There is no reliable national “per-acre” price for a pipeline easement. Compare the payment with the specific property rights the operator receives, the restrictions that remain for the life of the easement, construction losses, restoration obligations, and damage from later maintenance. Those are different economic items and should be identified separately in the offer and the signed agreement.
For U.S. farmland, the easement document and applicable state or federal law control. A useful comparison starts with a parcel map and a side-by-side reading of the proposed instrument, not with a neighboring owner’s headline payment. The Federal Energy Regulatory Commission (FERC) says a permanent right-of-way can last “20 to 50 years or more,” while some agreements continue until an abandonment determination. That possible duration makes restrictions on buildings, drainage, irrigation, trees, grading, tillage, and future farm plans part of the value calculation.

What a pipeline easement payment actually covers
An easement payment is consideration for a defined property right. It is not automatically a complete payment for every loss caused by the project. The offer may combine several items, or it may pay only for the permanent right and address crop and construction damage in separate clauses. Ask the company to identify each amount and each release in writing.
Permanent and temporary rights are different
A permanent easement usually gives the pipeline company continuing rights to install, operate, inspect, repair, replace, and access a line. A temporary construction easement or workspace exists for a limited project period and may cover grading, vehicle access, spoil storage, stringing pipe, or other work outside the permanent corridor. The acreage, duration, and permitted activities can differ substantially between the two areas.

Payments that should not be silently bundled
FERC’s landowner guidance identifies lost uses, resources, and property damage as possible compensation categories. In practical terms, request a schedule that distinguishes:
- consideration for the permanent easement itself;
- consideration for temporary workspace, access, or staging areas;
- standing or harvested crop and pasture losses during construction;
- fences, gates, roads, drainage systems, irrigation equipment, structures, and other surface improvements;
- soil compaction, topsoil loss, uneven settlement, erosion, or reduced productivity;
- damage from later inspection, maintenance, repair, replacement, or emergency work; and
- any claims, releases, deadlines, or dispute procedures attached to those payments.
A single check can cover more than one category, but the agreement should still say what the check buys. A broad release signed before the extent of crop or soil damage is known can be worth more than the apparent payment, because it may eliminate later claims.

| Area and duration | How many acres are permanent, temporary, or access-only? When does each right begin and end? | A permanent restriction can affect the parcel for decades; temporary workspace can disrupt one or more crop cycles. |
| Rights granted | May the operator install additional lines, replace the line, enlarge facilities, drive vehicles, clear vegetation, or enter without notice? | Broader rights create more potential interference and may reduce future use. |
| Abandonment | Does the easement end automatically when the line is inactive, or only after a formal abandonment decision? | An unused corridor may still restrict the land if the document keeps the right alive. |
| Allowed farming | Are ordinary cropping, grazing, haying, harvesting, and maintenance expressly allowed? | Clear permission protects the uses that generate present income. |
| Prohibited or consent-based uses | Are buildings, trees, ponds, deep excavation, drainage work, or heavy improvements prohibited or subject to written approval? | Consent requirements can block or delay planned improvements and affect marketability. |
| Damage and restoration | Who measures crop loss, repairs tile and fences, restores topsoil, corrects compaction, and pays for later failures? | Unclear responsibility shifts investigation and repair costs to the owner. |
| Claims process | What notice, evidence, deadline, and payment procedure applies to construction or future damage? | A short deadline or broad release can defeat an otherwise valid claim. |
Do not assume a restriction exists merely because it is common in another agreement. Conversely, do not assume a use is protected because a salesperson said it would be. The signed language controls.
Read the easement for duration, access, and abandonment
Permanent rights can outlast a farm plan
FERC’s landowner guide explains that a permanent right-of-way may continue until the Commission determines that the pipeline may be abandoned and that such rights can last 20 to 50 years or more. That is a description of possible duration in the federal interstate natural-gas context, not a guaranteed term for every pipeline or state. Check the instrument for its own termination trigger, renewal language, and treatment of an inactive line.
Access rights affect day-to-day operations
Look for the number and location of access roads, whether the operator can cross the farm outside the mapped corridor, notice requirements, gates and locks, hours of entry, and responsibility for rutting or damaged crops. An inspection right that sounds narrow may permit repeated vehicle traffic. A replacement clause may authorize a larger work area than the original installation.
Replacement, additional facilities, and abandonment clauses
Determine whether the company may replace the pipe with one of the same size only, install parallel lines, add valves or above-ground markers, or use the corridor for communications or other facilities. Ask what happens to the pipe and easement when service ends: removal, purging, continued monitoring, or a formal release. A right that survives inactivity can continue to constrain future buyers.

