Record what you can observe and prove; treat the cause, code compliance, structural safety, and legal responsibility as separate questions that may require a qualified professional or agency.
Because notice deadlines, inspection rights, agency powers, and court procedures differ by location, use the workflow below to build your evidence first, then verify the contract, warranty, and current rules where the property is located.

1. Start with a separate defect record for every issue
Do not describe an entire project as “bad workmanship.” Give each condition its own number and neutral label. A numbered list lets a contractor, inspector, regulator, mediator, or court match a statement to a place, image, document, and requested repair.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →What to record
- Defect number and short label: for example, “D-03 — water staining below kitchen window.”
- Exact location: property address, building or elevation, room, wall, floor, fixture, and a landmark that another person can find.
- Date first noticed: add dates of later observations, including when the condition changed.
- Observed facts: describe color, cracking, movement, gaps, leaks, noise, operation, measurements, or a failed function. State how and when you observed it.
- Conditions: note rain, temperature, use, load, or other circumstances if they affect whether the problem appears.
- Effects: explain interrupted use, damaged belongings or finishes, recurring moisture, access problems, or an immediate safety concern.
- Evidence links: list photo and video filenames, a short description of each view, and related contract sections, drawings, change orders, warranties, invoices, permits, or inspection records.
- Notice and response: record when and how each person was notified, the reply, promised action, and follow-up date.
- Inspection or repair: identify who attended, what was opened or changed, the before-and-after condition, and any written report.
- Requested remedy and status: state the repair, investigation, replacement, reimbursement, or other outcome you are asking for, and mark whether it is pending, attempted, accepted, or disputed.
Separate observations from conclusions
“A 2-millimeter crack runs vertically through the bedroom plaster beside the door; it was not visible on 4 May and appeared after heavy rain on 18 May” is an observation. “The foundation is failing” is a conclusion that requires appropriate evidence. Likewise, do not label a condition a code violation, fraud, structural failure, or legal breach unless a competent authority or qualified professional has established it.

Use a working defect table
| Field | Example entry |
|---|---|
| Defect | D-01 — shower leaks at the door threshold |
| Location | Ground-floor bathroom, east side of threshold |
| First noticed | 12 June 2026; observed again 15 and 19 June |
| Observed condition | Water reaches the hallway tile during a five-minute shower; grout is dark afterward |
| Effect | Hallway floor becomes slippery; paint at the skirting is blistering |
| Evidence | D-01-context-2026-06-19.jpg; D-01-close-2026-06-19.jpg; video D-01-2026-06-19.mp4 |
| Notice | Email to contractor on 20 June 2026; reply promised inspection on 24 June |
| Remedy requested | Find and correct the source, repair affected finishes, and confirm the test result in writing |
Keep the table factual even when you strongly suspect a cause. If a professional later identifies the cause, add that opinion as a dated report rather than rewriting your original observation.
2. Photograph and video the condition before it changes
Visual evidence should be understandable without you standing beside it. Official complaint guidance commonly asks for photographs or video; Michigan’s construction-enforcement guidance specifically calls for clear photographs showing the date taken.
A three-view method
- Context view: photograph the room, elevation, or work area so the location is identifiable.
- Relationship view: move closer to show the defect in relation to a door, window, fixture, joint, or other fixed reference.
- Detail view: fill the frame with the crack, gap, stain, failed component, or finish. Add a ruler or other scale only when it clarifies a dimension.
For moving or intermittent problems, make a short video that shows the setup, the action that triggers the problem, and the result. Narrate the date and location if useful, but do not edit the original recording to add claims. Keep the untouched original file and make labeled copies for your complaint.

- Use a consistent filename such as
D-03-close-2026-06-21.jpg. - Record the date and, when relevant, weather or operating conditions in the defect log.
- Preserve the original files and metadata. Store a backup in a second location.
- Do not overwrite originals with arrows, crop marks, filters, or annotations. Put marked-up copies in a separate working folder.
- Photograph active damage before mitigation when it is safe, then document the mitigation and resulting condition.
Photos can show what was visible; they do not, by themselves, prove causation, code noncompliance, or the cost of a proper repair.

