How to document construction defects in a new flat for a complaint

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Document defects before renovation or repair changes the evidence, then send a dated, numbered schedule through the developer’s, builder’s, owners’ association or warranty provider’s required channel. A useful complaint lets someone who has never seen the flat identify exactly what is wrong, where it is, when it was observed, how it affects use or safety, and what remedy you are requesting. Keep the original photographs, contracts, handover records and proof that your notice was received. Deadlines, inspection rights and the correct recipient depend on the country, contract and building arrangement; verify them before relying on any period.

What counts as a construction defect or snag?

A defect is a condition that is damaged, incomplete, unsafe, or inconsistent with the contract, approved plans, specifications or applicable building requirements. “Snag” is commonly used for a defect or unfinished item, but the preferred term varies by country and project. Your record should describe the observable condition rather than accuse a contractor of a cause you have not established. A photograph can show a crack, stain or gap; it does not by itself prove why it occurred or who is responsible.

As an Amazon Associate I earn from qualifying purchases.

Start documenting as soon as you notice an issue. Evidence is strongest when it shows the original, as-found condition and a clear timeline. If a defect creates immediate danger, make the area safe first and obtain qualified help, while preserving photographs and other records whenever it is safe to do so.

First actions: preserve the condition and report promptly

Inspect before renovation or alteration

Walk through the flat before painting, installing cabinets, replacing flooring or making other changes. Renovation can conceal a leak, cover a crack or remove a fitting that would have helped establish what was delivered. If urgent mitigation is unavoidable, photograph and describe the condition first, retain invoices, and keep removed materials where practical.

Use the designated reporting route

Check the handover pack, sale or building contract, defects-liability terms, warranty documents and building-management instructions for the required portal, email address or form. Submit the notice through that route and save the confirmation, reference number or delivery record. A verbal report to a site manager may be useful, but it should not replace the formal channel required by your documents or local process.

Do not wait for a perfect schedule

Send an initial notice for a serious or time-sensitive issue even if you are still assembling supporting material. State that further evidence will follow, then add a dated, numbered schedule. Delaying a report while trying to catalogue every minor mark can allow water damage or movement to worsen and may put a contractual notification period at risk.

Build a defect log that another person can use

Use one row for each distinct problem. Avoid a single entry such as “poor workmanship,” which forces the recipient to guess what you mean and makes follow-up difficult. Building and Plumbing Commission Victoria guidance captures the principle in the sentence: “When you are describing defects, be specific.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fields to record for every item

  • Item number: assign a stable identifier such as 01, 02 and 03. Do not reuse a number if an item is closed and a different problem appears.
  • Date first noticed: record the date and, if relevant, the time. If you discovered it during the handover inspection, say so.
  • Room and precise location: identify the room, wall, floor, ceiling, fixture or elevation. Add orientation or distance from a fixed feature when that removes ambiguity.
  • Observable condition: state what you can see, hear, smell or safely measure. Use neutral descriptions such as “paint is lifting in a 120 mm strip below the window” rather than “the builder used defective paint.”
  • Extent and recurrence: record dimensions when safe and useful, and say whether the condition repeats, spreads, appears after rain or returns after cleaning.
  • Effect on use or safety: explain blocked drainage, inability to close a door, loss of heating, trip risk, water entering the room or another concrete consequence.
  • Requested action: ask for inspection, testing, repair, replacement, adjustment or another specific response. Requesting an inspection is appropriate when the cause is uncertain.
  • Evidence references: list the matching photograph, video, report or invoice filenames.
  • Status: note when the item was submitted, who responded, promised dates, inspection dates and whether the condition changed.

Describe observations, not unproven causes

“Water pools on the bathroom floor beside the shower after normal use” is stronger than “the waterproofing failed.” “A diagonal crack runs from the window corner toward the skirting” records evidence without asserting structural movement. If you suspect a cause, label it as a question for a qualified inspector: “Please investigate the source of recurring moisture.”

Use a practical log format

Item First noticed Room/location Observable problem and extent Effect or recurrence Evidence files Notice, response and next action
01 YYYY-MM-DD Bathroom, floor beside shower Water remains pooled after normal use; record approximate area or depth only if safely measured Repeats after each shower 01-context.jpg; 01-close.jpg Sent to the designated contact on the submission date; record response due under local terms

Keep the log in an editable file and export a dated PDF for each submission. If the recipient changes an item number, preserve your original identifier and show the new reference beside it.

Take photographs and video that prove location and change

Use a context-to-detail sequence

  1. Take a wide context image showing the room, wall, fixture or elevation so the location is identifiable.
  2. Take a medium view that narrows the position to a door, window, drain, cabinet or other fixed reference.
  3. Take one or more close views that show the defect clearly. Add a ruler or other scale only when it helps demonstrate size and does not cover the condition.
  4. For moving, intermittent or sound-related issues, record a short video showing the event and narrate the date, location and action being performed. Keep the original file.