Translate restrictions into farm value
The economic question is not simply how many acres are inside a corridor. It is what the owner can no longer do, what requires permission, and how those limits interact with the rest of the tract.
Buildings, livestock facilities, and other structures
Many easements restrict buildings or foundations over the line and may require clearance from valves, markers, or access roads. Map existing barns, grain bins, livestock facilities, homes, wells, and planned expansions against the survey. A restriction that prevents a future shop or livestock building can affect the value of the whole farm, not just the strip, if the corridor runs through the only practical building site.
Trees, orchards, and perennial plantings
Vegetation clauses may allow the operator to remove trees that interfere with inspection or repair. Record existing orchards, windbreaks, timber, and perennial forage, and ask whether replacement plantings are barred. The loss is not limited to the cost of seedlings: years of growth, shelter, drainage effects, and farm layout may be involved.
Grading, drainage, and tile
Pipeline installation can intersect surface ditches, subsurface tile, terraces, waterways, and leveled fields. Check whether grading, excavation, tile replacement, or drainage improvements require prior consent. Require a preconstruction map and baseline condition for tile and grades. A promise to “restore drainage” is incomplete unless it identifies design standard, testing, correction deadlines, and who pays if water backs up after the crew leaves.

Center pivots, buried mains, wells, pumps, and risers can conflict with the corridor or access route. Ask whether the operator will relocate, protect, or replace equipment and whether future expansion needs consent. Include downtime and reinstallation costs in the damage schedule rather than treating them as an informal accommodation.
Roads, crossings, and deep tillage
Road crossings may be limited to designated points, and heavy loads can create rutting or compaction. Restrictions on deep ripping, subsoiling, drainage work, or excavation may be justified by damage-prevention requirements, but the agreement should state the depth, equipment, notice, and approval process. A vague prohibition can make ordinary conservation work risky; a clear procedure lets the operator and farmer plan safely.
Reasonably foreseeable changes
Federal appraisal guidance says easement covenants should be analyzed individually and collectively against zoning and other controls to estimate effects on present and alternate future uses. List realistic plans supported by farm records, zoning, permits, financing, or local demand: a new grain system, irrigation expansion, livestock facility, subdivision where legally possible, or conservation project. Do not claim speculative development merely to increase a valuation. Explain how the corridor changes the feasible design, cost, or timing of a reasonably foreseeable use.

Separate construction loss, restoration, and future damage
Each loss category needs its own measurement method, evidence, remedy, and payment timing. Combining them obscures whether the owner has been paid for a temporary event or a permanent impairment.

How crop-loss formulas differ by agreement and state
There is no national crop-loss formula. An agreement may use local market price, the farm’s production history, comparable adjacent yields, crop type, growth stage, or another negotiated method. Make the formula auditable: identify the acreage, expected yield, price source, harvest date, quality adjustment, and whether double-cropping or prevented planting is included.
Illinois example
Illinois law provides a statutory method for covered projects. It applies to the projects and circumstances defined by that state’s law, not automatically to another state or another kind of pipeline. Confirm the current statute and project coverage before relying on a calculation.
South Dakota agreement example
A South Dakota docket filing illustrates a negotiated approach tied to current market price and average production during the preceding five years. That filing is one agreement, not evidence of a standard South Dakota or national rate. Treat it as an example of how a contract can define inputs, not as a benchmark for your parcel.
If the company proposes a flat amount per acre, ask what crop, yield, and price assumptions produced it and which claims the payment releases. A flat figure can be reasonable for one field and inadequate for another with different crops, drainage, or construction timing.
Make restoration obligations measurable
Restoration language should describe the condition to be achieved, not merely promise that the land will be “restored.” Illinois Department of Agriculture agricultural impact materials emphasize agreements focused on restoring agricultural land and helping parties negotiate individual easements. Use that principle to request concrete terms.
Establish a baseline before work
- Photograph fields, terraces, ditches, tile outlets, fences, roads, gates, wells, irrigation components, and existing problem areas.
- Record soil horizons, topsoil depth, compaction or penetration measurements where practical, and representative yields.
- Mark tile lines, drainage crossings, waterways, and access routes on a plan signed by both sides.
- Identify who keeps the baseline record and how disputes over pre-existing damage will be handled.
Specify the restoration standard
Require separate handling of topsoil and subsoil, removal of excess rock, replacement of tile and fences, regrading, erosion control, reseeding, and access-road repair where applicable. State who selects contractors, who tests the work, and how quickly defects must be corrected. If the first crop cannot be planted on schedule, state how that prevented production is valued.

