To report construction noise in New York City, call 311 or submit a Noise from Construction service request through NYC311 online. Give the work location, the kind of noise, and when it is happening; for after-hours building construction, include the work type, hours, and whether a permit is posted. Save your Service Request number to check the status. The Department of Environmental Protection (DEP) handles noise complaints. Use a separate Department of Buildings (DOB) complaint for unsafe or potentially unauthorized work, and call 911 for an immediate danger.
Choose the right NYC complaint route
Start with the condition you need the City to address. Noise, a building-code concern, and an immediate hazard are different reports, even when they come from the same construction site. The correct route depends on what is happening, whether the work is active, and whether you are reporting noise or a separate building or safety issue.

| What is happening | Where to report it | Agency or response |
|---|---|---|
| Construction noise, including jackhammering | NYC311: “Noise from Construction,” by calling 311 or submitting a service request online | DEP handles noise complaints |
| Potentially unsafe building work, work without a required permit, work outside approved plans, or building work after hours that may violate building rules | NYC311: the relevant “Building Construction Complaint” route | DOB handles building-construction complaints |
| An immediate hazard, such as falling debris posing an immediate danger or a suspected gas leak | Call 911 | Emergency services |
| A tenant-protection-plan concern, dust issue, or another construction impact that is not simply noise | Use the specific NYC311 or DOB route for that issue; tenant-protection-plan concerns go to DOB’s Multiple Dwellings Inspections Unit | The agency depends on the issue |
A noisy site can also raise a separate safety or permit concern. If so, make the noise report and the relevant building complaint separately rather than expecting one service request to cover every problem. A noise complaint is handled by DEP; it does not replace a DOB report about building work.

Dust and tenant protections are also distinct from noise. DOB’s Tenant Protection Plan checklist directs noise complaints to DEP through 311, while a concern about whether a tenant protection plan is being followed should be directed to DOB’s Multiple Dwellings Inspections Unit and identified as a Tenant Protection Plan complaint. Using the category that matches the condition helps route the report to the agency responsible for it.
How to report construction noise through NYC311
- Call 311 or use NYC311 online. Select the construction-noise service request, listed as “Noise from Construction.” The service categories include “Construction during hours,” “Jackhammer during hours,” and “Construction or jackhammer before or after hours.” Choose the description that best matches what is happening. The report can be made whether the work is during the usual schedule or outside it.
- Identify the location clearly. Provide the construction site’s address or the most precise location you can. For street or highway work, describe where the work is taking place so the reported noise can be associated with the right location. If you do not know a street number, give useful identifying details such as the nearest intersection or the block where the activity is occurring.
- Describe the sound and timing. Say what you hear, such as jackhammering, and give the days and times it is occurring. If it is ongoing, report that it is happening now. For an after-hours building-construction complaint, NYC311 asks for the type of work, the work hours, and whether a permit is posted.
- Submit the request and keep the Service Request number. The number identifies your report. Use NYC311’s service request status function to check progress, or contact 311 with the number if you need to follow up.
- Attach a photo or video only as supporting information. NYC311 allows picture or video attachments for informational purposes. An attachment can help describe the reported condition, but it does not replace an inspection or guarantee enforcement action.
Report what you can observe rather than trying to decide the legal status of the work yourself. In particular, an after-hours report is more useful when it identifies the actual work and hours and notes whether a permit is posted, instead of assuming that all work outside ordinary hours is prohibited.
What to include in a useful report
A concise report should answer the practical questions an agency needs to understand the condition: where the work is, what noise you hear, and when it occurs. Give the best location you have, name the sound source if you can identify it, and describe whether it is happening now or at recurring times. “Construction noise” is a starting point; “jackhammering at the corner of X and Y at about 8 p.m.” is more specific and easier to distinguish from a different site or sound.

If you do not know whether a permit is posted, do not guess; report what you can verify. Likewise, describe the work rather than making an unsupported claim about whether it is authorized. The City can assess the circumstances and route the complaint to the appropriate agency.
If you are calling 311, have the location and the basic description ready so you can provide them clearly. If you file online, use the corresponding service-request category and provide the same facts in the form. Regardless of the method, keep the Service Request number once it is assigned. A report number is the practical link between the complaint and later status checks or a request for an inspection report.
Calling 311 or filing online
Both routes are ways to submit the construction-noise service request. Calling may be useful if you want to explain the location or distinguish a noise issue from a separate hazard, while the online form provides a place to submit the report and, where allowed, supporting picture or video files. The essential information remains the same: location, sound or work type, timing, and the permit-posting information for an after-hours building-construction report.
Do not substitute an app that records sound data for a service request. The NYC Noise app can collect information for DEP, but it does not create a noise complaint in the NYC311 service-request process. If your goal is to report the activity and be able to track the request, use 311 or NYC311 online.

