household element within its scope. Check whether earlier extensions, protected-area restrictions or an Article 4 direction affect the relevant class, and assess linked works together rather than assuming separate operations are independent.
Where to get the final answer
The LPA is the authoritative first contact for a site-specific uncertainty. Give it the complete, precise description and identify the permissions and PD provisions you have considered. The government’s household guidance expressly advises seeking LPA advice where there is doubt.
If you need a legally documented answer about a proposed scheme, use the LDC process described in the official lawful development certificate guidance. If the proposal is not lawful under an existing permission or PD right, follow the LPA’s application route and use the current permission guidance and determination guidance for the relevant procedure.