Name and cross-reference files

Use a consistent filename containing the item number and a short description, for example 01-context-bathroom.jpg and 01-close-pooling.jpg. Put the same filenames in the defect-log row and in the complaint attachment list. Building and Plumbing Commission Victoria asks complainants to label photographs and link them to numbered notice items; New South Wales accepts photographs or reports with a complaint.

Preserve originals and later states

Keep the unedited image files with their original metadata where available. If you crop or annotate a copy, retain the original and identify the edited version. Photograph the area again after a repair, after a temporary fix fails, or when the condition spreads. Record what changed and who performed the work. Do not delete an earlier image because a later image looks better.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assemble the documentary record

Core project documents

  • Sale, building or construction contract and any variations.
  • Plans, specifications, finish schedules and selections that define what was promised.
  • Handover, completion, occupancy or key-collection records.
  • Defects-liability, warranty or insurance documents and their contact instructions.
  • Inspection reports, certificates and correspondence about previous defects.
  • Invoices for emergency drying, temporary protection or other mitigation.

Keep a contact chronology

Save every email, letter, text message, portal submission, attachment and delivery receipt. After a call or site meeting, create a dated note listing participants, the item numbers discussed, what was agreed, promised actions and the next date. Send important oral agreements in a follow-up email: “My understanding is that items 03 and 04 will be inspected on the stated date.” Give the other party a chance to correct the record.

Protect file integrity

Store a read-only copy in a separate location and use a predictable folder structure by item number. Do not rely on a messaging app that may delete attachments or compress images. Preserve the original message and the attachment together so the date and sender remain clear.

Write the complaint notice

Identify the parties and the coverage

Begin with the complete property address, unit number, your name and contact details, and the builder, developer, contractor, warranty provider or building representative to whom the notice is directed. Add the contract, purchase, handover or warranty reference if one exists. State whether the notice concerns your private lot, shared property or both.

Attach a numbered schedule

For each item, provide the log fields, the requested action and the matching evidence filenames. Explain any recurrence or safety effect. If a professional report exists, identify its author, inspection date and the pages relevant to each item. Do not claim that a report proves liability unless it actually makes that finding within the author’s qualifications and scope.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Request a written plan

Ask the recipient to confirm receipt, identify the person handling the matter, and propose inspection and repair dates. Ask what access is required and whether temporary measures are permitted. Give a reasonable response date based on the contract or applicable process, not an invented universal deadline. Keep a complete copy of what you sent.

Retain proof of delivery

Save portal confirmation screens, automated emails, read receipts, postal tracking and signed delivery records. Building and Plumbing Commission Victoria describes email with a read receipt or registered post for its complaint process. Other jurisdictions may prescribe different methods, so follow the applicable instructions rather than assuming Victoria’s method applies elsewhere.

Apartment defects: private lot or common property?

Before sending a complaint, determine who controls the affected element. A defect inside your unit may be your individual claim; a defect in structure, façade, roof, shared plumbing, fire systems, lifts or another common area may require the owners corporation, strata committee, building association or managing agent to act. The boundary is defined by local law and the strata or condominium documents, not simply by where you noticed the symptom.

When to involve the owners’ representative

Tell the owners corporation or its representative about conditions that may affect multiple units or shared infrastructure. Provide your numbered evidence and ask that the representative submit or coordinate the common-property complaint. In New South Wales, complaints about common property in an occupied apartment building are best made by the owners corporation or its representative. An individual owner may complain about a defect limited to their lot, or where the owners corporation or strata manager does not respond. Confirm the equivalent route in your location.

Prevent duplicate or conflicting reports

Tell each recipient which other party has been notified and use the same item numbers. A shared chronology avoids one contractor repairing a visible symptom while the responsible building body is unaware of a wider leak or system defect.

Handle urgent and technically complex defects safely

Prioritize immediate hazards

For suspected structural movement, fire-safety failure, active water ingress, electrical danger, gas risk or another urgent hazard, keep people away from the area and contact the relevant emergency, building or qualified professional service. Do not wait for a routine defect portal when there is an immediate risk. Record what you observed and the steps taken to make the area safe.

Do not destroy the evidence

Do not conceal, demolish or permanently repair a disputed condition before documenting it and checking whether the builder, warranty provider or insurer must be allowed to inspect. Temporary measures may be necessary to prevent further damage; describe them, photograph them and retain receipts. Ask in writing whether an inspection is required before permanent work.

Use instruments cautiously

A consumer moisture meter can provide an indicative reading for suspected damp or water ingress, but the number depends on material, calibration, location and method. Record the device and location if you use one, and present the result as a screening observation rather than proof of a cause. No particular device is endorsed here, and a consumer reading is not a substitute for qualified inspection.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Know when to hire an independent consultant

Consider an appropriately qualified building consultant or snagging inspector when the defect is hidden, recurring, technically complex, widespread, disputed or potentially structural. Ask what qualifications and insurance the consultant holds, whether the inspection is visual or includes testing, what areas are excluded, when the report will be delivered, and whether the builder or warranty process accepts it. Hiring a consultant is not necessarily required by a complaint process. A regulator’s inspection may be limited to the items you reported rather than a full property survey.