3. Build one project file, not a stack of disconnected messages
Government complaint materials from Iowa, California, and Michigan identify many of the same records. Gather them while they are available and preserve the order in which events occurred.
Core documents
- Signed contract, scope of work, plans, specifications, and every change order
- Estimates, invoices, receipts, proof of payment, and any retention or deposit record
- Warranty terms, insurance documents, and written guarantees
- Permits, inspection reports, certificates, and notices from a building department, where available
- Advertisements, proposals, product descriptions, and written promises that influenced the agreement
- Emails, text messages, letters, portal messages, and call notes
- Photographs, videos, measurements, professional reports, and repair estimates
Make a contact and event chronology
Use one timeline for the project and reference defect numbers in each row. Include contract and work dates, the first appearance of each issue, every notice, replies, site visits, inspections, repair attempts, payment decisions, and periods when the condition worsened. Save the original message or letter alongside a PDF or printout so the date, sender, recipient, and attachments remain clear.
| Date | Event | Evidence | Next action |
|---|---|---|---|
| 8 June 2026 | Work completed in bathroom | Completion invoice; D-01 baseline photos | Monitor threshold after use |
| 12 June 2026 | D-01 first observed | Video D-01-2026-06-12.mp4 | Notify contractor in writing |
| 20 June 2026 | Written notice sent | Email and delivery record | Request inspection date |
| 24 June 2026 | Contractor inspection | Call note; new photos | Await written scope and schedule |
4. Write a complaint that can be investigated
Address the contractor, warranty provider, or other responsible party identified by your contract. Identify the project and the agreement, then present each defect as a numbered item. California Contractors State License Board complaint materials ask for project details, contract and payment information, complaint items, and attempts to contact the contractor; that structure is useful even when you are using a different channel.
Suggested complaint structure
- Header: your name and contact details, the property address, contractor’s legal and trading name, contract date, and project reference.
- Requested response: give a reasonable date for a written reply, subject to any contract or statutory deadline.
- Defect items: copy the neutral label, exact location, dates, observed condition, effects, and attached evidence for each number.
- Prior notice: list earlier calls, visits, emails, and promised repairs without editorial comments.
- Requested remedy: state what you want investigated, repaired, replaced, tested, or reimbursed. If the scope is uncertain, ask for a written inspection and proposed method rather than dictating an unsupported diagnosis.
- Attachments: provide an index with filenames, dates, and a short description. Keep the originals.
Use precise, supportable language
Prefer “water was visible on the hallway tile after a five-minute shower on 19 June” to “the waterproofing is defective.” Prefer “the window does not latch when the handle is turned fully” to “the installer violated the code.” You can identify a suspected cause as a question—“Please investigate whether the threshold seal or drainage is allowing water through”—without presenting it as proven.

5. Send the complaint and prove delivery
Put concerns in writing even if you first discussed them by phone. Consumer Affairs Victoria explains that written communication creates a record of discussions. Keep the sent email with headers, the complete message thread, attachments, and any delivery or read confirmation. For a letter, retain the signed copy, envelope, postal receipt, tracking record, and return receipt if used.
Continue logging calls and site visits: date, participants, what was said, promised action, and the next follow-up. A polite factual record is more useful than a series of unsupported accusations. Do not discard damaged materials or remove finishes before checking whether a contract, warranty, insurer, statute, or pending inspection requires an opportunity to examine them.
6. Choose a channel based on authority and remedy
No single route is best for every dispute. Compare the authority, deadline, notice format, remedy, evidence burden, fees, and possible effect on arbitration, insurance, warranty, or court rights before filing.

| Channel | What it may address | Key limitation or question |
|---|---|---|
| Contractor or warranty provider | Inspection, negotiated repair, warranty performance, or payment discussion | Check notice, access, exclusions, and required repair procedures in the contract or warranty |
| Licensing or construction regulator | Licensing conduct, regulated work, or code-related enforcement within the agency’s authority | Agency action does not automatically award homeowner compensation; confirm jurisdiction and available remedies |
| Consumer-protection office | Consumer complaints, information, mediation, or referrals depending on location | Its process and monetary authority vary; a private contract claim may still require another forum |
| Building department or inspector | Permit and code matters within local authority | A code inspection is not necessarily a determination of all contract damages or repair costs |
| Insurer | Covered damage or emergency mitigation under the policy | Prompt notice, exclusions, proof of loss, and permission for repairs may apply |
| Mediator or tribunal | Negotiated or adjudicated resolution where local rules provide it | Check filing deadlines, jurisdiction, fees, required pre-suit notice, and whether participation affects other rights |
| Court or arbitration | Binding determination of contractual or other legal claims when authorized | Rules, limitation periods, expert evidence, arbitration clauses, and required notices are location-specific |
Iowa’s Attorney General notes that some home-improvement problems require legal advice or court action. A regulator’s investigation and a claim for money are different objectives; decide which remedy you need before choosing the form.