Cover delayed and recurring problems
Compaction, settling, drainage failure, and uneven emergence may appear after the first season. Provide a monitoring period long enough to reveal those effects and explain whether the operator pays for testing and corrective work. A waiver that expires when construction payment is made is unsuitable for damage that cannot yet be observed.
Balance farm use with pipeline safety
Pipeline safety rules do not automatically eliminate farming, but they can limit activities that risk striking or exposing the line. The Pipeline and Hazardous Materials Safety Administration describes the need to balance landowner use with damage prevention and notes that documented agreements can clarify allowable activities. Before excavation or other ground disturbance, follow the applicable one-call notification law and the easement’s notice procedure.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Use appraisal analysis when the payment is disputed
A qualified independent agricultural or easement appraiser can analyze the property before and after the easement. The comparison should consider the rights acquired, restrictions imposed, access changes, construction effects, and present and alternate future uses. The appraiser should explain which loss is permanent and which is temporary rather than presenting one unexplained per-acre number.
Questions for an appraiser
- What is the legally permissible use before the easement, and what remains permissible afterward?
- Which restrictions reduce utility or marketability, and are they already imposed by zoning or another control?
- Does the corridor divide fields, interfere with equipment patterns, or remove the only practical site for a planned improvement?
- How are temporary construction damages separated from the permanent value of the easement?
- What comparable transactions or local market evidence support the conclusion, and what limitations apply?
The archived 1999 Title 7 Code of Federal Regulations valuation discussion is useful background on analyzing rights and restrictions, but it is not a substitute for checking the current codification or the program rules that apply to your property.
Understand the federal eminent-domain context
FERC’s landowner guide addresses projects under its interstate natural-gas authority. It explains that, after project approval, if the company and owner cannot agree, the company may acquire the easement through eminent domain and a court may determine compensation. That procedure does not describe every pipeline, state-regulated project, or local utility. Identify the project’s regulator and governing law before assuming the FERC process applies.

A practical comparison and negotiation workflow
- Collect the complete package. Obtain the easement, exhibits, route maps, construction workspace map, access plan, environmental or agricultural conditions, payment schedule, and every referenced attachment.
- Mark the affected land. Overlay permanent and temporary areas on your farm map. Note fields, crop rotations, tile, irrigation, roads, structures, trees, waterways, and planned projects.
- Create a rights-and-restrictions ledger. For each clause, record the company’s right, your retained use, any consent requirement, notice period, and the person who grants approval.
- Separate payment buckets. Ask the company to list permanent easement consideration, temporary workspace, crop loss, improvements, restoration, and future-work claims as separate lines.
- Document baseline conditions. Photograph and map the property before access. Preserve yield, soil, drainage, and repair records that can later demonstrate a change.
- Test the crop formula. Recalculate the proposed amount using the agreement’s acreage, yield, price, crop, and timing assumptions. Correct any assumption that does not match your field.
- Model foreseeable farm changes. Draw a future building, irrigation, drainage, or access plan and test whether the corridor blocks it or adds cost. Support the plan with zoning, permits, budgets, or farm records.
- Obtain independent advice. Use an agricultural or easement appraiser for before-and-after value analysis and a lawyer familiar with the governing state and project authority for document review.
- Negotiate measurable restoration. Add baseline records, topsoil and tile requirements, testing, monitoring, correction deadlines, and payment rules for delayed damage.
- Preserve a clean record. Keep signed maps, approvals, notices, photographs, invoices, field logs, and correspondence. Do not rely on oral assurances that are absent from the easement.
Questions to put in writing before signing
- Exactly which rights are permanent, which are temporary, and when does each expire?
- Can the operator replace or enlarge the line, add facilities, or use access outside the mapped corridor?
- What farm activities are allowed without permission, and which require written approval?
- Who pays for crop loss, fences, roads, tile, irrigation, compaction, drainage failure, and later repair work?
- What price, yield history, growth stage, and acreage determine crop compensation?
- What is the baseline restoration standard, who verifies completion, and how long can a claim remain open?
- Does any payment release unknown or future damage, and can that release be narrowed?
- What happens if the pipeline is abandoned, removed, or left inactive?
- Which regulator and state law govern the project, and where are disputes filed?
Common mistakes and how to correct them
Comparing only the headline per-acre number
Correction: Compare the rights, duration, restrictions, temporary losses, and releases line by line. A larger payment can be poorer compensation if it transfers broader rights or eliminates future claims.
Assuming a neighbor’s agreement is a market standard
Correction: Treat other agreements as context only. Corridor location, crop, soil, access, planned improvements, project authority, and contract language can differ.
Leaving restoration undefined
Correction: Attach a baseline map and measurable standards for topsoil, tile, compaction, grading, reseeding, and delayed inspection.
Recommended Free Tools
Signing a broad release before damage is visible
Correction: Separate known construction payment from later claims and negotiate a discovery-based deadline for latent damage.
Relying on an oral promise about future farm use
Correction: Put the permission, notice process, and response deadline in the easement or a signed exhibit.
Using an out-of-date state or federal formula
Correction: Verify the current statute, regulation, and project coverage. The Illinois materials, South Dakota agreement, and archived federal valuation text illustrate approaches; none is a universal rule.
Bottom line for farmland owners
Judge a pipeline easement by the property rights and restrictions that remain after the check is deposited. Demand a written separation between permanent easement value, temporary construction loss, restoration, and later damage. Map every present and reasonably foreseeable farm use, obtain an independent before-and-after appraisal when the restrictions are material, and have counsel confirm the governing law and release language. The signed easement—not a verbal assurance or a generalized per-acre figure—determines what you can do and what you can still claim.