Self-documentation versus a private inspection

Question Self-documentation Private consultant or snagging inspector
Technical scope Records visible conditions, dates and effects you can observe safely. May interpret patterns, conduct specialist tests or assess concealed causes, depending on qualifications and agreed scope.
Evidence format Log, labelled photographs, videos, correspondence and receipts. Should identify locations, explain methods and support findings with photographs or other evidence.
Visibility limits Cannot establish hidden conditions without opening-up or specialist equipment. May still be limited to non-invasive or visible inspection; confirm exclusions before booking.
Speed and cost Immediate and usually free apart from your time and storage. Turnaround and fee vary; obtain a written scope and price before work starts.
Acceptance by the process Usually forms the basic complaint record. Ask whether the builder, warranty provider, owners corporation or regulator will accept the report and whether its inspector must attend first.

Jurisdiction examples: periods and procedures are local

The following examples illustrate why you must check the law and contract for the flat’s location. They are not interchangeable rules.

Location and authority Published example How to use it
Singapore Housing & Development Board (HDB) For newly completed HDB flats, HDB guidance describes a one-year defects liability period from key collection and asks residents to report items within one month of key collection and before renovation. Requests can be submitted online or at the precinct Building Service Centre. Check the current handover materials and HDB instructions for your project; these periods do not create a worldwide deadline.
Victoria, Australia — Building and Plumbing Commission A written complaint notice is usually needed while the builder is still trading before a Home Warranty claim is assessed. Guidance says defective or non-compliant work claims generally must be made within 12 months of when the owner first knew or reasonably should have known of the issue. For a required complaint notice, the builder generally has 28 days to respond before the Commission can assess a claim. Other claim types have different periods. Check the current Commission requirements and your facts before relying on either period.
New South Wales, Australia — Building Commission NSW Complaint material may include owner and contractor details, work type and date, plans and contracts, completion-date evidence, dispute correspondence and defect reports or photographs. The agency says its inspector looks only at reported items, not a general inspection. Report each item you want considered and use the owners corporation or representative for common-property issues in an occupied apartment building.
Texas, United States — Property Code Chapter 27 For covered claims, a claimant may have to provide detailed written notice by certified mail at least 60 days before filing suit or initiating arbitration, provide certain available evidence and allow a reasonable inspection opportunity. The cited procedure includes a 35-day inspection period on request. Scope, exceptions and calculations depend on the statute and facts. Obtain local legal advice before relying on this process.

Follow-up, inspections and escalation

Track every promised action

Update the log after each response: date received, person responsible, proposed remedy, inspection date, access arrangements and completion date. If a promised visit does not occur, send a factual follow-up identifying the missed date and asking for a new date. Keep disagreements tied to item numbers rather than broad accusations.

Prepare for an inspection

Provide access to the reported areas and keep them in the documented condition where safe. Have the contract, plans, log, photographs and prior correspondence available. Ask the inspector to identify which items were examined and record any areas that could not be accessed. An inspection of reported items is not necessarily a full survey of the flat.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Escalate in the correct order

  1. Use the builder, developer or warranty provider’s required defect channel.
  2. Notify the owners corporation, strata manager or building association when common property may be involved.
  3. Use the relevant regulator, warranty scheme, dispute service or tribunal if the contract and local rules provide that route.
  4. Seek legal advice for limitation questions, proposed litigation or a disputed technical cause.

Keep documenting while escalation proceeds. A new response or repair can create evidence about whether the original condition was corrected, concealed or recurring.

Common documentation mistakes and their fixes

  • Vague wording: Replace “bad finish” with the exact location, appearance, dimensions and effect.
  • Unlabelled photographs: Use item-number filenames and list them beside the matching log entry.
  • Only close-ups: Add a context image so the recipient can locate the defect.
  • Edited originals only: Preserve the original files and identify any annotated copies.
  • Phone promises with no record: Send a written follow-up naming the agreed action and date.
  • Combining unrelated problems: Give each defect its own number and requested remedy.
  • Claiming a cause as fact: Describe the observation and request investigation unless a qualified report establishes the cause.
  • Repairing before inspection: Check inspection and warranty requirements first; document any emergency mitigation.
  • Sending to the wrong party: Check whether the issue is private-lot or common property and use the designated route.
  • Assuming a foreign deadline: Verify the local contract, handover pack, authority and current law.

A final pre-submission checklist

  • Every issue has a unique number and date first noticed.
  • Each location is precise enough for an unfamiliar person to find.
  • Descriptions state observable facts, extent, recurrence and effect.
  • Context and close photographs are labelled and cross-referenced.
  • Original files, contracts, plans, handover records and communications are preserved.
  • The correct builder, developer, warranty contact or owners’ representative is addressed.
  • The requested remedy and access for inspection are clear.
  • The submission method follows the contract or local authority instructions.
  • Proof of delivery and a copy of the complete submission are stored.
  • Urgent hazards have been made safe and referred to an appropriate qualified service.