When construction noise is allowed—and when it can still be reported
NYC311 and DEP describe the general construction schedule as weekdays from 7 a.m. to 6 p.m. Those are general hours, not a rule that makes every other instance automatically illegal. Authorized variances and qualifying emergency or other work can allow construction at other times.
Limited weekend work at certain homes
NYC311 describes a narrow exception for alterations or repairs to certain existing one- or two-family owner-occupied dwellings, convents, or rectories. Such work may take place on Saturday or Sunday from 10 a.m. to 4 p.m. only when the dwelling is more than 300 feet from a house of worship. This is a limited allowance, not a general weekend construction schedule.
The conditions matter: the exception concerns alterations or repairs to the listed kinds of existing property, the specified weekend time window, and the distance from a house of worship. It should not be read as a blanket authorization for weekend work at any building or site. If a weekend activity is noisy, you can still report it and provide the location, type of work, and time so the City can evaluate which rules apply.
Work outside ordinary hours
If noise occurs before 7 a.m., after 6 p.m., or on a weekend, you can still submit a construction-noise report. NYC311 says construction noise can be reported even when a site has a variance. Include the time and type of work; do not assume that a variance makes the noise unreportable, or that the hour alone proves a violation. The City must assess the reported circumstances.
Use the service-request descriptions that fit the event, including “Construction or jackhammer before or after hours” for activity outside the usual schedule. A report is still appropriate when the status of a variance or other authorization is unknown to you. You do not need to establish whether an authorization exists before you can contact 311; for an after-hours building report, give the requested details, including whether a permit is posted.
Construction activity during standard hours can also be reported as noise. The fact that the work is between 7 a.m. and 6 p.m. on a weekday does not mean that a resident cannot file a noise complaint. NYC311 lists “Construction during hours” and “Jackhammer during hours” as reportable categories. Choose the category that best describes what you hear and include the timing and location.
Noise mitigation rules do not change the resident’s reporting steps
Construction noise mitigation plans are part of the rules for covered activities. A DEP rule effective April 21, 2026, adds a construction-noise monitoring requirement for certain projects using alternative mitigation plans. That is a requirement affecting qualifying projects, not a prerequisite for a resident to contact 311 or file a noise complaint. Residents do not need to determine whether a project uses an alternative mitigation plan in order to report noise.

What happens after you submit a complaint
NYC311 routes the noise request to the appropriate agency, and DEP handles noise complaints. Use the Service Request number to check status. The reviewed City guidance does not promise a fixed inspection time, a deadline for resolving an initial noise report, or a particular outcome such as a summons, order, or work stoppage.
Recommended Free Tools
A submitted report starts the City’s service-request process; it is not a finding that a violation occurred. The status function can help you follow the request, but the reporting process does not guarantee that an inspector will arrive at a particular time or that the site will be ordered to stop work. Avoid interpreting the submission itself, an attachment, or a status update as a final enforcement decision.
If the noise continues or occurs at different times, keep a clear personal note of the dates and times and retain the Service Request number. When contacting 311 again, refer to the number and explain whether you are following up on the same reported condition or describing a new occurrence. If the issue also involves unsafe or potentially unauthorized construction, file that separate DOB complaint rather than relying on the noise request to cover it.
What photos and videos can—and cannot—show
Photos and videos can provide informational context about the reported condition. They do not by themselves establish that enforcement action will follow. NYC311 states: “A condition must be observed in person by a DEP inspector for a summons or Commissioner’s order to be issued.” A recording is therefore supporting information, not a substitute for an inspector’s in-person observation.
Use an attachment to help describe what is happening, not as a promise of a particular outcome. A video may show visible activity or help identify the type of work, but it does not replace the location and timing details in the complaint, nor does it establish the legal status of a permit or variance. Keep the report factual and let the responsible agency evaluate the condition.
Request a Noise Inspection Report after an inspection
If DEP completes an inspection related to your noise service request, you can ask for a Noise Inspection Report. NYC311 says the request must include:
- Your Service Request number
- The date of the inspection
- An email address or mailing address where the report can be sent
The report is sent 14 days after inspection completion or 14 days after the report request, whichever is later. This timing applies to obtaining the report after an inspection; it is not a response-time promise for the original noise complaint.