7. Check notice and inspection rules before formal escalation
Never copy a deadline from another state. Read the current statute, contract, warranty, and filing instructions for the property’s location, and confirm the required delivery method.
Texas example: Property Code Chapter 27
For covered construction-defect claims, Texas Property Code Chapter 27 requires written notice by certified mail, return receipt requested, at least 60 days before suit or arbitration. Section 27.004(a) requires notice “specifying in reasonable detail the construction defects that are the subject of the complaint.” The chapter also addresses supporting evidence and an opportunity for the contractor to inspect under statutory conditions. Coverage, exceptions, and current requirements must be verified before relying on this process.
Georgia example: Right to Repair Act
The Georgia Attorney General’s summary describes a different process for covered claims, including notice at least 90 days before suit and specified response and inspection steps. Georgia’s exceptions and procedure are not interchangeable with Texas’s. Use the Georgia requirements only for a Georgia claim after checking the current statute and contract.

Program-specific forms
Some programs have their own complaint forms. HUD Form 92556, “Construction Complaint for New Constructed Property,” is tied to the applicable HUD program and should not be treated as a universal construction-defect form. Follow the program’s eligibility and submission instructions.
8. Handle inspections, hidden causes, and repairs without losing evidence
Address immediate hazards first
Do not delay emergency work to obtain a perfect record. If there is an electrical danger, unstable element, sewage exposure, major leak, or continuing water intrusion, protect people and property and contact the appropriate emergency, utility, insurer, or qualified professional. Photograph and describe the condition before mitigation when safe, then keep invoices, removed-material photos, disposal records, and a written account of what was done and why.
When an independent professional helps
An independent qualified inspector or engineer may be useful for a hidden cause, safety concern, disputed repair scope, or question outside your expertise. Ask for a written report that identifies the observations, methods, measurements, limitations, photographs, and repair recommendations. The report should distinguish what was seen from what was inferred.

Before opening or testing concealed work
Destructive testing can destroy evidence and may affect warranty, insurance, or statutory inspection rights. Check local procedures and obtain written authorization where required. New Hampshire law, for example, addresses inspection and written authorization for testing; Texas Chapter 27 also provides inspection opportunities. Those examples do not create a nationwide rule. Photograph and record the proposed test, obtain consent from the party whose rights may be affected when appropriate, and preserve removed components.
9. Organize files so another person can follow them
Maintain an untouched original-evidence folder and a separate working folder for labeled copies, indexes, redactions, and annotated images. Back up both in at least two locations. Use one naming convention and a simple index that maps every attachment to a defect number and date.
- Do not edit, recompress, or overwrite original photographs and videos.
- Keep full email threads and attachments, not isolated screenshots where a complete export is available.
- Record who supplied each report, when it was received, and whether it is a draft or final version.
- Retain invoices and payment proofs even after a repair is completed.
- Keep damaged materials until the applicable inspection or evidence-preservation question is resolved.
This organization method improves clarity; no folder structure or file format guarantees that evidence will be admissible in a particular proceeding.
10. Mistakes that weaken a construction complaint
- One undifferentiated narrative: separate defects so dates, locations, and remedies are clear.
- Unlabeled photos: connect every image and video to a defect number, location, and date.
- Diagnosing without support: report observations and identify suspicions as questions until a qualified assessment supports them.
- Relying on phone calls: follow conversations with a short written confirmation and retain delivery proof.
- Assuming a regulator can award damages: check the agency’s jurisdiction and remedies before filing.
- Using another state’s deadline: verify local notice, service, inspection, and limitation rules.
- Repairing before documenting: record the condition and ask about inspection rights, except where safety or active damage requires immediate action.
- Overstating certainty: avoid calling a condition fraud, a code violation, or structural failure without reliable support.
11. A final pre-filing checklist
- Every defect has a number, neutral label, exact location, first-noticed date, later observations, conditions, effects, and status.
- Context, relationship, and detail photographs or videos are tied to the defect list.
- Original files are preserved, working copies are separate, and backups exist.
- The contract, change orders, plans, invoices, payment proof, warranty, insurance, permits, inspections, advertisements, and correspondence are indexed.
- The chronology includes work, discovery, notices, responses, inspections, repairs, and follow-ups.
- The written complaint identifies the project, lists each item, attaches evidence, records prior contact, and requests a defined response or remedy.
- Delivery and receipt records are saved.
- Local notice periods, service method, inspection rights, filing forum, and remedy limits have been checked.
- Active hazards have been addressed and mitigation has been documented.
- Any expert report states methods, limitations, observations, and recommendations separately.
12. When to obtain legal or technical advice
Consider prompt advice when the claim involves an imminent safety risk, substantial or concealed damage, a threatened deadline, a dispute over destructive testing, an arbitration clause, a failed warranty process, or a demand for significant compensation. Bring the indexed project file, defect register, chronology, original evidence, contract, and all notices. A lawyer can explain rights and deadlines in the relevant jurisdiction; an engineer or qualified inspector can address technical cause and repair scope. Neither role should be assumed from photographs alone.