For example, if you have the Service Request number and know the inspection date, include both when asking for the report and provide one delivery address. If you do not know whether an inspection occurred, first use the service-request status function or contact 311 with the request number. The report request is a follow-up step after an inspection, not a way to compel one or a substitute for filing the original noise complaint.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Why the NYC Noise app is not the complaint channel
The NYC Noise app collects information such as decibel level, date, time, and noise source for DEP, but it does not submit a noise complaint service request. NYC311 puts it plainly: “The app does not submit noise complaint services requests.” To file a complaint that can be routed through the City’s service-request process, call 311 or use NYC311 online.
This distinction matters if you want a report with a Service Request number that you can track. Noise measurements or other app data are not a substitute for the service-request channel, and the app does not replace the NYC311 complaint form. Use the reporting route that matches your goal: submit “Noise from Construction” through NYC311 to report the construction noise.
Common reporting mistakes to avoid
- Using the noise route for every construction problem. Report noise to DEP through NYC311; report a building safety, permit, or approved-plan concern through the relevant DOB building-construction route. Call 911 for an immediate danger.
- Treating the general schedule as an absolute ban. Weekday hours are generally 7 a.m. to 6 p.m., but limited weekend work, authorized variances, and qualifying emergency or other work can affect whether work is permitted at a given time.
- Leaving out the timing and type of work. State what is making the noise and when it occurs. For after-hours building work, include the work type, hours, and whether a permit is posted.
- Assuming a recording guarantees enforcement. Attachments are informational. NYC311 says a DEP inspector must observe the condition in person for a summons or Commissioner’s order.
- Failing to keep the request number. Save the Service Request number when you submit the report; it is needed to check status and is required when requesting a Noise Inspection Report.
- Assuming a variance means you cannot report the noise. NYC311 says construction noise can still be reported even if a site has a variance. File through NYC311 and describe the actual time and activity.
- Using the NYC Noise app instead of 311. The app collects noise information for DEP but does not submit a noise complaint service request.
- Combining separate problems into one report. A noise report does not replace a DOB building complaint or a report about a tenant protection plan. Use the route for each distinct issue.
Keep a useful record of your report
For a clear complaint and an easier follow-up, note the site location, the sound, the dates and times it occurs, and the Service Request number. If you submit more than one type of complaint, keep each request number with the issue it covers. This record helps you describe the reported problem consistently without treating a submitted request as proof that a violation has been found.
A simple note can record when the noise occurred, whether it was ongoing when you called or filed, and what kind of work you could identify. For an after-hours building report, also keep track of the work type, reported hours, and whether a permit was posted. These details are useful when checking status or explaining that a later report concerns the same location and activity.
Keep the noise request number separate from any DOB complaint number. DEP handles the noise issue and DOB handles building-construction concerns; one request cannot be assumed to update the status of the other. If the City inspects and you want a Noise Inspection Report, have the noise Service Request number, inspection date, and delivery address ready.

Can I report construction noise outside permitted hours?
Yes. NYC311 lists construction or jackhammering before or after hours as reportable, and says noise can be reported even when a site has a variance. Include the work type and hours. An after-hours building-construction report should also say whether a permit is posted.
What are NYC construction hours?
NYC311 and DEP describe general construction hours as weekdays from 7 a.m. to 6 p.m. There is a narrow weekend allowance for certain alterations or repairs to existing one- or two-family owner-occupied dwellings, convents, or rectories: 10 a.m. to 4 p.m. when the dwelling is more than 300 feet from a house of worship. Variances and qualifying emergency or other work can also affect the schedule.
Does a photo or video guarantee that the City will issue a summons?
No. NYC311 allows picture or video attachments for informational purposes, but says a DEP inspector must observe a condition in person for a summons or Commissioner’s order to be issued. An attachment can support a description; it does not guarantee enforcement.
Can I use the NYC Noise app to file a complaint?
No. The app collects information such as decibel level, date, time, and noise source for DEP, but it does not submit a noise complaint service request. Use 311 or NYC311 online to file and receive a Service Request number.
How do I check the status of my construction-noise complaint?
Keep the Service Request number assigned to the report and use NYC311’s service request status function, or contact 311 with the number. City guidance does not promise a fixed inspection time, resolution deadline, or particular enforcement outcome.
How do I get a Noise Inspection Report?
After DEP completes an inspection, request the report with your Service Request number, the inspection date, and an email or mailing address. NYC311 says it is sent 14 days after inspection completion or 14 days after the report request, whichever is later.
Where do I report unsafe construction or a permit concern?
Use the relevant NYC311 Building Construction Complaint route for potentially unsafe work, work without a required permit, work outside approved plans, or building work after hours that may violate building rules. DOB handles building-construction complaints. Call 911 for an immediate danger such as falling debris posing an immediate hazard or a suspected gas leak.
